Abstract

ABSTRAKOrang tua sering melakukan pemberian-pemberian dengan rasa kasih sayang kepada anak-anaknya, seperti hibah harta yang mereka punya secara keseluruhan. akan tetapi setelah hibah tersebut diberikan seorang anak melalaikan kewajiban serta tanggung jawabnya untuk tetap menafkahi orang tua. hal tersebut menimbulkan suatu penelantaran orang tua setelah memberikan hibah kepada anaknya sehingga hibah tersebut dibatalkan berdasarkan putusan hakim nomor 1934/pdt.g/2013/PA.Mdn. berdasarkan permasalahan tersebut maka perlu dibahas tentang bagaimana pelaksanaan hibah orang tua kepada anaknya ditinjau dari Hukum Islam dan Hukum Positif, bagaimana ketentuan Hukum Islam dan Hukum Positif mengenai pembatalan hibah karena penelantaran orang tua, serta bagaimana pertimbangan hakim terkait putusan nomor 1934/pdt.g/2013/PA.Mdn ketika adanya penelantaran orang tua setelah memberikan hibah kepada anaknya.Penelitian ini bersifat deskriptif analitis dengan jenis penelitian hukum normatif. Sumber datanya menggunakan Data Sekunder yaitu bahan hukum primer, sekunder, dan tertier. Teknik pengumpulan data mencangkup penelitian pustaka (library research). Alat pengumpul data menggunakan studi dokumen dan pedoman wawancara yaitu dengan Advokat dan Notaris/PPAT di Kota Medan. Analisis data menggunakan analisis kualitatif.Hasil penelitian ini menunjukkan bahwa, pelaksanaan hibah orang tua kepada anaknya ditinjau dari hukum Islam adalah dengan berlaku adil kepada setiap anak dengan jalan menyamaratakan bagian masing-masing. dan berdasarkan Hukum Positif yaitu Kompilasi Hukum Islam bahwa pelaksanaan hibah orang tua kepada anak dapat diperhitungkan sebagai warisan, hal ini berdasarkan Pasal 211 Kompilasi Hukum Islam. ketentuan Hukum Islam mengenai pembatalan hibah karena penelantaran orang tua dikehendaki menurut sebagian besar ulama fuqaha, Al-quran dan Hadist. karena beberapa alasan yaitu, pertama adanya pengecualian dalam Hukum Islam mengenai kebolehan pembatalan hibah antara orang tua dan anak, kedua perintah untuk selalu berbakti kepada orang tua (birrul walidain), ketiga kewajiban nafkah yang diberikan oleh anak kepada orang tua. pembatalan hibah karena penelantaran orang tua berdasarkan hukum positif yaitu dalam Kompilasi Hukum Islam dikehendaki berdasarkan Pasal 212 KHI bahwa hibah tidak dapat ditarik kembali kecuali hibah dari orang tua kepada anak kandungnya, dan pasal 714 KHES bahwa orang tua berhak menarik kembali hibah selama anak masih hidup, pertimbangan hakim dalam putusan 1934/PDT.G/2013/PA.Mdn berdasarkan Hadist Rasulullah SAW, dan Pasal 212 Kompilasi Hukum Islam mengenai kebolehan menarik kembali hibah orang tua kepada anak.Kata Kunci : Penelantaran, Orang tua, Hibah, Anak

Abstract

UUD NRI Tahun 1945 pasca amandemen, tidak memberi ruang kepada Lembaga Tinggi (MPR) dalam membuat produk Hukum TAP MPR lagi. Akibat dari kewenangan MPR yang sudah dihapus dan jelas tertera dalam Bab I ayat (2) dan Bab II Pasal 3 ayat (1) sampai dengan (3) UUD Tahun 1945 sebelum amandemen. Namun, hal dilematis ini menjadi problematika dan perdebatan antar ahli hukum tata Negara di republik ini, akibat dari Pasal I aturan Peralihan yang menyebutkan pengujian status hukum TAP MPR sebagai batu uji. Status Hukum TAP MPR memiliki legitimasi pada konstitusi, namun yang menjadi persoalan ialah kewenangan MPR dalam membentuk kembali TAP MPR serta mencabut. MPR tidak lagi menjadi lembaga tertinggi Negara melainkan lembaga tinggi yang disamaratakan dengan lembaga-lembaga lainnya yang disebutkan dalam UUD NRI Tahun 1945, sehingga ini menjadi buah simalakama dalam praktiknya akibat dari di hapusnya Kewenangan tersebut, dalam Pasal 1 ayat (2) UUD Tahun 1945 sebelum amandemen, pun juga Pasal 3 ayat (3) UUD Tahun 1945 sebelum amandemen. Judicial Review yang pernah diajukan ke Mahkamah Konstitusi (MK) tidak membuahkan hasil, akibat MK tidak memiliki ruang yang cukup jelas atas pengujian TAP MPR ini, UUD NRI Tahun 1945 memiliki kewenangan hanya menguji UU yang bertentangan dengan UUD bukan TAP MPR yang bertentangan dengan UUD.

