Abstract

The crime of defamation committed through electronic information has become an increasing legal concern following the enactment of Law No. 1 of 2024 concerning amendments to the Electronic Information and Transactions Law. In practice, however, judges often impose conditional sentences instead of imprisonment, as seen in Decision No. 160/Pid.Sus/2024/PN.Kbu. This study aims to analyze the legal, philosophical, and sociological considerations underlying the imposition of a conditional sentence on perpetrators of defamation through electronic means and to examine whether such a decision aligns with the objectives of law justice, legal certainty, and expediency. This research employs a normative juridical approach using secondary legal materials, including statutory regulations, court decisions, and relevant legal literature. The data were analyzed descriptively through legal interpretation methods. The results show that the judge’s decision was based on juridical considerations that the defendant was proven to have violated Article 45 paragraph (4) in conjunction with Article 27A of the ITE Law; philosophical considerations emphasizing rehabilitation rather than mere punishment; and sociological considerations reflecting mitigating and aggravating factors. The imposition of a conditional sentence was found to be consistent with the principles of justice, legal certainty, and expediency, serving both corrective and preventive purposes.

Abstract

The issue of legal protection for medical personnel in primary health care facilities remains a crucial concern in Indonesia’s health law enforcement. This study aims to analyze the forms of legal protection for medical personnel at Puskesmas Sinar Rejeki, Lampung Selatan, particularly in relation to professional negligence and the resulting legal implications from both criminal and civil law perspectives. The research applies a normative juridical approach by reviewing statutory regulations, legal doctrines, and relevant scholarly literature. The findings indicate that the protection of medical personnel is explicitly regulated under Law No. 17 of 2023 on Health and Government Regulation No. 28 of 2024, which guarantee occupational safety, legal certainty, and professional rights. Preventive protection includes licensing requirements and professional standards, while repressive protection involves mechanisms for resolving medical disputes through recommendations from the Indonesian Medical Disciplinary Board (MKDKI) prior to litigation. The study concludes that strengthening institutional supervision and legal literacy among medical practitioners is essential to ensure effective legal protection and uphold patient safety within primary health care services.

Abstract

Educational institutions in Indonesia are facing increasingly intense competition, requiring madrasahs to strengthen their marketing strategies to attract new students. This study aims to analyze the implementation of the educational service marketing mix strategy and its influence on student enrollment interest at MAN 1 Tangerang and MAN 5 Tangerang. The research employed a qualitative descriptive method through interviews, observations, and documentation involving school principals, teachers, and admission committees. The findings show that both schools have applied the seven elements of the marketing mix (product, price, place, promotion, people, process, and physical evidence) effectively, although their emphases differ. Product quality, competent teachers, and promotional activities through competitions and social media play significant roles in shaping a positive image and attracting new students. Meanwhile, the elements of place and price have a relatively minor impact but remain supportive. Overall, the integration of all seven elements creates a synergistic marketing strategy that enhances competitiveness and maintains a high level of new student interest. The results are expected to provide practical insights for improving educational marketing management in Islamic schools.

Abstract

This study examines the legal responsibility of the Public Trustee Office (Balai Harta Peninggalan, BHP) in implementing court determinations related to assets owned by individuals declared afwezigheid (absent). The main issue concerns how BHP manages, administers, and executes the sale of such assets within the limits of its statutory authority. The research aims to analyze the extent of BHP’s legal responsibility in safeguarding ownership rights while ensuring legal certainty in accordance with Indonesian civil law. This study applies a normative juridical method using statutory, conceptual, and analytical approaches based on primary and secondary legal materials. The findings show that BHP’s responsibilities are limited to administrative and representative functions, strictly bound by formal legal norms as stated in the Civil Code and the Ministerial Regulation No. 27 of 2013. The study concludes that the implementation of BHP’s authority must adhere to the principles of legality, accountability, and due process of law to prevent conflicts of interest and protect the rights of rightful heirs. This research contributes to strengthening the normative framework of public trusteeship in Indonesia’s civil law system.

Abstract

The enforcement of court decisions in corruption cases often faces legal and practical challenges, particularly when the convict’s assets are pledged as collateral under banking security rights. This study aims to examine how asset confiscation in corruption cases is carried out by the Prosecutor’s Office in fulfilling compensation payments when the assets are bound by mortgage rights, as well as to identify the inhibiting factors. Using a normative and empirical juridical approach, data were collected through literature studies and field interviews with prosecutors and criminal law scholars. The findings reveal that asset confiscation is constrained when the identified property has been mortgaged to a bank, as banking security rights provide legal protection to third parties acting in good faith. Consequently, the prosecutor cannot execute the asset to cover the compensation amounting to IDR 284,916,038, and the convict must instead serve an additional one-year imprisonment as ordered by the court. The main obstacles include substantive legal limitations, the absence of regulatory instruments for installment payments of compensation, and the convict’s preference to serve substitute imprisonment rather than paying compensation.

