Abstract

Jenis penelitian ini adalah field research/ penelitian langsung, sedangkan metode yang digunakan adalah dengan cara wawancara dan observasi langsung yang sekaligus merupakan sumber data primer. Sumber data sekunder berupa Peraturan Perundangan-undangan Republik Indonesia yang berkaitan dengan Penyelenggaraan Haji dan Umroh, serta sumber-sumber pendukung lainnya. Hasil penelitian sebagai berikut: A. Pelayanan yang diberikan oleh travel haji dan umroh Kota Medan, merupakan pelayanan prima/ pelayanan yang mengutamakan kualitas, kenyamanan. B. Strategi dan manajemen: 1). Strategi: a). Membuat cabang; b). Mengadakan kerja sama; c). Mendirikan kantor di tempat strategis; d). Menggandeng tokoh masyarakat; e). Melaksanakan penyuluhan; f). Memasang spanduk,di tempat ramai; g). Harga promo; h). Memaksimalkan pelayanan; i). Tempat tinggal yang baik; j). Menghindari transit; k). Memberikan pendamping yang berpengalaman, dan bersertifikat; l). Melengkapi seluruh keperluan jamaah. 2). Manajemen: a). Mengurus izin resmi; b). Mengatur model pelayanan kantor; c). Bekerjasama dengan berbagai media; d). Memotifasi staf dan pihak kantor; e). Mengatur izin dalam dan luar negeri; f). Evaluasi; g). Selalu berkomunikasi. C. Kendala: 1). Kurs mata uang yang fluktuatif; 2). Izin visa merupakan otoritas dari negara Arab Saudi; 3). Regulasi/ peraturan luar dan dalam negeri yang berubah-ubah; 4). Persaingan antara pemilik jasa travel haji dan umroh; 5). Terdapat travel haji dan umroh penipu. D. Upaya: 1). Kendala berkaitan dengan Kurs mata uang yang fluktuatif. Maka hal ini tidak bisa ditanggulangi secara pasti, hanya melakukan tindakan promo, 2). Kendala mengenai izin visa, tidak ada yang dapat dilakukan, hanya berharap hubungan antara bilateral antara Arab Saudi dan Indonesia tetap terjalin, 3). Regulasi/ peraturan luar dan dalam negeri yang berubah-ubah. Meminta up date data dari Kementerian Agama; 4). Persaingan antara pemilik jasa travel haji dan umroh. Memperbaiki manajemen; 5). Travel haji dan umroh penipu dan nakal. mempunyai dua dampak, dampak negatif: mempengaruhi kepercayaan publik/ pengguna jasa untuk bisa berangkat ke tanah suci. Dampak positif: Agar pengguna jasa, lebih memilih agen travel haji dan umroh yang terpercaya, nyaman, dan aman, bukan yang murah, tapi tidak mempunyai izin. ABSTRACT The title of this research thesis is: "TRAVEL AND UMROH TRAVEL MANAGEMENT AND MANAGEMENT (Study of Medan City Hajj and Umrah Travel Competition Analysis)". This type of research is field research / direct research, while the method used is by way of interviews and direct observation which is also a primary data source, while the secondary data sources in the form of the Republic of Indonesia Legislation Regulations relating to the Implementation of Hajj and Umrah, as well as sources other supporting sources. The results of the study are as follows: The services provided by Hajj and Umrah travel, are excellent services / services that prioritize quality, comfort. Strategy and management: 1). Strategy: a). Make a branch; b). Hold cooperation; c). Establish an office in a strategic place; d). Cooperating with community leaders; e). Carry out counseling; f). Place banners, in crowded places; g). Promo price; h). Maximizing service; i). Good residence; j). Avoid transit; k). Provide experienced, certified counselors; l). Completing all pilgrims' needs. 2). Management: a). Take care of official permission; b). Regulate office service models; c). Cooperate with various media; d). Motivating staff and offices; e). Manage domestic and foreign permits; f). Evaluation; g). Always communicating. Constraints: 1). Fluctuating currency rates; 2). Visa permission is the authority of the country of Saudi Arabia; 3). Changing foreign / domestic regulations / regulations; 4). Competition between Hajj and Umrah travel service owners; 5). There are Hajj travels and con artists. Efforts: 1). Constraints related to fluctuating currency rates. So this cannot be overcome with certainty, only doing promo actions, 2). Obstacles regarding visa permits, nothing can be done, only hoping that bilateral relations between Saudi Arabia and Indonesia will remain intertwined, 3). Foreign and domestic regulations / regulations are changing. Request up date data from the Ministry of Religion; 4). Competition between Hajj and Umrah travel service owners. Improve management; 5). Hajj pilgrimage and cheating and mischievous umrah. has two impacts, negative impacts: affecting public trust / service users to be able to go to the holy land. Positive impact: In order for service users, prefer a trusted, comfortable and safe hajj and umrah travel agent, not cheap, but do not have permission.

