Abstract

Legal protection of the rights of women workers is the fulfillment of basic rights inherent and protected by the constitution, this is regulated in Law Number 13 of 2003 concerning Manpower which includes protection for women workers who are entitled to be accepted and must be provided by employers. This study aims to determine the legal protection provided and received by female workers in Indomaret Swalayan, Somba Opu District, Gowa Regency. This research is a field research conducted with a juridical approach, data collection methods in the form of primary data and secondary data obtained through observations, interviews, documentation, collected data are analyzed qualitatively. The results of the study are that legal protection for women workers in accordance with the mandate of Law Number 13 of 2003 has not been fully implemented because there are still unfulfilled rights of women workers, such as payment of overtime and leave wages, provision of menstrual leave, and shuttle services for female workers who work after 23.00. The fulfillment of rights should be an integral part of legal protection efforts, and should be the domain of supervision from the government.

Abstract

Women's representation in the Badan Permusyawaratan Desa is mandated by the Village Law to encourage women's involvement in policy formulation at the village level. This study aims to analyze women's representation in the Badan Permusyawaratan Desa in Tabbinjai Village, Tombolo Pao District, Gowa Regency in the perspective of Islamic law. This research is a qualitative field research with a legislative and theological approach to syar'i. Data is sourced from primary and secondary data obtained through observation, interviews, and literature studies. Women's representation in the structure of the Badan Permusyawaratan Desa in Tabbinjai Village has fulfilled the provisions of laws and regulations, even though the quota does not reach 30%. The lack of interest and representation of women is influenced by various factors, such as lack of socialization about the role and function of the Badan Permusyawaratan Desa, an election system that seems closed, education level and the choice to focus on other professions. The involvement of women in the public sphere caused dissent among scholars, some expressly forbidding on the basis of hadith narrated by Abu Abkrah. Other scholars, however, argue that the hadith does not apply in general, but only applies to the Persian empire. Because historically, there are examples of women's leadership, both those described in the Qur'an and those that occurred during the time of the Holy Prophetsa and his companions.

Abstract

The guarantee of legal certainty of land rights has encountered various challenges, including in the implementation of land registration. The Badan Pertanahan Nasional has a central role in realizing systematic land registration despite the complexity of the problems that come with it. This study aims to determine the role of the Badan Pertanahan Nasional in optimizing land registration in Pangkajene dan Kepulauan Districts. The type of research used is qualitative field research with a normative juridical approach. The results showed that the stages of implementing land registration include the collection and processing of physical data, the collection and processing of juridical data and the issuance of documents proving proof of rights. Optimization of land registration in Pankajene dan Kepulauan Districts is carried out through several strategies, namely: a) responsive, fast and systematic services; b) systematic land program (free land registration), and c) online services. Registration of land rights is part of ijtihad to safeguard property and this effort is in line with one of the principles of al-Maqasid al-Sharia i.e. maintaining property (hifz al-mal) hifz al-mal).

Abstract

This study aims to find out how the government management system in Manimbahoi Village, Parigi District, Gowa District, shar'iyyah siyasah perspective. This type of research is field research using normative juridical and theological approaches. The results of this study show that the concept of government management in Manimbahoi Village, Parigi District, Gowa Regency is based on Law Number 6 of 2014 concerning Villages which includes planning, community empowerment, organizing village government institutions, using village resources, and supervising village governance. The concept of shar'iyyah siyasah emphasizes the administration of government, including the village government level held to achieve welfare - benefit in various aspects of life, if this principle becomes a benchmark, then obedience to ulil amri will follow the command to obey Allah and His Messenger.

Abstract

In principle, village regulations are decisions of the village community which form the basis for administering village governance which aims to protect rights and obligations, regulate living together and maintain community order at and or the will of the community. This study aims to find out how village regulations are formed based on Law Number 6 of 2014 concerning Villages in Matajang Village, Kahu District, Bone Regency. The results of this study indicate that the Formation of Village Regulations in Matajang Village, Kahu District, Bone Regency is in practice the basis for regulating local community affairs as an effort to realize the aspirations and will of the community. However, in reality, the implementation of village regulations is only the responsibility of the village head and the Village Consultative Body (BPD) without involving community participation in all stages of drafting village regulations. In addition, the formation of law according to siyasa syariyyah must fulfill the elements of legality; ummah and shura.

