Abstract

Humans are social beings who really need other humans to fulfill various kinds of necessities of life, especially in the economic field. Technological developments have had a very large influence on legal relations in the economic field in society, where at first they were only carried out by individuals with the sole aim of fulfilling needs, turning into activities that are also carried out by groups to seek profit. These activities are known as business terms which include production, sales, purchases, exchange of goods and services and others. Business relations in modern society aim to exchange interests. Roscoe Pound provides a definition of "interest" or "interest" is "a demand or desire which human beings, either individually or through groups or associations in relations seek to satisfy" (interest as a demand or desire that humans want to satisfy, either individually or groups or associations). Through business relationships, the exchange of interests of the parties is always stated in the form of a contract considering that every step of business is a legal step (contract content). An important moment in the process of forming or closing an agreement is the meeting of wills, the interlocking of each statement of will as conveyed by one party to the other in a reciprocal manner and as understood by each of them.

Abstract

The effect of educational administration on teacher performance at SMA Negeri 1 Serbajadi according to the hypothesis and from the observations of researchers is quite significant. This study aims to determine how much influence the educational administration has had on teacher performance at SMA Negeri 1 Serbajadi. This research method uses quantitative research methods. The sample is teachers at SMA Negeri 1 Serbajadi, a total of 37 people. The data processing method was carried out using SPSS software version 26. The results of the study: 1) From the results of the t test analysis, it is known that the sig. for the effect of the independent variable Education Administration on the dependent variable Teacher Performance is: 0.006 <0.05 and the t-count value is 3.526 > t table 2.026 so that it can be concluded that H is accepted, meaning that there is an influence of the independent variable Education Administration on the dependent variable Teacher Performance. 2) the output of the F test is known to be the sig. for the independent variables of Education Administration and other external elements simultaneously on the dependent variable Teacher Performance is 0.006 <0.05 and the calculated F value is 22.330 > F table 4.08, so it can be concluded that Ha is accepted means that there is influence of the Education Administration variables and other external elements simultaneously on teacher performance variable. 3) Based on the test results of the coefficient of determination (R2) it is known that the value of R Square is 0.862,

Abstract

The background of this research is related to the performance of school supervisors. School supervisors are ASNs who are one of the school administrative staff assigned to their respective work areas. Permen PAN and RB no. 21 of 2010 article 5 explains that the main duties of school supervisors themselves consist of carrying out academic and managerial supervisory duties in education units. With regard to the main tasks carried out by a school supervisor, of course it is not too much to say that the barometer of national education quality is determined by the level of competence of a school supervisor. Based on the background of the problems above, the problems identified in this study are as follows: 1) The role of school supervisors is not optimal in carrying out supervisory duties and functions, 2) The intensity of attendance of supervisors at target schools is still lacking, 3) Supervisors who come to schools tend to only carry out aspects of managerial supervision while other aspects are given little attention, 4) School supervisors rarely conduct class visits and provide direct guidance to teachers. In addition, school supervisors are considered to be lacking in providing guidance related to educational research. This research uses a quantitative approach. This research was conducted in the Padangsidimpuan City Education Office, on Jl. AH Nasution No. 97 Pijorkoling Padangsidimpuan. carried out from May 2021 to July 2021. with a population of 49 people, data collection techniques were carried out by observing, interviewing and distributing questionnaires/questions. Furthermore, the data were analyzed using SPSS Software Version 26. Based on the results of the study, it was concluded that: 1) The effect of work motivation on supervisory performance is: 67.1%; 2) the influence of Supervisory Competence on Supervisory Performance is: 64.4%; 3) The simultaneous influence of work motivation and competence of supervisors on supervisory performance is 65.6%.

Abstract

This article investigates in the literature the influence between Islamic banking performance and monetary policy. With the literature search method using Mendeley Desktop software. The results show that from the various literatures that examine monetary policy and Islamic banking performance, not much has been found that examines and links monetary policy to Islamic banking performance. The search results show that this research still has the potential to be re-examined empirically using both quantitative and qualitative methods, using both primary and secondary data.

Abstract

In Islam, everything should not be done haphazardly. Everything must be regulated and carried out by the rules. Moreover, the education management process, all of which must be well designed. SMA/MA educational institutions are asked to provide quality education because inferior educational institutions will gradually be abandoned by society and automatically marginalized. The purpose of this article is to understand the implementation of Islamic education management in SMA/MA, and to study the development and improvement of the quality of personnel in the management of Islamic education in SMA/MA. This type of research was conducted using qualitative research because the data is presented through descriptive analysis. The data collection technique is a literature survey by looking for scientific articles published at least in 2018. Through this research it can be shown that the implementation of Islamic education management in SMA/MA is through programs such as providing well-packaged student orientation events, delivering student learning programs that are in accordance with the curriculum by adding religious values, and running and assisting the program. extracurricular activities that lead to the formation of maturity and morale of students through healthy physical and social activities. In order to maximize human resources, both school principals, teachers and related parties need to carry out coaching and further learning both at the local and international levels so that from this learning and coaching they are able to answer the challenges the industrial world is currently facing in the era of society.

