Abstract

In the economic and socio-cultural life of today's society, notarial institutions play the most important role in people's lives, this can be seen and felt by people who want to carry out a legal action. For example, it can be seen in terms of the business world which is increasingly broad and growing, such as buying and selling, leasing, accounts payable and so on. Notaries as ordinary people, in carrying out their duties, can make mistakes or violations. A Notary who is proven to have violated the obligations and prohibitions of a Notary as regulated in Articles 16 and 17 of Law Number 2 of 2004 concerning Amendments to Law Number 30 of 2004 concerning the Position of a Notary, can be subject to sanctions in the form of civil sanctions, administrative sanctions, sanctions code of ethics and even criminal sanctions. In conducting this research, normative juridical research is used which has a method that is different from other research. The normative juridical research method is adopted by a system of reviewing a number of archives of related legislation, books, books and other scientific works in the library that can be used as a source of this research. This study shows that the object of the lawsuit in the decision of the State Administrative Court Number: 235/G/2019/JKT in the form of the Decree of the Minister of Law and Human Rights of the Republic of Indonesia Number: AHU.55.AH.02.04 YEAR 2019 concerning Disrespectful Dismissal from the Notary Position on behalf of Muhammad Irsan, S.H., Notary in Tangerang City violated the General Principles of Good Government based on Article 53 paragraph (2) letters a and b of Law Number 9 Year 2004 concerning State Administrative Court. law is certainty and justice, so in the case of dismissal of a notary must consider the elements that occur.

Abstract

Penyiksaan dapat diartikan sebagai tindakan menghukum dengan menyengsarakan, berbuat dengan menyengsarakan, berbuat bengis kepada yang lain dengan menyakiti. Penyiksaandigunakan untuk merujuk pada penciptaan rasasakituntuk menghancurkan kekerasan hatikorban. Segala tindakan yang menyebabkan penderitaan, baik secara fisik maupunpsikologis, yang dengan sengaja dilakukkan terhadap seseorang dengan tujuanintimidasi,balas dendam,hukuman,sadisme, pemaksaan informasi, atau mendapatkan pengakuan palsu untukpropagandaatau tujuan politik dapat disebut sebagai penyiksaan.Berdasarkan latar belakang penelitian tersebut akan dianalisa bagaimana Politik Hukum Nasional Terkait Pengaturan Larangan Penyiksaan Dalam Perspektif Perlindungan Hak Asasi Manusia di Indonesia. Penelitian ini dilakukan dengan menggunakan metode penelitian hukum normatif. Data penelitian menggunakan data skunder dan didukung oleh data primer. Data dikumpulkan dengan menggunakan studi pustaka dan studi dokumen. Analisis data dilakukan dengan metode anailisi kualitatif terhadap data skunder dan data primer.Berdasarkan hasil penelitian, Politik Hukum Nasional Terkait Pengaturan Larangan Penyiksaan Dalam Perspektif Perlindungan Hak Asasi Manusia di Indonesia telah menghasilkan beberapa peraturan perundang-undangan diantaranya: UUD 1945, TAP MPR RI No. XVII/MPR/1998 tentang HAM, UU No 39 Tahun 1999 tentang HAM, UU No. 26 Tahun 2000 tentang Pengadilan HAM, dan Kitab Undang-Undang Hukum Pidana. Selain itu, Indonesia juga telah mengadopsi beberapa aturan hukum Internasional yang menentang penyiksaan diantaranya: DUHAM, ICCPR, UNCAT. Meskipun larangan penyiksaan sudah tersebar di berbagai peraturan perundang-undangan di Indonesia, pada prakteknya UU tersebut tidak berlaku efektif untuk mencegah terjadinya Penyiksaan hingga untuk memberikan perlindungan terhadap korban Penyiksaan masih terbilang sulit. Politik hukum nasional harus diarahkan kepada upaya untuk mewujudkan perlindungan HAM terhadap korban penyiksaan. Untuk mengatasi maraknya praktik penyiksaan di Indonesia, maka perlu dilakukan langkah-langkah perbaikan segera. Perbaikan harus mencakup semua sektor baik dengan cara struktural maupun kultural.

