JUSTICIA SAINS: Jurnal Ilmu Hukum [E-ISSN: 2502-1788; P-ISSN: 2527-4201] is the Journal of Legal Studies published by the Faculty of Law of Universitas Sang Bumi Ruwa Jurai, Lampung, Indonesia. Its main aim to disseminate critical and original analysis from researchers and academic practitioners on various contemporary legal issues both local and foreign. The manuscript is published after undergoing a peer-review process by providing an exclusive analysis on law issues from various perspectives. This journal published biannually (June and November). The scopes of Justicia Sains Novelty are: Constitutional Law, Criminal Law, Civil Law, Islamic Law, Environmental Law, Human Rights, International Law, and also interconnection study with Legal Studies in accordance with the principle of novelty.

Abstract

All provinces, cities, and regencies held simultaneous regional head elections in 2024, Indonesian democracy reached a milestone. This study examines the legal dynamics, administrative challenges, and issues that arise in simultaneous regional elections, particularly in the postponement of regional heads' terms, official appointments, and Constitutional Court election result disputes. This is normative legal research using statutory, conceptual, and comparative methods. The analysis found that the Constitutional Court granted 26 of 309 election result disputes, 24 of which resulted in a revote. Revote is a remedial method to ensure electoral equity and election results. These findings underline the significance of strengthening regulations, improving organizer professionalism, oversight, and public political literacy for democratic, fair, and accountable regional elections.

Abstract

In this study, the philosophical basis of Nawawi al-Bantani's book Uqūd al-Lujayn will be analyzed. This book places the husband-wife relationship within a patriarchal framework and typically refers to the wife as a "slave" or "captive," a description that has sparked contemporary controversy. The purpose of this study is to examine the concept of Ammah according to Nawawi al-Bantani and its relevance to gender equality. Using documentation based on secondary data and literature, including books, articles, and journals related to Nawawi al-Bantani's thoughts on the concept of Ammah, as well as relevant perspectives and other sources reviewed thru content analysis, this study combines qualitative descriptive methods with a library research approach. The research findings indicate that the concept of Ammah is interpreted as protection and compassion toward wives, demonstrating its continued relevance in contemporary Islamic family law. However, the concept of Ammah in terms of restrictions on women and the symbolization of subordination is considered contradictory to the principle of gender equality. This research affirms the importance of recontextualizing classical Islamic legal thot to align with the demands of justice and harmony in contemporary family relationships

Abstract

Forgery of diplomas is a criminal offense that not only damages the integrity of the education system, but also threatens public trust in educational institutions and government. Although diploma forgery has been regulated, the practice of forgery still occurs frequently due to the lack of synchronization between the two regulations. This research aims to analyze the relevance and synchronization between the Criminal Code and the National Education System Law in handling the criminal act of diploma forgery so as to provide a comprehensive understanding of more effective law enforcement. The method used is normative- juridical research with statute approach and conceptual approach. Data is sourced from primary legal materials in the form of provisions in the Criminal Code and the National Education System Law, as well as secondary legal materials such as journals, legal literature, and related court decisions, namely district court decision Number 43/Pid.B/2021/Pn. Liw and the analysis is done descriptively-qualitatively. The results show that the regulation of diploma forgery in the Criminal Code is still general in nature through Article 263 on forgery of letters, while the National Education System Law only emphasizes administrative aspects without clear regulation of criminal sanctions. This has led to dualism in the application of the law and the potential for a legal vacuum in practice

Abstract

Banking crime is a form of white-collar crime that has a broad impact on the stability of the financial system and public trust. This research method uses a normative juridical approach. The sources and types of data used are primary and secondary. Data collection was conducted through library research. Data processing was carried out by selecting and examining the obtained data for completeness, as well as systematically classifying or grouping the data. Data analysis used qualitative juridical methods. This research focuses on the provisions of Law Number 10 of 1998 concerning Banking, Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering, and regulations of the Financial Services Authority (OJK). The results of this study indicate that banking crimes not only result in financial losses but also lead to a crisis of public trust. Therefore, strengthening regulations, increasing the role of law enforcement officials, and implementing prudential banking principles in banking practices are necessary.

Abstract

The legal position of astra children (children out of wedlock) in the structure of Balinese customary law, especially in inheritance rights and social participation in customary communities, often faces discrimination because their position is not fully recognized in the paternal lineage, which has implications for inheritance rights, participation in traditional ceremonies, and other social rights. Through a juridical-normative approach, this article aims to analyze the legal position of astra children (children out of wedlock) in the structure of Balinese customary law, inheritance rights, and social participation in customary communities. It also identifies tensions and conflicts between customary law and national law. Although the Constitutional Court Decision Number 46/PUU-VIII/2010 has given legal recognition to extra-marital children, its implementation in the customary realm still faces social and cultural resistance. The tension between the principle of customary law sovereignty and the supremacy of national law is the main highlight. This research shows that the position of astra children in Balinese customary law is influenced by the legitimacy of the biological father and the role of the extended family which has a direct impact on their civil and customary rights. Thus, there is a need for equal legal dialogue between the state and indigenous communities to find common ground that guarantees the protection of astra children's rights without eliminating the identity of customary law that is still alive in the community.

