Abstract

Divorce is one of the reasons for the breaking of the binding rope between husband and wife. Divorce occurs due to the disharmony of the relationship between husband and wife in carrying out their rights and obligations in a family. The existence of divorce does not mean the release of the husband's responsibility to provide for the ex-wife. There are still some obligations of the husband to provide for his wife after the breakup of divorce, according to applicable regulations. The rights of wives after divorce are regulated by Law Number 1 of 1974 and the compilation of Islamic law in the form of Iddah, mut'ah, madhiyah, hadhanah, and children. This applies not only to divorce cases but also to lawsuit divorces. The purpose of this study is to determine the judge's decision that accommodates the rights of wives after divorce in divorce cases. As well as what rights are imposed on the husband. This research method uses qualitative methods that are more devoted to field research, namely research whose object is a judge's decision that accommodates the rights of wives after divorce in divorce cases. The results showed that out of 237 divorce cases, only 28 rulings gave wives post-divorce rights. The decision of the judge of the Padang Panjang Religious Court regarding women's rights is concluded as follows: (1). There are still divorce cases with vertex judgements that do not contain the rights of wives because the judge only decides cases by the material of the lawsuit, so the judge does not (2). Not all divorce cases accommodate claims regarding their rights as wives. Although judges have ex oficio rights in determining the rights of women (wives), whether requested or unsolicited, the judges of the Padang Panjang Religious Court exercise their rights ex oficio to punish husbands for providing iddah, mut'ah, and past income according to ability and eligib ility.Perceraian merupakan salah satu sebab putusnya tali pengikat antara suami dan isteri. Perceraian terjadi akibat tidak harmonisnya hubungan antara suami dan istri dalam menjalankan hak dan kewajibannya di dalam sebuah keluarga. Adanya perceraian bukan berarti lepasnya tanggung jawab suami untuk memberikan nafkah kepada mantan Istri. Masih ada beberapa kewajiban suami untuk memberikan nafkah kepada sang istri pasca putusnya perceraian menurut ketentuan yang berlaku. Hak istri pasca perceraian yang diatur oleh Undang-undang Nomor 1 Tahun 1974 dan kompilasi hukum Islam berupa nafkah Iddah, mut'ah, nafkah madhiyah, hadhanah dan nafkah anak. Hal ini berlaku tidak hanya untuk perkara cerai talak, tetapi juga cerai gugat. Tujuan dari penelitian ini adalah untuk mengetahui keputusan hakim yang mengakomodir hak istri pasca perceraian dalam perkara cerai gugat. Serta hak-hak apa saja yang dibebankan kepada suami. Metode penelitian ini menggunakan metode kualitatif yang lebih dikhususkan pada penelitian lapangan, yaitu penelitian yang objeknya adalah putusan hakim yang mengakomodir hak-hak istri pasca perceraian dalam perkara cerai gugat. Hasil penelitian menunjukkan bahwa dari 237 perkara cerai gugat hanya 28 putusan yang memberikan hak-hak istri pasca perceraian. Putusan hakim Pengadilan Agama Padang Panjang mengenai hak-hak perempuan, disimpulkan sebagai berikut: (1). Kasus perkara cerai gugat dengan putusan verstek masih ada yang tidak memuat hak-hak istri, karena hakim hanya memutuskan perkara sesuai dengan materi gugatan sehingga hakim tidak (2). Kasus perkara cerai gugat belum semua yang mengakomodir gugatan mengenai haknya (istri). Meskipun hakim memiliki hak ex oficio dalam menentukan hak-hak perempuan (istri) baik diminta maupun tidak diminta, namun hakim Pengadilan Agama Padang Panjang menggunakan haknya secara ex oficio menghukum suami untuk memberikan nafkah iddah, mut'ah, dan nafkah lampau sesuai dengan kemampuan dan kelayakan.

