Abstract

An unlawful act is an act that is contrary to the legal norms prevailing in society and can harm other parties. In the context of Indonesian law, this unlawful act is regulated in Article 1365 of the Civil Code (KUHPerdata), which states that "Every act that violates the law and causes harm to another person, requires the person who committed the act to provide compensation." This study aims to legally analyze the settlement of compensation for unlawful acts in land lawsuits, focusing on the study of decision Number 111/PDT.G/2022/PN JMB. Unlawful acts that occur in the context of land disputes often involve losses felt by the injured party, so that regulations regarding compensation are important in the dispute resolution process. In this study, the author examines the legal basis underlying the provision of compensation for unlawful acts and the implementation of applicable legal principles in court. The approach used is the normative research method by analyzing laws and regulations, legal doctrines, and related court decisions. The results of the study show that in decision Number 111/PDT.G/2022/PN JMB, the court has carefully considered the elements of unlawful acts and determined the amount of compensation in accordance with the losses experienced by the plaintiff. This study also reveals the importance of a deep understanding of regulations related to compensation in the context of land cases to ensure justice and legal certainty in resolving land disputes in Indonesia.

Abstract

Law enforcement in Indonesia often experiences significant difficulties, especially regarding state apparatus. This study investigates the case of the shooting of a car rental entrepreneur by members of the Indonesian Navy. It assesses the legitimacy of police actions that rejected the request of the victim's family in an emergency without an official report. The goal is to determine the legitimacy of police actions that reject the request of the victim's family in an emergency. The normative juridical method used is a case study. This method analyzes the literature, regulations, expert opinions, legal documents, and legal legitimacy theory of Soerjono Soekanto. The results show that although police reports are administratively necessary, procedures must be flexible in emergencies to guarantee legal protection. An over-reliance on formal processes can hinder access to substantive justice. To maintain public legitimacy and trust in policing, this study emphasizes the importance of policy reform to balance legal compliance and operational responsiveness.

Abstract

This study examines the role of remote work flexibility, organizational justice, and psychological safety in influencing discretionary work behavior among employees. As organizations increasingly adopt hybrid and remote work models, understanding how workplace flexibility and psychological and structural fairness impact employee behavior beyond formal job descriptions has become essential. Using a quantitative approach, data were collected from a sample of employees across various industries and analyzed using SPSS version 26. Descriptive statistics, reliability analysis, correlation analysis, and multiple linear regression were conducted to explore the relationships among the variables. The results demonstrate that all three independent variables—remote work flexibility, organizational justice, and psychological safety—have a significant positive effect on discretionary work behavior. These findings suggest that organizations that provide flexible work arrangements, uphold fairness, and create psychologically safe environments can encourage employees to exhibit behaviors that benefit the organization beyond their core responsibilities. The implications of this study contribute both theoretically and practically to the fields of organizational behavior and human resource management by offering insights into how non-obligatory employee behaviors can be fostered through supportive work environments.

Abstract

The increasing integration of algorithmic technologies in recruitment processes has raised questions about candidate acceptance and perceptions of fairness. This study examines the effects of algorithmic hiring, perceived fairness, and HR tech literacy on recruitment acceptance. Using a quantitative approach, data were collected from 350 job applicants through structured questionnaires and analyzed using multiple linear regression via SPSS. The results reveal that all three variables—algorithmic hiring, perceived fairness, and HR tech literacy—significantly and positively affect recruitment acceptance. Among them, perceived fairness emerged as the strongest predictor, suggesting that candidates’ perceptions of just and transparent processes play a critical role in shaping their acceptance of technology-driven recruitment methods. Additionally, HR tech literacy facilitates understanding and comfort with algorithmic systems, enhancing candidate receptivity. The findings contribute to theories of technology acceptance and organizational justice and provide practical implications for designing inclusive, ethical, and effective tech-based recruitment systems. This study underscores the importance of balancing innovation with fairness and transparency to build trust and improve outcomes in digital recruitment.
