Abstract

This research was carried out with the aim of finding out the objectives of a foundation as a private legal entity according to Law Number 28 of 2004 and what are the requirements for establishing a foundation as a legal entity. By using normative juridical research methods, it can be concluded: 1. The aims of foundations as private legal entities according to Law Number 28 of 2004 are social, religious and humanitarian. Social goals: establishing formal and non-formal education, orphanages, retirement homes, nursing homes, hospitals, polyclinics and laboratories. Religious objectives: establishing facilities for worship, receiving and distributing alms. Humanitarian goals: providing assistance to victims of natural disasters, providing assistance to the homeless, the poor and homeless, preserving the environment. What are the requirements for establishing a foundation as a legal entity? How is the legal study aimed at establishing a foundation as a legal entity? Analysis of Law Number 28 of 2004 concerning Foundations? namely: founded by one or more people; there is wealth that is separated from the wealth of the founder; must be done with a notarial deed and made in Indonesian; must obtain approval from the Minister of Law and Human Rights; announced in the Supplement to the State Gazette of the Republic of Indonesia; must not use a name that has been legally used by another foundation, or is contrary to public order and/or morality; The name of the foundation must be preceded by the word "Foundation".

Abstract

Gambling, a practice long prohibited and criticized in many legal and religious traditions, persists in various societies. In the District of Dolok, North Padang Lawas Regency, a unique phenomenon has emerged where dice gambling becomes a part of marriage rituals. Although only practiced by a few, the existence of this gambling raises legal and ethical questions. The discussion focuses on: What are the legal sanctions for facilitators of dice gambling in marital traditions according to positive law and Islamic law in Indonesia? This research was conducted with a qualitative approach, analyzing positive legal literature and Islamic law, and adopting local understanding from the District of Dolok to understand the tradition and its implications. Research Findings: According to Islamic law, gambling falls under the category ofjarimah ta'zir, with reference from the Qur'an. Jarimah ta'zir can be in the form of whipping, imprisonment, or fines as per the head of government's regulations. Meanwhile, under Indonesian positive law, based on Article 303 paragraph (1) number 2 of the Criminal Code, perpetrators or facilitators of gambling can be sentenced to imprisonment or fines. The similarity between the two laws is that both establish the option of punishment in the form of imprisonment or fines. The author's suggestion is that local government and religious leaders in the District of Dolok should collaborate to provide education to the community about the negative impacts of gambling and the importance of respecting the applicable laws. Despite being bound by tradition, it is crucial for the community to understand and respect the limits of law and ethics.

Abstract

This research examines the juvenile criminal justice system in Indonesia, particularly in relation to the implementation of criminal sanctions against children involved in criminal acts. Using library research methods, this study explores various relevant literature and legal documentation to understand the approach taken in handling cases of children in conflict with the law. This research found that there is a tendency to prioritize restorative justice and diversion, which aims to reintegrate children into society without involving formal court processes. Diversion, as an alternative case resolution, allows children to avoid social stigma and long-term legal consequences that can hinder their personal development. The main focus is on rehabilitation and reintegration, taking into account psychosocial and environmental conditions that influence children's behavior. The research results show the need for a more holistic approach in the juvenile criminal justice system that is not only oriented towards punishment, but also towards recovery and development of children as individuals.

Abstract

The intersection of intellectual disabilities (ID) and mental health issues presents unique challenges and opportunities for healthcare professionals. This paper explores the prevalence, diagnosis, and treatment implications of co-occurring intellectual disabilities and mental health disorders. Through a comprehensive review of current literature and case studies, we examine how these conditions interact, the barriers to accurate diagnosis, and the best practices for treatment. Our findings suggest that integrated, multidisciplinary approaches are essential for effective management, emphasizing the need for tailored interventions and increased awareness among healthcare providers.

Abstract

Intellectual disabilities (ID) are a complex and heterogeneous group of disorders characterized by limitations in intellectual functioning and adaptive behavior. While biological factors are critical in understanding ID, the role of social determinants cannot be overstated. This paper provides a comprehensive review of the social determinants influencing the prevalence, diagnosis, treatment, and outcomes of intellectual disabilities. It synthesizes existing research to highlight how socioeconomic status, education, access to healthcare, cultural factors, and environmental influences shape the experiences of individuals with ID and their families. By understanding these social determinants, stakeholders can develop more effective strategies to support and empower individuals affected by intellectual disabilities.

