Abstract

The authority of the Indonesian National Armed Forces (TNI) in addressing acts of terrorism, as mandated by the TNI Law through Non-War Military Operations (OMSP), as stated in Article 7 paragraph (2) letter (b) number 3 of Law Number 34 Year 2004 regarding the Indonesian National Armed Forces, is one of the main tasks of the TNI in OMSP, hence it is the mandate of the TNI's authority in addressing acts of terrorism. To date, there are no implementing regulations that govern this TNI authority, resulting in ambiguity and a legal vacuum that causes hesitation in every military operation carried out by the TNI to counteract acts of terrorism, significantly threatening state sovereignty, thus raises questions with the problems: 1. What is the urgency of the regulation of authority in countering terrorism that threatens the sovereignty of the Indonesian State by the Indonesian National Armed Forces (TNI); 2. What is the model of involvement of the Indonesian National Armed Forces (TNI) in countering acts of terrorism that threaten the sovereignty of the Indonesian State? Therefore, the author uses normative legal research, a statutory approach method, a concept analysis, and a comparison approach. With this research, the author tries to explain that the arrangement of TNI authority in addressing acts of terrorism that have threatened state sovereignty is essential and urgent to be immediately enacted as the legality of the military operation carried out considering the current threat of terrorism which is increasingly developing following the times. So that the involvement of the TNI in addressing acts of terrorism is no longer carried out as an auxiliary task to the Indonesian National Police (POLRI). The TNI, in addressing acts of terrorism threatening state sovereignty, has clear and firm boundaries by the place, time, and level of threat such that the TNI can directly conduct military operations to address these acts of terror.

Abstract

The purpose of this research is to understand and analyze the ratio legis setting the minimum education requirements for senior high school or its equivalent for a presidential candidate from the study of treatises on discussing educational needs as well as to find out the conditions that can be used in determining the ability of a presidential candidate. The research method used by the author is a normative legal research method, by researching principles, synchronization, systematics, and legal comparisons. The author uses this type of normative legal research because, in formulating the problem, the author emphasizes the legal ratio to the educational requirements of a presidential candidate in Law No. 7 of 2017 concerning General Elections. This is influenced by the emergence of the author's curiosity about reasoning (ratio legis) from the minimum requirements for senior high school school or the equivalent for presidential candidates in Law No. 7 of 2017 concerning General Elections. The Indonesian House of Representatives is expected to be able to reformulate the development of regulations on educational requirements for presidential and vice-presidential candidates in Indonesia. The burden of duties carried out by a president certainly requires more ability to carry out the mandate that the people have entrusted to him in leading the running of the government. In this case, education is one of the components to assess a president's competence and ability.

Abstract

The transformation of work safety culture as part of the organizational culture is the company's effort to prevent work accidents so that productivity can be optimized. PT Semen Padang has carried out a work safety culture transformation but still has weaknesses in each element of work safety culture which includes basic assumptions, behavior and organizational situations. This study aims to analyze, reveal the obstacles and efforts that can be made by PT Semen Padang in realizing the transformation of work safety culture. The research approach uses qualitative methods. The research informants were 13 people who were determined by purposive sampling technique. Data were collected by interview, observation and documentation studies and then analyzed using data reduction techniques. presentation of data and drawing conclusions as well as SWOT analysis. The transformation of the work safety culture at PT Semen Padang requires improvement so that it can run effectively. The obstacles encountered were in the aspect of consistency in carrying out policies related to the transformation of work safety culture by all lines within the company. The existence of employee motivation to have a better work safety culture and support from the parent company, namely PT Semen Indonesia Group is a factor that PT Semen Padang can optimize to carry out work safety culture transformation. Abstract

To be able to answer how the construction of the implementation of the halal product guarantee system should be (das sollen) as the aim of regulating halal certification which adheres to the mandatory principle and is in line with the rule of law which prioritizes the principles of justice, benefit and legal order, it is necessary to harmonize the Law on Halal Product Assurance and the regulations implementation and maintain the consistency of the application of norms. In this paper, the author will present an ideal construction idea so that legal certainty in the implementation of halal product guarantees can be realized as the goal of the Halal Product Guarantee Law by applying Aristotle's rule of law theory (grand theory), which is supported by the theory of authority and the theory of responsibility (middle range). theory) and the theory of legal certainty (applied theory). Abstract

