Abstract

Article 160, paragraph (3) of the Job Creation Law prohibits the confiscation of assets by the Indonesia Investment Authority (INA). The provision prohibiting asset confiscation raises problems in the form of norm conflicts with the provisions of bail confiscation, criminal confiscation, and bankruptcy confiscation. Therefore, it is necessary to analyze the validity of the norms prohibiting the confiscation of INA assets. Based on this background, the purpose of this study is to analyze the juridical validity of the norms prohibiting the seizure of INA assets. This research uses a statutory and conceptual approach. The type of legal material consists of primary and secondary legal materials sourced from both primary and secondary data. The legal materials are analyzed through interpretation techniques. The results of this study reveal that the norm prohibiting the confiscation of INA assets in positive law does not fulfill the principle of juridical validity, making it an invalid norm. Suggestions to the legislators to make changes to the formulation of Article 160 paragraph (3) of the Job Creation Law in order to fulfill the principle of juridical validity.

Abstract

This study aims to determine the effect of three independent variables in this research model on the performance of employees at the Idano Tae sub-district office in South Nias Regency. All employees (30 people) in the research object are designated as respondents. The type of data is primary data, data collection using a questionnaire distribution method which is then processed with the help of Smart PLS software. The analysis tool used is simple and multiple linear regression. The results of partial testing show that the t count value ≥ t table value, (work environment and discipline on performance. While for the partial test of motivation on performance t count ≤ t table value. Simultaneous testing shows that the three independent variables together have a positive effect on performance.

Abstract

A number of characteristics, such as mathematical inclination and motivation to learn mathematics, must be taken into account during the mathematics learning process. The location of the study was SMPN 1 Tajurhalang. 107 students made up the sample for this study, which was selected using a probability sampling technique and data was gathered through questionnaires. The study variables include learning achievement (Y), learning desire (Z), learning style (X2), and mathematical inclination (X1). Path analysis is the type of data analysis used. The study's conclusions are as follows: (1) mathematical style and disposition directly affect online learning motivation; (2) mathematical style and disposition directly affect online learning achievement; (3) mathematical style and disposition indirectly affect online learning motivation; and (4) mathematical style and disposition indirectly affect mathematical disposition through online geometry learning achievement.

Abstract

The aim of this study is to explore the relationship between the frequency of using artificial intelligence (AI) technologies and the level of concerns about their implementation in Corporate Learning. Data were collected through an online questionnaire from 1308 respondents. The findings reveal a statistically significant, though weak, negative relationship indicating that respondents with higher frequency of AI use report lower concerns about its educational use. Contrary to expectations, older respondents demonstrated fewer concerns compared to younger ones. The regression analysis confirmed these results and indicated that additional factors might influence respondents' attitudes. Recommendations include publicly presenting the benefits of AI to alleviate concerns and encourage adoption by the mass population and business.

Abstract

In the era of globalization, companies face various challenges and risks, including competition. To survive in this constantly changing business environment, it is important to identify and address both opportunities and threats. The aim of this study is to investigate the impact of sustainable entrepreneurial orientation on business performance in SMEs, with competitive advantage acting as a mediating variable. The research surveyed 325 SME entrepreneurs in Jakarta City. The data was analyzed using the Structural Equation Modeling with Partial Least Square (SEM PLS) approach. The findings demonstrate that sustainable entrepreneurial orientation has a significant effect on business performance in SMEs. In SMEs, there is a significant relationship between sustainable entrepreneurial orientation and competitive advantage, as well as between competitive advantage and business performance. The relationship between sustainable orientation and business performance is mediated by competitive advantage.

Abstract

This systematic review of the literature discusses the effectiveness and challenges of implementing differentiated learning (DI) in secondary schools. This study analyzed 16 articles published between 2019 and 2023 using the PRISMA protocol. The study's results indicate that DI is effective in enhancing academic achievement and student engagement, particularly in the classroom among students with diverse abilities. However, the main challenges include a lack of teacher training, limited resources, large class sizes, and insufficient planning time. The success of DI is supported by collaboration between teachers, professional training, and a positive attitude towards inclusion. This study suggests that further research is needed for the practical training of teachers and the long-term evaluation of DI, particularly in developing countries, as well as for online learning.

Abstract

In the rapidly evolving digital era, consumers are increasingly exposed to a variety of new threats that were previously unimaginable, ranging from the misuse of personal data to the opaque manipulation of digital behavior through algorithms and persuasive design. These phenomena signal a profound shift in the consumer landscape, where legal certainty and traditional enforcement mechanisms may no longer suffice. This article critically analyzes whether current consumer protection laws, especially within the Indonesian context, are adequately equipped to address the contemporary risks posed by information technology. By employing a normative juridical approach and enriched with comparative legal analysis, the study draws upon key philosophical foundations from thinkers such as Satjipto Rahardjo, Gustav Radbruch, Aristotle, John Rawls, Ulrich Beck, and Nonet & Selznick. These theoretical perspectives are used to frame a vision of a more responsive, just, and forward-looking legal system. Through comparisons with regulatory frameworks in the European Union, the United States (notably California), Singapore, and Malaysia, this paper proposes that Indonesia's legal architecture must evolve not merely to react but to anticipate and shape digital transformations in ways that ensure fairness, transparency, and inclusivity. Such a legal model must be both normatively grounded and practically agile to protect consumers in an increasingly borderless and algorithm-driven marketplace.

Abstract

This study investigates the effect of Current Ratio (CR) and Debt to Equity Ratio (DER) on Return on Equity (ROE) in food and beverage sector companies listed on the Indonesia Stock Exchange (IDX). The population consists of 95 companies in 2023. Using purposive sampling, 26 companies were selected based on criteria such as consistent listing and publication of audited annual financial reports from 2020 to 2023. CR and DER are the independent variables, while ROE is the dependent variable. Panel data regression analysis was conducted using EViews software. The results show that CR and DER simultaneously have a significant effect on ROE. However, partially, CR does not significantly affect ROE, while DER has a negative and significant impact. This suggests that companies should manage their debt levels carefully, as excessive reliance on debt can reduce returns to shareholders. For investors, DER is a crucial indicator for evaluating financial risk and assessing a company's capital structure before making investment decisions.

Abstract

This study aims to analyze the formulation of legal regulation for the criminalization of LGBT sexual behaviour in Indonesia through the perspectives of Maqashid Syari'ah and Utilitarianism. In a country with a Muslim-majority population, the LGBT phenomenon frequently raises a conflict between human rights protection and religious values. Using a normative juridical approach, this study examines legislation, legal theories, and relevant secondary data. Findings indicate that there is no explicit national regulation criminalizing LGBT behaviour. The Maqashid Syari'ah perspective emphasizes the protection of five fundamental principles: religion, life, intellect, lineage, and property. Meanwhile, Jeremy Bentham's Utilitarianism asserts that legal policy should maximize societal benefit. The study concludes that integrating these two approaches provides a balanced foundation for criminal policy formulation that upholds moral values and public interest without compromising justice and human rights.

Abstract

This study examines the exercise of presidential powers in emergency situations within the framework of Indonesia’s 1945 Constitution, focusing on constitutional limits and legal guarantees. Using a qualitative approach with a normative juridical methodology, the research analyzes constitutional provisions, statutory regulations, and judicial practices to evaluate the effectiveness of Indonesia's legal framework in balancing crisis management with the preservation of democratic principles. The findings reveal ambiguities in emergency criteria, gaps in accountability mechanisms, and concerns over proportionality in restricting fundamental rights. Comparative insights and recommendations are provided to enhance legal clarity, strengthen oversight, and safeguard constitutional democracy during emergencies.