Abstract

Lingkungan hidup dan sumber daya alam memiliki nilai penting dan strategis bagi manusia dikarenakan manusia merupakan bagian dari lingkungan yang keberadaannya saling mempengaruhi. Maka kebutuhan akan lingkungan hidup yang sehat dan asri harus diupayakan dan diwujudkan. Perlindungan dan pengelolaan lingkungan hidup menjadi sangat penting, terutama di tengah berbagai fenomena lingkungan yang berpotensi merugikan perikehidupan manusia. Penegakan hukum dipandang sangat urgen untuk mencegah maraknya pencemaran dan perusakan lingkungan. Penegakan hukum lingkungan dapat dilakukan secara preventif maupun represif, yang merupakan upaya untuk mencapai ketaatan terhadap peraturan perundang-undangan lingkungan, dengan ruang lingkup meliputi bidang hukum administrasi negara, hukum pidana dan hukum perdata. Penegakan hukum lingkungan melalui instrumen hukum administrasi negara dapat dilakukan dengan beberapa cara yaitu pertama, pengawasan. Kedua, pemberian sanksi administrasi dan ketiga, gugatan melalui Pengadilan Tata Usaha Negara.

Abstract

The Free Nutritious Meal Program (MBG) constitutes one of the national priority initiatives launched by President Prabowo Subianto in early 2025 to address malnutrition and stunting in Indonesia. Conceptually, this program represents the state’s responsibility to guarantee the right to nutritious food for all citizens. However, its implementation faces challenges such as mass poisoning incidents, limited institutional preparedness, and weak legal foundations, raising constitutional questions regarding the program’s alignment with the principles of the rule of law, good governance, and human rights protection. This study employs a normative legal method with conceptual and statutory approaches, reviewing legislation, Constitutional Court decisions, and relevant scholarly literature. A qualitative analysis was conducted by tracing norms and constitutional principles related to the right to food and state obligations. The findings indicate that MBG constitutes a manifestation of the state’s constitutional responsibility as stipulated in Articles 28A–28J of the 1945 Constitution of the Republic of Indonesia; however, strengthening its legal basis through a Government Regulation in Lieu of Law (Perppu) is necessary to ensure legal certainty and accountability, as the element of “urgent necessity” has been fulfilled. Accordingly, MBG is not merely a populist policy but also a concrete implementation of the state’s commitment to public welfare and social justice.

Abstract

Legal protection for consumers using the PayLater feature on the Gojek app has become an important issue amid the development of fintech services in Indonesia. This feature offers convenience in transactions with a deferred payment system, but it also carries risks such as unclear information, misuse of personal data, and unethical collection practices. According to the Financial Services Authority (OJK) Regulation No. 77/POJK.01/2016, legal protection includes transparency of information, the legality of the service provider, protection of personal data, electronic agreements, and professional debt collection processes. Consumers also have access to dispute resolution mechanisms, such as the Consumer Dispute Resolution Body (BPSK), Alternative Dispute Resolution (ADR), courts, complaints to the OJK, and internal complaint mechanisms. Although existing regulations provide a strong legal protection framework, further improvements in education, transparency, and oversight are still needed to ensure consumer rights are better safeguarded. Collaboration between regulators, operators, and the public is key to creating a safe and sustainable fintech ecosystem

Abstract

The Indonesian Maritime Security Agency (Bakamla) plays a strategic role in ensuring security, safety, and law enforcement within Indonesia’s maritime jurisdiction. Although its authority is normatively stipulated through regulations such as Law No. 32 of 2014, Presidential Regulation No. 178 of 2014, and Government Regulation No. 13 of 2022, in practice Bakamla has yet to fully function as an ideal Indonesian Coast Guard. The absence of a specific law, overlapping authorities with other agencies, and limited resources hinder its operational effectiveness. This study aims to analyse Bakamla’s legal position and authority within the national legal system, identify discrepancies between regulation and operational reality, and formulate institutional strengthening strategies. Using a normative juridical approach, this research concludes that establishing a dedicated Coast Guard Law is an urgent step to develop a unified, professional, and effective national maritime security system

Abstract

The polemic regarding interfaith marriage in indonesia reflects the tension between positive law, religious values and the principles of human rights (HAM) the marriage law explains that a marriage is valid if it is carried out in accordance with each religion, making it difficult for interfaith couples to legally marry. If we look at the universal declaration of human rights (DUHAM), it gives everyone the freedom to marry regardless og religion. In indonesia, religious views on interfaith marriage also vary, some religious prohibit it, while others allow it with certain conditions. These diffrences in rule and views cause confusion and legal uncertainty. Therefore, clearer and fairer rules are needed so that everyone’s right to marry can still be respected without ignoring existing religious values.
