Abstract

The COVID-19 pandemic has prompted the Indonesian government to implement large-scale social restrictions (PSBB) to control the spread of the virus. This study aims to analyze the effectiveness of the PSBB policy and the level of public compliance with its implementation. Using a systematic literature search method, which collects and compares differences and similarities from databases such as Google Scholar, indexed journals, the archives of the Indonesian Ministry of Health, and other supporting publications, the analysis shows that the effectiveness of the PSBB has reached a moderate level (a 25%–40% decrease in cases in urban areas), influenced by interagency coordination and law enforcement. However, public compliance remains low (less than 60% in rural areas) due to economic factors, lack of outreach, and low levels of trust in the government. These findings highlight the need for a collaborative approach that enhances public education and economic incentives for similar policies in the future. This research is expected to strengthen public health literacy to enhance social resilience during the COVID-19 health crisis.

Abstract

This study examines the limitations of the application of the Business Judgment Rule in the Karen Agustiawan case concerning the acquisition of the Participating Interest in the Basker Manta Gummy (BMG) Block in Australia by PT Pertamina (Persero). It aims to analyze the concept of state losses from the perspectives of corporate law and corruption law. This research employs a normative legal method using statutory and conceptual approaches. The findings reveal differing interpretations between law enforcement authorities and the Supreme Court in assessing business decisions made by directors of state-owned enterprises. From a corporate law perspective, the Business Judgment Rule provides legal protection for directors who act in good faith, exercise due care, and avoid conflicts of interest. However, losses arising from business decisions in state-owned enterprises are often treated as state losses, creating the potential for criminalization of directors. In its ruling on the Karen Agustiawan case, the Supreme Court emphasized that not all losses suffered by state-owned enterprises constitute state losses but may represent ordinary business risks. The study concludes that the application of the Business Judgment Rule in Indonesia still requires clearer legal parameters to ensure legal certainty and adequate protection for directors in exercising their decision-making authority.

Abstract

This study examines a customary equity-based investment model as an alternative legal framework for partnerships between investors and the Port Numbay Indigenous Community in Jayapura City. It addresses the persistent inequality in investment practices, where customary land is generally treated only as an object of compensation rather than as an equity asset capable of providing sustainable economic benefits to indigenous communities. Using a normative-empirical (socio-legal) approach, the research analyzes statutory regulations, Papua’s Special Autonomy framework, customary land practices, and empirical data collected through interviews with customary leaders, clan representatives, and business actors. Qualitative analysis was conducted using statutory, conceptual, comparative, and case approaches. The findings indicate that existing investment arrangements rely mainly on one-time compensation, which provides limited legal certainty, economic sustainability, and community participation. The proposed model redefines indigenous communities as equity partners with proportional ownership, dividend rights, and participation in investment governance, based on the principles of Free, Prior and Informed Consent (FPIC), equitable benefit-sharing, and legal protection. This model offers a practical legal framework for promoting fair, inclusive, and sustainable investment in Papua.

Abstract

Papua’s Special Autonomy framework was designed to promote democratic, participatory, accountable, and welfare-oriented governance, particularly for Indigenous Papuans. However, its implementation in Jayapura City has not yet produced substantive public participation due to ineffective regulatory implementation, limited institutional and human resource capacity, inadequate legal literacy, and weak stakeholder coordination and assistance. This study analyzes the role of legal strengthening in optimizing public participation and formulates a legal strengthening strategy for Special Autonomy governance in Jayapura City. Using a qualitative approach grounded in a pragmatist paradigm, the study integrates Administrative Law and the Theory of Planned Behavior. Primary data were obtained through an in-depth interview with a member of the Papua Special Autonomy Development Acceleration Steering Committee, while secondary data came from legislation, policy documents, and scholarly literature. Data were analyzed using the interactive model of Miles, Huberman, and Saldaña. The findings show that participatory channels exist through the Papuan People’s Assembly, Indigenous forums, women’s and religious organizations, and political representation, but their influence on decision-making remains limited. The study proposes a collaborative governance-based legal strengthening model integrating regulatory reform, institutional strengthening, human resource development, legal literacy and assistance, transparency, accountability, and stakeholder collaboration to transform procedural participation into substantive participation.

Abstract

The placement of Indonesian National Police (Polri) members in certain civilian positions raises legal issues due to differences between Law Number 2 of 2002 concerning the National Police and Law Number 20 of 2023 concerning the State Civil Apparatus (ASN). This study aims to analyze the position of Polri members in civilian positions under these laws and examine the implications of Constitutional Court Decision Number 114/PUU-XXIII/2025. This research uses a normative legal method with statutory, conceptual, and case approaches. Legal materials were collected through literature review and analyzed qualitatively using deductive methods. The results show that the Police Law restricts active Polri members from holding positions outside the police institution, while the ASN Law allows placement in certain ASN positions based on competence, professionalism, and the merit system. The Constitutional Court Decision affirms these limitations by declaring the phrase regarding assignments from the Chief of Police in the Elucidation of Article 28 paragraph (3) of the Police Law unconstitutional and legally invalid. This decision strengthens civilian supremacy, limits police officers’ mobility in civilian positions, reinforces the merit system, and highlights the need for regulatory harmonization to ensure legal certainty and bureaucratic professionalism.