Abstract

This study examines the unresolved legal gap concerning the status of corporations as subjects of criminal law in cases of human rights violations. Although the 2023 Indonesian Criminal Code explicitly recognizes corporations as criminally liable entities through the application of identification theory and corporate culture theory, the Human Rights Court Law still limits liability to individual perpetrators. This disharmony creates uncertainty and weakens efforts to address corporate involvement in serious human rights violations, particularly in cases involving systemic abuses, environmental destruction, and labor exploitation. The objective of this research is to analyze the juridical position of corporations under the 2023 Criminal Code and evaluate the extent to which existing legislation supports or fails to support the enforcement of corporate criminal liability in human rights violations. Using a normative juridical method, this study examines statutory provisions, legal principles, and relevant international instruments, including the United Nations Guiding Principles on Business and Human Rights. The findings show that the 2023 Criminal Code provides a more comprehensive framework for imposing corporate liability, including expanded forms of sanctions and clearer attribution standards. However, the absence of corporate liability provisions in the Human Rights Court Law presents a substantive obstacle to consistent law enforcement. The study concludes that legislative harmonization, strengthened institutional capacity, and the development of specialized procedural mechanisms are essential to ensure accountability for corporations implicated in human rights violations.

Abstract

Islamic Religious Education (PAI) plays a fundamental role in students' character building, yet its implementation is often still trapped in a surface learning model oriented towards rote memorization. In line with educational policies in Indonesia that now emphasize the Deep Learning approach, an analysis of the alignment between PAI policies and this new approach is needed. This research uses a systematic literature review method with a qualitative approach. Data were collected from various empirical research articles published between 2022-2025. The method used is library research with a content analysis approach to various relevant scientific literature. The study results show that the principles of Deep Learning namely meaningful, mindful, and joyful learning are highly consistent with the goals of PAI to internalize moral values. However, there are challenges at the policy level, which often still focus on achieving curriculum content targets rather than facilitating a deep learning process. In conclusion, for PAI to be effective in character building, existing policies need to be reoriented to explicitly support and facilitate learning models that are contextual, reflective, and student-centered, in accordance with the essence of Deep Learning.

Abstract

This study aims to evaluate the implementation of the Merdeka Curriculum policy by analyzing its impact on student motivation and learning outcomes. This research uses a systematic literature review method with a qualitative approach. Data were collected from various empirical research articles published between 2022-2025, examining the curriculum's application in primary and secondary education. The data were analyzed using thematic content analysis. The main synthesis results show that the implementation of the Merdeka Curriculum, particularly through Project-Based Learning (P5) and differentiated learning, consistently has a positive and significant impact on increasing student motivation, independence, and active participation. Various studies also confirm an improvement in student learning outcomes, both cognitively and in 21st-century skills. The most frequently reported primary challenges are teacher readiness, administrative load, and limited supporting facilities. It is concluded that the Merdeka Curriculum is effective in improving motivation and learning outcomes, but its uniform implementation success is highly dependent on systematic support for teacher training and infrastructure fulfilment.

Abstract

The zoning system policy in New Student Admission represents a strategic effort by the Indonesian government to achieve equitable access to quality education. This research aims to analyze the implementation of the zoning system policy in student admission, identify supporting and inhibiting factors, and evaluate its impact on educational quality equity across schools and regions. The method employed is library research with a qualitative approach, analyzing official policy documents, accredited scientific journals, and research findings from the 2021-2024 period. Data analysis was conducted through content analysis techniques encompassing reduction, data presentation, and conclusion drawing. Research findings indicate that zoning system implementation has enhanced educational accessibility by prioritizing students based on geographical proximity, yet faces various challenges including uneven school distribution, facility quality disparities, teacher distribution inequality, and administrative complications. Positive impacts of this policy include improved access to nearby schools and opportunities for students from economically disadvantaged families, while negative impacts encompass student difficulties in choosing preferred schools and incomplete achievement of learning quality equity. Research findings suggest that the zoning system has not been fully effective in realizing educational quality equity due to persistent infrastructure disparities and community perceptions toward favored schools. Infrastructure improvements, quality teacher redistribution, policy adjustments aligned with local conditions, intensive socialization, periodic evaluation, and strengthened affirmative policies are necessary to enhance zoning system effectiveness.

Abstract

Indonesia's educational transformation faces complex challenges in preparing a generation capable of competing in the global era. This research examines the implementation of the Merdeka Curriculum as a strategic response to 21st-century learning needs through a systematic literature review approach. The study focuses on three fundamental aspects: policy implementation practices across various educational institutions, identification of supporting and inhibiting factors in learning transformation, and evaluation of impacts on student competency improvement. The research method employs a qualitative approach with content analysis techniques on scientific literature from 2021-2025 sourced from national and international journals and official policy documents from the Ministry of Education, Culture, Research, and Technology. Data analysis was conducted through content analysis techniques encompassing reduction, data presentation, and conclusion drawing. Findings reveal that Merdeka Curriculum implementation successfully integrates 4C skills through project-based learning and differentiation that accommodates diverse student characteristics. Principal leadership, teacher competency, and Platform Merdeka Mengajar support emerge as key success elements, while infrastructure limitations, inter-regional digital gaps, and human resource readiness remain significant obstacles. Positive impacts are evident in improved student literacy and numeracy, character strengthening through the Pancasila Student Profile, and teacher role transformation from teacher-centered to student-centered approaches. This research recommends strengthening continuous mentoring systems, equalizing access to learning technology, and affirmative policies for disadvantaged areas to accelerate inclusive and quality educational transformation throughout Indonesia.
