Abstract

Abstract The transition from Law Number 5 of 1992 on cultural heritage to Law Number 11 of 2010 occurred because the previous law was deemed no longer aligned with the developments, demands, and legal needs of society. Therefore, a replacement was necessary. Moreover, Law Number 11 of 2010 is more focused on the involvement of the community in the management of cultural heritage. This aspect forms the basis of this research, which aims to examine the implementation of the law in relation to the preservation of cultural heritage for the enhancement of the economy and the well-being of society, as outlined in the articles of the law. Literature studies, legal analysis, and case studies are the methods employed in this research. Data analysis is conducted qualitatively with an inductive approach, alongside explanatory analysis to draw conclusions. As a result, several explanations within the articles of Law Number 11 of 2010 prioritise the enhancement of the economy and the well-being of society, both in terms of the paradigm of cultural heritage preservation and its management as an integrated effort to protect, develop spatial planning (zones), and utilise cultural heritage effectively. Furthermore, efforts to improve the welfare of the community through the management and utilisation of cultural heritage must be proportionate to the efforts made for its preservation. Abstract

Abstract The management of zakat in Tiroang District, Pinrang Regency is managed by the Imam of the mosque and in its management does not have legality from the government, as explained by Madeali that "the one who manages zakat in Tiroang District, Pinrang Regency is an Imam of the mosque". This is certainly not in accordance with the concept of amil zakat according to MUI Fatwa Number 8 of 2011 where amil is an individual or group appointed by the government to manage the implementation of zakat; or individuals or groups formed by the maysarakat and then authorized by the government to manage the implementation of zakat worship. The purpose of this study is to find out the practice of zakat management in Tiroang District, Pinrang Regency and to find out the provisions of Islamic law on the status of mosque imams as zakat managers in the area. This type of research is classified as qualitative with the approach used, namely the normative theology approach (Syar'i) and the empirical approach. The data collection methods carried out in this study are observation, interviews and documentation. The results of the study show that the management of zakat in Tiroang District, which is managed by the imam of the mosque, has been running for generations. The form of zakat management in Tiroang District is starting from receiving zakat from muzakki, then recording and distributing it to mustahik zakat. Regarding reporting, the imam of the mosque did not report to any party. In his duties as a zakat manager, the Imam of the Tiroang District mosque always takes a share of zakat of around 10%. The management of zakat carried out by the Imam of the mosque in Tiroang District according to Islamic law is legal. Muzakki has lost his obligation. However, regarding the status of the imam of the mosque in Tiroang District as a person who manages zakat cannot be called a zakat manager (amil zakat) as explained in the provisions of Islamic law that a zakat manager (amil zakat) is someone who is given the task/appointed by the government to take care of all matters related to zakat. This is because the Imam of the mosque in Tiroang District is not appointed/given the task by the government to manage zakat, but only based on the community's agreement to manage zakat. Abstract

Abstract This research is entitled Islamic Law Review of the Validity of Self declare in the halal certification process of micro and small businesses (MSEs). The main problem of this research is How is the Islamic Law Review of the validity of self-declaration in the halal certification process of micro and small businesses (MSEs)? From this main problem, sub- problems can be formulated, namely (1) What is the concept of self-declaration in halal certification in Indonesia? (2) How are the provisions of Islamic law regarding certification given on the statement of business actors? The objectives of this study are (1) to find out how the concept of self-declaration in halal certification in Indonesia, (2) to find out how the provisions of Islamic law on certification are given on the statement of business actors. The