Abstract

Restorative justice is an alternative approach in the criminal justice system that balances offender rehabilitation, victim recovery, and community interests. This article analyze the implementation of restorative justice in Indonesia, its contribution to offender rehabilitation, and its role in facilitating victim recovery and strengthening a sense of social justice. The research method used is normative-juridical with descriptive analysis, reviewing laws and regulations, court decisions, academic literature, and international practices as comparative material. The results of the study indicate that restorative principles have been institutionalized through the Juvenile Justice and Child Protection Law, the Criminal Code, Supreme Court Regulation Number 1 of 2024, and regulations related to the termination of prosecution through a peace agreement. Offender rehabilitation is achieved through education, counseling, skills training, mediation, and community involvement to reduce recidivism. A victim-centered approach prioritizes compensation, psychosocial support, and community participation, fostering justice, social reintegration, and local wisdom–based collective harmony. Obstacles such as limited facilities, officer training, inter-agency coordination, and social stigma need to be addressed for effective implementation. Restorative justice affirms the philosophy of humanist criminal law, creating an inclusive, participatory, and recovery-oriented justice system, while strengthening social harmony and public trust in the law.

Abstract

This study explores the legal responsibility of marketplace platforms for the circulation of counterfeit products within the context of civil regulations, the Electronic Information and Transactions Law, and the Consumer Protection Law. The analysis focuses on normative and conceptual principles, aiming to understand how the principles of civil law, the ITE Law, and the Consumer Protection Law synergize to provide effective legal protection for consumers and brand owners. The method used is normative juridical with a statutory and conceptual approach, examining Article 1365 of the Civil Code, Law Number 11 of 2008, in conjunction with Law Number 19 of 2016, and Law Number 8 of 1999, through the study of documents, academic literature, and related regulations. The results indicate that marketplaces have significant legal responsibility to prevent the circulation of counterfeit products through active supervision, notice and takedown procedures, product verification, and transparent internal policies. Negligence in supervision can lead to civil liability, while implementing corporate social responsibility principles strengthens public trust and legal compliance. Strict legal implementation and consistent internal mechanisms are key to creating safe, fair, and sustainable e-commerce. This study provides a normative basis for strengthening online transaction oversight and policy recommendations for marketplaces in Indonesia.

Abstract

This article discusses the handling of online gambling as a cybercrime in Indonesia, focusing on the legal framework, law enforcement challenges, and strategies for increasing effectiveness. The research methodology uses a normative-juridical approach with descriptive analysis, combining legislative and conceptual approaches to evaluate the Criminal Code (KUHP), the Electronic Information and Transactions (ITE Law), and related regulations. The results show that Articles 303 and 303 bis of the Criminal Code and Article 27 paragraph (2) of the Electronic Information and Transactions (ITE) Law provide the legal basis for prosecuting perpetrators through criminal sanctions, website blocking, and asset confiscation. However, law enforcement faces multidimensional obstacles, including technical (perpetrator anonymity, foreign servers, encryption, VPNs), structural (suboptimal inter-agency coordination), legal (regulatory gaps), and social (low public legal awareness and online promotion). An effective law enforcement strategy requires a holistic approach, including increasing the technological capacity of authorities, international cooperation, regulatory harmonization, the establishment of cross-agency task forces, proactive digital monitoring, public education, and the application of restorative justice principles through the use of confiscated assets for rehabilitation and education programs. This strategic integration is expected to suppress online gambling practices, mitigate socio-economic impacts, and strengthen the rule of law in the digital age.

Abstract

Digital evidence has become a crucial element in modern criminal law enforcement in Indonesia, particularly in addressing cybercrimes such as online gambling, online fraud, and data theft. This study aims to analyze the legal standing of digital evidence, the challenges of its authentication and admissibility in court, and strategies to ensure its reliability in the judicial process. The study uses a normative juridical method with descriptive analysis through statutory and conceptual approaches, based on a study of legal regulations, court decisions, academic literature, and digital forensic guidelines. The results show that digital evidence has been legally recognized through the Criminal Procedure Code (KUHAP), the ITE Law, and Supreme Court regulations, as long as its authenticity and integrity can be proven. However, major challenges remain, including the potential for data manipulation, limited infrastructure, and a lack of competent human resources. Efforts to ensure the reliability of digital evidence include the implementation of standard forensic procedures, capacity building of law enforcement officers, cross-agency collaboration, the use of advanced technology, and strengthening an adaptive legal framework to support effective law enforcement and public trust.

