Abstract

This research examines the acculturation of ring exchange culture in the mappettu ada tradition carried out by the Cempa community of Pinrang Regency with the problems in the research, namely, First, how is the acculturation of the ring exchange culture in the mappettu tradition in Cempa Pinrang Regency? Second, what is the practice of exchanging rings at the mappettu event in Cempa, Pinrang Regency? Third, what is the review of Islamic law regarding exchanging rings at the mappettu event in Cempa, Pinrang Regency?This research is a type of field research using a normative approach that is descriptive qualitative in nature. The data collection techniques that the author uses are observation and interview techniques.The research results show that: (1) Exchanging rings at the mappettu event is a cultural acculturation process influenced by external factors (Western culture) which is imitated by the Bugis community in Cempa which brings the bride and groom together. (2) In the practice of exchanging rings at the mappettu event in Cempa, Pinrang Regency, namely with the development of modern times, the exchange of rings is carried out like a party by decorating the room, the bride and groom put rings on each other. gold ring directly on the left ring finger. (3) Judging from Islamic law, the practice of exchanging rings is not in accordance with the Shari'a where in practice there are elements between the prospective groom and the prospective bride touching each other when pairing the rings. Abstract

Abstrak: Tradisi i membahas tentang tradisi erang-erang. Penelitian ini terdiri dari tiga rumusan masalah; 1). untuk memahami konteks sosial tradisi erang-erang dalam perkawinan masyarakat Bugis di Kecamatan Mallusetasi Kabupaten Barru, 2). untuk memahami makna simbolik tradisi erang-erang dalam perkawinan masyarakat Bugis di Kecamatan Mallusetasi Kabupaten Barru, 3). Untuk memahami perspektif maslahah terhadap tradisi erang-erang di Kecamatan Mallusetasi Kabupaten Barru. Jenis penelitian yang digunakan dalam penelitian ini adalah jenis penelitian lapangan atau Field Research, dengan pendekatan sosiologis dan historis, yaitu pendekatan yang dibutuhkan untuk memahami secara sosial kemasyarakatan dan menganalisa sumber melalui cerita masa lampau. Sumber data yang digunakan yaitu data primer, yaitu data yang diperoleh langsung dari hasil wawancara dengan narasumber yang mana dalam hal ini adalah tokoh masyarakat dan masyarakat biasa. Data sekunder yaitu data yang diperoleh dari buku, dokumen, dan jurnal/skripsi penelitian terdahulu yang mempunyai kaitan dengan penelitian ini. Adapun teknik analisis data yaitu terdiri dari reduksi data, penyajian data, dan verifikasi/penarikan dan kesimpulan. Hasil penelitian menunjukan bahwa: 1) Prakti tradisi erang-erang bukan hanya simbol pertukaran materi, tetapi juga lambang komitmen dan persetujuan antar keluarga dalam pernikahan Bugis, mencerminkan kekayaan budaya dan komitmen untuk merayakan persatuan. 2) Dalam perkawinan Bugis, penyerahan erang-erang melibatkan simbolisme kompleks yang merefleksikan dinamika hubungan antar keluarga, menguatkan struktur sosial, dan mencerminkan norma-norma gender. 3) Kemaslahatan menyoroti pencapaian kesejahteraan dan kepentingan umum di masyarakat yang melibatkan lima asas hukum syara’ yakni pemeliharaan agama, jiwa, akal, keturunan, dan harta yang harus dijaga dengan sungguh-sungguh. kelima unsur tersebut merupakan inti dari kemaslahatan dan menjadi tujuan dari syariat itu sendiri. Sebaliknya, hal-hal yang tidak melibatkan kelima unsur pemeliharaan tersebut, akan diklasifikasikan sebagai mafsadah atau kerusakan Kata Kunci: Praktik Sosial; Erang-erang; Maslahah Abstrak: This thesis research discusses the erang-erang tradition. The research consists of three problem formulations: 1) to understand the social context of the erang-erang tradition in Bugis community weddings in the Mallusetasi Sub-District, Barru District, 2) to comprehend the symbolic meaning of the erang-erang tradition in Bugis community weddings in the Mallusetasi Sub-District, Barru District, 3) to understand the perspective of maslahah (benefit/utility) towards the erang-erang tradition in the Mallusetasi Sub-District, Barru District. The research method used in this study is field research or Field Research, with a sociological and historical approach necessary to understand societal aspects and analyze sources through historical narratives. The primary data source is obtained through interviews with informants, including community figures and ordinary people. Secondary data includes information from books, documents, and previous research papers or theses related to this study. Data analysis techniques include data reduction, data presentation, and verification/extraction of conclusions. The research findings indicate that: 1) The practice of the erang-erang tradition is not just a symbol of material exchange but also represents commitment and agreement between families in Bugis marriages, reflecting cultural richness and a commitment to celebrating unity. 2) In Bugis weddings, the presentation of erang-erang involves complex symbolism reflecting the dynamics of family relationships, strengthening social structures, and reflecting gender norms. 3) Maslahah highlights the achievement of well-being and common interests in society involving five principles of Sharia law: the preservation of religion, life, intellect, lineage, and wealth, which must be safeguarded diligently. These five elements are the essence of maslahah and serve as the goals of Sharia itself. Conversely, matters not involving the preservation of these five elements are classified as mafsadah or harm. Abstract

