Abstract

This study is a normative investigation that seeks to evaluate the review process associated with the allocation of HGU on HPL land. This regulation stands in contradiction to the UUPA, which stipulates that HGU should only be assigned on state-owned land; however, the legitimacy of the recent regulations offers a pathway for granting HGU on HPL territory. Additionally, this paper employs both the statutory approach and the conceptual approach. Legally speaking, the UUPA does not recognize HPL as a "land right," but rather designates it as "management." HPL emerged as one of the land rights through the Agrarian Ministerial Regulation No. 9 of 1965 and has evolved to the present as outlined in PP 18 of 2021. Perspectives regarding the definition of "management" differ. The UUPA defines "management" as authority, whereas PP 18 of 2021 interprets "management" as a form of land right. Moreover, concerning the HGU concept addressed in Article 28 of the UUPA, the land allocation must originate from the state's direct control, rather than from land that has been utilized by the holder of the HPL certificate for agricultural, fishery, or livestock purposes. This discrepancy clearly indicates conflicting norms, resulting in legal ambiguity and a possibility for judicial review.

Abstract

Halal tourism arrangements are included in the tourism agenda on Lombok Island. Lombok Island, since the inauguration of international events such as the GP series and super bikes organized by international parties with high reputations, must continue to adjust the provisions regarding halal tourism amidst liberalization in all sectors. The entry of international events is a challenge for the Indonesian government, especially the Lombok region. Lombok, which has a lot of potential for world-class tourist areas and has received world-class awards several times, needs to think about the conditions for halal tourism plans. Halal tourism has different standards, of course the effect of the word halal must be able to prove the quality and quantity of tourism based on halal standards. The formulation of the problem in this research is how is halal tourism regulated on the island of Lombok? The aim of this research is to determine the regulation of halal tourism on the island of Lombok. The research method used in this research is normative legal research methods. The results of this research reveal that the regulation of halal tourism in Lombok is not yet perfect due to the absence of statutory regulations equivalent to laws that specifically regulate halal tourism. Tourism regulations in New Lombok are based on regional government regulations of West Nusa Tenggara province and West Lombok Regency. There are several different definitions between these two rules in regulating halal tourism. Policy regarding the tourism industry in Lombok is still very dependent on the DSN-MUI which does not have a very strong position in making regulations and implementing halal tourism.

Abstract

This study aims to determine how Legal Protection for Lenders for the Transfer of Fiduciary Objects in the Form of Four-Wheeled Vehicles to Third Parties Without the Lender's Consent. This study uses an Empirical legal research method using a legal research method where empirical facts are taken from human behavior, both verbal behavior obtained from interviews and real behavior carried out through direct observation. Empirical research is also used to observe the results of human behavior in the form of physical remains or archives. The results of the study show; legal protection is an effort to provide protection to legal subjects, regarding actions that can be taken to maintain or protect the interests and rights of the legal subjects. Indonesia recognizes four material guarantee institutions, namely Pawn, Mortgage, Fiduciary, and Mortgage. One of the recognized guarantee institutions is fiduciary guarantee. Based on Law No. 42 of 1999 concerning Fiduciary Guarantees, it is explained that Fiduciary is the transfer of ownership rights of an object based on trust, where the object whose ownership rights are transferred remains in the control of the owner of the object.

Abstract

Legislation science plays a crucial role in forming fair and effective laws in Indonesia. The law-making process that is transparent and involves public participation will result in legal outcomes that are acceptable to all levels of society. This paper aims to explore how legislation science ensures that laws are aligned with the principles of justice, legal certainty, and effectiveness. The creation of fair laws requires the legislative process to consider not only formal legal aspects but also the existing social context. This research adopts a descriptive- analytical approach to explain the role and challenges of implementing legislation science in Indonesia.

Abstract

This study explores the legal provisions concerning the waiting period (iddah) for men using A Contrario reasoning within Indonesia’s positive law framework. Adopting a normative legal research approach, the study finds that Indonesian positive law, particularly Law Number 1 of 1974 on Marriage jo Law Number 16 of 2019 and Government Regulation Number 9 of 1975, explicitly regulates iddah only for women following divorce or the death of a spouse. In contrast, no legal requirement mandates men to undergo a waiting period before remarrying. Applying the Argumentum A Contrario method, which derives legal interpretation by considering the inverse of existing provisions, the study concludes that since the law exclusively prescribes iddah for women, men are not legally required to observe a waiting period.

