Abstract

This paper uses a case study of Mataram District Court Decision Number 26/Pid.Sus.Anak/2022/PN.Mtr. to examine the legal factors judges take into account when imposing correctional sentences on juvenile offenders of drug offenses. The research focuses on how the integrated assessment results serve as a foundation for the judge's deliberations, how the restorative justice principle is applied, and how well correctional sentences support child rehabilitation and deter recidivism levels. This study employs a case study methodology in conjunction with a normative juridical legal research method. Primary legal materials, such as court rulings, as well as secondary legal materials, such as laws and regulations, scholarly publications, and pertinent legal literature, were examined in order to gather data for a literature review.The results show that the integrated assessment has a strategic role in helping judges understand the child's condition comprehensively, encompassing legal, medical, psychological, and social aspects. The judge's considerations in the decision are not only based on legal aspects such as evidence and positive legal provisions, but also consider non-legal factors such as the child's psychological condition, family background, and potential for rehabilitation and social reintegration. The application of correctional punishment in this decision reflects the implementation of the principles of the best interests of the child and restorative justice, which prioritize recovery over repressive punishment. Corrective punishment is considered more effective than imprisonment in preventing recidivism and supporting the rehabilitation of child drug abusers, as long as it is supported by optimal rehabilitation and ongoing supervision.

Abstract

Indonesia, sebuah negara yang mempunyai banyak pulau dan memiliki sumber daya alam yang melimpah, kini menghadapi tantangan besar akibat ekspansi industri pertambangan. Hal ini terutama terjadi di daerah pesisir dan pulau kecil yang sangat rentan secara ekologis. Alih-alih meningkatkan perlindungan terhadap ekosistem sebagaimana diatur oleh Undang-Undang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil, sistem politik dan hukum pertambangan di Indonesia menunjukkan kecenderungan yang lebih otoriter dan terpusat. Hal ini berdampak pada kemudahan dalam mendapatkan izin serta pengembangan proyek strategis nasional melalui regulasi seperti Undang-Undang Cipta Kerja dan perubahan pada hukum pertambangan mineral dan batubara. Oleh karena itu, penelitian ini akan membuktikan hal tersebut dengan menganalisis kebijakan hukum pertambangan di kawasan pesisir dan pulau-pulau kecil, termasuk Undang-Undang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil, Undang-Undang Pertambangan Mineral dan Batubara, serta Undang-Undang Cipta Kerja beserta peraturan yang terkait. Metode yang digunakan, yakni yuridis-normatif sehingga dapat menelaah karakter politik hukum berdasarkan norma yang terbentuk, disharmoni regulasi yang ada, serta dampaknya. Hasil kajian menunjukkan bahwa politik hukum pertambangan saat ini otoriter-ortodoks dengan orientasi pada kepentingan investasi dan sentralisasi kewenangan, sehingga membuka ruang yang memudahkan eksploitasi pulau-pulau kecil melalui pertambangan terutama dengan gencarnya pertambangan berlabel PSN untuk kepentingan transisi energi. Penelitian ini merekomendasikan reorientasi politik hukum dengan penguatan prinsip demokrasi ekonomi yang berkelanjutan serta berwawasan lingkungan seperti yang diamanatkan oleh Undang-Undang Dasar, penegakan hukum dengan pengawasan ketat terhadap pemanfaatan pulau-pulau kecil, harmonisasi regulasi lintas sektor, serta penguatan partisipasi dan kontrol masyarakat pesisir untuk mewujudkan pembangunan ekonomi yang berkelanjutan dan berkeadilan.

Abstract

This research examines the evolving legal convergence between banking law and commodity futures law in the governance of bullion banking activities. Bullion banking represents a hybrid financial practice in which gold functions simultaneously as a physical commodity, a financial asset, and an underlying instrument in derivatives markets. Through various mechanisms such as unallocated gold accounts, gold lending and leasing, swaps, and over-the-counter derivatives transactions, bullion banks perform activities that both resemble and combine the functions of deposit-taking institutions and commodity market intermediaries. This dual characteristic challenges traditional regulatory classifications and creates tensions between prudential supervision in the banking sector and market conduct regulation in the derivatives sector. Using a normative juridical approach supported by comparative analysis of several jurisdictions, this research evaluates how existing legal frameworks regulate capital adequacy, asset segregation, insolvency mechanisms, transparency, and systemic risk in gold-related transactions. The analysis reveals the presence of regulatory fragmentation, potential overlap of supervisory authorities, and legal uncertainty regarding the proprietary status of gold claims, particularly within unallocated gold account structures. Such conditions may create opportunities for regulatory arbitrage while simultaneously increasing risks to financial system stability. The findings of this research indicate that a functional and activity-based regulatory model offers a more coherent approach to addressing the hybrid nature of bullion banking. Therefore, clearer legal classification of bullion-related products, harmonization of prudential and derivatives standards, and stronger cross-sector coordination among supervisory authorities are required in order to establish a more integrated legal framework, safeguard market integrity, and accommodate financial innovation in precious metals markets.

Abstract

This article analyzes legal settlements related to food purchase transactions with a focus on the non fulfillment of consumer rights regarding the circulation of non-halal products on the market and the legal implications related to certification obligations. This study is conducted to determine forms of consumer protectio and legal implications related to the circulation of products on the market that do not yet have halal certification. This study uses an empirical juridical an approach that merges primary data gathered from structured interviews with secondary data obtained from relevant legal sources and literature. The results suggest that legal protection for consumers is not fully effective due to the presence of business actors who sell products without certainty about their halal status. To overcome this, preventive and repressive forms of protection can be implemented. The implementation of laws related to halal certification obligations is carried out through socialization, education, supervision, and strict law enforcement. This research contributes to the development of consumer protection discourse by emphasizing the importance of strengthening supervision and transparency related to halal certification.