Abstract

This research aims to analyse the fulfilment of the rights of female teachers in educational institutions based on Law Number 13 of 2003, known as labour law. The goal is to see the extent to which educational institutions step in to understand and implement the law as stipulated by the government. Previous research did not discuss the fulfilment of women's rights in the field of education. The majority of existing research is carried out in companies, so the position of women teachers in the field of education tends to be forgotten. The method used in this research is qualitative research with data collection techniques in the form of observation and interviews. The results found that Prof. Hamka Maninjau Islamic Boarding School has fulfilled the rights of female teachers as well as possible. It can be seen from the form of leave and facilities provided for teachers who still have children who are still breastfeeding.Penilitian ini bertujuan untuk menganalisis pemenuhan hak-hak guru perempuan di lembaga pendidikan berdasarkan Undang-Undang nomor 13 tahun 2003 yang dikenal dengan undang-undang ketenagakerjaan. Tujuannya adalah melihat sejauh mana langkah lembaga pendidikan dalam memahami dan melaksanakan undang-undang tersebut sebagaimana yang telah ditetapkan oleh pemerintah. Penelitian terdahulu tidak banyak membahas mengenai pemenuhan hak pekerja perempuan dibidang pendidikan. penelitian yang ada mayoritas dilaksanakan di perusahaan-perusahaan sehingga posisi guru perempuan di bidang pendidikan cenderung terlupakan. Metode yang digunakan dalam penelitian ini adalah penelitian kualitatif dengan teknik pengumpulan data berupa observasi serta wawancara. Hasil yang ditemukan bahwa Pondok Pesantren Prof. Hamka Maninjau telah memenuhi hak-hak guru perembuan dengan sebaik-baiknya. Terlihat dari bentuk cuti dan kemudahan yang diberikan bagi guru yang masih memiliki anak yang masih ASI.

Abstract

Many women continue to face cases of sexual abuse in biological relationships between husband and wife, sometimes known as marital rape. This phenomenon is often considered taboo to be discussed, conveyed, and addressed. So in turn, the phenomenon of marital rape becomes a problem that cannot be resolved immediately. In particular, the main question in this research is how Islamic law views the phenomenon of marital rape in husband-and-wife relations and whether the urgency of sexual consent from the mubadalah perspective is a step to prevent marital rape. This research is included in the category of library research with a qualitative approach, data collection techniques with documentation types, data processing techniques with descriptive-analytic methods, and an analytical framework with mubādalah theory. The results of this study show that the act of marital rape due to unequal sexual relations between husband and wife is part of an act of violence, both physically and psychologically. Islam prohibits sexual intercourse through coercion and violence. Husband-wife relationships in any condition must have an element of pleasure from each party, meaning that there should be no coercion from both. Thus, sexual consent education needs to be pursued to become a preventive spirit and safe behaviour for instilling a foundation of mutual respect between individuals. This is expected to pave the way for married couples to enjoy a healthy and happy relationship for both parties.masih banyak dialami oleh perempuan. Fenomena ini sering dianggap tabu untuk dibicarakan, disampaikan dan disikapi. Sehingga pada gilirannya fenomena marital rape menjadi permasalahan yang tidak segera ditanggulangi. Secara spesifik, pertanyaan utama dalam penelitian ini ialah bagaimana hukum Islam memandang fenomena marital rape dalam hubungan suami istri dan bagaimana urgensi sexual consent perspektif mubadalah sebagai upaya preventif terjadinya martial rape. Kajian ini termasuk pada kategori penelitian kepustakaan dengan pendekatan kualitatif, teknik pengumpulan data jenis dokumentasi, teknik pengolahan data dengan metode deskriptif-analisis, dan kerangka analisa dengan teori mubādalah. Hasil dari penelitian ini adalah bahwa tindakan marital rape akibat hubungan seksual yang tidak seimbang antara suami istri merupakan bagian dari tindakan kekerasan, baik secara fisik maupun psikis. Islam melarang hubungan seksual dengan paksaan dan kekerasan. Hubungan suami istri dalam kondisi apapun harus ada unsur kesenangan dari masing-masing pihak, artinya tidak boleh ada unsur paksaan dari keduanya. Dengan demikian, pendidikan sexual consent perlu diupayakan guna menjadi semangat preventif dan safe behaviour dalam menanamkan landasan saling menghargai antar individu. Hal ini diharapkan mampu membuka jalan untuk pasangan suami istri agar dapat menikmati hubungan yang sehat dan membahagiakan bagi kedua belah pihak.