Abstract

This study aims to determine and analyze the effect of entrepreneurial competence and product innovation on competitive advantage at the DPC of the Indonesian Businesswomen Association of Medan. The method used in this research is quantitative descriptive method. The population in this study were members of the DPC of the Indonesian Businesswomen's Association of Medan, totaling 314 people. This study uses probability sampling techniques in simple random sampling in determining the sample. To determine the number of samples using the Slovin formula so that 76 respondents were obtained. Data processing in this study using the SPSS software program (version 27). The data analysis techniques used in this study are validity and reliability tests, Multiple Linear Regression Analysis, Classical Assumption Test, t test and F test, and Determination Coefficient Test. The results obtained from the data processing carried out are partially competent.

Abstract

English for Business training for managers of Parapat tourism object in Simalungun Regency as a form of soft skills development in order to further increase professionalism in organizational business, because the tourism sector will be interact with many people. Following by business workers at Parapat tourist attraction in Simalungun Regency. The result of this Community Service is effective communication skills training which is very useful in improving self-quality, developing effective communication skills to support the sustainable of business. The location of this service is a tourist attraction for Parapat of Simalungun Regency. The method is lectures and practices.

Abstract

A lack of awareness of the benefits and potential profits of Sharia investment can hinder the growth of the Sharia capital market. Efforts are needed to harmonize sharia regulations and clarify the standards that must be complied with by capital market participants. The purpose of this study is to analyze the regulations, implementation, and challenges of Sharia compliance in the capital market. The research method used is qualitative descriptive. The data collection techniques used are observation and documentation with interpretive data analysis. The results of the study show that clear, comprehensive, and responsive regulations to market developments can be a strong foundation for business and investment practices that are in accordance with Sharia principles. The implementation of Sharia principles in business and investment practices requires a strong commitment from all stakeholders. Challenges in maintaining Sharia compliance in the capital market include the complexity of financial instruments, different understandings of Sharia principles, transparency and reporting that still need to be improved, as well as the challenges of effective supervision and law enforcement. Awareness and education of Sharia principles among stakeholders is essential to increase understanding, transparency, and compliance. Ongoing education on sharia compliance can help address some of the challenges faced.

Abstract

This research was conducted in order to see Optimizing Employee Performance at Dr Reksodiwiryo Hospital Padang. With this research the researchers conducted this research on Jl. Dr. Wahidin No.1, Ganting Parak Gadang, Padang Timur District, Padang City, West Sumatra 25132. This research uses quantitative research, and uses primary data sources, the population of this research is 75 employees and the sample used is the entire population, so it uses a sampling technique bored for research, data collection used the questionnaire distribution method and used the Phat analysis model as the research model and used the Smart PLS version 3 tool to calculate research results. The results of this research are as follows: Leadership has a positive and insignificant effect on employee performance with an original sample value of 0.059 and a p value of 0.725. Work Quality has a positive and insignificant effect on Employee Retention with an original sample value of 0.123 and a p value of 0.538. Work Quality has a positive and insignificant effect on employee performance with an original sample value of 0.126 and a p value of 0.289. Employee retention has a positive and significant effect on employee performance with a value of 0.783 and a p value of 0.000. Leadership has a positive and significant effect on employee retention with an original sample value of 0.841 and a p value of 0.000. Leadership influences employee performance through employee retention positively and significantly with an original sample value of 0.658 and a p value of 0.000. Work Quality has an indirect and insignificant effect on Employee Performance through Employee Retention, with an original sample value of 0.096 and a p value of 0.540.

Abstract

In Law Number 31 of 1999 which was amended by Law Number 20 of 2001 concerning the Eradication of Corruption Crimes, Indonesia regulates the reverse evidence system. The question is, whether the implementation of this system is effective in preventing or even eliminating criminal acts of corruption as a whole in Indonesia. This research uses a legal theoretical framework as a tool for social reform introduced by Roscoe Pound and adapted by Muchtar Kusumaatmadja for the Indonesian context. According to this concept, law must function as a tool to reform and resolve social problems, including corruption crimes. The reverse evidentiary system, which is a specific policy in Indonesian corruption law, deviates from general evidentiary norms in legal procedures.
