Abstract

The purpose of this research is to know and analyze Law Enforcement as a Systematic Effort to Preserve the Environment. The research method that I used to complete this article is a normative research method. The data collection method prioritizes legal research with various legal materials through the results of a review of written sources such as documents, books, journals, which are related to legal materials because they are different from the ambiguity of law enforcement in environmental issues. The results of the study say that the legal action given to the perpetrators of environmental pollution and destruction consists of administrative aspects, civil aspects, and criminal aspects. Article 76 (2) Environmental Protection and Management Law No. 32 of 2009 stated that administrative sanctions consist of written warnings, enforcement by the government, freezing of environmental permits and revocation of environmental permits. Regarding the settlement of environmental disputes according to Article 84 of Law no. 32 of 2009, there are two ways to claim compensation and/or environmental cleaning costs, namely environmental dispute resolution outside the court and environmental dispute settlement outside the court

Abstract

Venezuela in recent years has faced a severe decline in economic stability. Causes of the crisis can be attributed to economic mismanagement, over-reliance on oil, corruption and authoritarian rule. These factors have resulted in hyperinflation, poverty, collapsing public services and mass emigration. The effects of the crisis were profound, impacting the welfare of the Venezuelan people and creating a humanitarian emergency. In addition, the crisis has regional implications as neighboring countries grapple with accommodating Venezuela's migrants and refugees. To overcome the crisis, a comprehensive approach is needed, including fiscal discipline, economic diversification, strengthening democracy, and anti-corruption measures. Sound fiscal policies, structural reforms and international cooperation are critical to stabilizing the economy, attracting investment and driving sustainable growth. In addition, protecting vulnerable populations through targeted assistance programs and social safety nets is essential. However, effective solutions require a broader commitment to democratic governance, human rights and social cohesion. Rebuilding trust in institutions, promoting transparency and encouraging citizen participation are critical to long-term recovery.

Abstract

This book discusses the management of natural resources that are prone to conflict, such as the exploitation of mining materials. In this case, usually the parties involved involve several elements such as the community, local government, non-governmental organizations or environmental NGOs, and of course companies that will carry out mining. In this case, of course, to gain profit and the local government supports mining in order to increase regional income. However, in this case it is not in line with the community and environmental NGOs who refuse mining on the grounds that it disrupts the economic well-being of residents from their original livelihoods and ecological damage due to mining activities. This conflict has frequently occurred in Indonesia since 1999 and has spread to various regions, from Sumatra, Java, Kalimantan, Sulawesi, Nusa Tenggara to Papua. Gold mining in Papua by 2 Agrarian Conflicts in Urutsewu: Political Ecology Approach PT Freeport Indonesia, for example, is one of the causes of the prolonged conflict. The trigger for this conflict is not only about the welfare of local people who are being ignored by the government and PT Freeport Indonesia. Even deeper, the conflict is also rooted in environmental damage due to the dredging of Mount Ersberg's gold deposit.

Abstract

The right to life and the right to welfare are two human rights that are often violated because of problems that hinder their protection and settlement in mining areas. Disputes arise when mining companies operate in an area, leading to social discord. How are mining permits issued in Indonesia? is the question posed at the heart of this thesis. and How does the law protect local residents from harm in mining areas? Philosophical strategies and enactment of moral laws are used in this research. Permits to operate mining companies in Indonesian territory are granted through a Mining Concession Work Agreement (PKP2B). Mining Business Permits (IUP), People's Business Permits (IUR), and Special Mining Business Permits (IUPK) are the three types of mining permits available in Indonesia. So that local communities and mining companies can work together and supervise each other, preemptive legal protection in the form of granting rights to local communities to manage and employ minerals and coal as well as the obligation to protect the ecosystem. Mining companies must be aware of their rights over natural resources, including dues, land payments, and reimbursement for the direct impacts of mining, even though an oppressive form of legal protection is that mining must be carried out on customary lands of indigenous peoples.
