Abstract

Abstract— Despite the various controversies, the presence of the Omnibus Law on Job Creation have repealed at least two regulations and changed at least 80 (eight twenty) other laws. One of those affected is the Law Number 40 of 2007 concerning Limited Liability Companies (UU PT). Study This study intends to examine what the existing concepts and problems look like on the Omnibus Law on Job Creation, as well as its implications for the regulation and the basic concept of a Limited Liability Company. This study is a normative research (doctrinal) to secondary data obtained from literature studies (library research), which consists of primary and secondary legal materials. Research result shows that the Omnibus Law is a legislative method by unites various types of laws into one specific law. This has the potential to negate the diverse interests of each laws in the name of one interest only. In addition, the practice of drafting it in Indonesia does not have a juridical basis and violates the principle of openness and participation. In terms of its implications for the PT Law, a number of the provisions in the Omnibus Law on Job Creation have expanded the meaning of the Company Limited by presenting the Sole Proprietorship model which gives birth to a number of contradictions in the basic concept of a Limited Liability Company, in addition to removing the minimum capital limit of the Company which is feared will cause vulnerabilities for business continuity.

Abstract

Abstract- In Indonesia, the state has a state basis, namely Pancasila, Pancasila is also a source of law and basic norms for organizing government administration. Pancasila can also be interpreted as the ideals of the Indonesian nation. In realizing regional autonomy in the government administration system, basic norms are needed to achieve it. There is a need for harmony between Law Number 23 of 2014 concerning Regional Government and the 1945 Constitution as mandated by Pancasila. In Indonesia, the highest power holder is the central government, but the location of the Indonesian state is very wide and consists of large and small regions so that in carrying out its authority, the central government is obliged to provide the competent authority. The method used in this journal is normative juridical. To manage their respective regions is called decentralization or regional autonomy. The principle of the Unitary State of the Republic of Indonesia cannot be separated from the principle of Regional Autonomy Article 18 of the 1945 Constitution, therefore Regional Autonomy is a subsystem of the power system of the Unitary State of the Republic of Indonesia. then in aggregate it will contribute to national welfare. Meanwhile, one dimension of the decentralization policy is improving the quality of public services. The estuary of these characteristics is realizing the constitutional mandate, namely realizing general welfare and educating the nation's life.

Abstract

Abstract— The purpose of this study is to determine the legal protection of contract workers in Termination of Employment, to prevent arbitrary termination of employment and to analyze the rights of contract workers who have been subject to Termination of Employment (PHK). The method used in this study uses normative legal research. namely relying on secondary data as the main data source. The conclusion of the analysis of contract workers who are laid off during the contract period must be given their rights while working until the end of the contract, and contract workers can take legal action if their rights are not fulfilled by the employer.

Abstract

Abstract— The islands of Lombok and Bali have been designated as national tourism gateways in the MP3EI Corridor V (Masterplan for the Acceleration and Expansion of Indonesian Economic Development). Lombok Island, one of the national tourist destinations with the nickname Island of a Thousand Mosques, has a very diverse and potential tourist attraction. The choice to develop tourism does not always have a positive impact on the community, so a policy concept is needed which is expected to provide positive changes and impacts on the people of Lombok in particular and Indonesia in general. This article is an empirical normative research, meaning that the problems raised, discussed and described in this study are focused on the application of rules or norms in positive law and seeing phenomena in the field. This type of normative juridical research is carried out by examining various kinds of formal legal rules such as laws, literature which are theoretical concepts which are then linked to the problems that are the subject of discussion. The results of this study are to formulate the concept of people-based tourism, namely firstly the presence of policies that are prosperous, secondly policies that protect local wisdom, thirdly policies that protect community participation, fourthly policies that limit foreign investment, fifth, namely policies that optimize corporate social responsibility (CSR). )for tourism development.