type of research used is library research or library research. The method used is data collection which is done by reading references and literature with the aim of supporting this research. The research approach used is the Shari'i Theological Approach with a normative juridical approach. The results of the study indicate that halal certification with a self- declaration scheme in the perspective of Islamic law is said to be valid, because the concept of self-declaration in Indonesia does not necessarily mean that business actors can declare that their products are halal, but there are still mechanisms that regulate the self-declaration such as products that are not risky or use materials that have been confirmed halal and PPH assistance is carried out. In addition, the presence of self-declaration has fulfilled the three basic principles of muamalah fiqh, namely the Principle of Tawhid, the Principle of Mubah, the Principle of Maslahah. The implication of this research is to help ensure that products claimed to be halal by micro and small businesses (MSEs) through the self-declaration scheme actually meet halal standards recognized by Islamic law, so that consumers can have greater confidence in the products in circulation, besides that this research is also expected to be the basis for improving regulations related to halal certification of self-declaration schemes, including improving supervision and monitoring mechanisms to prevent unauthorized self-declaration practices. Abstract

Abstrak Penelitian ini bertujuan untuk menganalisis pengaruh literasi keuangan dan lifestyle santri terhadap manajemen keuangan pribadi santri di pondok pesantren Al-kautsar Kraksaan Probolinggo. Metode penelitian yang digunakan adalah kuantitatif dengan pendekatan eksplanatif. Sampel penelitian terdiri dari 81 santri yang dipilih melalui teknik simple random sampling. Data dikumpulkan menggunakan kuesioner dan dianalisis dengan regresi linier berganda menggunakan SPSS 26. Hasil penelitian menunjukkan bahwa literasi keuangan memiliki pengaruh negatif terhadap manajemen keuangan pribadi santri, yang berarti bahwa pemahaman keuangan yang baik tidak selalu berbanding lurus dengan pengelolaan keuangan yang efektif. Sebaliknya, lifestyle santri memiliki pengaruh positif yang signifikan, menunjukkan bahwa kebiasaan konsumsi santri berperan besar dalam cara mereka mengelola keuangannya. Berdasarkan penelitian ini menegaskan peningkatan literasi keuangan yang lebih praktis, agar santri dapat menerapkan pengetahuan keuangan secara lebih efektif dalam kehidupan sehari-hari. Selain itu, diperlukan pemahaman yang lebih seimbang tentang gaya hidup, sehingga mampu mengelola keuagan mereka secara bijak dalam mengatur keuangan mereka di lingkungan pesantren. Kata Kunci: Literasi Keuangan, Lifestyle, Manajemen Keuangan Pribadi Abstract This study aims to analyze the influence of financial literacy and santri lifestyle on personal financial management of santri at the Al-Kautsar Kraksaan Probolinggo Islamic boarding school. The research method used is quantitative with an explanatory approach. The research sample consisted of 81 santri selected through a simple random sampling technique. Data were collected using a questionnaire and analyzed using multiple linear regression using SPSS 26. The results of the study indicate that financial literacy has a negative influence on personal financial management of santri, which means that good financial understanding is not always directly proportional to effective financial management. On the contrary, santri lifestyle has a significant positive influence, indicating that santri consumption habits play a major role in how they manage their finances. Based on this study, it emphasizes the increase in more practical financial literacy, so that santri can apply financial knowledge more effectively in their daily lives. In addition, a more balanced understanding of lifestyle is needed, so that they are able to manage their finances wisely in managing their finances in the Islamic boarding school environment. Abstract