Abstract

Sexual crime against children is a crime against humanity where the victim, who in this case is still a child, is hurt not only physically but also psychologically. The bad impact experienced by the victim is the same as destroying human values because this crime has robbed people of their rights to live safely and comfortably because they have received a bad stigma from the community so that not a few victims have lost their future. Based on this polemic, legal remedies must be enforced fairly against perpetrators of sexual crimes against children. The law must provide strict sanctions so as to provide a deterrent effect and be able to minimize the occurrence of sexual crimes against children in Indonesia. The application of chemical castration to perpetrators of sexual crimes against children is a new legal effort that is considered fair and firm in tackling these crimes. Although it is considered fair and firm, in the effort to apply the chemical castration law, there are still some problems because this is still relatively new and law enforcers in Indonesia are still not familiar with this legal remedy. The problems studied in this study are how to regulate chemical castration (Chemical Castration) based on applicable law in Indonesia and how the efforts of law enforcers in carrying out chemical castration executions in Indonesia. The research method used is a normative juridical approach and is expected to provide a comprehensive explanation of matters relating to the application of chemical castration to perpetrators of sexual crimes against children in Indonesia. Based on the results of this research study, the application of chemical castration to perpetrators of sexual crimes against children in Indonesia is basically regulated in Law Number 17 of 2016 concerning Child Protection and then for procedures for implementing chemical castration, installation of electronic detection devices, rehabilitation and announcement of the identity of the perpetrator. Sexual violence against children is regulated in PP No. 70 of 2020. Although the regulation of the application of chemical castration in Indonesia has been regulated, the efforts of law enforcers in carrying out the execution of castration punishment in Indonesia are still experiencing obstacles. Starting from the implementation process, which experienced pros and cons from various parties and the execution process that had not been clinically tested, which did not guarantee the effectiveness of the chemical castration punishment.

Abstract

The Clauses specified in the Fiduciary Collateral Contract potentially harm the fiduciary givers and are contrary to the prevailing legal provisions such as the clause which states that debt collectors can come into the places where the collateral is kept any time, the clause which gives the authority to do anything, the clause which gives absolute power of attorney, the clause about the seizing of fiduciary collateral, and the clause about the cost of making notarial deeds and fiduciary registration. It is also found that there is legal protection for fiduciary givers such as prohibition to make clauses as specified in Article 18 of Law on Consumer Protection, Article 33 of Law on Fiduciary Collateral, the Supreme Courts Ruling No. 18/2019 and prohibition of business people on the Transfer of Liability (Regulation of OJK No I/POJK.07/2013 on Consumer Protection in Financial Service Sector. Beside that, the Fiduciary givers can report and file a complaint to BPSK, OJK, and the Court. Finally, it is found that the liability of a Notary as the public official who makes the contract which potentially harm the Fiduciary givers. His liability is in the civil law (specified in Article 84 and Article 65 of Law No. 2/2014) and in the administrative law ( specified in Article 65 A of Law No. 2/2014).

Abstract

In the 1945 Constitution, it has been emphasized that people with disabilities have the same rights, obligations and positions as other citizens, including in terms of obtaining a pre-employment card, this research focuses on the visually impaired because in terms of making a pre-employment card, there are still some obstacles which are still felt. difficulties in participating in the worker card selection process, To find out the pre-employment card policy for the visually impaired, and To find out the legal umbrella that protects work rights for the visually impaired. This study uses a qualitative descriptive method with data collection techniques sourced from the results of several primary data and secondary data. Primary data comes from interviews, while secondary data comes from books, websites, laws, and journals.

Abstract

The harmonization of draft regional regulations is part of the stages of drafting the formation of laws and regulations to harmonize the substance of the draft laws and regulations and adapt them to the techniques of drafting laws and regulations, as an effort to minimize the occurrence of cancellation or revocation of regional regulations due to disharmony with regulations. related legislation. The formulation of the problem that will be described in this paper is how to implement the harmonization of regional legal products based on the provisions of the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 22 of 2018 concerning the Harmonization of Draft Laws and Regulations Formed in the Regions by the Designer of Legislation -Invitation. The method used in this research is a normative juridical research method. The results of the study indicate that in the process of forming regional regulations, they must go through the stages of harmonization by involving the drafting of laws and regulations. The results of the study show that there are still many regional regulations in the regions that have not gone through the harmonization stage, thus allowing the draft regional regulations that have been formed not to comply with the laws and regulations both formally and materially. Abstract

