Abstract

The term constitutional law is also commonly used in the legal lecture literature, where it is known as the term state law, which in fact both terms are translations of the Dutch term staatsrecht. The development of constitutional law in Indonesia starts from customary HTN. During the reign of the Dutch East Indies, the HTN of the Dutch East Indies was in force. When the Japanese occupied Indonesia, what applied was the HTN during the Occupation of the Japanese Army. After Indonesia was proclaimed its independence on August 17, 1945, what took effect was HTN Indonesia (Initial Period of Independence - Validity of the 1945 Constitution in the Republic of Indonesia which was one of the states within the RIS Country - Period of Validity of the 1950 Constitution - Old Order Period - New Order Period - Period Reform Order). The demand for changes in the representation system was followed by the emergence of debates about the general election system (for example between districts or proportional, between open and closed list systems) and parliamentary structure (for example the problem of parliamentary chambers and the existence of the DPD). The demand for a more equitable relationship between the center and the regions is followed by theoretical studies on the form of the state and models for implementing regional autonomy. These demands cover many aspects. The existing regulatory and institutional framework according to the positive Constitutional Law at that time was no longer in accordance with the development of people's aspirations and life.

Adhering to the advantages that exist in this media, the inhibiting factors for its use in MAS Amaliyah Sunggal are still experienced or felt by PAI teachers, such as facilities and infrastructure, in this case the number of infocus is limited so that the implementation is carried out alternately with other subject teachers. In addition, teaching staff or teachers have limited skills on how to use media in the teaching and learning process in the classroom and are not fully capable of making their own learning media. Then, not all material in the lesson can use Power Point-based interactive learning. Even so, there are supporting factors for the use of this media in the school, such as positive perceptions of teachers such as interactive learning media based on Power Point facilitating the delivery of subject matter and achieving learning objectives, attracting students' attention and interest in learning so as to make students more enthusiastic and eager to listen to learning and follow every learning step that has been prepared by the PAI teacher. In addition, the teacher has the willingness to carry out varied and interesting learning in each learning meeting. Finally, there is a school's willingness to continuously try to provide learning facilities or school facilities and infrastructure that support learning activities.

Abstract

There are three areas of law that live and grow (the living law) in Indonesia, which are Customary Law, Islamic Law, and Western Law. These three areas of law are the main material for the national legal system. Islamic law which is based on the Qur'an and hadith has perfectly regulated all aspects of life including muamalah matters, and one part of muamalah activity is pawning. The rapid development of Islamic Banks is a challenge to itself to make the actors in this industry need to innovate in creating banking products, but of course, it must be in accordance with Islamic principles. This research was conducted by tracing the various legal bases for the application of gold pawning to Islamic banks and the practice model so that this research was carried out in a normative juridical manner using a statute approach and comparative law studies as well as complementing it with the results of interviews regarding the practice of gold pawning on Islamic banks. The results of the study shows that the values of Islamic law, which are the living law after going through legal politics, have been transformed into and become part of the national legal system. Therefore, their practice is in accordance with sharia principles.
