Abstract

This study examines the application of Regional Regulation No. 11/2012 on road and river boundary lines and evaluates the effectiveness of its sanctions in Cirebon Regency, Indonesia. The issue of illegal buildings violating road and river borders remains prevalent, mainly along Jalan Pilang. This research analyzes how effectively the regulation and its sanctions are implemented to curb these violations. The study employs an empirical juridical approach, using primary and secondary data from field research, document reviews, and interviews. The findings reveal that enforcing sanctions under Regional Regulation No. 11/2012 could be more effective, with numerous illegal structures still encroaching on regulated boundaries. Although supported by legal provisions, the local Government's enforcement efforts face challenges due to community non-compliance and insufficient enforcement mechanisms. The results highlight the need for more vigorous regulatory enforcement and public awareness to uphold spatial planning laws. This study contributes to understanding the complexities of spatial regulations and provides recommendations for enhancing legal compliance in local governance.

Abstract

This study aims to analyze the influence of intellectual capital on financial performance in the banking sector listed on the Indonesia Stock Exchange (IDX), with Return on Assets (ROA) as the leading indicator. Intellectual capital is measured using Value Added Intellectual Coefficient (VAIC), which consists of three components: Value Added Capital Employed (VACA), Value Added Human Capital (VAHU), and Structural Capital Value Added (STVA). The quantitative method is used with secondary data from the annual financial statements of banking companies for the period 2018–2022. The sample consisted of 15 banks selected through the purposive sampling technique. The results of the regression analysis show that VACA, VAHU, and STVA have a significant and positive influence on ROA, which shows that investment in intellectual capital plays a vital role in improving bank profitability. These findings have implications that banks can prioritize human and structural capital development to enhance financial performance. The recommendations of this study include further exploration of the long-term impact of intellectual capital on various economic conditions.

Abstract

In the era of global economic development, the Islamic financial system has emerged as an alternative for various groups who wish to conduct economic activities in accordance with Islamic principles. This study aims to explore how musyarakah contracts are implemented in investment partnerships between investors and businesses in the Islamic financial sector and identify the factors that influence their successful implementation. This research uses a descriptive qualitative approach to understand and analyze the implementation of musyarakah contracts in profit-sharing partnerships in the Islamic financial sector. Primary data was obtained through semi-structured interviews with Islamic business actors, investors, and Islamic finance practitioners. Secondary data were obtained from relevant literature, such as scientific journals, books, and annual reports of Islamic financial institutions. The results show that musyarakah contracts based on the principles of profit sharing and risk sharing provide benefits for both parties. Investors can actively participate in business management with better transparency, while business actors get additional capital to support business expansion. The implementation of musyarakah contracts has shown positive developments in the Islamic financial sector, especially in Indonesia, where regulations and policies have supported the development of sharia-based businesses. However, there are still challenges related to investors' and businesses' understanding of the agreement mechanism, as well as the need for strict supervision to ensure compliance with sharia principles. This research is expected to contribute to the further development of musyarakah contracts in the Islamic finance sector and strengthen the position of Islamic finance in the global market.

Abstract

Cyber terrorism uses information and communication technology to scare individuals or governments. In Indonesia, terrorism-related cyberattacks have increased by 300% in the past year, despite regulations such as the Law on the Eradication of Terrorism and the Law on Electronic Information and Transactions (UU ITE). This legal gap in handling cybercrime requires an effective reconstruction of criminal law. This research aims to analyze the effectiveness of law enforcement against cyber terrorism, identify legal gaps, and provide recommendations for necessary legal reforms. The approach used is normative law, with analysis of the Law on Eradication of Terrorism and ITE Law, as well as case studies to explore challenges in law enforcement. It was found that there are normative gaps in the existing regulations. While the ITE Law and Terrorism Eradication Law provide a legal framework, they do not clearly define cyber terrorism or provide sufficiently strict sanctions. There is a need for regulatory reform to cover aspects of cybercrime. Proposed reforms include a clear definition of cyber terrorism, increased sanctions, and the application of technology in law enforcement. International cooperation and public awareness are also important to create a safe environment. To improve law enforcement against cyber terrorism in Indonesia, comprehensive law reform is needed. Gaps in the ITE Law and Terrorism Eradication Law should be addressed with clear definitions and stricter sanctions, as well as through the use of technology and international cooperation
