Abstract

Artikel ini ditulis dimaksudkan untuk menjawab pertanyaan : Mengapa poligami menjadi polemik yang tak kunjung usai ? Penulis berusaha untuk menjawab pertanyaan besar tersebut dengan mengkaji poligami dari berbagai perspektif dengan library research sebagai basis penelitiannya yang dikelola dengan paradigma integrasi–interkoneksi-multidisipliner. Hasilnya adalah bahwa boleh tidaknya berpoligami bergantung dari perspektif mana kita melihat. Dengan demikian, setidaknya kajian ini memberikan semacam pegangan bagi para pemerhati studi tentang poligami.

Abstract

Sejarah Islam telah mewariskan sebuah peninggalan khasanah intelektual yang teramat berharga, yaitu pemikiran fiqh yang sangat kaya akan sentuhan filosofis dan hikmah kesyariahan. Para ulama telah dengan sangat produktif menuliskan gagasan intelektualnya di seputar pemikiran hukum (legal opinion) pada awal-awal puncak gemilang peradaban Islam abad 2 – 3 Hijriyah. Oleh karena sangat produktifnya para ulama masa itu dalam upaya memahami pesan-pesan Syari’ yang termuat dalam al qur’an maupun al-Hadis, imbasnya umat sekarangpun mewarisi pula sejumlah perbedaan pendapat yang dihasilkan dari dialektika hukum Islam yang terjadi kala itu. Sehingga umat merasa inferior untuk bisa bersatu pendapat dalam platform yang sama atau dalam menemukan kalimatun sawa yang mampu mengikis sekecil apapun bentuk dan ragam varian perbedaan pendapat tersebut. Dari titik inilah tulisan ini akan disajikan. Di sisi lain, sejatinya penelitian ini termasuk jenis penelitian metode kajian dengan menggunakan pendekatan penelitian kualitatif yang teknik analisis datanya meminjam teori Analisis Isi. Sehingga persoalan yang menjadi core tulisan ini akan dianalisis berdasarkan prosedur baku yang terdapat dalam teknik Analisis Isi. Kesimpulan akhir dari kajian ini adalah bahwa terdapat beragam akar perbedaan pendapat di antara para ulama itu terutama sekali hal itu disebabkan oleh : Perbedaan pendapat yang diakibatkan oleh eksistensi Nash, Perbedaan pendapat akibat penggunaan qaidah ushuliyah maupun qaidah fiqhiyyah, perbedaan daya intelektualitas masing-masing ulama, dan Perbedaan metode istinbathiyah dalam menginstinbathkan hukum.

Abstract

Fiqh (baca : Hukum Islam) dan perubahan sosial adalah bagaikan dua sisi dari sekeping mata uang. Satu dengan lainnya senantiasa terkait dalam perjalanan waktu dan tempat. Maka ketika Fiqh yang merupakan sebuah produk pemahaman atau pemikiran atas suatu teks (Al - Qur'an dan Al - Hadits) bersinggungan dengan perubahan sosial tentunya ia harus sanggup melakukan dialog dengan setiap wacana yang berkembang termasuk menghadapi kejadian yang luar biasa seperti adanya pandemi Covid-19 ini, sehingga pencapaian substansi yang ada di balik pemahaman itu yang tak lain adalah kemaslahatan akan senantiasa dapat dicapai. Sebagaimana dikatakan dalam kaidah Fiqh : dar 'u al mafasidi muqaddamun 'ala jalbi al mashalihi (menolak kemafsadatan, lebih didahulukan dari pada menarik kemaslahatan). Oleh karena itu tindakan preventif dalam menghadapi merebahnya pandemi Covid-19 harus lebih diutamakan.

Abstract

Online transactions are order transactions in a global era business model that is not face-to-face, with only conducting data transfers via cyberspace (data intercange) via the internet between the two parties, namely sellers and buyers, this information technology development enables remote transactions, where anyone can interact even without face to face (face to face). In online business the most important thing is the availability of information and the benefits. Or what is now better known as e-business or e-commerce, the type of research used in this research is library research, buying and selling online including aspects of muamalah which are basically permissible. Unless there is an argument forbidding it. In addition, the terms and conditions of online purchase agreement also do not conflict with the terms and conditions of the Islamic legal system of engagement.

Abstract

Islam mengajarkan kepada umatnya untuk berbuat dan berkelakuan baik dalam hal apapun. Tidak memungkiri dalam hal pernikahan Islam juga memberikan peraturan yang baik juga, peraturan yang baik ini diperuntukkan kepada umatnya supaya tidak terjerumus terhadap hal-hal yang tidak diinginkan (kejahatan).Dalam hal pernikahan pun juga diberikan aturan. Hal ini semata demi kebaikan kehidupan umat manusia didunia dan di akhirat.Pernikahan menjadi hak setiap orang. Negara menjamin warga negara untuk membentuk rumah tangga melalui perkawinan yang sah. Negara pun telah mengatur bagaimana agar sebuah perkawinan dapat dilakukan secara sah.Bukan hanya itu, negara juga menata aturan agar semua pernikahan dicatat. Sehingga jalinan pernikahan itu memiki perlindungan hukum, baik di dalam maupun di luar pengadilan.

