Ulumuna (P-ISSN: 1411-3457; E-ISSN: 2355-7648), a journal of Islamic studies published twice a year (June and December) by State Islamic University (UIN) of Mataram since 1997, publishes original (library or field) research articles in the field of Islamic studies. It promotes multidisciplinary approaches to Islam and Islamicate societies and focuses on six main topics: (1) the Qur’an and hadith (2) Islamic Law (3) Islamic Theology (Kalam) (4) Islamic Philosophy (5) Islamic Mysticism (Tasawwuf) (6) Islamic Education (7) Islamic Communication and Propogation (Dakwa) and (8) Islamic Politic. All submitted manuscripts are subject to double-blind review process. Ulumuna was admitted as an accredited journal by the Director General of Strengthening Research and Development, Ministry of Research Technology and Higher Education of the Republic of Indonesia in 2017. The accreditation is given through a Director Decree No. 32a/E/KPT/2017 and is effective until 2022. Ulumuna has become a CrossRef Member since year 2015. Therefore, all of its publications have a unique Digital Object Identifier (DOI) number.

Abstract

This research aims to analyze the extent to which judges have applied progressive legal paradigm in deciding Sharia banking disputes and the extent to which the decisions have fulfilled the principles of legal certainty, justice, and value. This normative legal research uses statutory and case study approaches by analyzing Sharia banking dispute decisions obtained from the website of the Supreme Court of the Republic of Indonesia. This research found that decisions based on textual legal interpretations tend to less implement progressive law, lacking of accommodating people's sense of justice as they put more emphasis on legal certainty. Meanwhile, decisions based on contextual legal interpretations tend to implement progressive law by prioritizing legal justice rather than legal certainty, more accommodating people’s sense of justice. Such different decisions are partly attributed to the different interpretations of judges due to different levels of competence and different understanding of Sharia among the judges. By participating in integrated and sustainable training, judges can improve their competence to deleiver justice for all concerned parties.

Abstract

Justice has long been studied by philosophers, religious figures, and politicians. It is nearly impossible to speak about the law without talking about justice since justice is the goal of the law. Rawls's concept of justice has an orientation towards social welfare (li al-maslahat al-umma). This conception has relevance to the principles of maqasid al-shari'a, which also emphasizes justice. This paper will explore Rawls’s concept of justice and Auda’s notion of maqasid al-shari'a and apply them as an analytical device to examine the construction of family formulated in the Compilation of Islamic Law. Family constitutes the most basic unit in society, and any legal stipulation related to the family must be critically re-examined. This study argues that constructing a just family based on maqasid al-sharia will form a family that benefits the family members and society. The dimension of justice fosters and provides space for equality in the domestic household. In contrast, the maqasid al-sharia dimension serves as an external dimension within the scope of the family. This dimension forms a family construction that safeguards and protects religion, the soul, the Intellect, offspring, and property.

Abstract

The emergence of neo-Khawarij groups in the contemporary world has attracted domestic and international attention. These groups have shown a propensity for growth, as evidenced by the increasing number of terrorist attacks in the form of suicide bombings carried out in the name of Islam. Such acts of terror have led to Islam being labeled as a religion of hate, bigotry, and terrorism. Through the analysis of Maqāṣid al-sharī‘a in understanding Islamic texts, in this study, Islamic Moderation is proposed as a paradigm to reduce the penetration of radical ideology in religion. This study proposes the adoption of moderate Islam as a paradigm for countering the spread of radical ideologies within the religion. To this end, this paper begins with an overview of the references used by radical groups and the acts of terror they have committed. It then advocates for the importance of Maqāṣid al-sharī‘a in understanding Islamic texts. It offers the concept of moderate Islam as a precautionary measure for mitigating the penetration of radical ideologies.

Abstract

This study examines the traditional Bugis mappasajang game and analyses the intersection of traditional values in that game with those of Islamic traditions. Based on the empirical research in Toro Village, Bone, South Sulawesi, the study employed observation and interview to collect the data. This study found that despite the negative impacts of game, like other games that often take excessive time and neglects daily routines amongts children or youth, the study shows that noble characters are inherently present in the traditional game. The player of mappasajang can learn how to make balance, create resilience, and establish cooperation, unity and creativity since all these characters and skills are badly needed to play the game successfully. In addition to sharpen motoric skills, unlike online games, the traditional game also helps to nurture one’s personality in dealing with others and strengthen social bond and community cohesion. This is relevant to the principle of traditional game or sport promoted by Islam.

Abstract

The study aims to examine the integration of religious values, Aceh culture, and global issues, which form the Sexual Violence Crime Law (UU-TPKS). This article is a qualitative study with a descriptive approach where the primary data were obtained through interview and group discussion. The study used relevant sources from books, journals, and articles related to the chosen theme as the secondary data. This study shows that integration of religious values into the Sexual Violence Crime Law (UU-TPKS) is necessary because Indonesian law must be based on the Pancasila philosophy as a result of the translation into Islamic values. It further shows that religious, cultural, and global values embodied in that law are the values of tauhid, justice, freedom, kindness, cooperation, equality, and tolerance. The state must measurably implement all values and derive them into laws and regulations. The study also reveals that such an integration reflects the integration of religious principle and values and local wisdom described in various meanings and symbols. Abstract