Abstract

The problems of this research are the form of profit sharing agreement in goat raising, the rights and obligations of the parties in goat rearing and legal protection if one party fails to default in goat rearing in Kisaran city, Asahan Regency.This study uses empirical juridical research with the object of research in Siumbut Baru Village, Kota Kisaran Timur District and Sidomukti Village, Kota Kisaran Barat District, Asahan Regency. In addition, conducting interviews with livestock owners, breeders and village officials.The results showed that the form of profit-sharing agreement in the maintenance of goats in Siumbut Baru Village, Kota Kisaran Timur District and Sidomukti Village, Kota Kisaran Barat District, Asahan Regency, was based on local customary law and was made orally. The terms and obligations of the goat owner are obliged to provide and submit 100% (one hundred percent) capital and the goat owner has the right to get his investment back from the profit-sharing business results. The rights and obligations of the goat freeman are to take good care of the goats that have been entrusted to him to be cared for and are obliged to take care of the goats entrusted to him in accordance with the agreed profit sharing agreement. The right of the freemason to receive the profits from the agreed percentage distribution in the profit sharing of goat rearing. Legal protection in the goat production sharing agreement, where the owner of the goat can claim compensation in the maintenance of the goat if the object of the agreement dies because of the farmer's intentional or negligence when raising the goat. On the other hand, the breeder cannot be sued for compensation if the goat in maintenance dies due to a disease outbreak or natural disaster (force majeure), in this case the breeder is protected by law.

Abstract

Penjual dan pembeli mempunyai kewajiban yang harus dipenuhi sebelum melakukan penandatanganan akta jual beli misalnya melakukan pembayaran pajak pengalihan hak atas tanah dan/atau bangunannya. Permasalahan dalam penelitian ini adalah mengenai kepastian hukum keabsahan akta jual beli yang telah ditandatangani oleh para pihak dan saksi-saksi namun belum ditandatangani oleh PPAT dikarenakan pajak pengalihan hak atas tanah dan/atau bangunannya belum dibayarkan, akibat hukum dari Putusan MA No. 541 PK/PDT/2019 dan sanksi PPAT dalam pembuatan akta jual beli tersebut. Metode penelitian yang dipakai adalah metode penelitian yuridis normatif. Jenis data yang dipakai adalah data sekunder yang terdiri dari bahan hukum primer, sekunder dan tersier. Teknik pengumpulan data yaitu dengan studi kepustakaan. Data-data yang telah diperoleh selanjutnya dianalisis secara kualitatif untuk mendapatkan hasil penelitian yang bersifat deskriptif. Penelitian ini menunjukkan bahwa akta jual beli tersebut dikatakan sah apabila telah memenuhi syarat materiil dari jual beli serta telah memenuhi Pasal 1320 dan Pasal 1458 KUHPerdata. Akibat hukum dari Putusan MA No. 541 PK/PDT/2019 yaitu akta jual beli tersebut terdegadrasi menjadi akta dibawah tangan. PPAT yang membuat akta jual beli tersebut dapat dikenakan sanksi administratif berupa teguran tertulis sampai dengan pemberhentian dengan tidak hormat dari jabatannya dan sanksi perdata berupa dapat dimintai pertanggungjawaban dalam bentuk penggantian biaya, ganti rugi dan bunga.

Abstract

ABSTRACT            Guarantee sellers in the form of land are accepted because land has high economic value and does not experience a decrease in value, so that the state regulates everything related to land as outlined in the Basic Agrarian Law which provides for arrangements for land use and supervision. Land guarantee institutions that provide strong legal certainty and protect both creditors and debtors, namely Mortgage Rights. The problem in this study is regarding the legal rules governing the obligation to register mortgage guarantees, the position of mortgage guarantees that are not registered by individual creditors, and legal protection for the parties in guaranteeing mortgage rights that are not registered by individual creditors. Normative juridical research method The type of data used is secondary data consisting of primary, secondary and tertiary legal materials. The technique of collecting data is by studying the literature. The data that has been obtained is then analyzed qualitatively to obtain descriptive research results. This research shows that lending and borrowing money usually uses the submission of property rights certificates as collateral, the use of collateral in the form of land certificates must be based on mortgage rights as collateral for repayment of debts to creditors based on the UUPA. From the copy of the mortgage land book and the copy of the Mortgage Deed, the APHT must be registered at the local land office, but in practice the registration of the mortgage is negligent or the creditor does not register it, giving rise to legal consequences.

