Abstract

Termination of Employment is a legal action that may be undertaken by an employer against an employee under certain conditions, including violations of workplace discipline. One controversial case involves the dismissal of an employee found consuming tuak (a traditional alcoholic beverage). This study aims to analyze the legal aspects of such termination based on Indonesian labor regulations and contributes to a broader understanding of cultural context in the enforcement of labor law in Indonesia. The research employs a normative juridical approach, using literature review and case analysis. The findings indicate that termination of employment due to the consumption of tuak can only be legally justified if the act occurred during working hours, within the workplace, or demonstrably affected job performance and workplace safety. Termination is deemed unlawful if it does not follow the prescribed procedures or lacks sufficient evidence of serious misconduct as stipulated in the company's internal regulations. Therefore, any termination decision must take into account the principles of fairness, proportionality, and legal certainty for both parties.Keywords: Tuak; Company; Termination of Employment

Abstract

This study examines the legal basis for Human Rights Protection of Private Military and Security Company (PMSC) employees. Despite frequent violations of their rights, no binding international law currently regulates this matter. The purpose is to identify the existing legal framework and potential measures to enhance protection. This research applies a normative juridical (doctrinal) method by analyzing international humanitarian law, human rights instruments, and comparative approaches. The findings reveal that the absence of binding law leads to legal uncertainty and vulnerability for PMSC employees, with several documented cases of human rights violations. The study concludes that strengthening international instruments and harmonizing national laws are crucial to ensure effective human rights protection for PMSC employees. Keywords: Human Rights; Humanitarian Law; Private Military and Security Company; Workers’ Rights

Abstract

A notary has the position of a public official authorized to draw up authentic deeds required by society in legal acts. In carrying out this role, a notary has the obligation of refusal, namely the obligation to maintain professional secrecy by refusing to provide testimony or disclose information related to a deed or any statement obtained in the course of duty, including during summons or examination by investigators, prosecutors, or judges. This obligation of refusal functions as a legal safeguard for notaries to ensure that professional secrecy is preserved and not misused. The role of the Regional Notary Honorary Council is crucial in this mechanism, as it has the authority to approve or reject requests for summons or examinations of notaries by law enforcement officers. This research applies a doctrinal legal method by examining relevant statutory provisions, doctrines, and literature. The findings show that the obligation of refusal is a legal instrument designed to protect the confidentiality of authentic deeds, while the Regional Notary Honorary Council, through its authority, acts as a filter to protect notaries from being compelled to disclose professional secrets without lawful grounds. Therefore, the obligation of refusal not only safeguards the interests of notaries but also upholds the principle of deed confidentiality to ensure legal certainty and protection for the parties involved. Keywords: Notary, Obligation of Refusal, Protection of Professional Secrecy, Regional Notary Honorary Council

Abstract

Streaming Service Provider is a method of sending files in the form of video or audio that can be widely enjoyed by the public via the internet network from one computer to another and can be downloaded freely without any time limits. The purpose of this study is to be a reference for law enforcement in implementing fair, certain, and beneficial rules. The problem in this thesis is in the actions of perpetrators of violations of exclusive copyright of copyright who upload or distribute films. The results of this study found that the act of uploading films on one of the nobar24 streaming sites has fulfilled the elements of committing an act of violating the exclusive rights of the creator because the film is a cinematographic work protected in Article 40 letter m of the Copyright Law Number 28 of 2014. As for legal efforts that can be taken by the creator or copyright holder if there is a problem or dispute regarding copyright, dispute resolution can be done through non-court channels, in the form of alternative dispute resolution, arbitration or through the courts.Keywords: Exclusive Rights; Film; Website

Abstract

This research examines the form of legal protection of well-known trademarks in Indonesia in the context of disputes filed in “bad faith”, with a case study of Supreme Court Decision Number 1850 K/Pdt.Sus-HKI/2022 between VANS and OTOVANSCLASSIC trademarks. The purpose of the research is to analyze the effectiveness of the application of legal protection under Law Number 20 of 2016 concerning Trademarks and Geographical Indications. This research uses a normative juridical approach with descriptive-analytical methods sourced from literature studies and secondary data. The results show that the Supreme Court provides appropriate legal protection to VANS by canceling the registration of the OTOVANSCLASSIC trademark which is considered to have similarities in principal and filed in bad faith. This decision is a form of preventive and repressive protection against infringement of rights to well-known trademarks and reflects fair law enforcement. Keywords: well-known trademark; bad faith; legal protection; essential similarity; trademark dispute

