Abstract

This study provides a critical perspective on the role of legal policy actors in shaping the restorative justice paradigm in Indonesia. Criminal justice reform in Indonesia requires the implementation of restorative justice concepts. This study aims to evaluate the role of legal policy in guiding the adoption of restorative justice and to assess the compatibility of restorative policies with national criminal law principles. The research method used is normative qualitative, employing a document study approach that includes analysis of the Criminal Procedure Code (KUHAP), Supreme Court Regulations, and Police Chief Regulations. The results of the study indicate that the regulatory framework has provided substantive support, but the effectiveness of implementation is still hampered by technical guidelines that are not yet detailed, uneven distribution of resources, and the tendency of law enforcement officials to use a retributive approach. The findings also reveal that the integration between formal and informal mechanisms is not yet optimal, so that the protection of victims' rights and the principle of proportionality of restorative intervention are not consistently applied.Keywords: Legal politics; Restorative Justice; Criminal Justice System.

Abstract

Indonesia as a maritime country with two-thirds of its territory being sea faces major challenges in preserving the marine environment, especially due to shipping and oil exploration activities. This study aims to analyze the implementation of the 1982 United Nations Convention on the Law of the Sea (UNCLOS) in protecting the marine environment in Indonesia through a case study of oil pollution in Bintan waters. The research method used is normative juridical, with an analysis of the provisions of UNCLOS Chapter XII and national regulations, such as the PPLH Law, PP 19/1999, etc. The results of the study shows that Indonesia has ratified the provisions of UNCLOS into national law, but still faces obstacles in law enforcement, coordination between institutions, and supervision in border areas. The repeated cases of oil pollution in Bintan highlight the weak supervision of tanker waste disposal and the need to strengthen the emergency response system. This study recommends increasing international cooperation, harmonizing regulations, and strengthening law enforcement capacity in order to realize the sustainability marine environmental protection in Indonesia. Keywords: Bintan Sea; International Maritime Law; Marine Protection; Oil Pollution.

Abstract

This study aims to analyze the role of legal education in enhancing legal awareness and compliance of society in Indonesia. The research employs a normative juridical method using a statute approach and a conceptual approach through the examination of scholars’ opinions. The data consist of primary, secondary, and tertiary legal materials, which were analyzed qualitatively through stages of data reduction, classification, interpretation, presentation, and conclusion drawing. The findings indicate that legal education, both through formal and non-formal channels, significantly contributes to fostering law-abiding citizens. First, legal education develops public knowledge of the principles of the rule of law in Indonesia. Second, it strengthens understanding of the content, objectives, benefits, and sanctions of legal rules. Third, it cultivates a positive attitude toward law based on accurate knowledge and comprehension. Fourth, it encourages consistent behavior in upholding legal norms and regulations. Therefore, legal education plays a strategic role in improving legal awareness and ensuring compliance with the law, ultimately contributing to the realization of a law-abiding society in Indonesia. Keywords: Legal Education; Legal Awareness; Legal Compliance; Indonesia

Abstract

The position of secured creditors in Indonesian bankruptcy law raises critical issues regarding the limits of execution rights and the protection of stakeholders’ interests. This study specifically examines these dynamics through the case study of Decision Number 20/Pdt.Sus-Gugatan Lain-Lain/2023/PN.Niaga.Smg. Using a normative juridical approach, the research analyzes the execution rights of secured creditors, particularly holders of security rights, within the framework of prevailing bankruptcy law. The findings reveal that although secured creditors enjoy privileged rights, their enforcement is subject to strict legal procedures, including a 90-day execution moratorium following the bankruptcy ruling. These results highlight a shift in Indonesian bankruptcy law toward a more responsive and adaptive system, functioning not only as a debt resolution mechanism but also as an instrument to maintain economic balance and social justice Keywords: Bankruptcy; Separatist Creditors; Mortgage Rights

Abstract

Currently, the organization of music concerts requires careful planning and coordination. However, in practice, unilateral cancellations by organizers still frequently occur, causing losses to consumers. This study aims to analyze the elements of unlawful acts and the forms of legal protection available to consumers in cases of unilateral concert cancellations. A normative juridical approach is employed in this research by examining the provisions of Article 8 letter f of Law Number 8 of 1999 on Consumer Protection and Article 1365 of the Indonesian Civil Code. The findings indicate that concert cancellations without valid justification can be classified as unlawful acts. Concert organizers are obliged to provide compensation to consumers in the form of damages. The legal protection afforded is based on the principles of justice and the responsibility of business actors. This study highlights the necessity of including consumer protection clauses in concert contracts and strengthening dispute resolution mechanisms that are both swift and fair.Keywords: Consumer Protection; Unlawful Act; Music Concert; Compensation; Consumer Protection Law.