Abstrak Praktik akad mudharabah sebagai salah satu instrumen ekonomi syariah sering menjadi objek sengketa yang diadili di Pengadilan Agama (PA) dan Pengadilan Negeri (PN) di Indonesia. Kedua lembaga ini memiliki pendekatan hukum yang berbeda, di mana PA cenderung menggunakan sumber hukum syariah seperti Kompilasi Hukum Ekonomi Syariah (KHES) dan fatwa Dewan Syariah Nasional-Majelis Ulama Indonesia (DSN-MUI), sedangkan PN mengacu pada hukum positif seperti Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan Undang-Undang Perbankan Syariah. Penelitian ini bertujuan untuk menganalisis perbedaan penggunaan dan penafsiran sumber hukum oleh hakim PA dan PN dalam menyelesaikan sengketa akad mudharabah, serta implikasinya terhadap kepastian hukum dan penerapan prinsip syariah. Dengan menggunakan pendekatan komparasi hukum, penelitian ini menemukan bahwa PA lebih fokus pada keadilan substantif berdasarkan maqashid syariah, seperti pelindungan terhadap harta (hifdzul maal) dan pelaksanaan akad yang bebas dari unsur gharar dan riba. Di sisi lain, PN menitikberatkan pada keabsahan kontrak secara formal dan pemulihan kerugian material. Perbedaan pendekatan ini menciptakan potensi disharmoni hukum yang berdampak pada kepastian hukum bagi para pihak yang bersengketa. Oleh karena itu, diperlukan upaya harmonisasi antara hukum syariah dan hukum positif, seperti integrasi fatwa DSN-MUI ke dalam regulasi nasional dan pelatihan hukum syariah bagi hakim PN. Penelitian ini memberikan kontribusi pada pemahaman lebih dalam tentang dinamika sistem hukum dualisme di Indonesia dan menawarkan rekomendasi untuk meningkatkan konsistensi penerapan hukum syariah dalam sistem peradilan. Kata Kunci: komparasi hukum, maqashid syariah, mudharabah, Pengadilan Agama, Pengadilan Negeri.   Abstract The practice of mudharabah contracts as one of the sharia economic instruments is often the object of disputes tried in the Religious Courts (PA) and District Courts (PN) in Indonesia. These two institutions have different legal approaches, where PA tends to use sources of sharia law such as the Compilation of Sharia Economic Law (KHES) and fatwas of the National Sharia Council-Indonesian Ulema Council (DSN-MUI), while PN refers to positive law such as the Civil Code (KUHPerdata) and the Sharia Banking Law. This study aims to analyze the differences in the use and interpretation of legal sources by PA and PN judges in resolving mudharabah contract disputes, as well as their implications for legal certainty and the application of sharia principles. Using a comparative legal approach, this study found that PA focuses more on substantive justice based on maqashid sharia, such as protection of assets (hifdzul maal) and the implementation of contracts that are free from elements of gharar and usury. On the other hand, the PN emphasizes the formal validity of the contract and the recovery of material losses. This difference in approach creates the potential for legal disharmony that has an impact on legal certainty for the disputing parties. Therefore, efforts are needed to harmonize sharia law and positive law, such as the integration of DSN-MUI fatwas into national regulations and sharia law training for PN judges.  This study contributes to a deeper understanding of the dynamics of the dualism legal system in Indonesia and offers recommendations to improve the consistency of the application of sharia law in the judicial system. Abstract

Abstrak Foto prawedding sebelum akad nikah dapat dikategorikan termasuk ke dalam unsur-unsur ikhtilaṭh, hal tersebut dikarenakan pose dalam foto prewedding yang tidak sesuai dengan ketentuan syariat Islam seperti berpelukan, bergandengan tangan, dan merangkul pasangan. Penelitian ini menggunakan metode penelitian kualitatif dan pendekatan deskriptif analisis, dengan teknik pengumpulan data yaitu wawancara, dokumentasi, dan kuesioner. Hasil penelitian bahwa, Para pelaku kegiatan foto prawedding tidak memahami apa sebenarnya yang dikatakan dengan ikhtilath, mereka beranggapan bahwa adengan pegangan tangan bukan perbuatan ikhtilath dan hal tersebut masih dalam batasan syari’at Islam, yang mereka pahami yang tidak diperbolehkan dalam syari’at Islam adalah berciuman, pelukan dan lainnya, mereka menganggap bahwa perbuatan yang tidak dibolehkan itu adalah sesuatu yang secara langsung dapat menimbulkan syahwat seperti adanya kontak fisik pada bagian-bagian yang dianggap sensitife dan dapat membangkitkan nafsu. Pasal 25 Ayat (1) dapat dipahami bahwa subyek hukum yang dapat dimintai pertanggungjawaban atas perbuatan ikhtilath adalah setiap orang yang dengan sengaja atau sukarela melakukan perbuatan ikhtilath. Jika dikorelasikan dengan praktik foto prawedding sebelum akad nikah diketahui bahwa pengambilan foto prawedding dilakukan atas dasar suka sama suka oleh calon pengantin. Selain pihak calon pengantin fotografer prawedding juga dapat dikenakan sanksi (uqubat berdasarkan penjelasan Pasal 25 Ayat (2). Berdasarkan hasil penelitian tersebut maka dapat disimpulkan bahwa praktik foto prawedding merupakan perbuatan ikhtilath karena dilakukan sebelum akad nikah dan gaya pose yang tidak bertentangan dengan hukum Islam. Kata Kunci: Prawedding, Ikhtilath, Sebelum Akad Nikah, Qanun, Hukum Jinayat   Abstract Pre-wedding photos before the wedding ceremony can be categorized as including ikhtilaṭh elements, this is because the poses in pre-wedding photos are not in accordance with the provisions of Islamic law, such as hugging, holding hands, and embracing the partner. This research uses qualitative research methods and a descriptive analysis approach, with data collection techniques, namely interviews, documentation and questionnaires. The results of the research are that, the perpetrators of pre-wedding photo activities do not understand what is actually said by ikhtilath, they think that holding hands is not an act of ikhtilath and this is still within the limits of Islamic law, what they understand is that what is not permitted in Islamic law is kissing, hugging and so on, they consider that the prohibited actions are things that can directly cause lust, such as physical contact on parts that are considered sensitive and can arouse lust. Article 25 Paragraph (1) can be understood to mean that the legal subject who can be held responsible for acts of ikhtilath is every person who intentionally or voluntarily commits acts of ikhtilath. If it is correlated with the practice of taking pre-wedding photos before the wedding ceremony, it is known that pre-wedding photos are taken on the basis of mutual consent by the prospective bride and groom. Apart from the prospective bride and groom, pre-wedding photographers can also be subject to sanctions (uqubat based on the explanation of Article 25 Paragraph (2). Based on the results of this research, it can be concluded that the practice of pre-wedding photos is an act of ikhtilath because it is carried out before the marriage ceremony and the posing style does not conflict with Islamic law. Abstract

Abstrak Penelitian ini bertujuan untuk mengkaji peran Batik Tulis Sumber Ayu dalam meningkatkan ekonomi masyarakat Desa Sumber Kembar, Kecamatan Pakuniran, Kabupaten Probolinggo. Menggunakan pendekatan kualitatif deskriptif dengan studi kasus, data diperoleh melalui wawancara mendalam, observasi, dan dokumentasi. Hasil penelitian menunjukkan bahwa Batik Tulis Sumber Ayu memberikan dampak positif terhadap pemberdayaan perempuan dengan menciptakan lapangan kerja dan meningkatkan pendapatan keluarga. Selain itu, usaha ini berkontribusi pada pelestarian budaya lokal dan meningkatkan kesejahteraan sosial masyarakat. Batik ini juga mendukung pengembangan ekonomi berkelanjutan melalui keterlibatan aktif masyarakat dalam produksi dan pemasaran. Penelitian ini merekomendasikan penguatan kolaborasi antara pelaku usaha, pemerintah, dan masyarakat untuk memperluas dampak positif Batik Tulis Sumber Ayu dan menciptakan model pemberdayaan ekonomi lokal berbasis potensi budaya. Kata Kunci: pemberdayaan, ekonomi, pendapatan, keluarga.   Abstract This study aims to examine the role of Batik Tulis Sumber Ayu in improving the economy of the people in Sumber Kembar Village, Pakuniran District, Probolinggo Regency. Using a descriptive qualitative approach with a case study, data were collected through in-depth interviews, observations, and documentation. The findings indicate that Batik Tulis Sumber Ayu has a positive impact on women's empowerment by creating job opportunities and increasing family income. Additionally, this initiative contributes to the preservation of local culture and enhances the social welfare of the community. The batik also supports sustainable economic development through active community involvement in production and marketing. This study recommends strengthening the collaboration between entrepreneurs, the government, and the community to expand the positive impact of Batik Tulis Sumber Ayu and create a model of local economic empowerment based on cultural potential. Abstract