Abstract

The occupation of protected forest land by individuals through land ownership certificates creates a complex legal problem because it intersects forestry law, land registration, prosecutorial intelligence, and the doctrine of state asset recovery. Protected forest areas are not merely administrative objects but ecological public assets whose function is connected to water regulation, erosion control, flood prevention, and the protection of public welfare. This article aims to analyze the legal framework governing protected forests, the position of land certificates issued over protected forest areas, the role of prosecutorial intelligence in detecting and supporting the recovery of state assets, and the structural and substantive barriers that hinder recovery efforts. The research applies a normative juridical method supported by empirical orientation through a case-based reading of the emergence of individual ownership claims over protected forest land in the Sambas/Pemangkat context. The analysis shows that prosecutorial intelligence may play a strategic role in early detection, data collection, legal mapping, asset tracing, interagency coordination, and prevention of further transfer or exploitation. However, its role must be framed as support for lawful recovery rather than direct land execution. The main barriers include fragmented authority, sectoral ego, non-integrated forest and land data, limited technical capacity, and the absence of a comprehensive non-conviction based asset forfeiture mechanism. The article proposes an integrated forest-land asset recovery model based on synchronized geospatial data, legal audit of certificates, interagency protocols, temporary object security, and ecological restoration. This model is expected to strengthen legal certainty, protect state assets, and support environmental justice.

Abstract

The background of this study is the enactment of Law Number 3 of 2025 concerning the Indonesian National Armed Forces (TNI), which provides an opportunity for active TNI personnel to occupy certain positions within the State Civil Apparatus (ASN), supported by Law Number 20 of 2023 concerning the State Civil Apparatus. This study aims to analyze the regulation of TNI personnel under the 1945 Constitution of the Republic of Indonesia and the legal implications of the presence of TNI personnel in certain ASN positions for the guarantee of civil liberties. This study employs a normative legal research method using statutory, conceptual, and historical approaches. Legal materials were obtained through library research supported by interviews with the Commission for Missing Persons and Victims of Violence. The results indicate that the position of the TNI within Indonesia’s constitutional system is regulated under Article 30 paragraph (3) of the 1945 Constitution as an instrument of national defense. The presence of TNI personnel in certain ASN positions has implications for the potential occurrence of dual loyalty, weakening of civilian supremacy, disruption of the ASN merit system, and potential restrictions on civil liberties. Therefore, the appointment of active TNI personnel to civilian positions must consider the principles of the rule of law, democracy, and civilian supremacy. This study concludes that the involvement of the TNI in certain ASN positions may be unconstitutional if it obscures the position of the TNI as an instrument of national defense and expands its role into the civilian sphere.

Abstract

The rapid development of Artificial Intelligence has enabled the creation of deepfake pornography by manipulating a person’s face, voice, or image without consent. This practice threatens privacy, dignity, reputation, and the psychological condition of victims, while Indonesian law has not yet regulated it explicitly. This study analyzes the forms of legal protection for victims of Artificial Intelligence-based pornographic crimes and the legal measures available to restore their reputation. The research uses a doctrinal method by examining legislation, legal principles, books, scientific articles, and other relevant legal materials through qualitative analysis. The findings show that the Pornography Law, the Electronic Information and Transactions Law, the Personal Data Protection Law, the Sexual Violence Crimes Law, and the Criminal Code can serve as legal bases, but their provisions remain fragmented and require extensive interpretation. Victims may receive preventive and repressive protection, including content removal, legal assistance, psychological rehabilitation, restitution, and the right to be forgotten. However, weak digital forensic capacity, delayed content removal, social stigma, and the absence of specific Artificial Intelligence regulation limit effective recovery. Legal reform must therefore clarify prohibited conduct, responsibility, platform obligations, and integrated victim recovery.

Abstract

The phenomenon of illegal investment in Indonesia continues to increase and causes significant losses to the public. The rise of investment fraud schemes, such as Ponzi schemes and unauthorized offerings, demonstrates the weakness of early detection and the state's delay in taking preventive and repressive measures. This delay directly impacts the legal standing of victims, who often lack adequate protection in criminal, civil, and administrative proceedings. This study aims to analyze the legal standing of victims of illegal investment, the forms of legal protection available, and the state's responsibility for delays in supervision and law enforcement. The research method uses a normative juridical approach by examining laws and regulations, court decisions, and relevant literature. The results indicate that victims are in a weak position due to the lack of specific regulations regarding the recovery of illegal investment losses and the suboptimal mechanisms for restitution, compensation, and oversight by relevant authorities such as the Financial Services Authority (OJK), the Investment Alert Task Force, and the police. This study recommends strengthening legal instruments, establishing a victim restitution fund, and accelerating state action as a form of constitutional responsibility in providing protection to citizens. Thus, legal protection for victims of illegal investment can be realized effectively and fairly.

Abstract

This paper discusses the comparison of criminal law enforcement in copyright protection between Indonesia and Singapore. In the era of the digital economy, the importance of copyright for creators over their works is crucial in forming the basis of incentives for innovation and creative investment. Copyright violations are becoming increasingly complex due to the ease of digital content piracy across countries, which requires an effective law enforcement reform system. The aim of this research is to analyze criminal law regulations, the implementation of law enforcement, and identify similarities and differences between the two countries in providing copyright protection. The research method used in this study is normative juridical with a comparative law approach, which examines legislation, doctrines, and international instruments such as the Berne Convention and the TRIPS Agreement. Research shows that Indonesia has a legal basis for copyright protection through Law Number 28 of 2014 on Copyright. Still, law enforcement tends to be reactive and faces challenges in resources, inter-agency coordination, and public legal awareness. On the other hand, Singapore, with its common law system, applies a proactive approach, quick law enforcement through fast-track litigation, and effective collaboration between legal institutions and digital service providers. Although both countries share the same commitment to copyright protection, Singapore demonstrates higher effectiveness in carrying out criminal law enforcement. This study concludes that Indonesia needs to strengthen the capacity of its officials, improve cross-sector cooperation, and raise public awareness to achieve a more optimal legal protection system.