Abstract

Mining is all or part of the stages of activity in the management and exploitation of minerals or coal which includes exploration, feasibility studies, construction, mining, management & refining, transportation & sales, and post-mining activities. As for what is the dispute in this study, how is the responsibility of the perpetrators of criminal acts in conducting a mining business without IUP, IPR or IUPK Permits & How to consider the rules of the Panel of Judges in determining the crime of carrying out a mining business without IUP, IPR or IUPK Permits from Study Decision Number: 518 /Pid.Sus/2022/ PN.Tjk? the research method used is normative & empirical juridical, the output of research on criminal liability for conducting mining business without a permit is imprisonment for 2 (two) months & 15 (fifteen) days & a penalty of IDR 5,000,000.00 (5 million rupiah) And the legal considerations of the Panel of Judges in determining the criminal act of conducting a mining business are not yet perfect because it is too light for the perpetrators who have committed mining crimes without causing environmental damage as a result, as a result of which they cannot have a deterrent effect on the perpetrators.

Abstract

Simultaneous elections in 2024 will soon take place, this is marked by the start of several election stages starting from the formation of election commissions/organizers to the drawing of serial political party numbers. The holding of democratic elections in accordance with the principles of elections is a must to be realized, especially in the simultaneous elections in 2024. So that concrete efforts are needed in monitoring, overseeing and supervising and supporting stages by stages in the implementation of elections. Constitutionally, Bawaslu is an institution whose job is to supervise the implementation of elections. However, the involvement and participation of the public/community in terms of monitoring the implementation of elections is important to do by looking at the form, number and characteristics of massive and systematic violations. Public involvement is a constitutional right in overseeing and giving control over the holding of democratic elections in order to ensure people's sovereignty in the holding of elections. There are several important and crucial stages in the election stage, namely the collection of voter list data which is often found by fictitious voters and unregistered voters and the second crucial stage is the implementation of voting in the field. The 2024 simultaneous elections will be more complicated and take up a lot of time and energy so that the existence and involvement of the public/community in terms of oversight and monitoring functions is absolutely necessary in order to assist the Bawaslu in carrying out its duties and functions so that quality elections can be created with intelligent voters by being able to suppress and minimize the number of election violations.

Abstract

Penelitian ini bertujuan untuk mengetahui dasar terjadinya pertambangan ilegal di Samarinda dan untuk menganalisis penerapan izin serta sanksi terhadap pelaku usaha tambang ilegal dalam putusan 312/Pid.Sus/2019/PN Smr. Jenis penelitian yang digunakan adalah yuridis normatif yaitu penelitian hukum dengan menggunakan studi kepustakaan. Dasar terjadinya pertambangan illegal di Samarinda didasari oleh beberapa aspek yaitu ekonomi, sosial, dan regulasi. Aspek ekonomi membahas mengenai kebijakan birokrasi yang dianggap mahal,sulit, dan memakan waktu. Aspek sosial membahas mengenai kurangnya pengetahuan masyarakat awam terkait izin usaha pertambangan. Dan aspek regulasi membahas adanya aturan yang berubah-ubah menimbulkan tambang ilegal sebagai akibat dari regulasi yang tidak mengakomodir kebutuhan masyarakat. Dalam putusan 312/Pid.sus/2019/PN Smr menunjukkan bahwa pelaku usaha tidak menerapkan izin pertambangan sebagaimana mestinya yang tertuang dalam peraturan perundang-undangan sehingga majelis hakim PN Samarinda menjatuhkan sanksi berupa pidana penjara selama 1 (satu) tahun 6 (enam) bulan dan denda sejumlah Rp. 10.000.000, (sepuluh juta rupiah) dengan ketentuan apabila denda tersebut tidak dibayar diganti dengan pidana kurungan / penjara selama 1 (satu) bulan sebagaimana merujuk pada Pasal 158 Undang-Undang Nomor 4 Tahun 2009 (UU Minerba). Pemberian sanksi terhadap pelaku tambang ilegal ini masih berfokus pada pemberian sanksi pidana pokok yang dimana hal ini jarang memberikan efek jera bagi pelaku sehingga pemberian sanksi terhadap pelaku tambang ilegal ini dapat dilakukan dengan adanya pidana tambahan yaitu pencabutan beberapa hak tertentu misalnya berupa dicabutnya izin usaha tambang sehingga tidak boleh lagi beroperasi. Hal ini dapat menjadi sebuah terobosan hukum dalam pembaharuan hukum pidana Indonesia.