ABSTRACT Multi Level Marketing adalah salah satu bentuk marketing atau pemasaran yang berbentuk jaringan yang dilakukan melalui banyak level (tingkatan), dan sering disebut dengan istilah up line (tingkat atas) dan down line (tingkat bawah). Bisnis MLM ini menerapkan sistem pemasaran modern melalui jaringan kerja (network) distribusi yang berjenjang. Dalam perkembangannya, muncul penipuan bisnis yang berkedok Multi Level Marketing sehingga membuat citra bisnis Multi Level Marketing ini sering menerima kritik dari masyarakat. Hal ini di sebabkan sebagian besar orang yang berbisnis Multi Level Marketing tidak mengetahui kriteria, dan syarat-syarat dari bisnis Multi Level Marketing secara keseluruhan, baik apakah dalam bisnis ini mengandung unsur yang di larang atau tidak. Penelitian ini menggunakan pendekatan kualitatif dengan jenis diskriktif. Sumber data diperoleh melalui wawancara, observasi dan dokumentasi. berdasarlan hasil penelitian ini menunjukan bahwa Pertama, Bisnis Multi Level Marketing Pada Produk PT. GrYa Smart Mandiri Pamekasan Branch uses a Multi Level Marketing (MLM) system, which is a tiered network system. The tiered network system is carried out by means of promotions on various social media such as Facebook, WhatsApp, Instagram and Tik-Tok. Second, the MLM business on the products of PT GrYa Smart Mandiri Pamekasan Branch in the perspective of Islamic Economics in terms of marketing has fulfilled because it meets the requirements, which consist of GrYa products that are marketed in quality, labeled halal, tayyib and avoid syubhat; the contract system must meet the rules of the pillars of buying and selling; intensive formula must be fair, not oppressive and benefit /alah oriented. There is no excessive mark up on the price of goods; it does not focus on tertiary goods when people are struggling with the fulfilment of primary needs and Multi Level Marketing does not use a pyramid system that harms the people who are the latest to enter as members. Hal ini di sebabkan sebagian besar orang yang berbisnis Multi Level Marketing tidak mengetahui kriteria, dan syarat-syarat dari bisnis Multi Level Marketing secara keseluruhan, baik apakah dalam bisnis ini mengandung unsur yang di larang atau tidak. Penelitian ini menggunakan pendekatan kualitatif dengan jenis diskriktif. Sumber data diperoleh melalui wawancara, observasi dan dokumentasi. berdasarlan hasil penelitian ini menunjukan bahwa Pertama, Bisnis Multi Level Marketing Pada Produk PT. GrYa Smart Mandiri Cabang Pamekasan menggunakan sistem Multi Level Marketing (MLM), yaitu sistem jaringan yang berjenjang. Sistem jaringan yang berjenjang dilakukan dengan cara promosi di berbagai social media seperti facebook, whatshaap, instagram dan tik-tok. Kedua, bisnis MLM pada produk PT. GrYa Smart Mandiri Cabang Pamekasan dalam Perspektif Ekonomi Islam di lihat dari aspek pemasarannya sudah memenuhi karena memenuhi syarat–syarat, yang terdiri dari produk GrYa yang di pasarkan berkualitas, berlebel halal, tayyib dan terhindar dari syubhat; sistem akadnya harus memenuhi kaidah rukun jual beli; formula intensif harus adil, tidak mendzalimi dan berorientasi kemaslahatan/falah. tidak ada excessive mark up harga barang; tidak menitik beratkan barang–barang tertier ketika umat bergelut dengan pemenuhan kebutuhan primer dan Multi Level Marketing tidak menggunakan sistem piramida yang merugikan orang yang paling belakangan masuk sebagai member. Abstract

Abstrak Pencatatan pernikahan di Indonesia bukan hanyakewajiban administratif, tetapi juga merupakan mekanisme hukum yang penting untuk memastikan perlindungan, terutama bagi perempuan dan anak-anak. Terlepas dari ketentuan dalam UU No. 1 Tahun 1974, UU No. 22 Tahun 1946, Peraturan Menteri Agama No. 20 Tahun 2019, dan Kompilasi Hukum Islam (KHI), pernikahan yang tidak dicatatkan (umumnya dikenal dengan istilah nikah sirri) masih banyak terjadi dan menimbulkan tantangan hukum yang serius. Artikel ini bertujuan untuk menganalisis pentingnya pencatatan pernikahan sebagai perlindungan hukum bagi perempuan dan anak dari perspektif Maqashid al-Syari'ah oleh Al-Syatibi. Dalam konteks perlindungan hukum, pendekatan maqashid asy-syari’ah yang digagas oleh Al-Syatibi menjadi relevan untuk digunakan sebagai kerangka analisis. Maqashid syari’ah merupakan prinsip-prinsip dasar dalam hukum Islam yang bertujuan menjaga lima aspek utama kehidupan manusia: agama (hifzh al-din), jiwa (hifzh al-nafs), akal (hifzh al-‘aql), keturunan (hifzh al-nasl), dan harta (hifzh al-mal). Pencatatan perkawinan yang dilakukan secara hukum negara punya kaitan erat dengan prinsip-prinsip tersebut, terutama dalam memberikan perlindungan hukum khususnya terhadap perempuan dan anak, seperti menjaga kejelasan status keturunan, melindungi hak-hak keperdataan seperti nafkah, warisan, akta kelahiran anak, hingga hak atas harta bersama. Kata kunci: Pencatatan Perkawinan, Perlindungan Hukum, Perempuan dan Anak, Maqashid al-Syari'ah, Al-Syatibi.   