JUSTICIA SAINS: Jurnal Ilmu Hukum [E-ISSN: 2502-1788; P-ISSN: 2527-4201] is the Journal of Legal Studies published by the Faculty of Law of Universitas Sang Bumi Ruwa Jurai, Lampung, Indonesia. Its main aim to disseminate critical and original analysis from researchers and academic practitioners on various contemporary legal issues both local and foreign. The manuscript is published after undergoing a peer-review process by providing an exclusive analysis on law issues from various perspectives. This journal published biannually (June and November). The scopes of Justicia Sains Novelty are: Constitutional Law, Criminal Law, Civil Law, Islamic Law, Environmental Law, Human Rights, International Law, and also interconnection study with Legal Studies in accordance with the principle of novelty.

Abstract

This study aims to explore how supervisory and enforcement policies are implemented by the Customs and Excise Office of Type Madya Pabean B Pekanbaru in the context of enforcing customs regulations, while also identifying various obstacles encountered during the implementation process. The methodology employed in this research adopts a qualitative approach combined with a descriptive research model. The data were collected primarily through direct field observation and in-depth interviews. The data analysis process involved several stages: data collection, data reduction, structured data presentation, and finally, drawing conclusions based on empirical findings. The results of this study indicate that the policies implemented are in accordance with the prevailing legal provisions. However, several challenges persist, particularly regarding the availability and capacity of human resources, limitations in infrastructure and facilities, and weak inter-agency coordination. Therefore, improvement strategies should focus on enhancing cross-institutional collaboration and ensuring consistent law enforcement to create a deterrent effect for violators of excise regulations

Abstract

Corruption in Indonesia has reached alarming levels and is categorized as an extraordinary crime due to its multidimensional impacts, both economic, political, and social. Corruption eradication has so far been approached primarily through criminal law instruments and state institutions, such as the Corruption Eradication Commission (KPK). However, the fact that corruption rates remain high indicates the need for a more philosophical approach. This article aims to examine corruption eradication in Indonesia through a philosophical perspective encompassing the dimensions of ontology, epistemology, and axiology. This research method uses a normative juridical approach. The sources and types of data used are primary and secondary data. Data collection was conducted through library research. Data processing was carried out by selecting and examining the obtained data for completeness, as well as classifying or grouping the data systematically. The data analysis used is qualitative juridical. The results of this study indicate that corruption eradication cannot be sufficiently understood as an individual crime, but rather as a structural phenomenon that requires modern knowledge methods and a value orientation towards substantive justice, good governance, and constitutional legitimacy. Therefore, it is necessary to increase the independence of law enforcement agencies, epistemological innovation in the field of evidence, anti-corruption ethics education, and a humanistic axiology of law enforcement.

Abstract

Digital transformation presents new challenges for copyright protection in Indonesia. Law No. 28 of 2014 on Copyright is considered to be insufficiently responsive to the dynamics of digital infringement, such as illegal distribution, works based on modern technology, and weaknesses in the protection system and royalty distribution on digital platforms. This article discusses the urgency of updating the Copyright Law to make it more adaptive, including expanding the scope of protection in the digital realm, integrating security technologies such as Digital Rights Management (DRM) and watermarking, strengthening the responsibility of User-Generated Content (UGC) platforms, and aligning regulations with international standards. Key challenges include the difficulty of cross-border law enforcement, low public literacy, dualism in protection systems, and the lack of transparency in collective management organizations. Proposed solutions include inter-agency collaboration, improving public literacy, utilizing work protection technologies, and reforming the royalty distribution system. With comprehensive regulatory updates and cross-sector collaboration, copyright protection in Indonesia is expected to become more effective and competitive in the digital age.

Abstract

Kegiatan pertambangan timah ilegal di Bangka Belitung telah menimbulkan kerugian ekonomi dan ekologis yang signifikan. Salah satu isu utama yang muncul adalah bagaimana bentuk pertanggungjawaban pidana korporasi yang terlibat dalam praktik tataniaga timah ilegal serta mekanisme pemulihan kerugian ekonomi lingkungan akibat aktivitas tersebut. Artikel ini bertujuan menganalisis penerapan pertanggungjawaban pidana korporasi berdasarkan Peraturan Mahkamah Agung (Perma) Nomor 13 Tahun 2016 dan Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup (UU PPLH), serta menelaah kebijakan pemulihan ekonomi lingkungan melalui pendekatan hukum pidana lingkungan dan ekonomi hijau. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan kasus. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana korporasi belum diterapkan secara optimal karena lemahnya pembuktian keterlibatan manajemen dalam kejahatan lingkungan, sementara pemulihan ekonomi lingkungan masih bersifat parsial dan belum memperhitungkan nilai ekonomi ekosistem secara komprehensif.

