Abstract

The aims of this journal for discusses the use of social media as an instrument of public diplomacy by the Indonesian government to strengthen its national image, increase global public engagement, and expand the reach of diplomatic messaging in the digital era. The transformation of diplomacy toward digital diplomacy has positioned platforms such as Instagram, X (formerly Twitter), TikTok, and YouTube as strategic spaces for communicating Indonesian values, policies, and political positions in a more interactive, rapid, and measurable manner. Using a descriptive quantitative approach supported by engagement data, trends in netizen responses, and patterns of diplomatic content distribution, this study demonstrates that social media can enhance the effectiveness of public diplomacy through three main mechanisms: (1) broader and real-time amplification of diplomatic messages, (2) increased interactivity that strengthens emotional connections between the government and global audiences, and (3) the formation of positive perceptions through visual narratives and digital storytelling. However, this study also identifies several challenges, including the risk of misinformation, limited narrative control, and gaps in digital literacy. These findings emphasize that social media is not merely a complementary tool but has become a strategic element of Indonesian public diplomacy, requiring professional, consistent, and adaptive management in response to the dynamics of the global digital environment. This article is expected to make both conceptual and practical contributions to the future development of Indonesia’s public diplomacy strategy.

Abstract

This study aims to analyze the gap between civil law norms and social practices in the implementation of agricultural sharecropping agreements between landowners and cultivators in Tranjang Village, Siman District, Ponorogo Regency. The study employs a juridical- empirical approach by combining normative legal analysis of statutory provisions with empirical field research through observation and in- depth interviews with 15 informants consisting of landowners, cultivators, and village authorities. The findings reveal that most sharecropping agreements in Tranjang Village are conducted verbally based on mutual trust between landowners and cultivators, without written contracts or official authorization by village authorities. Such practices are rooted in agrarian social values emphasizing kinship and mutual cooperation, but do not fully comply with formal legal standards stipulated in Law No. 2 of 1960. This gap is caused by low legal awareness, complex and costly administrative procedures, social and cultural values that prioritize trust over formal rules, and the passive role of village government in facilitating contract registration. The study recommends revitalizing the role of village authorities in facilitating agricultural contracts through the provision of simple contract formats that can be legalized quickly and affordably, legal socialization with participatory local cultural approaches, and revision of Law No. 2 of 1960 to be more adaptive to the social realities of agrarian communities while ensuring legal protection for cultivators.

Abstract

This quantitative study aims to analyze the influence of business actors’ responsibility on product quality and consumer satisfaction, with Miss Daster Indonesia as the research focus. In the digital commerce era, the increasing number of marketplace transactions requires business actors to ensure product quality, accurate information disclosure, and consumer rights protection. This research employs a quantitative survey approach involving respondents who have previously purchased Miss Daster Indonesia products through online marketplaces. A Likert-scale questionnaire was used to measure variables such as product information accuracy, product quality, after-sales service effectiveness, and consumer satisfaction levels. The collected data were analyzed using descriptive statistics and regression tests to determine the influence of independent variables on consumer satisfaction. The findings show that business responsibility reflected in the accuracy of product descriptions, material quality, and responsiveness of after-sales service significantly affects consumer satisfaction. However, several issues, such as product discrepancies and slow complaint handling, were still identified and negatively influenced consumer perceptions. These results highlight the need for improved consistency in product quality, transparent information, and faster complaint-response mechanisms to strengthen consumer trust and satisfaction.