The purpose of this research is to study the Istinbat system of the Indonesian Ulema Council (MUI), Nahdlatul Ulama (NU), and Muhammadiyah. This research is a qualitative research, the type of research is library research. The data collection method is literature review. The results showed that; Istinbat method of the Fatwa Commission of the Indonesian Ulema Council (MUI) refers to the Qur'an, Hadith, consensus, Qiyas and other legal arguments. In its fatwa, the MUI also does not reject other legal arguments that are not debated by the ulama, such as: istihsan, istishab, sad al-dzari'ah, and other arguments that are still disputed by scholars. The Istinbat method of Nahdatul Ulama Bahtsul Masail Institute implements the concept that Istinbat is not taken directly from the original source, namely the Qur'an and Hadith. However, the extraction of the law is done by dynamically mentatbiqkan (harmonizing) the texts expressed in the book in the context of the problem for which the law is sought. Meanwhile, the istinbat method of tarjih and tajdid assembly refers to the benefit as a priority benchmark without ignoring sociological and anthropological aspects. And in istinbat not bound to a particular school of fiqh.

Abstract

This study examines the penne anreang tradition in Bugis wedding ceremonies in Suppa District, Pinrang Regency, focusing on its philosophical significance and compatibility with Islamic law. The research aims to describe the implementation of penne anreang, analyze its symbolic and philosophical meanings, and assess its position within the frameworks of ‘urf shahih and mashlahah mursalah. A qualitative methodology was employed through participant observation and in-depth interviews with cultural leaders, religious figures, and practitioners, followed by thematic analysis to identify embedded social and religious values. The findings reveal that penne anreang functions as a symbol of marital responsibility, reinforcing values such as unity, humility, and mutual support. It qualifies as ‘urf shahih because it aligns with Islamic legal principles while simultaneously strengthening social cohesion. However, younger generations increasingly perceive the practice as mere formality, threatening the loss of its philosophical essence. This study contributes to broader debates on Islamic law and legal pluralism by demonstrating how local customs can be integrated with Sharia without eroding cultural identity. The findings underscore the importance of intergenerational education to sustain the philosophical values of local traditions in the face of modernization.

Abstract

This study aims to examine the ipalai tapi' tradition in marriage in Suppa District, Pinrang Regency, and analyze it from the perspective of Islamic law. This research employs field research methods with a qualitative descriptive approach. Primary data were obtained through observation, interviews with the community and cultural figures, and documentation. Secondary data were obtained from archives, journals, and previous studies. The findings indicate that the ipalai tapi' tradition emerged as a response to the high divorce rate and other household issues, functioning as a symbol and prayer to protect the newlyweds' household from undesirable matters. The ipalai tapi' process is carried out after the marriage contract, using a tapi' cloth that is draped over the bride and groom and then sewn by a community or family elder, symbolically binding the couple to ensure a lasting relationship. The Islamic legal analysis categorizes this tradition as al-urf shohih, which means permissible customs.This study recommends that the ipalai tapi' tradition be maintained and preserved as part of local culture that does not contradict Islamic teachings.

Abstract

This study examines the Mabbarazanji tradition in post-wedding ceremonies within the Bugis community of Kandiawang, South Sulawesi, through the lens of Islamic legal philosophy. As a locally rooted religious practice, Mabbarazanji encapsulates collective recitations, symbolic offerings, and communal participation that transcend its ritualistic function to embody cultural identity and spiritual values. The research aims to explore how the tradition is practiced, perceived by the community, and positioned within the framework of ‘urf (custom) and maqāṣid al-sharī‘ah (objectives of Islamic law). Employing a qualitative fieldwork design, data were gathered over two months through participant observation, semi-structured interviews with religious and cultural leaders, and documentation of the ceremony. Thematic analysis revealed that Mabbarazanji is not only considered a sacred obligation but also a medium for transmitting ethical values such as unity, loyalty, and gratitude. Symbolic items—such as sticky rice, bananas, and eggs—convey culturally embedded meanings that align with Islamic virtues. The discussion situates Mabbarazanji as a case of dynamic religious embodiment, where local tradition and Islamic legal principles coexist. While generational disengagement poses challenges to its continuity, the ritual’s alignment with sharī‘ah norms and its capacity to promote social cohesion underscore its theological and cultural legitimacy. This study contributes to the discourse on the integration of local customs within Islamic jurisprudence and highlights the role of vernacular ritual in preserving ethical traditions in the face of modern transformation.