Abstract

The rise of digital business and technological advancement has shifted conventional economic practices to digital platforms, with e-commerce often dominated by companies using strategies like predatory pricing to maintain market control. Such practices, including flash sales and free shipping, are challenging to regulate due to difficulties in gathering sufficient evidence. This study employs a socio-legal research method, with data from interviews and legal materials, identifying three key indicators of predatory pricing: sales below production cost, competitor exit, and subsequent price increases. Although Indonesia's Business Competition Supervisory Commission (KPPU) enforces competition laws, evidence challenges and legal interpretation complexities remain. Policy reform and capacity-building efforts are essential for effective oversight in this evolving digital landscape.Keywords: E-commerce;Legal Supervision;Predatory Pricing

Abstract

This study addresses the issues in Decision Number 455/Pid.Sus/2024/PN Sby concerning the judge's considerations in fulfilling the rights of a child victim of sexual crimes committed by an online motorcycle taxi driver. This paper employs normative legal research methods. The findings indicate that the panel of judges based their fulfillment of the victim’s rights on both juridical and non-juridical considerations. Juridical aspects include the indictment by the public prosecutor, the defendant’s testimony, witness statements, submitted evidence, and provisions within criminal law. Non-juridical aspects encompass the defendant’s background, the impact of the offense, the defendant’s personal circumstances, and the surrounding socio-economic conditions. The judge’s considerations in rendering the verdict are deemed to have not fully fulfilled the sense of justice for the victim.Keywords: Child; Fulfillment of Rights; Judicial Consideration; Sexual Violence Crime

Abstract

The increasing tension between Indonesia and China in the South China Sea (SCS), particularly around Indonesia’s Exclusive Economic Zone (EEZ), necessitates an in-depth legal analysis of state responses to foreign violations of sovereign rights. This study aims to identify China’s maneuvers and examine the Indonesian government’s response to these actions in the North Natuna Sea (NNS). This is a normative legal research employing an international legal approach. Data were collected through literature review and analyzed qualitatively using a descriptive-analytical method. The findings indicate that China has conducted systematic and continuous maneuvers in the North Natuna Sea. As a coastal state, Indonesia holds sovereign rights in its EEZ; therefore, in response to any violations by other countries that threaten these rights, the Indonesian government may enforce legal measures and formulate strategic policies to defend and protect the area through diplomacy and maritime defense.Keywords: China Maneuvers; Defense; North Natuna Sea; South China Sea; Sovereign Rights

Abstract

Trust in the performance of law enforcement officers, especially the police, is experiencing a crisis due to several actions taken that are not in favor of the community. This study aims to describe the public's response to the professional ethics of the police in carrying out their duties and authorities. The research data are public opinions regarding the police in carrying out their duties in the community. Data collection was carried out using an in-depth interview method with an accidental technique. Data validation techniques were carried out using triangulation to test the validity of the data. Analysis was carried out using an interactive method based on the results of in-depth interviews. The results of the study are (1) a positive public response to the police in protecting and caring for the community, especially in creating a sense of security from criminal acts in the community, (2) negative public response to the police who still commit irregularities, especially related to the practice of extortion and arrogance in law enforcement, and (3) the implementation of police duties is considered not to be in accordance with the professional code of ethics, so professionalism is required in every implementation of their duties.Keywords: professional ethics; public trust; law enforcement; duties; authority.

Abstract

Human trafficking is a violation of human rights that requires state protection, one of which is through the provision of restitution to victims. The Supreme Court Regulation (PERMA) Number 1 of 2022 regulates the restitution mechanism; however, in Samarinda, no victims have yet submitted such claims. This study aims to examine the implementation of PERMA 1/2022 and analyze the obstacles that hinder victims from exercising their right to restitution. Using a socio-legal approach supported by literature review, the research involves law enforcement officers, the Witness and Victim Protection Agency (LPSK), and social institutions as its primary subjects. The findings show that the implementation of PERMA in Samarinda has not been optimal. The main obstacles include weak communication between law enforcement officers and victims, limited outreach, and victims’ lack of understanding of their right to restitution. Academically, this research contributes by highlighting gaps in the restitution mechanism and offering policy recommendations for strengthening institutional coordination, enhancing victim protection, and improving the effectiveness of restitution implementation in Indonesia.Keywords: Implementation; Human Trafficking; Restitution; LPSK; Law Enforcement