Abstract

HIV/AIDS merupakan permasalahan kesehatan masyarakat yang tidak hanya berdimensi medis, tetapi juga memiliki implikasi hukum, sosial, dan hak asasi manusia. Negara memiliki kewajiban konstitusional untuk melindungi segenap warga negara, termasuk dalam upaya pencegahan penyebaran dan penanggulangan dampak HIV/AIDS. Penelitian ini bertujuan untuk menganalisis tanggung jawab negara dalam memberikan perlindungan hukum terhadap penyebaran dan dampak HIV/AIDS berdasarkan kerangka hukum nasional dan prinsip-prinsip hak asasi manusia. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan konseptual, dan pendekatan hak asasi manusia. Bahan hukum yang dianalisis meliputi peraturan perundang-undangan di bidang kesehatan, hak asasi manusia, serta instrumen hukum internasional yang relevan dengan penanggulangan HIV/AIDS. Hasil penelitian menunjukkan bahwa tanggung jawab negara tercermin dalam kewajiban untuk melakukan upaya preventif, promotif, kuratif, dan rehabilitatif secara berkelanjutan, serta menjamin perlindungan hukum bagi orang dengan HIV/AIDS dari stigma dan diskriminasi. Namun demikian, masih terdapat tantangan dalam implementasi regulasi, khususnya terkait harmonisasi kebijakan, penegakan hukum, dan efektivitas perlindungan hak-hak ODHA. Penelitian ini menyimpulkan bahwa penguatan peran negara melalui kebijakan hukum yang komprehensif dan berorientasi pada perlindungan hak asasi manusia merupakan prasyarat utama dalam menanggulangi penyebaran dan dampak HIV/AIDS secara berkeadilan.

Abstract

This article examines legal protections for bona fide buyers in informal land transactions, referencing Cirebon District Court Decision Number 59/Pdt.G/2022/PN Cbn as a key legal basis. It focuses on the conflict between the formal land registration regime outlined in Article 19 of Law No. 5 of 1960 and Article 37 of Government Regulation No. 24 of 1997, which mandates a PPAT deed, and the reality of community-based informal transactions. The study employs a normative juridical approach, including legislative, case, and conceptual analyses, along with prescriptive-argumentative methods to interpret the judge's considerations. Findings indicate that the court evaluated the agreement’s validity, the seller's authority, payment status, and the plaintiff’s control over the property as grounds for ratifying the transaction. As a good-faith purchaser, the plaintiff deserves legal protection, making the decision a means to legitimize administrative processes judicially. This ruling promotes substantive justice and legal certainty by updating land registration data and highlights a regulatory gap: protection currently relies on litigation rather than preventive administrative measures. Strengthening administrative legalization procedures for private transactions and establishing normative criteria for good-faith buyers are crucial steps toward achieving just and certain land law in Indonesia.

Abstract

Negara Indonesia adalah negara hukum, di mana yang menjadi Landasan ini ada pada pasal 1 ayat 3 UUD 1945, jadi tidak heran jika hukum merupakan aspek yang sangat penting di dalam bangsa ini salah satunya terkait kecelakaan kerja. Salah satu kecelakaan kerja yang terjadi hingga menyebabkan kematian tenaga kerjanya. Insiden tragis ini terjadi pada saat proses bongkar muat semen, di Pelabuhan I Selatpanjang dibawah naungan PT. Indomakmur Expressindo. Tujuan dari penelitian ini adalah untuk menganalisis pelaksanaan tanggung jawab perdata perusahaan terhadap pekerja yang mengalami kecelakaan pada saat bekerja, ,serta upaya penyelesaiannya terhadap keluarga korban. Dalam penulisan skripsi ini metode penelitian hukum yang digunakan adalah metode pendekatan sosiologis, yaitu suatu pendekatan masalah dengan mengkaji peraturan yang berlaku dibandingkan dengan pelaksanaan ketentuan yang ada pada lapangan. Dalam proses tanggung jawab perdata yang dilakukan, pihak PT. Indomakmur Expressindo menerapkan pencegahan, penanganan serta pertanggungjawaban terhadap keselmatan kesehatan kerja (K3) serta Jaminan Kecelakaan Kerja dari BP Jamsostek.. Penyelesaian perkara yang dilakukan berdasarkan peraturan perundang-undangan yang berlaku.