Abstract

Penelitian ini membahas penerapan kaidah fiqih "darurat tidak membatalkan hak orang lain" dalam konteks akad jual beli dan akad pinjam-meminjam. Kaidah ini menegaskan bahwa keadaan darurat yang dialami seseorang tidak boleh merugikan atau menghilangkan hak pihak lain yang terlibat dalam suatu akad. Kajian ini menggunakan pendekatan normatif dengan analisis terhadap teks-teks hukum Islam klasik dan modern. Dalam akad jual beli, keadaan darurat, seperti kebutuhan mendesak untuk menjual barang di bawah harga pasar, harus tetap memperhatikan prinsip keadilan bagi kedua belah pihak. Sementara itu, dalam akad pinjam-meminjam, situasi darurat seperti ketidakmampuan pengembalian utang tepat waktu harus diselesaikan tanpa merugikan hak kreditur. Hasil penelitian menunjukkan bahwa kaidah ini memiliki relevansi signifikan dalam menjaga keseimbangan antara kemaslahatan individu dan kepentingan masyarakat, sesuai dengan prinsip keadilan dalam hukum Islam.

Abstract

Pernikahan dalam Islam dinyatakan sah apabila memenuhi rukun dan syarat yang ditetapkan, termasuk pelaksanaan ijab dan qabul. Penelitian ini bertujuan untuk mengeksplorasi pelaksanaan akad nikah dengan ijab qabul bersyarat satu nafas di Kabupaten Nabire. Metode penelitian yang digunakan adalah pendekatan kualitatif deskriptif, dengan pengumpulan data melalui wawancara mendalam dan observasi perilaku masyarakat terkait praktik ijab qabul. Hasil penelitian menunjukkan bahwa meskipun secara hukum Islam tidak ada kewajiban untuk mengucapkan ijab dan qabul dalam satu nafas, masyarakat Kabupaten Nabire memandang hal ini sebagai elemen penting untuk kesempurnaan akad nikah. Saksi pernikahan sering kali meminta pengulangan ijab qabul apabila tidak dilakukan dalam satu nafas, mencerminkan kuatnya pengaruh norma sosial dan budaya dalam praktik tersebut. Penelitian ini merekomendasikan sosialisasi yang lebih luas tentang fleksibilitas dalam pelaksanaan ijab dan qabul, berdasarkan pandangan ulama, untuk memberikan pemahaman yang lebih mendalam kepada masyarakat. Batasan penelitian ini adalah fokusnya yang terbatas pada satu wilayah (Kabupaten Nabire), sehingga hasilnya mungkin tidak sepenuhnya mencerminkan praktik di daerah lain. Penelitian ini memberikan wawasan tentang interaksi antara hukum Islam dan norma sosial dalam konteks pernikahan di Indonesia, khususnya mengenai persepsi dan praktik akad nikah.

Abstract

This journal aims to determine the factors that cause divorce. By using the literature review method or literature review, the author writes down several factors that greatly dominate the occurrence of divorce. The data sources used in this writing are from various reputable articles totaling 3029 articles that are relevant to the topic to be discussed. This journal concludes that first; The moral factor is a form of emotion whose embodiment is jealousy, hurt, anger, revenge and hatred towards other people because they think that other people get what they don't get. Second; The factor of the existence of a third person or environment, in which this actor can originate from a lack of attention between husband and wife, can also be from a lack of inner connection between the two such as a lack of feelings of happiness both physically and mentally for both of them. Third; Economic factors, in which the economic balance in the family has a relationship with family happiness as well as success in business and income of the heads of the household. Fourth; Factors of persecution (domestic violence) which is violent behavior or violent procedures that can injure or abuse. Regarding violence, we often hear the language of domestic violence or domestic violence, where husbands abuse their wives. Fifth; Social and cultural factors, which are also social and cultural factors that cause divorce. Because of the different opinions between the husband and the wife that causes disputes and results in divorce.

Abstract

Kepemimpinan keluarga dalam islam perspektif fenomenologi dipahami sebagai satu pendekatan bahwa kepemimpinan merupakan amanah dan tanggung jawab yang tidak hanya dipertanggung jawabkan kepada anggota-anggota yang dipimpinnya, tetapi juga akan dipertanggung jawabkan dihadapan Allah Swt. Tujuan dari penelitain ini ialah ingin memahami lebih jauh konsepsi kepemimpinan dalam keluarga islam perspektif fenomenolgi. Metode penelitian ini adalah kajian Pustaka (library research) dengan Teknik analisis data, dalam penelitian ini menggunakan sumber data primer dan sumber data sekunder. Hasil dari penelitian ini adalah: 1. Kepemimpinan keluarga dalam islam dikenal dengan istilah qiwamah. yang merujuk kepada ayat al-Qur’an surat an-nis’ ayat 34 menyebutkan bahwa sebuah keluarga harus ada kepemimpinan yang baik untuk mewujudkan kehidupan yang harmoni penuh dengan keridhaan Allah swt. 2. dalam pendekatan fenemenologi dapat di uraikan berdasarkat tiga tahapan yakni Reduksi fenomenologis, reduksi eiditis, dan reduksi transendental. 3. kepemimpinan keluarga perspektif fenomenologi harus terintegrasi dan kolaboratif antara suami-istri demi mencapai keluarga Sakinnah mawadah warahmah