In the era of the industrial revolution 4.0 which was marked by technological changes and demands for rapid change, education faced major challenges in developing student creativity. Learning motivation and parental support play a very important role in stimulating students' creativity in this era. This study aims to describe learning motivation and parental support with student creativity in the era of the industrial revolution 4.0. This study uses a quantitative method with descriptive correlation. The population of this study was 479 students of class XI and XII at SMKN 3 Padang, and the sample was 218 students who were selected using a proportional stratified random sampling technique. The research instrument is a Likert scale. The results of the validity test of the learning motivation instrument were 0.441, parental support was 0.442, and student creativity is 0.672. The results of the reliability test of the learning motivation instrument were o.886, parental support was 0.801, and student creativity was 0.846. Data were analyzed using descriptive statistics, simple and multiple regression. The results showed that: (1) on average the description of learning motivation was at a high level, (2) the description of parental support was at a high level, (3) and the description of student creativity in the era of the industrial revolution 4.0 was in the high category, (4) ) there is 7.5% (R=0.275, at significance 0.000) in the relationship between learning motivation and student creativity, (5) there is 7.2% (R=0.268, significance 0.000) in the relationship between parental support and student creativity, (6) there was 11% (R=0.332, at a significance of 0, 000) in the relationship between learning motivation and parental support with student creativity in the era of the industrial revolution 4.0. The implications of this research can be used as a need assessment to create a guidance and counseling service program at SMKN 3 Padang.

Abstract

This study aims to describe family support and self-efficacy with student resilience in completing thesis. This study uses a correlational descriptive quantitative method. The population of this study were 442 undergraduate students at the Faculty of Education who were active in 2018, with a sample of 210 people, who were selected using a proportional stratified random sampling technique. The instruments used were family support questionnaires and self-efficacy questionnaires. Analyzed with descriptive statistics, simple regression and multiple regression. Abstract

The study examines the factors influencing the effective implementation of gender equality in the Newcastle Local Municipality (NLM). The study, being qualitative in nature, is based on a single case study considering the NLM as a locus. Information is gathered through literature review. The data is analysed through conceptual analysis. The findings obtained indicate a gender disparity at the NLM in terms of councillor and management positions. There are also social, economic, political, ideological, and institutional factors hampering the achievement of gender equality and, these are comprehensively addressed in the study. The study offers recommendations which can be applied in NLM and other municipalities to enhance gender equality. The importance of involving local government and municipalities in the fight against gender inequality cannot be underestimated. It is therefore necessary to address the existing research gap concerning gender equality in local government.

Abstract

The purpose of this article is to provide schools with the necessary knowledge and skills to manage sustained crises in schools. The role of heads of department (HODs) in administering schools during times of crisis is covered in this article. The Covid-19 crisis has brought to light a new chance to explore the role of HODs, the stakeholders they represent, and how they could progress toward a larger understanding and better response to critical school concerns. As a result, the author's goal in this article is to find out "How should HODs exercise their powers in crisis management?" The author emphasizes the significance of flexibility and organizational creativity in times of crisis based on this investigation. The author also discusses how HODs can bridge the gap between school administrators and teachers, school crisis management and resolution, knowledge of technology information, and communication, virtual learning, communication, crisis management strategies, and how principals can support HODs when the next crisis is right around the corner. The Corona Virus (Covid-19) epidemic created fear and vulnerability among people and school personnel and students, particularly in educational systems.

Abstract

This study aims to examine the effect of leadership style, organizational culture and career development on job satisfaction with work motivation as a mediating variable for District/City BPS employees in Aceh Province. The number of respondents in this study were 214 civil servants at the Regency/City BPS in Aceh using the Stratified Random Sampling method. The data analysis method used is Structural Equation Modeling with AMOS Software. The results of this study found that leadership style and organizational culture directly had a significant effect on job satisfaction, while career development had no significant effect on work motivation. Then work motivation has a significant effect on job satisfaction, while leadership style, organizational culture and career development have no significant effect on job satisfaction. The results of the mediation effect prove that work motivation is able to mediate the effect of leadership style and organizational culture on job satisfaction partially (partial mediation), but is unable to mediate the effect of career development on job satisfaction.

Abstract

The Foundation Law provides an understanding that a foundation is a legal entity engaged in religious, social, and humanitarian fields. This research discusses the juridical implications of the joint meeting held at Yayasan Pura Dwijawarsa with the aim of appointing the foundation's trustees, the regulation of the joint meeting is contained in article 7 number 6 of the Articles of Association contained in the Deed of Establishment of Yayasan Pura Dwijawarsa Number 29 dated April 25, 2008 made before notary Niluh Elita Mahariany S.H., M.Kn, the article states that if for any reason the foundation does not have a trustee, then since the vacancy is obliged to appoint a trustee based on the decision of a joint meeting by the management and supervisory organs. But what happened in Yayasan Pura Dwijawarsa, the joint meeting aimed at appointing the coach was carried out by the management and supervisors who had ended their term of office. This research is a socio-legal research using a sociological juridical approach. The results of the analysis show that there are several impacts arising from the existence of the joint meeting so that it is not in accordance with one of the objectives of the law, namely legal certainty.