Abstract

This change in legal form is regulated by the Minister of Home Affairs Regulation No. 3 of 1998 concerning the Forms of BUMD and Government Regulation No. 54 of 2017 concerning BUMD. This research tries to examine the problems: the legal regulations change the legal form of a regional company to become a regional company, the factors that encourage the change in the legal form of a regional company to become a regional company and the legal consequences that arise on company assets after changing the legal form by referring to Law No. 23 of 2014 and Government Regulation No. 54 of 2017. The method used is normative legal research method. The nature of the research is descriptive. The type of data used is secondary data sourced from primary, secondary and tertiary legal materials. Secondary data were collected using literature study techniques and field studies with data collection tools in the form of interviews. Furthermore, these data were analyzed using qualitative analysis. The results show that the legal regulations changing the legal form of a regional company to a regional company have been regulated in Ministerial Regulation No. 3 of 1998 concerning Forms of BUMD and Government Regulation No. 54 of 2017 concerning BUMD. Meanwhile, the factors that led to the change in the legal form of a regional company to become a regional company were encountered, namely too much intervention from the government, no separation of political interests and economic interests, the lack of interest from other investors, and a lack of competent human resources. Based on the analysis of the change in the legal form of a regional company to a regional company, there is a legal vacuum on the accountability of asset management after changing the legal form.Keywords: local companies, regional companies, legal form..

Abstract

Abstract The BIT (Bilateral Investment Treaty) is a legal umbrella in guaranteeing investment in the host country. Generally, these agreements are made to attract more investors both from within and outside the country for the sake of economic improvement and development. The crucial issue is when the BIT provides full facilities for investors without considering whether the provision of investment protection threatens the sovereignty of the state and peoples in the future or not. In the fact, will the policy actually attract more investment into the destination country or will it become a legal loophole for unruly investors in taking advantage of the legal loopholes in BIT agreements. It is only natural that these kinds of questions arise as a form of public dissemination or facts that occur directly. Because this BIT not only guarantees protection for investment, but also provides flexibility for investors to sue the state if their investment is harmed by the policies of the recipient country of investment. Even this investment dispute settlement mechanism is guaranteed through ISDS (investor-state dispute settlement). Where the ISDS clause provides guarantees for investors to sue the state in international arbitration. This clause does not apply vice versa for the state in suing investors who harm the state and the peoples. If so, then the provision of excessive investment protection with the ISDS clause in this BIT has the potential to threaten the sovereignty of the state and people. This research will review the case of investor lawsuits against Indonesia and impacted in a crisis of legitimacy over policies made by the state. Including highlighting the protection of investors and the ISDS mechanism whether it is constitutionally contradictory or not.

Abstract

ABSTRACT            A natural event resulting in the formation of new land which known as a land rising has the potential to be a place to live or a source of income. One of the cases is the land rising is at Bangka Jaya Sub-district, Aceh Utara Regency. The Law No. 11/2020 concerning on Job Creation is expected to be the most recent reference in overcoming various problem, one of which is Indonesian agrarian sector. However, there has been no detailed regulation on the rising land in many regions of Indonesia. Therefore, the issues addressed in this study are the Indonesian law/regulation following the enactment of Law No. Il of 2020 on Job Creation, the legal protection of the land rising possession at Bangka Jaya beach, Dewantara Sub-district, Aceh Utara Regency, as well as the process of submitting land rising ownership right at Bangka Jaya beach, Dewantara Sub-district, Aceh Utara Regency.            This empirical juridical research with qualitative and analytical descriptive study is employed. The primary and secondary data are collected through documents, observation, and in-depth interview.            The findings indicate that the regulation of land rising is not detailed in Law No. 11 of 2020 concerning Job Creation. However, according to government regulation No. 18 of 2021 on Management Rights, Land Rights, Flats Units, and Land Registration, land rights are state property. There is no legal protection for the community who occupy the land rising which is similar to the occupation of the land rising occurred in other places. As a result ofthe absence of legal certainty, the submission process of land ownership in Bangka Jaya beach can not be carried out. It is expected that the government create a special regulation such as Qanun concerning the land rising due to the potential cases of land rising in Aceh and other cities. A legal advice/socialization on illegal land ownership and the consequences, so the local government starts mapping on the land rising around Bangka Jaya coastal area.

