Abstract

Tujuan penelitian ini adalah untuk menganalisis pengaturan Hukum Kekayaan Intelektual Komunal (KIK) dalam melindungi hak masyarakat adat di Indonesia, implementasi perlindungan hukum dan Upaya Pemerintah dalam melindungi hukum KIK sebagai kebutuhan masyarakat adat terhadap KIK Nias. Jenis penelitian yang digunakan adalah penelitian hukum empiris dengan data lapangan melalui wawancara kepada selaku Anggota Lembaga Adat Bawomataluo di Desa Bawomataluo Kecamatan Fanayama Kabupaten Nias Selatan. Analisis data dilakukan dengan cara memilih data sekunder hasil penelitian kepustakaan dan data primer hasil penelitian lapangan dianalisis seecara kualitatif. Penelitian ini berkesimpulan, masih belum melindungi hak masyarakat adat di Indonesia karena tidak mengatur terkait ganti rugi dan ketentuan pidana bagi pelaku yang melanggar keetentuan KIK. Perlindungan hukum tidak dapat diwujudkan seecara efektif dikarenakan instrumen hukumnya masih belum memadai sehingga penegakan hukum pidana terkait pelanggaran KIK tidak dapat dilakukan secara optimal guna melindungi hak masyarakat Nias dalam kepemilikan KIK atas Tari Maena, Fahombo dan Tari Faluaya. Upaya Pemerintah dalam melindungi hukum KIK sebagai kebutuhan masyarakat adat terhadap KIK Nias belum maksimal. Pemerintah Daerah belum menginformasikan atau mensosialisasikan manfaat pendaftaran KIK tersebut kepada masyarakat. Selain itu, Pemerintah Daerah juga kurang memperhatikan resiko para pelompat dalam atraksi lompat batu dan kurang memperhatikan keseejahteraan penari dalam menampilkan budaya tari perang.

Abstract

The activity of channeling funds through credit occupies the most important position, because it provides the greatest profit and opinion. The profit comes from credit interest which is commonly called fee-based income, therefore in lending must be carried out with the principle of prudence through accurate and in-depth analysis. The research in writing this scientific work is normative juridical research. Normative juridical research is research that examines the application of legal rules and norms related to the topic discussed. The nature of this research is descriptive, namely research that analyzes a legal regulation. The process of implementing credit to customers is carried out in a way: File Submission, Investigation of former loans, Interview I, On The Spot, Interview II, Credit Decision, Signing of credit contracts / other agreements, Credit Realization, Distribution / withdrawal. In applying the prudential principle in providing credit, banks can analyze the data and character of prospective customers by applying the 5P principle and the 5C principle. The process of resolving disputes between banks and customers in the event of bad credit can be done through non-litigation channels, which are out-of-court settlements and through litigation channels, which are the last resort of banks to make efforts to recover debtor credit either by executing credit collateral, taking over credit collateral by banks or by filing a lawsuit in the District Court.

Abstract

Permasalahan dalam penelitian ini adalah urgensi penerapan keadilan restoratif di Lembaga Kepolisian, penerapan pendekatan keadilan restoratif dengan korban anak dan efektivitas penerapannya di Kepolisian Resor Sibolga. Metode penelitian dalam penulisan ini adalah metode normatif dengan dukungan data empiris dan bersifat deskriptif analisis. Berdasarkan hasil penelitian ini diantaranya, urgensitas Lembaga Kepolisian RI menerapkan keadilan restoratif yaitu untuk menguatkan kedudukan Lembaga Kepolisian Republik Indonesia, mengatasi dinamika penegakan hukum pidana di Indonesia yang terkesan membebani negara, memenuhi suatu kebutuhan hukum masyarakat Indonesia yang sesuai dengan nilai-nilai yang hidup dalam masyarakat Indonesia. Pelaksanaan pendekatan keadilan restoratif  pada Lembaga Kepolisian Republik Indonesia didasarkan pada Perpol Nomor 8 Tahun 2021 serta Pasal 12 Perkap Polri Nomor 6 Tahun 2019. Dalam penanganan perkara tindak pidana dengan korban anak melalui pendekatan di Kepolisian Resor Sibolga telah dilakukan sebanyak 2 (dua) kali pada tahap penyidikan dengan mengeluarkan surat perintah penghentian penyidikan (SP3). Penerapan pendekatan keadilan restoratif dengan korban anak di wilayah hukum Kepolisian Resor Sibolga dapat dikatakan belum efektif dikarenakan faktor hukum, penegak hukum, sarana dan prasarana, masyarakat, serta kebudayaan.