Abstract

Hierarchically, the sub-district head as a district apparatus has a coordinating function in administering government in the sub-district area under the auspices of the regent through the district/city regional secretary. This study aims to analyze the appointment of sub-district heads in Barru District from the Siyasah Syariyyah perspective. The type of research used is qualitative research (field research) by taking data sources from the process of observation, interviews, documentation and literature studies. The results of the study show that the implementation of the appointment of sub-district heads as regional autonomous positions in Barru Regency has followed the qualifications for the post of sub-district heads mandated in laws and regulations by fulfilling technical competence, which is measured by the level of quality of education, technical training, and technical work experience as well as managerial competence. measured by the level of leadership experience. The appointment of sub-district heads in siyasa fiqh studies is not outlined textually but is emphasized in general in selecting leaders with the prerequisites of shiddiq, amanah, fathanah and tabligh.

Abstract

The pension fund program is one of the efforts to improve the welfare of Civil Servants who have entered retirement for their service and dedication to the country. This study aims to analyze how the welfare of old age for Civil Servants in Jayapura City Islamic Law Perspective. The type of research used is qualitative research (field research) with juridical and normative syar'i approaches, data sources in the form of primary and secondary data obtained through observation, interviews, documentation and literature studies. The results showed that Civil Servants who have entered retirement will receive pension funds through two main programs, namely the Tabungan Hari Tua program and dana pensiun managed by PT. Taspen Jayapura City Branch, the pension scheme aims to provide income continuity, especially to meet daily needs in old age. Security of the necessities of life is an aspect of concern in Islam, even one of the principles of maqashid al-shari'ah is the obligation to maintain property (economic ability) in addition to the obligation to maintain religion, soul, reason, and offspring.

Abstract

Decisive elites are groups or institutions that have collectivity in influencing the social order of government. This study aims to determine the existence of decisive elites in rural development from the perspective of shar'iyyah siyasah. This research is a qualitative field research with an empirical juridical and normative syar'i approach. The results showed that the decisive elite group in the Selayar Islands Flower Village played a direct role in contributing thoughts, ideas and constructive criticism in determining the direction of development, problem solving and implementation of village activities whose reality was only represented by certain elites, such as political elites, scholars, women, and youth elites. Development in accordance with the principles of shar'iyyah siyasah is participatory development and involves various elements, not dominated by certain groups, but becomes a collective responsibility in accordance with the principle of equality and the principle of deliberation.

Abstract

Regional government affairs are organized using the principle of autonomy. Regional governments have roles and strategies in fostering and supervising their regions, especially in the preparation and implementation of regional regulations. This study aims to find out how the Implementation of Regional Regulation Number 6 of 2017 Article 18 Paragraph 2 regarding the Control of Livestock. This type of research uses a qualitative field research method with an empirical juridical and normative syar'i approach. The results of this study indicate that the Implementation of Regional Regulation Number 6 of 2017 Article 18 Paragraph 2 on the Control of Livestock has not been running effectively and efficiently. As for several factors of the ineffectiveness of Regional Regulation No. 6 of 2017 include the lack of socialization provided by the government, lack of legal awareness, lack of firmness from law enforcement, and the absence of availability of land owned by breeders.

Abstract

Sexual violence against women continues to increase. Komnas Perempuan recorded that there were 226,062 cases of sexual violence against women in 2020 increasing to 338,496 cases in 2021. Through Law Number 31 of 2014 concerning Protection of Witnesses and Victims, it contains rights that women should receive as victims of sexual violence. This study aims to reveal the implementation of the rights of women victims of sexual violence in the city of Makassar. This type of research is a qualitative field research with normative juridical and normative theological approaches. The results of the study show that sexual violence in Makassar City is still relatively high. In addition, the protection of the rights of women victims of sexual violence has not been implemented properly due to the lack of capacity of law enforcement to understand victims' rights, impunity for perpetrators, limited escort staff, culture of siri' society, and limited access to legal aid in the regions are obstacles in protecting and fulfilling the rights of victims of sexual violence.