Abstract

Ethics is a study of the legitimate and correct deeds and moral choices made by a person. In Greek is also known as ethos, which means custom habits. While in Arabic ethics is also known as Akhlak which means morality, temperance, conduct or character. Simply put, business ethics means learning about which is good/bad, right/wrong in the business world based on the principles of morality. This research is backed by the habit of sellers/traders in the market of Langsa city in the application of business ethics in Islam that emphasized on the ethics of trading. The purpose of this research is to know how an objective picture of the implementation of business ethics in conducting sales transactions in the traditional market of the Langsa city, and how Islamic reviews on the application of ethical trading in conducting Buy and sell transactions in the market. This research is a field research. The results of this research show that the implementation of trading transactions in the market of Langsa city has been executed well and is seen from two variables used two variables (attitudes of faith and habits) dominant show agreed with each A given statement. This indicates that business ethics in sales transactions that have been applied by traders are derived from the hereditary inheritance from parents (parental advice) or obtained by self-taught (natural) with ethical consideration and Unethical.

Abstract

Waqf is one of the Islamic social instruments that is closely related to the socio-economic community. In Indonesia, waqf not only plays a role and function in the side of worship, but waqf is expected to help the economy of the people. Waqf in Indonesia is regulated by Law No. 41 of 2004 has been implemented in a number of community empowerment programs. The Indonesian Ulama Council has legalized this productive waqf in cash waqf, this has enabled the public to donate their money to the institution or organization of the waqf body. Other problems faced in the development of waqf in Indonesia are the development of waqf resource management, a lack of professionalism, commitment and understanding of productive waqf. The stagnation of productive waqf in Indonesia needs special attention from the government and sharia economic activists, where for the development of productive waqf that has existed long ago during the time of Khalifah Usman Bin Affan r.a so that this can become a pilot project for the development of productive waqf in Indonesia.

Abstract

This study discusses the application of Islamic economic law in the practice of multiple contracts in Islamic banks. The multi-contract is a contract between two parties to carry out muamalah transactions or transactions consisting of two or more contracts, for example, contracts consisting of buying and selling and ijarah contracts, buying and selling contracts, and so on. That all legal consequences of a combination contract, as well as all rights and obligations arising from it, are considered as an inseparable unit, having the same position as the legal consequences of the contract. This research is library research with a descriptive method. The results of the study conclude that multi-contract is a method of building Islamic economic law in a highly developed economic field. This goes beyond the limits of classical custom which is simply divided into 'aqd al-musamma and 'aqd ghair al-musamma. This division has been going on for a very long time and is only written in fiqh books without any theoretical and practical developments. The emergence of multi-contracts has transcended two aspects of legal norms, developed as a theory of contracts, and provided opportunities for Islamic banking to be easier and more open in developing products based on contracts that are avoided and free from usury activities. Abstract

The digital revolution happening nowadays brings significant impacts. Therefore, internet creates a new opportunity for the entrepreneurships, product providers, and the ease of unlimited transaction. The implementation of digital marketing has targeted Muslim fashion product. There are Syariah Economic Report data from quartal of 2019-2020 indicating the decrease due to pandemic of Covid-19, although the Koyu Hijab experienced product sale increase. This research aims at finding out the influence of mobile marketing, integrated digital marketing, and push digital marketing towards the Muslim consumers’ interest. The type of research implemented was descriptive quantitative utilizing primary data. The data collection was done using questionnaire with 4 Liker scales. The sampling technique used was purposive sample method covering 400 respondents. The data analysis technique used was multiple linear regression, coefficient determination test, t-test, and f-test. The analysis instrument applied in the research was IBM statistic version 2.1. The research result shows that mobile marketing, integrated digital marketing, and push digital marketing has positive and significant influence simultaneously towards Muslim consumers’ interest variable. Abstract

This research is a normative research which is part of library research or (library research). Where this research will examine cash waqf which is not far from the existing problem formulation. Namely; 1) how is the concept of cash waqf in Indonesia and how is it related to the concept of madzhab fiqf?; 2) what is the role of the state in the success of cash waqf and progress in building the economy of the people in the future?; last 3) what is the maqashid of cash waqf as an economic empowerment of the people in the perspective of maqashid Ibn 'Asyur?. The results of the study show that the concept of Indonesian waqf fiqh allows cash waqf or cash waqf. This permissibility was responded to by the emergence of the MUI fatwa on cash waqf, and accompanied by several laws and regulations such as the Waqf Law no. 41 of 2004 as well as several other regulations. Not only that, the progress of cash waqf in the future is expected to help the people's economy, such as empowering MSMEs, agriculture, commerce, livestock and other economic sectors of the people. With the maqashidy-based analysis Ibn 'Asyur shows that there are two maqashids to be addressed in the practice of cash waqf itself. First, maqashid ammah in the form of general benefit (universal) for economic empowerment of the people which can be allocated to places of worship, education, health and other social matters. Abstract

