Abstract

The phenomenon of shrinking civic space is one of the problem trends faced by various countries in the world. Furthermore, this trend little by little has the potential to open up opportunities for the birth of conditions where full civic space cannot be accessed by the public because the authorities deliberately close this space. The patterns played by the authorities in recent years in reducing civic space can be said to be very cruel. Efforts to silence are not only achieved by civil society, human rights defenders are also criminalized and intimidated by public officials. This research aims to understand developments and provide an overview of shrinking civic space, especially for human rights defenders in Indonesia. In this paper the author uses a research method in the form of a normative legal approach. In collecting and describing legal materials, the author uses an approach in the form of data collection in the form of a literature review or what is often known as a literature review. The results of this research show that the shrinking civic space that occurs among human rights defenders, especially in Indonesia, is real. The many silencing efforts carried out by both state and non-state actors have become a scourge and a sad reality for efforts to uphold human rights in Indonesia. Abstrak fenomena shrinking civic space (penyempitan ruang sipil) menjadi salah satu tren permasalahan yang dihadapi oleh berbagai negara di belahan dunia. Lebih jauh lagi, tren tersebut sedikit demi sedikit berpotensi membuka peluang lahirnya kondisi dimana ruang sipil secara penuh tidak dapat di akses oleh masyarakat dikarenanakan para penguasa secara sengaja menutup ruang tersebut closing civic space. Pola-pala yang di mainkan para penguasa beberapa tahun belakangan ini dalam memperkecil civic space dapat di bilang sangat keji. Upaya pembungkaman tidak hanya didapatkan masyarakat sipil saja, para pembela HAM juga turut mendapatkan kriminalisasi serta intimidasi dari para pejabat public. Penelitian ini bertujuan untuk mengetahuan perkembangan serta memberikan gambaran mengenai shrinking civic space khususnya pada para pembela HAM di Indonesia. Dalam tulisan ini penulis menggunakan Metode penelitian berupa pendekatan hukum normative. Dalam menghimpun sertha menjabarkan bahan hukum, penulis menggunakan pendekatan berupa pengumpulan data dalam bentuk kajian literature atau yang sering dikenal dengan sebutan literature review. Hasil penelitian ini menunjukan bahwa shrinking civic space yang terjadi pada para pembela HAM terkusus di Indonesia nyata adanya. Banyaknya upaya pembungkaman yang dilakukan oleh para actor baik negara maupun non negara menjadi momok serta kenyataan yang pilu bagi upaya penegakan HAM di Indonesia.

Abstract

This research aims to analyze the correctional efforts done by Sentra Handayani Jakarta towards child perpetrators of brawls. In this context, Sentra Handayani Jakarta is present as a social rehabilitation institution that prioritizes the provision of education in fostering child brawlers. This research uses a legal empirical research method with a field research approach. Data collection techniques in the form of interviews were used to examine the process of mentoring and rehabilitation of child perpetrators of brawls at Sentra Handayani Jakarta. The results showed that the rehabilitation efforts of child perpetrators of brawls at Sentra Handayani Jakarta were colored by quite complex problems. This is related to the tough diversion efforts with victims, to the parents of children who are not cooperative. However, not a few child perpetrators of brawls have also been successfully rehabilitated so that they can be accepted back into society.

Abstract

Indonesian government has taken various measures to strengthen the status and identity of Papua, which continues to evolve with each change in administration. After the status of Papua as a Military Operations Area was revoked in 1998, a significant number of troops continue to be deployed to Papua. Numerous human rights violations persist in Papua to this day. Over the years, the government has sought to enhance security in Papua by deploying military personnel, such as the TNI and Polri. However, instead of ensuring safety in Papua, the number of casualties, both among civilians and military personnel, continues to rise. This study aims to examine the human rights conflicts experienced by the Papuan community. The research gathers descriptive data through a qualitative case study of literature. The findings indicate that human rights violations are likely to persist in Papua in the coming years. The central government of Indonesia has been criticized for its failure to establish peace and prosperity in Papua. This has led many Papuans to express a desire to leave the NKRI. Another contributing factor is the slow and often delayed judicial process, which is attributed to poorly designed components of the legal system.

Abstract

The constitution is a set of principles that organize government power, the rights of the governed and the relationship between the government and the governed). In general, the constitution or basic law contains 3 (three) main points, namely: First, there is a guarantee for human and citizen rights; Second, the establishment of a fundamental constitutional structure; and Third, there is a division and limitation of constitutional tasks which are also fundamental in nature. The research method in this paper uses normative juridical research methods, namely library law research which is carried out by examining library materials or mere secondary data. In general, there are several differences between the Constitutions of Portugal and the State of Uzbekistan in terms of nature, procedures for amending the constitution, form of government, form of state, and system of government.

Abstract

Kasus kekerasan seksual di Indonesia semakin masif terjadi dan dapat menyasar siapa saja tanpa pandang gender, baik laki-laki ataupun perempuan. Akan tetapi, konstruksi gender yang berkembang dalam masyarakat dinilai mempengaruhi respon atau perlakuan yang diberikan kepada korban kekerasan seksual. Tujuan penelitian ini untuk menjelaskan bentuk-bentuk perbedaan perlakuan berbasis gender terhadap korban kekerasan seksual pada perspektif kesetaraan gender. Memakai metode riset normatif di mana meneliti data sekunder lewat studi kepustakaan dan studi dokumen dengan pendekatan teori kesetaraan gender. Hasilnya yaitu bentuk-bentuk perbedaan perlakuan berbasis gender terhadap korban kekerasan seksual diperlihatkan oleh penegak hukum, perangkat hukum, lembaga sosial, hingga masyarakat. Dari perspektif kesetaraan gender, korban laki-laki belum mempunyai akses lengkap sebagaimana korban perempuan. Bagi korban perempuan, pengetahuan masyarakat ataupun penegak hukum belum sensitif gender, sarat ketidakberpihakan terhadap perempuan karena adanya ketimpangan relasi gender. Dibutuhkan sinergi dari berbagai pihak untuk mewujudkan atmosfir penanganan perkara kekerasan seksual yang responsif gender terhadap korban kekerasan seksual.