Abstract

Perkawinan merupakan sebuah impian yang menjadi target pada masa tertentu bagi seseorang, akan tetapi tidak semua individu mendamkan perkawinan karena beberapa alasan yang mereka anggap sebagai suatu hal yang membebani setelah perkawinan. Lalu bagaimana dengan penundaan perkawinan yang telah direncanakan karena adanya penyebaran wabah pada suatu negara. Penelitian ini menggunakan pendekatan kualitatif dengan mengunakan metode deskriptif analitis dengan menumpulkan data-data yang bersifat konseptual dan dianalisa dengan metode miler dan huberman. Tulisan ini mendiskripsikan tentang penundaan pernikahan dalam masyarakat Islam yang selama ini terjadi karena kurangnya pemahaman tentang konsep pernikahan dalam islam, serta penundaan perkawinan yang bukan karena alasan takut menikah tetapi karena wabah yang menyebar dan membahayakan jiwa manusia. Hasilnya adalah menunda pernikahan karena alasan yang negatif sangat tidak dianjurkan karena akan menjerumuskan kepada hal yang mengarah pada kemaksiatan, sedangkan menunda perkawinan karena menyelamatkan banyak jiwa manusia adalah perbuatan yang mulia.Kata kunci, Penundaan, Perkawinan, wabah covid-19

Abstract

Background: the Religius courts of Malang city is a Judicial Instution that intended for Muslims in seeking justice because Malang Including areas with high cases than that was the background of rapid trial in addition it is also influenced by deficiencies related to limited courtroom and a small number of judges and in the trial practice there is something new, namely the trial process by examining two direct witnesses without being summoned one by one and related to the legal status of the decision in a speedy hearing, it is valid and legally binding. Methods: In this study using descriptive research with qualitative methods that are more inclined to the analysis. The data collection process was carried out in several ways, namely by Interviewing, Documentation and Observation with 4 research subjects. Results: The results of the study showed that there was a fast trial practice in the Malang Religious Court related to the background, practice and legal status of the verdict in the trial with the fast system. Conclusions: the conclusions include the reasons behind the quick trial, their practice and the legal status of the decisions in them.Keywords: Background, Practice, Legal Status of the Verdict in a quick trial

Abstract

The verstek decision is a decision that the defendant does not attend at the beginning of the first trial and is still absent for the hearing on the following day. The impact when the defendant is not there is that the defendant does not know the trial schedule. Then the verstek trial was held by a summons from the trial through the substitute clerk of the court. The substitute clerk makes a summons at the residence of the defendant. If the defendant is not in the residence, then the call is sent through the family, neighbors or the village head. From the results of the judges' considerations, the Verstek decision was the verdict handed down by the judge outside the presence of the defendant. In the Verstek decision, there is a statement that the defendant is absent even though he has been properly summoned. In this study there are two legal remedies, ordinary legal remedies namely those used not yet fixed, such as technology, appeal and cassation and extraordinary remedies namely those used permanent legal force. Abstract

Provisions for the distribution of inheritance for people left by the testator have been outlined in the Qur'an and the Hadith of the Prophet in detail and clearly. The verses of the Qur'an and the Hadith of the Prophet directly regulate inheritance and without ignoring someone at all. From the background of the research above, the researcher formulated the problem, namely regarding the view of Islamic law on the distribution of inheritance systems in Muslim families and the practice of inheritance among Muslim families. The method of study in this paper uses qualitative methods. Data collection procedure is done using the observation method, interview method, and documentation methods. In this study shows that the view of Islamic law on the distribution system of inheritance in Muslim families still more or less using customary inheritance law, but prioritizing using Islamic inheritance law first. And in the distribution system uses what is already listed in the Qur'an and al-Hadith. Abstract

A witness is a person who has met the formal and material requirements and his testimony is given in court from what he has seen and experienced by himself, but what if the witness does not see it directly but only hears it from someone else ? in the witness's civil law it is called testimonium de auditu. As for the problems of the statement above is as follows : How about the strength of the witness testimonium de auditu in the divorce case at Religious court in Malang city ? and How is the consideration of judges about the witness testimony de auditu at Religious court in Malang city ?. To answer the questions above, the researcher uses a qualitative approach, The data is collected using documentation interview techniques with three judges as informants, and library research about testimonium de auditu. From the results of the research that has been done it can be concluded that according to the judge, the strength of the witness testimony de auditu at the Religious Court in malang city is not recognized as a tool of evidence, but rather in practice The judge has the authority to examine the witness, and it is not wrong for the judge to hear the witness' testimony, The not as direct evidence. But the testimony can beoconstrued asoa tool of proof of hypothesis with objective and rational judgment and it can serve as a basis fot proving something. And the judge’s consideration of the use ofithe witness deiauditu inidivorceicases inireligious courts malang city. that is based on the article 16 (1) UU Number.14 year 1970 junco. UU Number.4 year 2004 about the main points of judicial authority, jurisprudence supreme court 11 november 1959 number. 308 K/SIP/1959. and This includes cese verstek so there is no objection.