Abstract

The objectives to be achieved are to know and analyze about: Implementation of Information and documentation service policies in improving Public Relations Services at the Human Resources Development Agency of North Sumatra Province and what factors support and hinder it. . This research uses a type of qualitative research that focuses on the Implementation of Information and Documentation Service Policies in Improving Public Relations Services at the Human Resources Development Agency by focusing on the flow of services and personnel willingness and competence in providing information and documentation for the public. In the framework of the Implementation of Information and Documentation Services in Improving Public Relations Services, it becomes a supporting element for BPSDM Nort Sumatra Province in carrying out its activities as a training institution that creates Professional, Trustworthy and Dignified ASN. Implementation at the Human Resource Development Board of North Sumatra Province needs overall support and commitment to get better results. This is demonstrated by the leadership's commitment to improving the performance and competence of personnel in managing information and documentation in improving public relations services. The inhibiting factors in terms of communication, resources, disposition and bureaucratic structure make it a consideration for BPSDM Nort Sumatra Province to continue to strive to implement personnel performance and competence improvement programs in managing Information and Documentation in Improving Public Relations Services through collaborative planning, budgeting, implementation, evaluation and reporting as a whole.

Abstract

The issuance of the Head of the Education and Training Agency of Finance Regulation number PER-2/PP/2019 on E-Learning Guidelines within the Ministry of Finance accommodates the implementation of modern e-learning as a primary tool for human resource development. This regulation provides a legal basis and ensures consistency in planning, experimentation, implementation, responsible personnel (PIC), evaluation, reporting, tutors, duration of implementation, and technological support. This research aims to analyze the implementation of e-learning training and the inhibiting and supporting factors in the Bea and Cukai Belawan Office through a qualitative descriptive method and data collection through interviews. The findings indicate that the implementation of E-Learning Training to enhance the competencies of employees in the Bea and Cukai Belawan Office, North Sumatra, still requires improvement. The main inhibiting factor is the lack of employee commitment, while supporting factors include communication, resources, and bureaucratic structure. Recommendations for improvements are necessary to address the inhibiting factors and strengthen the supporting factors in order to enhance the effectiveness of e-learning training implementation in the office.

Abstract

The formulation of the problem in this study is related to regulation, the actualization of stopping investigations with a restorative justice approach at the Aceh Regional Police Office, and efforts to overcome obstacles to the application of restorative justice in the process of handling criminal cases from a legal perspective. The method used is empirical juridical research. Empirical juridical, namely a study that besides looking at positive legal aspects also looks at its application or practice in the field, in this case the approach is used to qualitatively analyze the termination of investigations with a restorative justice approach at the Aceh Regional Police Office. From the results of the study, the legal arrangements governing the termination of investigations using a restorative justice approach are regulated in Perpol 08 of 2021 which in practice contain formal and material requirements. The actualization of the application of stopping investigations with a restorative justice approach has been carried out 10 (ten) times at the Aceh Regional Police and has been running well in accordance with the internal rules of the police institution. Judging from the legal aspect, the Criminal Procedure Code does not regulate the termination of investigations on the grounds of restorative justice, so that it raises doubts for investigators in actualizing the termination of investigations with a restorative justice approach.

Abstract

The purpose of this study was to analyze implementation and what factors influence the implementation of the Online Submission Risk Basic Approach (OSS RBA) system in improving the quality of service at the Investment and One-Stop Services Office of Aceh Tamiang Regency. To analyze implementation, Edward III's theory was used, among others, namely communication, resources, disposition and bureaucratic structure This research is a qualitative research, which produces descriptive data from data in the field. The data collection process was carried out by researchers through three data collection techniques, namely: observation, in-depth interviews, documentation study. The results of the study found that in the implementation of the application, the implementation was quite good, in terms of the communication that was carried out. Human resources and budget, not yet sufficient. Disposition, is in accordance with the regulations and provisions of its implementation and is in accordance with the applicable SOP. The inhibiting factor is the lack of outreach to the community as business actors; Lack of implementing staff or human resources implementing the OSS RBA application system; Budget resources that are still limited so that they cannot meet the facilities and infrastructure for the OSS RBA application system services; The rules change frequently which makes it difficult for employees to keep abreast of developments.