Abstract

This study aims to analyze the protection of the right to a healthy environment in cases of illegal logging from a human rights perspective. From an axiological perspective, this study emphasizes that law does not merely function as a written norm, but has instrumental value in realizing ecological justice, sustainable development, and protecting the rights of present and future generations. This value requires the state, authorities, and society to work together to preserve the environment as an integral part of human rights. The research method used is normative juridical with a legislative approach, human rights doctrine, and case studies of illegal logging. The results show that illegal logging causes ecological damage, loss of resources, and serious violations of the basic rights of communities, especially vulnerable groups who depend on forests. Existing legal protection is still formalistic and weak in implementation, especially in the aspects of law enforcement and environmental restoration. Therefore, strengthening human rights-based regulations, increasing the capacity of officials, and community involvement in monitoring forest management is needed.

Abstract

This study aims to examine the policy of criminalizing sexual intercourse with corpses within the framework of Indonesian criminal law. The primary focus lies in comparing the old Criminal Code, which did not explicitly regulate such acts (only through Article 181 on mistreatment of corpses), with the new Criminal Code, which explicitly criminalizes the act under Article 271. Employing a normative juridical approach, this research is analyzed using the principles of legality, the theory of culpability, and supported by non-legal theories such as morality, legal sociology, and forensic psychology to strengthen the rationale for criminalization. The findings demonstrate that penalizing sexual acts with corpses is legally justifiable, both from the perspective of substantive and procedural criminal law, as it reflects the protection of human dignity even after death. This study also identifies several challenges in the implementation, including low public awareness and evidentiary difficulties, and proposes enhancing legal education and inter-agency collaboration as potential solutions. The research contributes to the development of a more humanistic and responsive Indonesian criminal law in addressing contemporary crimes.

Abstract

Indonesia's investment legal system has established the principle of equal treatment between foreign and domestic investors, as stipulated in Law Number 25 of 2007 concerning Investment. A fast and transparent licensing system will reduce administrative costs and accelerate project implementation. These efforts will increase investor confidence, improve Indonesia's image as an investment-friendly country, and encourage more inclusive economic growth. Normative legal research, or legal research, utilizes both normative and conceptual juridical approaches. Three research approaches are used: a statutory (statistical) approach, a conceptual (conceptual) approach, and a comparative approach. The research results show that Indonesia's investment licensing system has a significant influence on foreign investment interest and realization. Indonesia's licensing policy strategy needs to be directed at accelerating the licensing process and strengthening business certainty by adopting best practices from Vietnam and Thailand

Abstract

The dominance of the United States Dollar (USD) in the global financial system, a legacy of the Bretton Woods Agreement, is now facing serious challenges due to growing dedollarization efforts by various countries, particularly the BRICS bloc. Geopolitical events, such as the sanctions against Russia in 2022, have accelerated the push to reduce reliance on the USD in order to minimize external economic vulnerabilities and establish a multipolar monetary system. Indonesia, which officially became a member of BRICS in January 2025, views this membership as a strategic move to strengthen global collaboration, advocate for the interests of the Global South, and achieve ambitious domestic economic growth targets. Despite concerns regarding potential threats to its non-aligned foreign policy, Indonesia adopts a pragmatic and gradual hedging strategy, combining engagement with BRICS and Western-led blocs to diversify partnerships and ensure strategic flexibility. This article analyzes the extent to which Indonesia's BRICS membership influences the direction of its national monetary policy from a legal perspective, examining the roles of BRICS initiatives such as the New Development Bank (NDB) and the BRICS Contingent Reserve Arrangement (CRA) in dedollarization efforts, with a particular focus on the use of local currency settlement (LCS) in trade. Furthermore, the article explores the relationship between Indonesia's positive law—particularly the mandate to stabilize the Rupiah under the Bank Indonesia Act and the exceptions to Rupiah usage under the Currency Act—and dedollarization initiatives within the framework of international cooperation. In conclusion, Indonesia's membership in BRICS legally opens up opportunities to diversify its national monetary policy. However, the success of its implementation will heavily depend on Indonesia's ability to navigate complex geopolitical dynamics and manage relationships with various power blocs strategically while maintaining domestic economic stability.

Abstract

The right to health, as a fundamental part of human rights, demands the commitment of the state to provide quality and equitable health services. Puskesmas, as the frontline, play a crucial role in accessibility and health system strengthening. However, the reality on the ground shows that there are challenges, such as damage to facilities and incomplete laboratories at several Puskesmas in Central Lampung District, including Puskesmas Wates. This problem raises a critical question: How is the relevance of fulfilling health service standards to the realization of strengthening primary health services at Puskesmas Wates Lampung Central. This research uses normative legal methods, with a statutory and analytical approach, examining primary, secondary, and tertiary legal materials. The focus is on reviewing the Decree of the Minister of Health Number HK.01.07/Menkes/1047/2024 on Equipment Standards. The results of the study are expected to identify the significance of the fulfillment of equipment standards in improving the quality of service and capacity of Puskesmas Wates, and provide policy recommendations for optimizing the strengthening of primary health services in the context of fulfilling the right to public health
