The purpose of this study is to determine the authority of the Regency/City General Election Supervisory Body (Bawaslu) in resolving electoral process disputes based on Law Number 7 of 2017 concerning Elections. The research method used is normative juridical through a statutory approach. The main data sources in this study consist of primary legal materials, secondary legal materials and tertiary legal materials. Data analysis was carried out qualitatively through analytical and prescriptive methods. The conclusions drawn by the researcher from the results of this study were carried out using a qualitative descriptive normative method. The results of the research are that the Regency/Municipal General Election Supervisory Body (Bawaslu) has the authority to resolve electoral process disputes that occur in regencies/municipalities, both among election participants or election participants with the KPU due to the issuance of a Decree or Official Report. The process of implementing electoral process disputes is carried out through mediation and adjudication. Election process dispute decisions made by Bawaslu are final and binding, except for election process disputes relating to the verification of Election Political Parties, determination of DCT members of DPR, DPD, Provincial DPRD, and Regency/Municipal DPRD as well as the determination of Candidate Pairs that can be sued to the Election Commission. Administrative Court (PTUN). It is recommended to Bawaslu to strengthen the human resources of Bawaslu members at the Regency/City level, especially the ability of Bawaslu members to resolve disputes in the election process.Keywords: Authority, Regency/City, Dispute, Election

ABSTRAKTujuan penulisan ini adalah menganalisis pengaturan pertanggungjawaban pidana kontraktor atas kegagalan bangunan dalam hukum pidana yang berlaku saat ini dan merumuskan bentuk ideal pertanggungjawaban pidana kontraktor atas kegagalan bangunan di masa mendatang. Jenis Penelitian yang digunakan adalah penelitian hukum normative melalui pendekatan undang-undang (statue approach); dan pendekatan konseptual (conceptual approach). Hasil Penelitian ini menelitian ini menujjukan, pertama, pengaturan pertanggungjawaban pidana bagi kontraktor atas kegagalan bangunan yang berlaku saat ini hanya merujuk pada Kitab Undang-Undang Hukum Pidana yang rumusan pertanggungjawaban pidananya masih terkungkung dalam pandangan bahwa subjek hukum hanya manusia secara persoon saja. Sedangkan dalam KUHP tidak mengenal pertanggungjawaban pidana oleh korporasi padahal kontraktor adalah bagian dari subjek hukum korporasi. Undang-Undang No. 2 Tahun 2017 tentang Jasa Konstruksi yang berlaku saat ini hanya mengenal pertanggungjawaban secara perdata baik melalui jalur litigasi dan non litigasi. Kedua. Idealnya, ada dua model pertanggungjawaban pidana bagi kontraktor atas kegagalan bangunan. Pertama, mengingat kontraktor adalah sebuah badan hukum yang berbentuk korporasi maka baik pengurus dan korporasi keduanya sebagai pelaku tindak pidana dan keduanya pula yang harus memikul pertanggungjawaban pidana. Kedua, pemisahan pertanggungjawaban pidana bagi pengurus dan korporasi. Meminta pertanggungjawaban pidana dan mengancam pengurusnya yang sebagai pelaku dengan ancaman pidana penjara dan denda serta meminta pertanggungjawaban pidana denda bagi korporasinya.Kata Kunci: Pertanggungjawaban Pidana Kontraktor; Kegagalan Bangunan.ABSTRACTThe purpose of this paper is to analyze the contractor's criminal liability arrangements for building failure in the current criminal law and to formulate an ideal form of contractor's criminal liability for future building failures. The type of research used is normative legal research through a statute approach (statue approach); and a conceptual approach (conceptual approach). The results of this study point out, first, the regulation of criminal liability for contractors for building failures that currently applies only refers to the Criminal Code, which the formulation of criminal liability is still confined in the view that legal subjects are only human beings in a manner. Meanwhile, the Criminal Code does not recognize criminal responsibility by corporations even though contractors are part of the legal subject of the corporation. Law No. 2 of 2017 concerning Construction Services that currently applies only recognizes civil liability, both through litigation and non-litigation channels. Second. Ideally, there are two models of criminal liability for contractors for building failures. First, considering that the contractor is a legal entity in the form of a corporation, both the management and the corporation are the perpetrators of a criminal act and both must bear criminal responsibility. Second, separation of criminal responsibility for management and corporations. Asking for criminal responsibility and threatening the management as the perpetrator with imprisonment and fines and asking for criminal fines for the corporation.Keywords: Contractor's Criminal Liability; Building Failure.

Every Indonesian citizen actually has the same rights before the law. Likewise, the perpetrators of criminal acts get treatment in accordance with the capacity of the acts committed. Legal protection does not really focus on welfare, but rather on the determination of the consequences of a legal event. This is outlined in the 1945 Constitution Article 27 Paragraph 1. Responding to the paradigm of thinking about the perpetrators of criminal offenses should get the maximum punishment, it does not mean to impose a sentence that exceeds the legal capacity in force in the country. this also applies to the double cast in the 2017 regional elections which took place in the District of West Aceh. The mechanism of the process of legal protection for perpetrators of criminal acts, is part of legal efforts in ensuring justice with legal certainty for the benefit of the law through formal and or material stages. The existence of Indonesia as a form of unitary state has recognized and respected customary law community units and their traditional rights as long as they are still alive and in accordance with the development of society. One of them is regarding the specificity of customary institutions in the province that have certain and special powers such as the Tuha Peut Aceh institution and the West Sumatran Nagari Customary Council (KAN), this study will examine the similarities and differences in the authority of the two traditional institutions in the area. along with the position in the institutional structure of government in the village. This study aims to examine the position of Aceh's Tuha Peut Institution and West Sumatra's Nagari Adat Density Institution and to describe the differences and similarities in authority between the two institutions. The research method uses normative research or library research with a statutory approach and a comparative approach. The results of the study show that the authority for formulating village budgets, formulating village regulations, as well as supervision carried out by the two traditional institutions on the village government will have a positive impact on everyone, where any legal problems that can still be resolved in traditional institutions can still use traditional institutions. existing in an area.