Abstract

This study aims to determine Police Law Enforcement in Disclosing Narcotics Crimes Using the Undercover Buy Technique at North Kolaka Police Station. The formulation of the problem posed is: What are the legal strengths and consequences for undercover buys made by non-Police members (informants)? and What are the obstacle factors in uncovering narcotics crimes with the Undercover Buy Technique?. The type of research used by the author in the preparation of this thesis final project is research that uses empirical research methods. The empirical legal research method is a legal research method that functions to see the law in a real sense and research how the law works in society. Covert Purchase as stipulated in Law No. 22 of 1997 which has been changed to Law No. 35 of 2009 is an addition to the investigator's authority in efforts to eradicate narcotics trafficking. This is because narcotics crimes are organized, secret crimes, and in practice they use sophisticated modus operandi and technology, making it difficult to collect evidence. Unlike other criminal acts, the implementation of covert purchases in narcotics crimes is not contrary to human rights if carried out in accordance with applicable regulations. However, it will be different if it is not implemented in accordance with applicable regulations. This is because the implementation of covert purchases cannot be separated from the participation of the community, so that the rights of the people who participate must be protected. In order to reduce errors and the implementation of covert purchases, it is necessary to know and understand clearly by investigators regarding the implementation of covert purchases themselves as stipulated in Law No. 35 of 2009. Abstract

Abstract- The purpose of the research is to find out the role of the DPRD's supervisory function in realizing good governance to create a prosperous society as well as the obstacles faced by the DPRD and efforts to strengthen it as a government administration institution on its performance. The type of research used is empirical juridical legal research using primary and secondary data sources, namely through the results of data analysis. By using the data obtained from the survey results, namely interviews and distributing questionnaires. The results of this study indicate that the implementation of the DPRD's supervisory function is carried out by the Commission to review, study and continuously evaluate several aspects that have not gone well. In carrying out its performance towards the Government, of course the DPRD has faced obstacles as well as various efforts to overcome these obstacles. One of the obstacles faced by the DPRD's supervisory function is differences in political interests, inadequate expert staff and laws and regulations that often experience changes. In this case, the efforts made by the supervisory function of the DPRD to overcome the obstacles it faces are by optimizing the role of the DPRD's fittings, the existence of clear and straightforward rules and other things that need to be corrected by the DPRD. As local government partners, the DPRD needs to be sensitive and responsive to the governance management process in the region. With the functions, duties, authorities and rights possessed by the DPRD, it is hoped that it will be able to play its role optimally in controlling the implementation of regional regulations. The goal is to create a regional government that is efficient, clean, authoritative and free from corruption, collusion and nepotism.

Abstract

Abstract-The purpose of this study was to analyze the role of the crown witness in the premeditated murder case of Brigadier Joshua associated with the principle of non-self-incrimination and the obstacles to using a crown witness in the premeditated murder case of Brigadier Joshua associated with the principle of non-self-incrimination. This writing research method uses a normative juridical method with three approaches, namely the statutory approach (statute approach), conceptual approach (conceptual approach), and case approach (case approach). The results of the research on the role of the crown witness in the premeditated murder case of Brigadier Joshua were linked to the principle of non-self-incrimination, there were five defendants who were used as crown witnesses against the other defendants namely Ferdy Sambo, Putri Candrawathi, Bripka Ricky Rizal, Strong Ma'ruf and Bharada E However, there were two defendants who refused to be the crown witness for the other defendant, namely Ferdy Sambo who refused to be a witness for Putri Candrawathi, and vice versa Putri Candrawathi refused to be a witness for Ferdy Sambo. With this in mind, there are obstacles that come from obstacles to the defendant, obstacles to evidence, and obstacles to the trial judge. Based on this study, the use of crown witnesses in court proceedings is common. Aims to open the veil of crime from the defendant who was used as a witness. However, the use of crown witnesses must still pay attention to the human rights of the accused. In criminal law theory, this provision is referred to as the principle of non-self-incrimination, namely the defendant has the right not to provide information that incriminates himself (privilege against self-incrimination), which in practice the attitude of silence and not admitting to the accused is used as an excuse or circumstance that can be aggravating for punishing the accused.