Abstract

UUPA mengatur pendaftaran tanah yang bertujuan memberikan jaminan kepastian hukum. Permasalahan yang terkait dengan pendaftaran tanah adalah perjanjian pinjam nama (nominee). Salah satu sengketa pertanahan tersebut yaitu Putusan Mahkamah Agung No. 2305/K/Pdt/2020. Penelitian dilakukan untuk mengetahui jawaban dari perumusan masalah mengenai keabsahan akta perjanjian pinjam nama atas hak kepemilikan tanah oleh badan hukum, tanggung jawab notaris atas akta perjanjian pinjam nama atas hak kepemilikan tanah dan pertimbangan hukum perjanjian pinjam nama dalam putusan mahkamah agung no.2305 K/Pdt/2020.Metode penelitian yang digunakan adalah metode penelitian yuridis normatif. Jenis data yang dipakai adalah data sekunder, terdiri dari bahan hukum primer, sekunder dan tersier. Teknik pengumpulan data dengan studi kepustakaan. Data-data yang telah diperoleh selanjutnya dianalisis secara kualitatif untuk mendapatkan hasil penelitian yang bersifat deskriptif.Berdasarkan hasil penelitian diketahui bahwa perjanjian pinjam nama kepemilikan hak atas tanah oleh badan hukum mengandung kausa yang tidak halal karena tujuan dibuatnya untuk menghindari Pasal 21 ayat (2) UUPA dan Pasal 26 ayat (2) UUPA sehingga akta notarisnya juga tidak sah. Tanggung jawab notaris dalam pembuatan akta perjanjian pinjam nama atas hak kepemilikan tanah berupa tanggung jawab secara perdata, administrasi dan kode etik. Pertimbangan hakim dalam perkara nomor 2305K/Pdt/2020 dinilai tidak mempertimbangkan faktor-faktor yuridis lainnya seperti hak milik atas tanah dalam UUPA, ketentuan pendaftaran tanah, keabsahan akta perjanjian pinjam nama, konflik ahli waris dan laporan pajak.Kata Kunci: Perjanjian Pinjam Nama, Badan Hukum, Notaris

Abstract

ABSTRAKSelama Pengembalian aset adalah sistem penegakan hukum yang dilakukan oleh negara korban tindak pidana korupsi untuk mencabut, merampas, menghilangkan hak atas aset hasil tindak pidana korupsi melalui rangkaian proses dan mekanisme baik secara pidana dan perdata. Aset hasil tindak pidana korupsi baik yang ada di dalam maupun di luar negeri dilacak kepada negara korban tindak pidana korupsi sehingga diakibatkan oleh tindak pidana korupsi dan untuk mencegah pelaku tindak pidana korupsi sebagai alat atau sarana untuk melakukan tindak pidana lainnya.Penelitian yang dilakukan adalah penelitian hukum normatif dengan penelitian yang mengacu pada norma-norma dan asas asas hukum yang terdapat didalam peraturan perundang-undangan alasannya didasarkan paradigma hubungan dinamis antara teori, konsep-konsep diambil dari data dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier.Pengaturan hukum pidana pengembalian kerugian keuangan negara hasil tindak pidana korupsi,diatur dakam Undang-Undang Nomor 31 Tahun 1999 Jo. Undang-Undang No 20 Tahun 2001, dan mekanisme perampasan aset terhadap hasil tindak pidana korupsi yang dikuasai pihak ketiga, yakni menyelidiki hasil tindak pidana korupsi yang digunakan untuk membeli aset, penggeledahan atas aset atau dokumen terkait hasil tindak pidana korupsi, penggeledahan atas terkait aset hasil tindak pidana korupsi, Melakukan identifikasi terkait hasil tindak pidana korupsi. Kendala dalam pelaksanaan terdapat beberapa pengaturan mengenai perampasan aset hasil tindak pidana korupsi yang mengacu kepada Kitab Undang-Undang Hukum Pidana, Kitab Undang-Undang Hukum Acara Pidana, dan Undang-Undang Tindak Pidana Korupsi dirasa belum memadai untuk memberikan dasar pijakan dalam melakukan perampasan dan pengembalian aset.