Indonesia still has a very crucial problem, the problem is human trafficking. This study is aimed at identifying and analyzing legal protection for Indonesian workers who work in the Middle East against crimes of trafficking in persons based on national law and international law as well as the application of sanctions given to perpetrators. The research method in this article is juridical normative using a statute approach and a conceptual approach. The results of this study are a form of protection for migrant workers, there are several international regulations, one of which is CEDAW. Meanwhile, the government's efforts in legal protection for TKI victims of human trafficking are by issuing various legal instruments, one of which is the UU PTPPO (Pemberantasan Tindak Pidana Perdagangan Orang). From this research, it can be concluded that the government needs to collaborate bilaterally, as well as multilaterally, especially the destination countries for placing Indonesian migrant workers, and cooperate with non-governmental organizations in combating human trafficking.

In the section weighing Qanun Aceh Number 11 of 2018 on Islamic Financial Institutions (LKS) states that the juridical reason of the establishment of Qanun LKS is a follow-up to the implementation of Article 21 Qanun Aceh Number 8 of 2014 on the Principals of Islamic Shari'ah. After the promulging of Qanun LKS, many Conventional Bank Financial Institutions in Aceh decided to close their business in Aceh, so that if people still want to use conventional bank services, then the transaction must be done outside Aceh. In fact, almost all business actors in Aceh's economic activities are connected to outside areas, while in outside areas many business actors, especially corporations, have not fully used the Shari'ah banking system. The formulation of the problems discussed in this study is: "Is the legal politics promulgated Qanun Aceh Number 11 of 2018 on Islamic Financial Institutions has been able to improve the economy in Aceh?". The research method used in this research is normative-empirical research on the implementation of normative law provisions (laws) in action on any particular legal event that occurs in a society with a Live Case Study approach, which is an approach to a legal event whose process is still ongoing or has not ended. The results showed that in practice Aceh's economic independence is still very low, in the case of business actors, many obstacles are experienced in the services of Islamic banks, including difficulty making transactions with partners from outside Aceh who generally use conventional bank accounts. The advice given in this study is that conventional financial institutions that have been established in Aceh in facilitating the transactions of business people in Aceh and to succeed financial institutions based on islamic sharia principles only need to open Sharia business units from their conventional financial institutions that have been formed, this is in accordance with the mandate of Article 21 Qanun Aceh Number 8 of 2014 on The Principals of Islamic Shari'ah which is the basis or juridical reason of the establishment of Qanun LKS so that for business actors who transact with business actors outside Aceh who predominantly have not used shari'ah financial institutions can be facilitated in conducting business transactions, so that this will have an final impact on improving the economy in Aceh.

An act against the material law in criminal law is that a person commits an act against the law living in society (unwritten law). So if a person's actions are not against an unwritten law, then he cannot be punished. The author wants to investigate whether the theft of loose palm oil in Lamie Village is an act against the law or not. The author's initial hypothesis is that in several plantations in Lamie Village, after harvest workers have finished harvesting palm oil where they work, there is a habit of harvesting workers choosing loose palm kernels that have fallen to the ground and then sold. The research method in this writing is through an empirical juridical approach. This research was conducted by enforcing or applying normative law into legal relationships in society. The results of the study said that all garden owners in Lamie Village with a land area of 3 ha and above allowed harvesters to take loose palm oil. So the harvester's actions are not against the unwritten law. Then, some garden owners whose land area is 3 ha and below must have prior permission from the garden owner. If the permit is given then it does not violate the unwritten law, but on the contrary if the permission is not given then the perpetrator may be subject to Article 362 of the Criminal Code concerning theft.

Recognition of the traditional rights of the community, such as the implementation of traditional and cultural life which differs from one region to another, is the glue of the Unitary State of the Republic of Indonesia. One of them is the customs and culture that exist in society in Aceh, namely Langgeh Rights. Langgeh rights are former rights, namely the right of one person is more important than others, to get the opportunity to buy the neighbor's land at the same price. Langgeh rights can be given to the closest person to the seller, namely, relatives of the seller, other members of customary law, or neighbors whose land is directly sold with the land to be sold. Langgeh rights aim to prevent the land from being purchased by foreigners from outside the customary law community. In practice, the settlement of disputes over the rights of langgeh (syuf'ah) in Aceh almost entirely cannot be resolved through the Syari'ah Court, but will be resolved in the gampong customary court, this is because the Acehnese are a society that upholds the Shari'ah who expect peace. They do not expect mutual hostility, so the outcome of the customary justice process is peace.