Abstract

The role of women in development is very significant from a social, cultural, and economic perspective. The existence of women has an important role in both the family and society. This study aims to analyze the role of women Kaili business actors in the Palu City Forest in providing family economic strengthening from a social and cultural perspective. This study was designed using a quantitative approach. The population of this research is Kaili women who have businesses in the Palu City Forest. The sample of this research is women Kaili business actors in the Palu City Forest, with a total of 183 respondents. Data collection techniques consist of observation, questionnaires, and documentation. Data analysis uses descriptive statistical analysis. The results of the study show that women Kaili business actors in the Palu City Forest play a role in encouraging the strengthening of the family economy. From a social perspective, women Kaili business actors have a high level of social bounding, which is indicated by the kinship of women Kaili with other families that creates empathy and togetherness. This can also encourage the strengthening of the family economy. Meanwhile, from a cultural perspective, the level of inequality among women Kaili business actors in the Palu City Forest is strongly influenced by culture. This inequality means that women Kaili business actors in the Palu City Forest do not feel competitive and different from other business actors, so they feel relaxed in doing business and have an impact on strengthening the family economy.Peran perempuan dalam pembangunan sangat signifikan dilihat dari sudut pandang sosial, budaya, dan ekonomi. Keberadaan perempuan mempunyai peranan penting baik dalam keluarga maupun masyarakat. Penelitian ini bertujuan untuk menganalisis peran perempuan pelaku usaha Kaili di Hutan Kota Palu dalam memberikan penguatan ekonomi keluarga dari segi sosial dan budaya. Penelitian ini dirancang dengan menggunakan pendekatan kuantitatif. Populasi penelitian ini adalah ibu-ibu Kaili yang mempunyai usaha di Hutan Kota Palu. Sampel penelitian ini adalah perempuan pelaku usaha Kaili di Hutan Kota Palu yang berjumlah 183 responden. Teknik pengumpulan data terdiri dari observasi, angket, dan dokumentasi. Analisis data menggunakan analisis statistik deskriptif. Hasil penelitian menunjukkan bahwa perempuan pelaku usaha Kaili di Hutan Kota Palu berperan dalam mendorong penguatan perekonomian keluarga. Dari segi sosial, perempuan pelaku usaha Kaili mempunyai tingkat ikatan sosial yang tinggi, ditandai dengan kekerabatan perempuan Kaili dengan keluarga lain sehingga menimbulkan rasa empati dan kebersamaan. Hal ini juga dapat mendorong penguatan perekonomian keluarga. Sedangkan dari segi budaya, tingkat ketimpangan di kalangan perempuan pelaku usaha Kaili di Hutan Kota Palu sangat dipengaruhi oleh budaya. Ketimpangan tersebut membuat perempuan pelaku usaha Kaili di Hutan Kota Palu tidak merasa kompetitif dan berbeda dengan pelaku usaha lainnya, sehingga merasa santai dalam berusaha dan berdampak pada penguatan perekonomian keluarga.

Abstract

Supreme Court Circular (SEMA) No. 3 of 2018 has effectively eliminated the possibility of granting requests for marriage registration in cases of polygamous marriages based on unregistered unions. This provision raises concerns about its potential to create various problems, particularly in relation to the protection of women and children. This research aims to analyze the issues arising in marriage law following the issuance of SEMA No. 3 of 2018 and its relevance to the protection of women and children, as well as the regulation of itsbat nikah (marriage legalization) for sirri polygamous marriages from the perspective of maqashid sharia. The study employs a library research methodology, utilizing secondary data sources. The data were collected through literature reviews and analyzed using qualitative data analysis methods. The findings indicate that the regulation of itsbat nikah for sirri polygamous marriages under SEMA No. 3 of 2018 aligns with the principles of protecting women and children. This regulation was introduced to uphold the core values enshrined in Indonesia’s marriage laws. From the perspective of maqashid sharia, the provisions in SEMA No. 3 of 2018 correspond to the objectives of maqashid in preserving maslahah (public interest) at the dharuriyat level, particularly in safeguarding religion, lineage, and property.

Abstract

This research aims to explore the exploration of spirituality, gender equality, minority rights in the context of Islamic education, and the integration of spirituality. This research uses a qualitative approach, and data collection techniques, namely interviews and document analysis. Qualitative data was analyzed using a thematic analysis approach by triangulating the data to increase validity. The research results show that the role of spirituality in education is the main pillar in forming a holistic individual. The integration of spiritual values in the curriculum forms students who are academically intelligent and morally responsible. Spirituality gives rise to empathy, tolerance, and justice, forming the basis of positive character. Spirituality-based Islamic education guides students to understand themselves and their environment in depth. Gender equality challenges involve unequal access and gender-based violence. Women's involvement in decision-making needs to be increased. Public awareness and policy support are key to creating a just society. Gender equality initiatives in Islamic education emphasize equal access and the development of social skills. Identification of minority rights demands recognition of language, culture, and protection of fundamental rights. Steps towards inclusive education include awareness, policy changes, human resource development, parental involvement, and continuous evaluation. The integration of spirituality, gender equality, and minority rights creates an inclusive and holistic system, empowering all learners. Penelitian ini bertujuan untuk mengetahui eksplorasi spiritualitas, kesetaraan gender, hak minoritas dalam konteks pendidikan Islam, dan integrasi spiritualitas. Penelitian ini menggunakan pendekatan kualitatif, teknik pengumpulan data, yaitu wawancara dan analisis dokumen. Data kualitatif dianalisis menggunakan pendekatan analisis tematik dengan melakukan triangulasi data untuk meningkatkan validitas. Hasil penelitian menunjukan bahwa Peran spiritualitas dalam pendidikan menjadi pilar utama membentuk individu holistik. Integrasi nilai-nilai spiritual dalam kurikulum membentuk siswa cerdas secara akademis dan bertanggung jawab moral. Spiritualitas memunculkan empati, toleransi, dan keadilan, membentuk dasar karakter positif. Pendidikan Islam berbasis spiritualitas memandu siswa memahami diri dan lingkungan secara mendalam. Tantangan kesetaraan gender melibatkan ketidaksetaraan akses dan kekerasan berbasis gender. Keterlibatan perempuan dalam pengambilan keputusan perlu ditingkatkan. Kesadaran masyarakat dan dukungan kebijakan kunci dalam menciptakan masyarakat adil. Inisiatif kesetaraan gender dalam pendidikan Islam menekankan akses setara dan pengembangan keterampilan sosial. Identifikasi hak minoritas menuntut pengakuan bahasa, budaya, dan perlindungan hak fundamental. Langkah menuju pendidikan inklusif mencakup kesadaran, perubahan kebijakan, pengembangan sumber daya manusia, keterlibatan orang tua, dan evaluasi terus-menerus. Integrasi spiritualitas, kesetaraan gender, dan hak minoritas menciptakan sistem inklusif dan holistik, memberdayakan semua peserta didik.