Abstract

Penelitian ini mengkaji secara kritis pembekuan berita acara sumpah advokat Firdaus Oiwobo, S.H., dan Razman Arif Nasution oleh Pengadilan Tinggi Ambon dan Banten dalam kerangka dialektika hukum yang mempertemukan ketegangan antara independensi advokat, supremasi yudisial, dan batasan konsep contempt of court. Problem akademis utama yang diangkat adalah bagaimana kewenangan pengadilan dalam menegakkan disiplin persidangan dapat berbenturan dengan prinsip due process of law serta doktrin officium nobile yang menjadi basis fundamental independensi advokat. Karena itu, penelitian ini bertujuan untuk menganalisis legitimasi dan implikasi yuridis dari pembekuan sumpah advokat sebagai instrumen pengendalian profesi hukum, sekaligus mengidentifikasi potensi penyalahgunaan kewenangan yudisial dalam konstruksi hukum Indonesia. Dengan menggunakan metode normatif yuridis melalui pendekatan perundang-undangan, kasus, dan konseptual yang dianalisis secara hermeneutik-kritis. Hasil penelitian menunjukkan bahwa pembekuan sumpah advokat oleh pengadilan tinggi tidak sekadar tindakan administratif, tetapi merupakan wujud intervensi yudisial yang berimplikasi pada pelemahan independensi profesi hukum. Meskipun bertujuan menjaga marwah peradilan, tindakan tersebut melampaui batas kewenangan yang sah dan bertentangan dengan prinsip fair trial serta due process of law. Selain itu, contempt of court dalam sistem hukum Indonesia masih memiliki ambiguitas regulasi, sehingga dapat menjadi instrumen represif terhadap advokat yang bersikap kritis dalam ruang persidangan. Penelitian ini merekomendasikan revisi regulasi contempt of court agar tidak membatasi kebebasan advokat serta mendorong pedoman yang menyeimbangkan kewenangan yudisial dan independensi profesi hukum, demi mencegah distorsi supremasi hukum dan delegitimasi institusional.

Abstract

Mixed marriage refers to a marriage involving couples with different nationalities, with one party being an Indonesian citizen. Such marriages frequently occur in various countries due to work activities or tourism. One of the issues arising from mixed marriages is divorce, which has implications for the children born from these marriages, especially regarding their custody, as they are often unable to choose whether to live with their mother or father following the divorce. Typically, both parents desire custody, resulting in legal disputes brought before the court. In such cases, the judge's considerations are crucial, as they must examine and decide the case by prioritizing the best interests of the child to ensure the fulfillment of their rights and development. This research explains the judge’s considerations in determining child custody resulting from divorce in mixed marriages. This research is normative juridical research, utilizing secondary data derived from primary and secondary legal materials. Based on the analysis, it is concluded that in determining child custody due to divorce in mixed marriages, the judge may grant custody rights to both parents. In this case, the mother, an Indonesian citizen, was granted custody of the first child, who was nine years old, based on the panel of judges considering the child’s preference, who felt more affectionate towards his mother and practiced Catholic prayers with her in daily life. Meanwhile, the father, a foreign national, was granted custody of the second child, who was five years old, because the child expressed affection towards his father and stepmother, Mama Lena, and practiced Islam in his daily prayers, following his father’s religion. Therefore, the panel of judges based the determination of child custody on the child's preferences to ensure their best interests.

Abstract

PPJB is a preliminary agreement that is obligatory, so that it only creates an obligation to be carried out at a later date as outlined in the main agreement, namely AJB. PPJB does not yet provide for the transfer of land rights, so the ownership of the land object of sale and purchase has not yet passed from the land owner to the buyer. But in reality, there are still parties who consider that the PPJB has transferred ownership rights to the land. The purpose of this research is to analyse and identify the validity of PPJB that is paid in full and carried out in good faith and its legal consequences in Supreme Court Decision Number 3753 K/Pdt/2020 and to analyse and identify the legal protection of buyers in a sale and purchase binding agreement that is paid in full and carried out in good faith in the decision. The research method used is Normative Juridical, using positive law inventory research specifications, and finding law in concreto, using secondary data, and qualitative normative analysis. The results showed that the Panel of Judges of the Supreme Court had given a decision related to the problem, in which the Panel of Judges of the Supreme Court was of the opinion that the PPJB made between the Plaintiff and the Defendant before the Notary was a general agreement that had not transferred ownership rights, so that the AJB made between Defendant 1 and Defendant 2 before the PPAT was valid proof of transfer.

Abstract

Management of public funds in infrastructure projects in Indonesia is an important aspect that influences national development. Transparency and accountability in the use of public funds are the main focus, especially in accordance with Law no. 2 of 2017 concerning Construction Services. This article aims to analyze the application of these principles in the management of public funds. The research method used is normative research, which includes literature studies, legal document analysis, and case studies to evaluate the effectiveness of regulations in increasing transparency and accountability. The discussion includes an analysis of the legal norms governing the management of public funds as well as the challenges faced in their implementation. The research results show that although Law no. 2 of 2017 provides a clear legal framework, there are still weaknesses in implementing the principles of transparency and accountability, which could potentially lead to misuse of funds. The conclusion of this article emphasizes the need to strengthen regulations and more effective monitoring mechanisms to ensure efficient and responsible use of public funds, as well as increase public trust in the management of public funds.

Abstract

Aerobic gram-negative bacteria Pseudomonas putida is commonly found in soil and air. It is renowned for its extraordinary metabolic ability to break down various complex organic materials, such as aquaculture pollutants. This article discusses the role of P. putida in bioremediation and the ability of P. putida to break down organic compounds such as aromatic and aliphatic chemicals. This study identified key genetic traits and metabolic pathways that enhance the efficiency of bacterial bioremediation by synthesizing relevant literature using a descriptive qualitative approach. These results demonstrate the importance of utilizing the diverse characteristics of bacteria for innovative bioprocesses that can produce sustainably manufactured products, which in turn promotes biotechnology-based economic development and environmental sustainability.