Abstract Marriage registration in Indonesia is not only an administrative obligation, but also an important legal mechanism to ensure protection, especially for women and children. Despite the provisions in Law No. 1 of 1974, Law No. 22 of 1946, Minister of Religious Affairs Regulation No. 20 of 2019, and the Compilation of Islamic Law (KHI), unregistered marriages (commonly known as nikah sirri) are still prevalent and pose serious legal challenges. This article aims to analyze the importance of marriage registration as legal protection for women and children from the perspective of Maqashid al-Syari'ah by Al-Syatibi. In the context of legal protection, the maqashid ash-shari'ah approach initiated by Al-Syatibi is relevant to be used as an analytical framework. Maqashid shari'ah are basic principles in Islamic law that aim to protect the five main aspects of human life: religion (hifzh al-din), soul (hifzh al-nafs), intellect (hifzh al-'aql), offspring (hifzh al-nasl), and property (hifzh al-mal).  Marriage registration carried out under state law has a close relationship with these principles, especially in providing legal protection, especially for women and children, such as maintaining clarity of offspring status, protecting civil rights such as maintenance, inheritance, child birth certificates, and rights to joint property. Abstract

Abstrak Mediasi adalah proses penyelesaian sengketa dengan bantuan mediator netral yang tidak dapat memutuskan, hanya membantu pihak-pihak mencapai kesepakatan. Proses ini mengikuti Peraturan Mahkamah Agung No. 1 Tahun 2016. Penelitian ini mengkaji penerapan mediasi sengketa ekonomi syariah di Pengadilan Agama Kelas IA Makassar dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa praktik penerapan mediasi sengketa ekonomi syariah di pengadilan agama kelas IA Makassar telah sesuai dengan peraturan Mahkama Agung RI No 1 Tahun 2016 Akan tetapi, mediasi dalam sengketa ini sering kali terbukti tidak berhasil karena banyaknya kreditor yang wanprestasi dalam memenuhi kewajibannya kepada debitur yang mengingkari dari kesepakatan awal. Situasi ini membuat debitur merasa dirugikan dan tidak dapat mencapai perdamaian, maka dari itu tingkat keberhasilan di pengadilan agama makassar sangatlah lemah dan para hakim harus tegas sesuai dengan peraturan yang berlaku. Berdasarkan ketentuan hukum ekonomi syariah Ketentuan Hukum Ekonomi Syariah Terhadap Penerapan Mediasi Sengketa Ekonomi Syariah sudah sesuai dengan peraturan Mahkamah Agung Republik Indonesia Nomor 1 Tahun 2008  yang telah di ubah dengan peraturan Mahkamah Agung RI  No 1 Tahun 2016 tentang prosedur Mediasi di Pengdilan. Implikasi penelitian ini  para hakim harus lebih tegas dalam menghadapi perkara sengketa ekonomi syariah agar terjadi perdamaian  dalam penyelesaian mediasi sesuai dengan prosedur mediasi Nomor 1 Tahun 2016. Kata Kunci: Hukum Ekonomi Syariah, Mediasi, Sengketa   Abstrac Mediation is a dispute resolution process with the help of a neutral mediator who cannot decide, only helps the parties reach an agreement. This process follows Supreme Court Regulation No. 1 of 2016. This study examines the application of sharia economic dispute mediation in the Makassar Class IA Religious Court with a qualitative approach. The results of the study indicate that the practice of implementing sharia economic dispute mediation in the Makassar Class IA Religious Court is in accordance with the Supreme Court Regulation of the Republic of Indonesia No. 1 of 2016. However, mediation in this dispute often proves unsuccessful because many creditors default in fulfilling their obligations to debtors who deny the initial agreement. This situation makes debtors feel disadvantaged and unable to achieve peace, therefore the success rate in the Makassar Religious Court is very weak and judges must be firm in accordance with applicable regulations. Based on the provisions of Islamic economic law, the provisions of Islamic Economic Law on the Implementation of Islamic Economic Dispute Mediation are in accordance with the regulation of the Supreme Court of the Republic of Indonesia Number 1 of 2008 which has been amended by the regulation of the Supreme Court of the Republic of Indonesia Number 1 of 2016 concerning Mediation procedures in Court. The implication of this study is that judges must be more assertive in dealing with Islamic economic dispute cases so that peace can be achieved in mediation settlement in accordance with the mediation procedure Number 1 of 2016.