Abstract

This study aims to analyze the legal framework and criminal liability for crimes of negligence committed by officials of the Free Nutritious Meals Program (MBG) that result in food poisoning. The method used is a normative legal approach based on legislation, through a review of the old Criminal Code, Law No. 1 of 2023, and Presidential Regulation No. 115 of 2025. The novelty of this study lies in the analysis of the criminal liability of MBG officers as legal subjects in cases of food poisoning resulting from negligence through a comparison of provisions in the old Criminal Code, the 2023 Criminal Code, and Presidential Regulation No. 115 of 2025, as well as the identification of a legal gap regarding specific regulations for MBG officers. The research findings indicate that poisoning is the result of negligent conduct (culpa), with the level of criminal liability depending on the resulting harm, such as minor injury, serious injury, or death. In the old Criminal Code, Articles 359 and 360 served as the basis, whereas the 2023 Criminal Code regulates this more systematically in Articles 474 and 475, including aggravated penalties for certain professions. The principles of legality and “no punishment without guilt” (geen straf zonder schuld) serve as the primary foundations. This study also identified a regulatory gap regarding specific provisions for MBG officers, highlighting the need for strengthened regulations and oversight.

Abstract

Drug-related recidivism remains a serious concern within Indonesia's correctional system. Records from the Regional Office of the Ministry of Immigration and Corrections of Central Sulawesi for 2025 show 378 repeat offenders among 2,078 narcotics inmates, about 18 percent, amid occupancy levels nearing 95 percent above capacity. This study analyzes the effectiveness of narcotics inmates' correctional programs in preventing recidivism and identifies obstacles to their implementation. The study employs an empirical juridical approach combined with statutory and sociology-of-law approaches, drawing on 75 inmate respondents and four correctional officials at Class IIA Palu, Class IIB Toli-Toli, Class III Kolonodale, and Class III Palu Women's Prisons. The findings reveal that correctional work is delivered through personality development, independence training, narcotics rehabilitation, and social reintegration schemes covering parole, conditional leave, and pre-release leave. Environmental factors dominate initial involvement (53.33%), while nearby drug distribution networks are the leading trigger of reoffending (42.5%). Programme effectiveness is constrained by overcrowding, the absence of resident psychologists, ad hoc addiction-therapy cooperation with the National Narcotics Agency, limited facilities, weak family support, and discontinued post-release supervision. Building on these findings, the study recommends assigning permanent psychologists and addiction counsellors to every prison, adopting risk and needs assessment as the basis for individualised programmes that address environmental and network-related triggers of reoffending, and institutionalising after-care through binding cooperation agreements among prisons, the Correctional Centre, regional government, and rehabilitation agencies. Strengthening structured, individualized correctional programs and cross-institutional coordination constitutes a strategic priority for reducing narcotics recidivism in Central Sulawesi.

Abstract

Bribery as a form of organized corruption poses serious evidentiary challenges given its covert nature and the involvement of influential actors within circles of power. This study analyzes the legal standing of justice collaborators in bribery disclosure and evaluates the application of justice principles in their legal protection in Indonesia. It employs a normative juridical method with statutory, conceptual, and case-based approaches, analyzing legal materials qualitatively through deductive reasoning and comparison across judicial decisions. The findings reveal that although collaborator status is normatively recognized, its application remains inconsistent due to the absence of standardized eligibility criteria. Across six bribery cases, no collaborator received a sentence lighter than the prosecution's demand. Tommy Sumardi, Abdul Khoir, and Maliki were sentenced more heavily than demanded, the latter two after panels annulled the status granted by the Corruption Eradication Commission, while Andi Narogong's sentence rose from eight years at first instance to thirteen at cassation. This study recommends standardizing eligibility criteria through binding regulation, strengthening the binding force of witness protection agency recommendations, and codifying the collaborator's position within criminal procedural law.

Abstract

This article aims to analyze the problems of the Free Nutritious Meal Program (MBG) from a human rights perspective and to formulate policy reform directions aligned with the fulfillment of the right to food. This issue is significant because a program designed to improve nutritional status has revealed various implementation challenges, including food safety, nutritional quality, governance, and budgetary implications for other sectors. This study employs a normative juridical method with a qualitative approach by examining legal doctrines, scholarly literature, and empirical evidence derived from policy reports and findings. The results demonstrate that MBG continues to experience structural shortcomings in fulfilling the right to food, as reflected in weak oversight, unequal benefit distribution, limited public participation, and a policy orientation that prioritizes quantity over quality. Furthermore, the program’s budgetary policy has the potential to generate conflicts among the fulfillment of different rights, thereby failing to reflect an integrated rights-based approach. The novelty of this study lies in the development of an evaluation and policy reform model for MBG based on the Human Rights-Based Approach (HRBA), integrating the PANEL principles, the capability approach, and right-to-food-based evaluation indicators as a comprehensive framework for assessing and improving policy design and implementation. This reform model is expected to enhance policy effectiveness while ensuring the fulfillment of the right to food in a safe, adequate, equitable, and sustainable manner.