Abstract

This article analyzes dispute resolution in housing purchase transactions between consumers and a housing developer, focusing on the failure to fulfill consumer rights and the effectiveness of dispute resolution mechanisms. The study aims to identify juridical factors causing disputes and to examine how dispute resolution mechanisms operate in practice. This research employs a sociological legal approach by combining primary data obtained through structured interviews and questionnaires with secondary data derived from legal materials and relevant legal literature. The findings indicate that disputes arise primarily from the developer’s lack of transparency in providing accurate information, financial incapacity to complete housing construction, and absence of good faith in fulfilling contractual obligations. Dispute resolution efforts are predominantly pursued through non-litigation mechanisms such as consultation and negotiation. However, these mechanisms have not produced optimal outcomes due to weak commitment from the developer, differences in interests between the parties, and insufficient government supervision. This study contributes to consumer protection discourse by emphasizing the need for stronger supervision, transparency, and good faith in housing development practices to ensure effective protection of consumer rights.

Abstract

The use of Artificial Intelligence in investment decision-making and corporate financial management constitutes part of the digital transformation in corporate governance, which requires legal certainty regarding the liability of the Board of Directors. While the use of AI has the potential to enhance efficiency and accuracy in business analysis, it simultaneously gives rise to legal risks where decisions generated by AI result in losses to the company.This study aims to analyze directors’ legal liability for corporate financial losses arising from the use of Artificial Intelligence in investment decisions and to examine the application of the Business Judgment Rule and fiduciary duty as forms of legal protection. This research employs normative legal methods using statutory and conceptual approaches, relying on primary, secondary, and tertiary legal materials. The findings indicate that AI does not constitute a legal subject; therefore, liability remains with directors as final decision-makers. The use of AI expands the directors’ duty of care by requiring technological risk awareness and system oversight. Legal protection under the Business Judgment Rule applies when decisions are made rationally, based on adequate information, and free from conflicts of interest. Excessive reliance on AI without critical evaluation may be considered negligence. Accordingly, AI utilization in corporations necessitates stronger fiduciary duty standards and good corporate governance.

Abstract

This article aims to analyze the position and implementation of the principle of Free, Prior, and Informed Consent (FPIC) in forestry business activities that intersect with the rights of indigenous peoples, and examine its relationship with the principles of Good Corporate Governance and the fiduciary obligations of directors in managing legal and social risks. The main issues discussed are the extent to which the national legal system substantively accommodates FPIC and how fragmented norms and weak institutional coordination hinder its implementation in practice. This research uses normative legal research methods with legislative, conceptual, and case study approaches to examine the relationship between international standards, national legal frameworks, and corporate practices in the forestry sector. The main findings indicate that FPIC in the national legal system is still partially constructed and tends to be reduced to a formalistic consultation mechanism, so it does not yet function as a substantive agreement that provides an equal bargaining position for indigenous peoples. This condition is exacerbated by regulatory fragmentation and weak institutional coordination, which leads to a lack of synchronization between the licensing process and the recognition of indigenous territories. This article contributes to strengthening the argument for the need to strengthen legal substance, institutional structures, and legal culture so that corporate governance in the forestry sector is more equitable, sustainable, and respects the rights of indigenous peoples.

Abstract

Asset Takeover (AYDA) constitutes a non-performing loan resolution mechanism recognized in banking practice, including in Rural Credit Banks (BPR). Although normatively permitted, its implementation may raise legal concerns, particularly when collateral is taken over without the debtor’s consent and without proper execution of security rights as regulated by law. This study aims to analyze debtor legal protection against unilateral collateral takeover by a BPR, based on Jember District Court Decision Number 128/Pdt.Bth/2023/PN Jmr, and to examine the application of the principles of legal certainty and good faith in the AYDA mechanism. This research employs normative legal methods using statutory and case approaches. The results of the study show that the legal protection for debtors for collateral taken over by BPR without the debtor's consent is based on the Jember District Court Decision Number 128/Pdt.Bth/2023/PN Jmr and analyzes the application of the principle of legal certainty and the principle of good faith in the AYDA mechanism, especially in the obligation of creditors who act honestly and fairly towards the debtor during the collateral takeover process. In addition,, Such practice also fails to reflect the principle of good faith as mandated under Article 1338 paragraph (3) of the Civil Code. The court decision affirms that creditors’ preferential rights are not absolute and must be exercised in accordance with statutory provisions and justice principles. Therefore, AYDA implementation must ensure transparency, proportionality, and adherence to legal certainty and good faith.