AbstractHealth services are divided into public health services and individual services. In this connection the doctor is the person who is needed and trusted to be able to provide assistance in trying to treat a patient who is in need of a medical treatment. The relationship between doctors and patients at the time of individual health services begins when a patient first comes to the practice room with a complaint about his health. A doctor will conduct a series of initial examinations in the form of an interview called anamnesa, followed by a physical examination that leads to a patient diagnosis. The formulation of the problem in this study is how is the legal protection for patients based on the Civil Code, how is the hospital's responsibility for patients who are unconscious during first aid in the ER, how are the guidelines for emergency services based on health law. The method used in this research is a normative juridical research method. The results of the study indicate that the hospital's legal responsibility in the practice of health services and medical practice in hospitals should be applied not to deviate from Law Number 44 of 2009 concerning Hospitals, Law Number 36 of 2009 concerning Health, Law Number 36 of 2009 concerning Hospitals. 2014 concerning Health Workers, Law Number 29 of 2004 concerning Medical Practice and Law Number 38 of 2014 concerning Nursing. This is because the legal responsibility of hospitals in resolving medical service disputes in Indonesia requires benefits according to the principle of.

Abstract

Law Number 11 of 2012 concerning the Criminal Justice System for Children (UU SPPA) brings fundamental changes to the juvenile justice system in Indonesia. This can be seen from the adoption of the principle of best interest for children which comes from Article 3 of the United Nations Convention on the Rights of the Child and ratified by the Indonesian government through Presidential Decree No. 36 of 1990 in the process of resolving cases of children in conflict with the law. This is in accordance with the concept of the State in Indonesia, namely the rule of law that applies proper legal principles and the application of the principle of The Best Interest of the Child to children in line with the concept of the rule of law of Indonesia. The principle of the best interest of the child or the principle of the best interest for children contained in the explanation of the Law on the Criminal Justice System for Children which states that the best interest for children is that all decision making must always consider the child's survival and development. The crime of decency that is contradicting the values and norms prevailing in Indonesia continues to occur today. Ironically, even the perpetrator of the crime of decency is a child. The implementation of the handling of children who are perpetrators of crimes of decency by the North Sumatra Regional Police cannot be equated with actions taken by adults. Diversion through the restorative justice approach must be put forward, as referred to in Article 1 number 6 of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. The North Sumatra Regional Police as the beginning of the gateway to the process of handling decency crimes committed by children in applying the principle of the best interest of the child does not always run smoothly, there are several obstacles to the police in applying these principles, one of which is that the Police does not have a written standard for application of the principle of the best interest of the child against the child offenders of decency crime. The principle of the best interests of the child has not fully become the main consideration, especially in handling in the police. The application of the principle of the best interests of the child must be proportional. The application of this principle is like the fruit of simalakama, on the one hand it aims to protect and nurture children who are in conflict with the law, but on the other hand there are interests of victims and society that must be protected from the point of view of justice.

Abstract

The purpose of this study is to determine the legal basis for implementing a therapeutic contract between a doctor and a patient and the implications of legal protection in a therapeutic contract for the parties. Therapeutic contract is an agreement between a doctor and a patient that authorizes the doctor to carry out activities to provide health services to patients based on the expertise and skills possessed by the doctor. Based on the therapeutic contract, the doctor and the patient together determine the most appropriate medical action to be taken. This research is normative juridical research using secondary data by processing data from primary legal materials, secondary legal materials and tertiary law Based on the research results, it is known that the legal basis for implementing therapeutic contracts between doctors and patients is based on the provisions of Article 1320 of the Civil Code and Article 1338 of the Civil Code, Article 68 The Act No. 36 of 2014, Article 5 The Act No. 36 of 2009, Article 39 The Act No. 29 of 2004. Furthermore, the therapeutic contract must fulfill the provisions of informed consent, which is an agreement on medical efforts made by the doctor after the patient has received information from the doctor regarding medical measures that can be taken to help him along with the risks that may occur. Then the implications of legal protection in therapeutic contracts for the parties can be seen from the rights and obligations that arise between doctors (health workers) and patients. Basically, the object in the therapeutic contract is the maximum effort to heal the patient. The patient's obligation is to provide complete and honest information about his health problems, comply with the advice and instructions of a doctor pay fees or services.

Abstract

This study aims to analyze the legal arrangements related to the making of a nominee deed made by a notary, to find out more clearly how the legal system in Indonesia actually regulates foreign investors in this case foreign citizens who want to invest in Indonesia, understand in more detail the forms of responsibilities and roles of foreign investors. a Notary related to the making of the nominee deed which we know is a deviation from the duties in the position of a Notary and analyzes the decision of the Supreme Court Number 3403K/Pdt/2016. The focus of the problem relates to finding out how the loophole from making a nominee deed becomes a way to carry out legal smuggling for foreign nationals to have ownership rights to land sourced from borrowing the name (nominee) of an Indonesian citizen.