This research seeks to examine contemporary challenges relating to the realization of intra- and interreligious tolerance within the Indonesian Islamic Religious Education (IRE) system. To this end, I identify three areas requiring revisiting: the challenges facing teachers of IRE in regard to the promotion of intra- and interreligious tolerance, the implications of these challenges for typologies of student tolerance and intolerance, and the proposed strategy to cope with the challenges. The study utilizes a qualitative approach across multiple sites. Data were collected in the form of in-depth interviews, document analysis, and observation at a madrasah (MA, Indonesian: Madrasah Aliyah) and two high schools (SMA, Indonesian: Sekolah Menengah Atas). Data were analyzed through six steps of Braun and Clarke's thematic analysis. This research finds that: (1) challenges related to the emergence of intra- and interreligious intolerance are traced to the domination of the mono-religious education model within the study of IRE in MA and SMAs; (2) the domination of this mono-religious education model is implicated in a number of tolerance and intolerance student typologies, such as active-passive intolerance and active-passive tolerance and active intra- and interreligious tolerance; (3) the proposed strategy to cope with challenges faced by IRE teachers to promote intra and inter-religious tolerance is mutual supporting religious education model, which could be supported via macro-, meso-, and micro-educational system policy and regulation.

Abstract

Traditions in society is not only the product of the cultural heritage of a particular community that has been preserved for generations, but also of an interpretation of the transcendental values of teachings derived from the holy text of the Quran. It may also be the result of a marriage between religious understanding and the tradition of its adherents or the relationship between religion and local traditions. In this regard, this study aimed to unveil and analyze the cultural realities within the ‘Maleman’ tradition of the Sasak community as a product of interpreting the Quranic text regarding the night of ‘lailatul qadar’, which was the focal point of this study. Anchored in a phenomenological qualitative approach and an interactive analysis model from in-depth interviews and participant observations, symbolic meanings and religiosity values were discovered within the ‘Maleman’ tradition. It was the result of the Sasaknese community’s interpretation within their cultural landscape that has been preserved to this day. Additional findings indicated that the ritual of lighting the ‘dile Jojor’, a traditional torch made from the castor seeds, on the odd nights of the 21st, 23rd, 25th, 27th, and 29th of Ramadan was intended to welcome ‘laelatul qadar’, which the Sasak community of Lombok believed to be a night that must be ‘pursued’ (QS. al-Qadr [97]): 1-5 and guided by (QS. al-Taghabun [64]): 8. Similarly, the selection of raw materials for ‘Dile Jojor’ from the fruit of the ‘Jarak’ (Castor) tree, symbolically analogized from the term ‘syajarah mubarakah zaituna’ (QS. al-Nur [24]): 35. Both have a common element, namely they contain oil that can produce light.”

Abstract

This study aims to explore the role of Islam on the morphological authenticity of house buildings in the indigenous people of Limbungan Perigi Village, Lombok Timur and its relationship with the existence of cultural tourism. The ethnographic method summarised qualitative data through in-depth interviews and participatory observations for four months at the research site. Data analysis is sourced from primary data in the form of contact persons who know the identity of the data studied (elders, traditional leaders and indigenous youth) who have settled permanently. Research samples are taken purposively for data representation that must be valid and provide accurate and factual information. Secondary data in the form of literature references are also material for improving this research. The results showed a close relationship between Islam, the traditional house of the Limbungan community and the positioning of cultural tourism by the local government. The traditional house of the Sasak tribe of Limbungan Perigi has Islamic architectural values such as Bale (houses), roofs, walls, doors, floors, foundations, stairs, barns, and others. This value contains aesthetics, holistic education, manners, and social, cultural and economic values. Customs, traditions and Islam in the indigenous people of Limbungan Perigi are the subjects of a comprehensive study in this research.

Abstract

The Chinese ethnic minority Muslim community is a cultural entity that represents two social crisis poles. This fact motivates them to practice the informal Islamic education method while keeping their religious, social, and cultural backgrounds in mind. This article aims to comprehend and investigate the method of informal Islamic education in Yogyakarta's Chinese ethnic minority Muslim community. This study is a type of field research using a descriptive-analytical case study method. The primary data sources were the DIY (Daerah Istimewa Yogyakarta) Chinese Muslim Association of Indonesia's board of directors, members, and the community. Scientific literature and organizational documents are examples of secondary data sources. This study's data collection uses in-depth interviews, observation, and documentation techniques. According to the findings of this study, education with the vision of Islam as raḥmah li al-‘ālamīn takes place in informal environment settings such as the family, community, and society. This vision is translated into various methods behind informal Islamic education in Yogyakarta's ethnic Chinese Muslim minority community.

Abstract

This article aimed to offer a closer comprehension concerning Judaism in the work of Abū al-Fath Muhammad ibn ’Abd al-Karīm ibn Ahmad al-Shahrastānī’s (d. 1153) work in the study of religions, al-Milal wa al-Nihal. Employing content and document analysis methods, this research goes over the framework of Comparative Theology, advancing further perspectives and considerations of Islamic-Jewish relations built within medieval Islamic literature. This research concluded that the employment of Comparative Theology as a framework led to an enhancement of reading the content of al-Milal wa al-Nihal¸ involving a novel procedure to develop the dialogue between Islam and other religions through the schema of ‘Commitment’ and ‘Openness.’ With a particular reference to the research question offered, this research was able to grasp a deeper yet broader cognition of the relevance of Comparative Theology as a cutting-edge perspective concerning the discussion of Sēp̄er Yəṣīrā, Tanakh, aséret ha-dvarím, and Joshua continued leadership in Judaism about Islam, which, as such, provided an extensive discussion of the study of Islam and Other Religions, particularly on Jews-Islam theological encounters.