Abstract Basically, buying and selling transactions in determining the contract, the party who transacts has the right to continue or cancel a contract. A solution in Islam, offering the right of khiyar. The purpose of this study was to determine the implementation of Khiyar in Ba'i Salam transactions at the Student Cooperative Store and to review it from the perspective of muamalah fiqh. The conclusion is that in the practice of ba’I salam carried out by the Gontor Putri 2 student cooperative with distributors, they have implemented khiyar aib, khiyar ru’yah, and khiyar syarat. When viewed from the point of view of fiqh muamalah, the application of khiyar aib is appropriate, because there was a new defect known to the buyer after the contract was made and before the receipt. khiyar aib is still allowed in muamalah fiqh because khiyar aib does not prevent the perfection of the handover of goods. However, the actual khiyar ru’yah, and khiyar syarat in ba'i salam are not necessary, because if the order has the right of the khiyar, then the goods will be borne by the seller, and so on, it is enough just to mention the specifications of the goods for the validity of the salam contract. Abstract

Cryptocurrency investment has become a phenomenon in various countries, including Indonesia, especially among millennials. In February 2021, there were 4.2 million cryptocurrency investors in Indonesia, most of them are millennials. A cryptocurrency is a new form of investment, which has high volatility, where investors are faced with the risk of very volatile price changes. This study aims to determine the millennial generation's understanding of the risks of investing in cryptocurrency and how the millennial generation manages risk and maximizes profits when investing in cryptocurrency assets. The methodology used in this study is a qualitative method by conducting in-depth interviews, where the respondents are cryptocurrency investors with an age range of birth from 1980 to 2003. The results of this study indicate that the millennial generation has realized the risks faced when investing in cryptocurrencies and the risk management and profit maximization used are by determining stop loss and take profit points, waiting and selling, applying the dollar-cost averaging method, and investing long-term. Abstract

Abstract The rules of fiqh (qawā'id al-fiqhiyyah) have a goal, namely as the determination of Islamic law from various new problems due to progress and changing times, including in the economic field (muamalah maliyah) in Islamic financial institutions. By making the rules of fiqh as the legal basis, it is a must to get convenience from contemporary economic problems which do not have the dominant texts of shar'ih in the Qur'an and hadith. Even in financing the results of Islamic banking through musharaka. With the public's interest in this financing, it is necessary to increase understanding related to the rules of fiqh in Islamic law. So the purpose of this study is to explain or describe the rules of fiqh as a legal principle in musharaka financing transactions. The method used is qualitative. Data collection techniques in this study were sourced from primary and secondary data. Primary data comes from the Qur'an, hadith, and fatwas in the DSn-MUI, while secondary data comes from books, journals, and research reports related to the implementation of qawā'id al-fiqhiyyah. Abstrak Kaidah fikih (qawā’id al-fiqhiyyah) memiliki tujuan yaitu sebagai asas dalam penetapan hukum Islam dari berbagai macam permasalahan yang baru akibat kemajuan dan perubahan zaman, termasuk dalam hal bidang perekonomian (muamalah maliyah) di lembaga keuangan syariah. Dengan menjadikan kaidah fikih sebagai landasan hukum merupakan suatu keharusan guna mendapatkan kemudahan dari persoalan ekonomi kontemporer yang dominan tidak memiliki nash shar’ih dalam al-Qur’an dan hadist. Pun dalam pembiayaan bagi hasil perbankan syariah melalui musyarakah. Dengan meningkatnya minat masyarakat dalam pembiayaan ini, perlu adanya peningkatkan pemahaman terkait kaidah fikih dalam hukum Islam. Sehingga tujuan dari penelitian ini untuk menjelaskan atau mengambarkan kaidah fikih sebagai asas hukum dalam transaksi permbiayaan musyarakah. Metode yang digunakan yaitu kualitatif. Teknik pengumpulan data pada penelitian ini bersumber dari data primer dan sekunder. Data primer berasal dari al-Qur’an, hadist, dan fatwa-fatwa dalam DSn-MUI, sedangkan data sekunder berasal dari buku-buku, jurnal-literatur, serta laporan hasil penelitian terkait implementasi qawā’id al-fiqhiyyah.

Abstract

This article aims to analyze the system of determining workers’ wages according to Syafi’iyah fiqh and positive law; the government is looking for an alternative approach to national labour issues, especially in the mechanism of applying wages that are by the efforts of workers as contained in the book of the Syafi’iyah school of thought. This research aims to determine the system for setting workers’ wages in Indonesia and to contribute ideas to Islamic economic law. At the same time, it can be applied in the life of Islamic society in the era of globalization and free markets. The method used in this paper is descriptive analysis with a normative juridical approach. The primary sources used in this writing are books by fiqh scholars from the Syafi’iyah school of thought and laws related to workers’ wages, namely Government Regulation (PP) Number 36 of 2021 concerning wages. The findings in this study are that workers’ salaries in Government Regulation (PP) Number 36 of 2021 obtained by workers are still different from the work performed by workers, and the risks they face are disproportionate. At the same time, the determination of wages, according to Syafi’iyah fiqh, must be based on the principles of justice that workers, employers, and the government feel. The focus of justice is translated as setting a minimum wage based on meeting the most basic needs of a worker. Thus, the most critical wage, according to Syafi’iyah fiqh, is real wages, not nominal wages (money).