Abstract

Anak-anak selaku generasi penerus bangsa membutuhkan perlindungan hak mereka, termasuk ketika terlibat dalam konflik hukum. Faktor lingkungan dan orang tua berperan penting dalam perkembangan anak, yang dapat memengaruhi perilaku mereka, termasuk dalam tindak pidana seperti pencabulan. Diversi menjadi salah satu pendekatan yang dipakai untuk melindungi anak dan mencegah konsekuensi negatif. Studi ini mengeksplorasi pelaksanaan diversi terhadap anak pelaku pencabulan, fokus pada kasus di Pengadilan Negeri Surakarta. Tujuan penelitian untuk menjelaskan mengenai pelaksanaan diversi pada anak pelaku pencabulan dan pertanggungjawaban yang diberikan kepada anak pelaku. Memakai metode normatif di mana meneliti data sekunder lewat studi kepustakaan dan dokumen yang berkaitan dengan diversi. Hasilnya menunjukkan jika diversi memungkinkan penyelesaian kasus di luar pengadilan, memberikan kesempatan bagi anak untuk merasa aman dan memperoleh pemahaman terkait konsekuensi perbuatannya. Namun, pidana penjara tetap menjadi opsi terakhir dalam kasus pengulangan tindak pidana yang serius. Putusan pengadilan menekankan pada pendekatan rehabilitatif dan pencegahan kriminalitas, dengan memberikan pidana pembinaan dan pelatihan kerja sebagai alternatif untuk membantu anak memperbaiki perilaku mereka. Pentingnya perlindungan hak anak dan pendekatan yang berorientasi pada kepentingan terbaik anak menjadi fokus dalam proses peradilan pidana anak.

Abstract

This research aims to analyze the implementation of the bank secrecy principle which becomes an obstacle for the police in investigating embezzlement crimes. The study used is juridical-normative method with a qualitative analysis. Techniques of data collection using Statute Approach and library research. The source of law used includes primer, sekunder, and ternary data. Primary sources by reviewing the legislation. Secondary data is taken from the literature in the field of law as well as expert opinions of scholars. Tertiary data through interview guidelines with investigators of the Criminal Investigation Unit at the Bandung City Police Resort. The results show that banking has a very strict confidentiality principle; police investigations experience obstacles related to the application of the principle of bank secrecy; and there is an imbalance between the Banking Law and the Criminal Procedure Code, causing confusion for banks and police investigators.

Abstract

This study aims to analyze the principle of the presumption of innocence which is a principle with the aim of ensuring the fulfillment of the rights of every individual to obtain justice and equality in the criminal justice process carried out by law enforcement officers in Indonesia. The research method used is normative juridical with a descriptive analytical approach. The results of the study indicate that the implementation of the principle of the presumption of innocence has not been fully implemented as evidenced by the frequent repressive actions of law enforcement officers, such as shootings on the spot, which have given rise to various legal and social polemics. In conclusion, there needs to be a stricter control mechanism to balance legal interests and human rights so that every individual who commits a crime, including perpetrators of terrorism, still gets equality before the law. Thus, Indonesia as a country of law can still maintain its integrity to uphold human rights and fight the threat of terrorism that threatens the safety of society.

Abstract

Penelitian ini membahas tentang norma hukum terkait pidana penjarahan dalam situasi bencana alam di Indonesia, dengan fokus pada konsep alasan pemaaf. Studi ini mengeksplorasi relevansi peraturan dalam KUHP lama dan UU No. 1 Tahun 2023 serta penerapan alasan pemaaf dalam kasus penjarahan. Menggunakan metode normatif dengan pendekatan perundang-undangan, penelitian ini bertujuan untuk meninjau kerangka hukum terkait pencurian dalam situasi darurat, sebagaimana diatur dalam hukum positif Indonesia. Studi kasus penjarahan di Palu pasca-gempa 2018 digunakan untuk mengkaji apakah tindakan tersebut dapat dimaafkan berdasarkan keadaan darurat. Hasil penelitian menunjukkan bahwa alasan pemaaf dan pembenar dapat berlaku dalam kondisi tertentu, namun pelaku yang melampaui batas kebutuhan pokok tetap harus mempertanggungjawabkan tindakannya.

Abstract

This study aims to examine the phenomenon of femicide in Indonesia, focusing on the murder case in Cirebon. Femicide, as a form of extreme violence against women, is often triggered by complex social, cultural, and economic factors. The research method used is descriptive qualitative with a sociological juridical approach, which includes news analysis and secondary data related to femicide cases. The results of the study indicate that the patriarchal structure that dominates society contributes to the high number of femicide, where many perpetrators are intimate partners of the victim. Law enforcement against perpetrators of femicide also faces significant challenges, including a lack of understanding of gender issues among law enforcement officers. This study recommends the need for more effective public policies and strict law enforcement to protect women and prevent future femicide.