Abstract

The concept of inclusive finance in the fintech era encourages Islamic banking to improve the quality and innovation of technology-based products. Currently, the development of financial technology is starting to move towards the digitization of financial institutions The purpose of this research is: first, to know the concept of Sharia equity crowdfunding in Indonesia from the perspective of sharia compliance; second, to find out the implementation of crowdfunding-sharia from the perspective of shariah compliance. The method used by researchers is the thematic approach method. The results of this study show that transactions in the concept of Sharia equity crowdfunding can be developed and granted but must be in accordance with sharia compliance with the orentation of economic transactions in the real sector. As for the agreement that can be used in the form of mudharabah, musyarakah, salam, ijarah, and qard, The field of construction/agriculture/agricultural plantations can be a partner (mudharib). The implementation of the sharia equity crowdfunding (SEC) model must still pay attention to risk management and legal issues and become an alternative solution for Islamic banks. Based on the findings of this study, the following recommendations are made: Islamic banking must innovate products using the SEC model to reach MSMEs and startups through the use of mobile platforms and collaboration with fintect; improve SEC literacy and socialization of Sharia economy through financial technology; sec.The SEC model can be an alternative to my banking innovation in financial instruments by targeting MSMEs, startups. By supporting the implementation of the SEC model, it is expected that there will be technological modernization and improvement in the quality of Islamic banking human resources.

Abstract

There is an interesting relation between Prophetic Law and Pancasila as well as Indonesian government significant role towards international law, both in theoretical and conceptual perspective. In Indonesian politic nowadays, the government have played significant role not only in observing international treaty but played a big role to the establishment of cooperation between non-block nations in Asia and Africa. On one hand, the perspective of theory and concept of Prophetic law is relevant. Prophetic law can be explained particularly through Prophetic leadership that is based on the holy book of various religion such as Judaism, Christianity, and Islam. On the other hand, however there is a significant relation between Prophetic Law and Pancasila when the founding fathers designed to formulate Pancasila as the state ideology of Indonesia. The founding fathers are nationalists and ulama. They are involved to discus and formulate to agree which ideology would be adopted in Indonesia once gaining its independence. Prophetic Law can be defined as rule of law are based on revelation by God through the Prophet. Fundamental principles of Prophetic Law are (1) God made Law; (2) liberty and humanity; (3) actual values. Prophetic Law doesn’t believe rule of law is just human rule of law, but rather to consider prophetic values. So, truth, justice, and values are not separated from the substantive of law. Prophetic Law is national identity.

Abstract

This research was conducted in Sumberarum Village, Songgon, Banyuwangi which aims to find out (1) the history of the Dewata Agung Temple; (2) The structure of the Dewata Agung Temple; (3) The function of the Great Gods Temple. This research is historical research, so the steps taken are (1) Heuristic data collection (observation, interviews, study of documents), (2) Criticism of sources, (3) Interpretation and (4) Historiography of historical writing. Based on findings in the field, Pura Dewata Agung has existed since 1970 and before the establishment of Pura Dewata Agung, its name was Sanggar Pamujan, where this pamujan studio was used as a prayer for Jawi Wishnu Buddhists. Then in 1970, Jawi Wishnu Buddhists moved to Hindu Dharma because they had to choose one of the religions that have been determined and have legality in the new order government, then Buddha Jawi Wishnu inevitably has to change religions, one of which is to choose Buddhism or Hindu Dharma. This was then followed by Jawi Wishnu Buddhists deliberating with several Jawi Wishnu Buddhist leaders to find common ground to choose between Buddhism and Hindu Dharma. the result of the people's agreement that they chose Hindu Dharma because their considerations were based on the sacred texts of the Vedas and the same God who is worshiped, namely Sang Hyang Bhatara Wishnu. So that the Jawi Wishnu Buddhists in Sumberarum Village moved to Hindu Dharma and they worked together to start building the Great Gods Temple. The structure of the Dewata Agung Temple uses the Dwi Mandala concept in which this concept divides the temple into two parts, namely Nista Mandala (the unholy part) and Utama Mandala (the most sacred part). The function of the Great Gods Temple is divided into three namely, (1) Religious function as a place for prayer and religious ceremonies (2) Religious Education function as a place for pasraman or often called Hindu religious education; and (3) social function as a meeting place for meetings and deliberations. Abstract

Assessment is a process to determine the ability of an object. Judging from the aspect of the instrument, the results of a comprehensive assessment need to be carried out using both physical and non-physical instruments. Judging from the assessing elements, a comprehensive assessment needs to be carried out by several elements, so that it will produce complete and comprehensive data. Judging from the elements being assessed, the ideal assessment is one that is able to know and assess the competence of the object being assessed. Performance appraisal is a process to find out a job that is carried out routinely (periodically) which is intended to find out the shortcomings and weaknesses of the object being assessed. Performance appraisal for school supervisors needs to be carried out with instruments that are not only physical, but also with non-physical instruments. The school supervisor's assessment also needs to be assessed not only by one element but also by several elements that are related to the performance of the school/madrasah supervisor. The school supervisor's assessment also needs to be carried out based on the competence possessed by the school supervisor. Performance appraisal can be done in various types/methods, including (a) individual assessment, namely the assessment process to determine personal performance carried out by school/madrasah supervisors. (b) formal assessment of the bureaucracy, namely the assessment process carried out by means of a formal bureaucratic document, namely the Employee Achievement Assessment List (DP3). (c)collaborative assessment, namely a process of evaluating/assessing the performance of school/madrasah supervisors which is carried out by involving many elements that have the relevance of authority. (d) competency assessment, namely the assessment process is carried out based on the competence possessed by the object being assessed. Assessment of the performance of school supervisors in the office of the Holy Ministry of Religion is not only carried out in a formal bureaucratic manner, but is carried out in various ways so as to be able to produce the performance of school supervisors as a whole and comprehensively..

Abstract

This article focuses on the idea of a fifth amendment to the Indonesian constitution, namely an amendment to the UUD NRI 1945. Stressing today’s constitutional problems, which we identify as deriving from the norms in the UUD NRI 1945, this article presents the urgency of the fifth amendment and how to bring about a democratic constitution. Using a statutory and conceptual approach, this normative study identifies a number of foundational issues in the UUD NRI 1945. Thus, the fifth amendment of the constitution finds its urgency. Through this article, we encourage the fifth amendment to be conducted to present a democratic constitution, both materially and formally.