Abstract

The purpose of this study was to describe the pattern of the typical Baboon wasp/Banjar dialect to the accompaniment of the Kuda Gipang dance at the Asam Rimbun studio through sound study and notation. Qualitative descriptive research methods are used as a reference in implementing data collection techniques by interviewing, observing and documenting. The data that has been obtained is then analyzed to get the conclusion of the research findings in the form of the Banjar baboon notation. In this study, the Kuda Gipang Igal Anak dance was the sample. This activity lasts for 4-5 months. The results of the study are as follows: The Variety of Movements in the Kuda Gipang Dance at the Asam Rimbun Art Studio, is very much based on the rhythm of wasps of baboons. There are 11 distributions of wasp patterns based on the variety of motions, namely (1) Initial punch, (2) Timangan 1, (3) Timangan 2, (4) Kijik Punch, (5) Lagurih Punch, (6) Kapak Taguk Punch, (7) Punch Jumping Horse, (8) Horse Ax Punch, (9) Hunjal Punch, (10) Dump, (11) Sambah Dump. Baboons have Pambaduk and Rumpiang parts. There are 10 basic sound colors for baboons, 3 of which are produced by Pambaduk, 5 for Rumpiang and 2 for Pambaduk and Rumpiang Combined. Each pattern has 8 beats, using a 4/4 time scale, where there are 4 beats/counts in each bar -his. The. The baboon tabuhan in the Kuda Gipang Igal Anak dance has a role in harmony between the movements and the dance accompaniment and requires harmonization between the dancers and the musicians.

Abstract

The purpose of this research is to analyze the legal regulations regarding the provision of legal aid in Indonesia, the role of the The Truth and Justice Light Legal Assistance Institution for the poor who experience criminal cases and the constraints they face for the poor who experience criminal cases (Studies at Class IIA District Courts range). The research method used is descriptive method, while the data analysis technique uses qualitative. The results of the research show that the provision of legal assistance to the poor is regulated in Law no. 16 of 2011 concerning Legal Aid. YLBH-CKK provides legal assistance based on requests for legal assistance from residents who have experienced criminal cases. The obstacles faced by YLBH-CKK for the poor are: the public still does not understand the Legal Aid Law by assuming that every transaction with a legal aid institution is synonymous with spending money The big one, there are no restrictions in law who are entitled to legal aid so that criminals who have become recidivists can apply for legal aid, there are advocates who ask for payment from clients receiving legal aid without heeding the applicable rules, weak supervision of advocates when interact with clients, as well as the lack of allocation of funds from the government.

Abstract

This research focuses on the form of punishment for children who commit narcotic crimes based on Indonesian laws and regulations. obstacles to law enforcement against children as perpetrators of narcotics crimes in the Medan City Region. penal and non penal policy strategies carried out by the Indonesian National Police in tackling Narcotics Crimes by children. The research method used is normative juridical. The data was collected by means of a literature study which was sourced from secondary data consisting of primary, secondary and tertiary legal materials, then analyzed qualitatively. The results of the first research are that the form of punishment for children who commit narcotic crimes under the law can be subject to criminal sanctions in the form of imprisonment and sanctions in the form of medical and social rehabilitation. The imposition of criminal sanctions for children is used as an ultimum remedium. Obstacles to Law Enforcement Against Children as Perpetrators of Narcotics Crime in the Medan City Region can be categorized into internal constraints and external constraints. Internal obstacles consist of the presence of the police who back up/protect drug dealers so that raid information is always leaked, minimal operational funds, limited human resources in the Medan Polrestabes narcotics unit, and the lack of arresting tools in eradicating narcotics. While the external constraints consist of, the environment is not good, the rise of nightclubs, the changing modus operandi, the presence of new types of drugs. The non-penal policies carried out by law enforcement officials consist of counseling, outreach, collaboration, anti-drug campaigns, with the distribution of pamphlets and social media, as well as the establishment of the Anti-drug Tangguh Village Command Post to prevent the abuse and illicit trafficking of narcotics in Medan City. The Penal Policy is carried out by applying criminal, medical and social rehabilitation for children who are involved in narcotics crimes.
