Abstract

The text discusses the dissenting opinion in the decision of the Constitutional Court Judge in the case of the petition a qua No. 90/PUU-XXI/2023 which examines article 169 letter q regarding the minimum age limit requirements for presidential and/or vice-presidential candidates. The dissenting opinion in the decision has generated both pro and contra perceptions from legal experts. However, the dissenting opinion of some Constitutional Court Judges does not invalidate the decision; the decision is final and can be enforced as determined by the Constitutional Court. Methodologically, this research uses a normative research method through library research, which includes legal materials related to the formulation of the problem, such as legislation, books, journals, and other related readings. These materials are then systematically collected, organized, and examined in order to draw a conclusion to address the problem formulation.

Abstract

Governance in Indonesia has experienced significant changes since the post-Reformation era of 1988, particularly with the implementation of Law Number 22 of 1999 on Regional Government, which initiated the decentralization of authority from the central to regional governments. This implementation was further reinforced by Law Number 32 of 2004, which emphasized the obligation of regional governments to manage their own affairs based on the principle of autonomy. This study examines the influence of asset management on the optimization of fixed assets in the Government of Batu Bara Regency. The population in this study consisted of 99 employees distributed across 35 work units, resulting in a sample of 79 respondents representing the population. The analysis method used was Partial Least Square (PLS), with questionnaires distributed to 79 respondents. The results showed that asset inventory did not have a significant influence on the optimization of fixed assets, whereas asset legal audit and asset valuation had a positive and significant influence. Asset supervision and control were found to moderate the influence of asset inventory on the optimization of fixed assets, but did not significantly moderate the influence of asset legal audit and asset valuation.

Abstract

It is suspected that there has been aggression in the school environment, including at the elementary school level. Concrete efforts are needed to reduce aggression behavior in schools carried out by fellow students, because the impact of aggression behavior inflicts prolonged psychological trauma on victims of aggression. This type of research is quantitative research with a post-test only experiment design. The aggressiveness scale is used to measure aggression behavior that has met the item discrimination and reliability indexes. The research data were analyzed with the Mann-Whitney non-parametric test, resulting in significant differences in aggression behavior of group students who acquired character learning, social skills, and morals with control group students. The aggression behavior that acquired character learning, social and moral skills was lower than the aggression behavior of the control group students. These findings suggest that character learning, social and moral skills have an effect on students' aggression behavior.

Abstract

In an increasingly competitive business world, companies are required to produce quality products. SAM is a formal system that utilizes information to support various company activities. SAM has four main characteristics: broad coverage, aggregation, integration, and timeliness. Product quality control functions to integrate quality maintenance and development so that production and service are more efficient and satisfy consumers. There are three components of SAM in quality control: quality control objectives, quality feedback, and quality incentives. Companies need to control the products they produce to minimize defects. SAM helps present information on product quality and employee performance, as well as managing data into reports that support managers in decision making.

Abstract

The determination of child custody in divorce cases involving dual citizens is a complex issue that requires special attention to Indonesian legal jurisdiction. This study analyzes how Indonesian legal jurisdiction is applied in determining child custody in divorce cases involving couples of different nationalities, based on the Marriage Law No. 1 of 1974 and related international regulations. The case study of the Supreme Court Decision No. 2021 K/Pdt/2020 was also studied to understand the factors considered in decisions related to child custody. The main factors that the Supreme Court considers include the psychological and emotional well-being of the child, the financial ability of the parents, the relationship between the child and the parents, as well as the residence and nationality of the child. The results of the study show that custody decisions are always aimed at the best interests of the child, taking into account relevant national and international legal aspects.

Abstract

This research examines Supreme Court Decision No. 321 K/Pdt/2017 which deals with name borrowing agreements for land ownership by foreigners in Indonesia. In the context of increasing foreign investment, the practice of name borrowing is often a solution for foreigners to circumvent the prohibition on land ownership, but it also poses various legal challenges. Through a normative analytical descriptive juridical approach, this study analyzes the substance of the decision, the legal risks for the parties involved, and the social and economic implications of this practice. The results of the analysis show that name loan agreements are not legally recognized and are potentially null and void, resulting in legal uncertainty and conflicts that harm both foreigners and Indonesian citizens. The research also highlights that the absence of legal protection for the parties can result in financial and reputational losses. Overall, the findings indicate the need for policy reformulation and stricter regulations to govern land ownership by foreigners in Indonesia, in order to maintain social and economic balance and encourage sustainable investment development.

Abstract

This study aims to explore the influence of organizational culture and demographic profiles on employee attitudes at Eastern Samar State University (ESSU) Guiuan Campus. Using a quantitative research method with a correlational design, the study examines relationships among variables such as age, gender, educational attainment, employment status, and organizational culture, which encompasses the values of excellence, accountability, and service. Data were collected through questionnaires utilizing a Likert scale to measure organizational culture and employee attitudes. The findings indicate that ESSU Guiuan's organizational culture strongly emphasizes excellence, accountability, and service, with high levels of job satisfaction and employee commitment. While demographic profiles were not found to significantly affect most aspects of organizational culture and employee attitudes, employment status was significantly related to service quality, and job designation influenced employee engagement. The study recommends enhancing professional development programs, fostering innovation through employee engagement, and strengthening effective leadership to promote a more inclusive and dynamic organizational culture. These findings provide valuable insights for strategic interventions to improve organizational culture and employee well-being in higher education institutions.
