Abstract

This study aims to analyze the implications of foreign labor policies on industrial competitiveness and domestic labor opportunities, while identifying the legal and policy challenges arising from their implementation. The research employs a library-based (library research) qualitative approach, combining juridical-normative analysis with policy analysis, using primary sources such as laws, regulations, and government policy documents, and secondary sources including scholarly articles, books, and previous research reports. Findings indicate that while foreign labor can enhance productivity and facilitate technology transfer, without effective selection mechanisms and oversight, the policy may disadvantage domestic workers. The study emphasizes the necessity of an integrative policy framework that balances industrial competitiveness with the protection of domestic labor rights.

Abstract

This study analyzes consumer legal protection in the practice of digital concert ticket concierge services in Indonesia based on the right to "accurate, clear, and honest" information under Article 4(c) of the Consumer Protection Law (UUPK), and compares it with the standards in Section 5 of the Federal Trade Commission Act in the United States. Using a normative method with statutory and comparative approaches, the research finds that concierge service practices operate in a specific regulatory vacuum. The norm in the UUPK is vague and inoperable, while protection through civil law and the Electronic Information and Transactions Law (ITE Law) is proven to be limited. In contrast, the system in the United States, administered by the Federal Trade Commission (FTC), is more effective with objective evaluation standards, the reasonable consumer standard principle, and proactive enforcement mechanisms. It is concluded that Indonesia requires regulatory reform that adopts a more operational approach from the US.

Abstract

This study aims to analyze civil liability arising from the use of public figures’ images in AI-generated photographs and to assess the adequacy of Indonesian civil law in providing legal protection for image rights. This research employs a normative legal method with statutory, conceptual, and socio-legal approaches. Data were collected through a literature-based study of primary and secondary legal sources and analyzed qualitatively using deductive legal reasoning. The findings indicate that the unauthorized use of public figures’ images in AI-generated photographs may be classified as an unlawful act (onrechtmatige daad) under Article 1365 of the Indonesian Civil Code. Consequently, perpetrators may be held civilly liable for compensation and other remedial measures aimed at restoring the violated rights of the affected individuals.

Abstract

This study aims to analyze the aspect of maslahah and the effectiveness of the policy from the perspective of Islamic law. This research employs a qualitative method with a field research approach and descriptive analytical methodology. Primary data are derived from the related circular letter, while secondary data are obtained from relevant scientific literature. Data analysis is conducted through data reduction, data display, and conclusion drawing, with validity ensured through source triangulation. The findings indicate that, conceptually, the policy aligns with the principle of maslahah, particularly in enhancing the welfare of mustahik and reflecting prudence in religious practice. However, in practice, its effectiveness remains suboptimal due to limited socialization, differences in understanding, and variations in community compliance, thus requiring improved policy communication and public education.

Abstract

This study examines the relationship between national savings, capital accumulation, and economic growth in Indonesia during the period 2020–2024 by integrating conventional growth theory (Solow–Swan and Blanchard) with Islamic economic perspectives, including maqasid al-shariah, risk-sharing mechanisms, and Islamic financial instruments. Using secondary data from BPS, Bank Indonesia, OJK, and the Ministry of Finance, this research applies descriptive–quantitative analysis, Pearson correlation, and steady-state simulations to evaluate Indonesia’s growth dynamics. The findings show that Indonesia’s national saving rate (33–34% of GDP) reflects strong domestic financial capacity but remains below the estimated golden rule level. Investment efficiency is also relatively low, as indicated by a high ICOR (6–7), suggesting limited output gains from capital accumulation. The positive correlation between savings and output (r ≈ 0.78) mainly reflects macroeconomic stability rather than long-term causality. Furthermore, Islamic financial instruments such as sovereign sukuk, profit-sharing financing, productive waqf, and ZISWAF demonstrate significant potential to improve capital efficiency and promote inclusive and sustainable economic growth.

Abstract

This study aims to analyze the harmonization between the Qanun on Street Vendors in Aceh and Law Number 20 of 2008 concerning Micro, Small, and Medium Enterprises from the perspective of legal protection for micro-enterprises. This research uses a normative juridical method with statutory and comparative approaches. Primary legal materials include Qanun of Banda Aceh City Number 3 of 2007, Qanun of East Aceh Regency Number 1 of 2020, Qanun of Lhokseumawe City Number 1 of 2014, and Law Number 20 of 2008. Secondary legal materials in the form of books, journals, and previous studies were collected through library research and analyzed qualitatively using legal interpretation and content analysis. The results show that conceptually both legal frameworks share the same objectives, yet normative tension arises because Law No. 20 of 2008 is inclusive and protective, emphasizing empowerment, while the Qanun on Street Vendors in Aceh tends to be regulative and administrative, focusing on control and sanctions. Implementation in the field leads to vertical conflicts because control measures are not balanced with the provision of alternative locations and adequate empowerment programs. Harmonization is needed through an integrative-participatory policy model that combines the principles of empowerment, community participation, and inter-governmental coordination.
