Abstract

Socialization of the BPJS program is a strategic effort to increase understanding and participation of workers in the social security system. However, in practice, there are still employees who do not follow the socialization process, thus potentially hampering the effectiveness of the program. This study aims to analyze the role of the Social Security Organizing Agency (BPJS) in socializing the health insurance program for workers and to identify factors that cause workers' non-engagement. This research uses a qualitative approach with interview techniques, observation, and documentation analysis of employees and socialization organizers. The results showed that the role of BPJS in socializing the health insurance program has not been fully effective. The effectiveness of socialization depends on the communication strategy used, the level of involvement of company management, and the method of delivering information. Employee disengagement is caused by lack of access to effective information, lack of support from the company, and the perception that socialization does not have significant added value. Therefore, a more interactive, adaptive, and technology-based communication strategy is needed to increase employee involvement in the socialization of the BPJS program.

Abstract

This study examines the legal protection of Intellectual Property Rights (IPR) for Micro, Small, and Medium Enterprises (MSMEs) in Indonesia amid the implementation of import relaxation under Minister of Trade Regulation No. 8 of 2024. While the policy aims to facilitate trade and material access, it raises concerns about IPR protection and MSME competitiveness. Using a qualitative case study, this research draws on interviews with MSME actors, legal experts, and officials, supported by legal documents and academic sources. Thematic analysis revealed that, although the regulation improves access to imported raw materials, it also increases IPR violations, particularly through foreign products imitating local innovations. Many MSMEs struggle to protect their intellectual assets due to weak enforcement mechanisms. The study concludes that stronger legal frameworks and government oversight are crucial to balancing trade liberalization with effective IPR safeguards. It emphasizes the need for greater awareness among MSMEs and improved institutional support to preserve local creativity and ensure fair competition. This study also proposes a collaborative policy model involving MSMEs, the government, and legal institutions to enhance sustainable IPR protection and policy coherence in the context of global trade

Abstract

The enactment of Law no. 17 of 2023 concerning Health brings significant changes to the independent practice of midwives, especially in aspects of regulation, licensing and authority. This regulation aims to improve the quality of health services, but also presents challenges for midwives in carrying out their practice. This research aims to analyze the impact of implementing Law no. 17 of 2023 regarding the independent practice of midwives, as well as identifying challenges and opportunities that arise as a result of changes to these regulations. This research uses a qualitative approach with document analysis methods, which involves a study of Law no. 17 of 2023, as well as scientific journal articles, WHO reports and relevant previous research. The research results show that this policy causes changes in the risk-based licensing system, increasing the authority of midwives, but also creates challenges in terms of regulatory adaptation, licensing costs, and the need for additional training. On the other hand, this regulation provides opportunities to simplify licensing procedures for low-risk services, stronger legal protection, and integration of health technology. Implementation of Law no. 17 of 2023 requires a good adaptation strategy so that midwives can adapt their practices to new regulations, while also taking advantage of opportunities to improve the professionalism and quality of maternal and child health services in Indonesia.

Abstract

Acupuncture practice is a top choice for many consumers at Klinik L BEAUTY & HEALTH JAKARTA, especially Therapist Amelia Kurniasari, S.Tr.Akup. However, concerns about consumer protection in this sector are still relevant. This study aims to explore aspects of consumer protection in acupuncture practice at this clinic. Using a qualitative approach, we interviewed consumers and analyzed online comments, and conducted an audit of the clinic's compliance with applicable regulations. The results revealed positive consumer perceptions of acupuncture services, but also a need for increased transparency, information and legal protection. The importance of ethical standards and regulatory compliance played a major role. This study provides insights for health practitioners and law enforcement to improve consumer safety and protection in acupuncture practice.

Abstract

This research will discuss the urgency to regulate the transparency obligation of targeted advertising. Being the most popular method of marketing in today’s digital era, targeted advertising continuously becomes a target of controversy among consumers. Concern over targeted advertising ranges from the data collection process to how it is targeted towards consumers. This creates uncertainty among consumers due to the opacity of targeted advertising algorithms. Through a normative juridical method, this research will examine the adequacy of Indonesia’s regulations in addressing the issue of targeted advertising, ranging from the Consumer Protection Law, EIT Law, PSTE Regulation, and PMSE Regulation compared to the European Union’s Digital Services Act. Abstract

The government needs to ensure that the management of HGB in the IKN is carried out by paying attention to the rights of local communities and indigenous peoples. The application of the principle of social justice as taught by John Rawls by paying special attention to more vulnerable groups. In every policy related to the procurement of building use rights to accelerate the development of the IKN, the principle of social justice must be maintained. This means that policies must provide protection for vulnerable groups and ensure that this development benefits all levels of society. This study aims to provide an understanding of the Ratio legis regulation of Building Use Rights for investors in Law Number 5 of 1960 and in Law Number 6 of 2023 and to find out, understand and explain the perspective of John Rawls' Theory of Justice in the regulation of building use rights in order to accelerate the development of the IKN. This research is normative in nature using a statutory regulatory approach, an approach and a conceptual approach. Research data were collected by means of document/literature studies.

Abstract

In the Indonesian civil law system, the plaintiff’s ability to withdraw a lawsuit before the defendant responds is a key procedural aspect regulated by Article 271 of the Reglement op de Burgerlijke Rechtsvordering (Rv). This analysis explores the application of this rule in Determination Number 203/PDT.G/2022/PN PLK at the Palangka Raya District Court, where the plaintiff, Porwanto, withdrew a lawsuit for unlawful acts against three defendants before their response. The court approved the withdrawal, ordered the plaintiff to pay court costs of Rp2,160,000, and removed the case from the register. This case reflects the balance between plaintiff autonomy and judicial efficiency, yet it raises concerns about potential procedural abuse. This study underscores the need for strict oversight to ensure such flexibility does not compromise fairness for all parties involved.

Abstract

The shooting incident at the Indonesian Ulema Council (Majelis Ulama Indonesia/MUI) office has raised public concern regarding the security systems of religious institutions in Indonesia. This study aims to analyze the security system of the MUI office using the Routine Activity Theory (RAT), which emphasizes three key elements for the occurrence of crime: a motivated offender, a suitable target, and the absence of a capable guardian. Employing a case study approach and qualitative methods, data were collected through document analysis, media reports, and interviews with relevant stakeholders. The findings reveal that weaknesses in surveillance and the lack of technology-based security systems contributed to the incident. These results highlight the urgency of upgrading security measures, including enhancing the capacity of security personnel, installing electronic surveillance systems, and establishing more adaptive standard operating procedures (SOPs) to respond to potential threats. Abstract

The phenomenon of illegal parking has evolved into a serious problem in urban areas, including the city of Surabaya. Although the Surabaya City Government has established various regulations to organize the parking system, violations of these provisions still frequently occur, causing disturbances to traffic order, the comfort of road users, and the aesthetic value of the city. This article aims to analyze the legal implications of parking practices that are not in accordance with applicable laws and their impact on efforts to organize effective, efficient, and sustainable urban transportation governance. This study includes an analysis of the parking management system implemented, the authority and responsibility of law enforcement officials, as well as the obstacles to its implementation. This article also offers alternative solutions based on technological innovations and data-driven approaches to strengthen an orderly and equitable parking system. The results of this study are expected to serve as normative and applicative recommendations for the Surabaya City Government.