Abstract

The implementation of electronic land certificates in Indonesia is still facing various obstacles that hinder the full realization of this policy. As part of the digital reform in land administration, the government has issued Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Regulation No. 3 of 2023 on the Issuance of Electronic Documents in Land Registration Activities. However, its enforcement has not been optimal due to technical, regulatory, and institutional challenges. In contrast, Australia has successfully implemented electronic land certificates since 2011, initiated through the Inter-governmental Agreement (IGA), which established regulatory harmonization among its states and territories. This article aims to analyze the challenges of implementing electronic certificates in Indonesia and to examine Australia’s experience as a comparative reference. The research applies a normative juridical method using statutory and comparative approaches. The findings highlight that Indonesia may learn from Australia’s experience, particularly in terms of regulatory harmonization, technological infrastructure readiness, and the enhancement of public legal literacy to support the successful adoption of electronic land certificates. Keywords: Electronic Certificates; Implementation; Land Registration; Comparative Law.

Abstract

This study aims to find out and analyse the use and impact of beach areas that are not in accordance with laws and regulations as tourism support. The methods used in this study are normative and empirical legal methods with legislative, conceptual, case, and sociological approaches. The results of this research show that the act of privatization and the use of beach areas in West Lombok, especially in Tanjung Bias Beach, where culinary entrepreneurs in the form of cafes, restaurants and hotels tend to have an impact that results in a decrease in the function of coastal boundaries, which is characterized by the narrowing and pollution of the beach. This is certainly contrary to Regional Regulation Number 11 of 2011 concerning the Regional Spatial Plan of West Lombok Regency, that the spatial pattern plan has been determined as a tourism strategic area and an economic strategic area. Keywords: Juridical implications; Coastal Borders; Utilization, Tourism

Abstract

This study aims to analyze the factors hindering law enforcement in Indonesia through the perspective of Lawrence Friedman's legal system theory, which consists of legal structure, legal substance, and legal culture. The research employs a normative legal method with statutory and conceptual approaches. Data were analyzed from primary and secondary legal materials and correlated with relevant empirical practices. The findings reveal that the main obstacles to law enforcement lie in the lack of integrity and professionalism among law enforcement officials, inconsistencies in legal substance, and the generally low level of legal culture in society. Low legal awareness and a preference for informal dispute resolution further weaken the formal legal system. This study recommends structural reforms of law enforcement institutions and the enhancement of legal culture through legal education and consistent, fair law enforcement. Keywords: Legal Structure; Legal Substance; Legal Reform; Public Legal Awareness.

Abstract

This study aims to evaluate the conformity of the legislative process and the substantive content of Law Number 3 of 2025, which amends Law Number 34 of 2004 concerning the Indonesian National Armed Forces (TNI), with the principles of proper law-making, the rule of law, and civilian supremacy as enshrined in the 1945 Constitution of the Republic of Indonesia. Using a normative juridical approach, the research finds that the legislative process for the TNI Law revision did not fully adhere to the principles of legality, transparency, and public participation, as regulated by Law Number 12 of 2011 in conjunction with Law Number 13 of 2022. The substance of the revision also raises concerns regarding the principles of civilian supremacy and the rule of law, particularly due to the expanded role of the TNI in civilian affairs without sufficient oversight and the allowance of active military officers to occupy strategic civil positions without retirement mechanisms. These findings indicate formal defects in the TNI Law revision that may threaten democratic principles, accountability, and the integrity of the national legal system.This research contributes to the development of constitutional law studies and strengthening the principle of civil supremacy in the legislative process. Keywords: TNI, civilian supremacy, legislation, democracy

Abstract

The existence of traditional dental practitioners (tukang gigi) is often considered an alternative dental care option for lower-middle-class communities, although such practices are generally unlicensed and exceed the authority granted by law. This study aims to analyze two main issues: first, the forms of legal protection for consumers against unauthorized dental practices in Kutai Kartanegara Regency; and second, the legal remedies available to consumers harmed by such practices. This research applies a socio-legal approach, collecting empirical data through interviews with various parties, including traditional dental practitioners in Kutai Kartanegara Regency, consumers who suffered losses, the Kutai Kartanegara Health Office, the Consumer Dispute Settlement Agency (BPSK) of Samarinda City, and dentists who have treated patients previously handled by tukang gigi. The findings reveal that unauthorized dental practices, such as tooth filling, extraction, braces installation, and veneer application, can be classified as unlawful acts (onrechtmatige daad) under Article 1365 of the Indonesian Civil Code. These acts cause both material and immaterial losses to consumers, thereby requiring legal protection under Law No. 8 of 1999 on Consumer Protection and relevant civil law provisions. With effective protection mechanisms and legal remedies, consumers are expected to obtain legal certainty and fair accountability for the losses suffered.Keywords: Consumer Protection, Traditional Dental Practitioners, Unlawful Act, Liability.