Abstract

This article focuses on the face of women in Levinasian face ethics. The author raises issues related to the increasing phenomenon of violence against women in Indonesia. This fact shows that women in Indonesia are still neglected. According to Levinasian face ethics, this paper intends to criticize the problems that occur from a philosophical point of view. The method of discussion of this paper is a critical analysis of cases of violence against women in the household in the light of Levinasian face ethics. Forms of violence against women in Indonesia are strongly influenced by a patriarchal culture that places the position and status of men above women. This cultural model opens up space for male superiority over women. The concept of Levinasian face ethics is an effective tool in minimizing acts of violence against women in the household. The author arrives at the finding that the root of the problem behind the rampant cases of domestic violence in Indonesia is the failure to understand the existence of women and weak law enforcement. Levinas' ethics of responsibility provide new treasures for understanding Indonesian society, namely that the existence of women is part of everyone's responsibility. A woman's face is how "she" shows herself. I came to the finding that the presence of women in the order of living together demands my responsibility, which is none other than respect for her. It is a form of engagement for the well-being and peaceful lives of others.

Abstract

This research explores the strategic role of female teachers in encouraging female students to take leadership roles and participate actively in school. Although female students often face barriers such as gender stereotypes, social pressure, and lack of support, female teachers have the potential to overcome these challenges through a variety of strategies. This study highlights how female teachers can be inspirational role models, create inclusive learning environments, and provide positive and constructive feedback. In addition, through the integration of gender equality education in the curriculum, class discussions, seminars, mentoring programs, and the provision of educational resources, female teachers can increase female students' awareness and understanding of their rights and the importance of gender equality. The research method used in this research is library research with an approach that involves collecting and analysing information from various existing written sources. The results showed that support and guidance from female teachers not only increased female students' self-confidence and motivation but also equipped them with leadership skills that are important for future success. Thus, this research emphasises the important role of female teachers in empowering women in the educational environment, as well as their contribution to creating a more just and equal society.

Abstract

This paper examines the relationship patterns of extremist married couples in Indonesia. The analysis was carried out using the descriptive analysis method on the data collected through literature searches by utilising previous research reports from certain agencies and mass media reports related to convicted extremist couples in Indonesia. The results showed that there were two patterns of relationships formed between husband-and-wife terrorist couples. In the early phase of pre-ISIS (Islamic State of Iraq and Syria) women, the wife played more of a role as a follower of her husband (own property), while in the next phase (ISIS Cluster), there was a shift in the relationship between husband and wife terrorist couples, where the relationship that occurs is senior-junior partner; the wife is not just a follower but rather actively and independently in making decisions to become part of extremists to terrorists, both as seniors and juniors from their husbands. This shows the changing role of women in acts of terror, in line with changes in the husband-wife relationship of extremist couples. These phenomena can influence each other. The independence that women have begun to show in their involvement in the extremist world requires the state, apparatus, and society to see women from a different perspective. Women are not always the victims of extremist acts in the family.

Abstract

The formation of a generation that has character and upholds Islamic values can only be obtained through education in which there is a learning and teaching process. Islam itself obliges every believer to study, both men and women. The purpose of this study is to examine the philosophical basis and urgency of gender-equal Islamic Religious Education in Indonesia as a means to produce a generation that carries out its role while still emphasizing morality as well as religious values, both men and women, without exception. This research is a qualitative study with data collection techniques using library research methods that utilize and collect various sources of literature to then examine information relevant to the research topic. The results showed that Islam recognizes the same rights between men and women in getting education. Islamic Religious Education philosophically does not only focus on spiritual aspects but also intellectual.