Abstract

Psychological violence is a form of non-physical harm that causes serious mental suffering and requires strong legal protection within a just and recovery-oriented criminal justice system. This research aims to examine how legal protection is provided by the Police to victims of psychological violence crimes. Using a library research method, the study analyzes literature, legislation, and other written legal materials related to victim protection. The findings indicate that legal protection for victims of psychological violence is a state obligation implemented through law enforcement agencies, including the police, prosecutors, and courts, and covers legal, psychological, and social aspects. In Indonesia, psychological violence has been legally recognized as a criminal act, particularly in the domestic sphere under Law Number 23 of 2004 concerning the Elimination of Domestic Violence, and is further reinforced by Law Number 13 of 2006 as amended by Law Number 31 of 2014. In conclusion, police-provided legal protection is essential not only to guarantee victims’ rights during the legal process but also to ensure state recognition of the suffering experienced by victims of psychological violence.

Abstract

In response to rapid organizational change and increasing environmental complexity, leadership has become a critical factor in determining organizational effectiveness. This study conducts a Systematic Literature Review (SLR) to examine the dynamics of leadership theories within the context of Indonesian organizations, a setting characterized by distinctive cultural, social, and institutional values. The review was carried out following a structured SLR procedure consisting of planning, identification, screening, eligibility, and synthesis stages. Articles were selected based on explicit inclusion criteria, including peer-reviewed journal publications, empirical studies focusing on leadership in Indonesian organizational contexts, publications in English or Indonesian, and studies published within a defined time frame. A total of selected studies were systematically analyzed to identify dominant leadership styles, key influencing factors, and their impacts on organizational outcomes such as employee performance, motivation, organizational commitment, and job satisfaction. The findings indicate that transformational, transactional, and culturally embedded leadership styles are most prevalent, with cultural values, organizational structure, and leader–follower relationships playing significant roles. This study contributes by providing an integrative mapping of leadership theories in Indonesia, highlighting contextual challenges and opportunities, and offering clear directions for future research on culturally adaptive and evidence-based leadership development in Indonesian organizations.

Abstract

The management of science laboratories plays a strategic role in supporting experiment-based learning, which can enhance students’ motivation and academic achievement. However, many schools still face challenges related to limited equipment, inadequate maintenance, and the inconsistent implementation of laboratory activities. This study aims to explore in depth how science laboratories are managed in secondary schools and how such management influences students’ motivation and academic performance. A qualitative approach with a case study design was employed. Data were collected through observations, in-depth interviews with teachers, students, and laboratory personnel, and document analysis, including inventory records, practicum schedules, and laboratory SOPs. Data analysis followed Miles, Huberman, and Saldaña’s interactive model. The findings indicate that the laboratory management is functional but not optimal due to limited resources, the absence of laboratory assistants, and irregular practicum implementation. Both teachers and students express highly positive perceptions of laboratory activities, which are shown to significantly increase motivation through engaging and meaningful hands-on experiences. The results also reveal that students who actively participate in laboratory work demonstrate better conceptual understanding and higher academic achievement. The study concludes that science laboratories have substantial potential as pedagogical spaces that mediate improvements in motivation and learning outcomes.

Abstract

In the digital era, schools are increasingly required to modernize administrative processes to meet the demands of efficiency and quality service. This study aims to examine the implementation of digital performance management to improve educational administration and staff performance. Using a qualitative case study approach, data were collected through in-depth interviews, participant observations, and document analysis, then analyzed following Miles’ interactive model of data condensation, display, and conclusion drawing. The findings show that digital performance management has improved administrative workflows by shifting from manual to real-time, structured, and paperless processes, resulting in more efficient, accurate, and transparent services. Service quality improved across speed, reliability, responsiveness, and accountability. Challenges remain, including variations in staff digital competence, dependence on ICT infrastructure, and occasional network instability. Recommended strategies include ongoing staff training, technological infrastructure enhancement, periodic system evaluation, and strong digital leadership. Digital performance management plays a strategic role in enhancing school administration quality and provides valuable insights for the digital transformation of educational administration. These findings are expected to contribute to policy development on the digitalization of secondary school educational administration.

Abstract

The hospitality industry plays a significant role in regional economic development, yet its financial performance is often influenced by various internal factors. This study aims to empirically examine the effect of company size, leverage, and Good Corporate Governance (GCG) on the financial performance of hospitality businesses. Employing a mixed-methods approach, the research collected data through purposive sampling, resulting in a total of 117 industry respondents. Quantitative data were analyzed using multiple linear regression, while qualitative insights were gathered to capture perceptions and experiences of industry practitioners involved in the study. The findings indicate that company size, leverage, and GCG significantly affect financial performance. By integrating quantitative and qualitative methods, this study offers a more comprehensive understanding of the factors shaping financial outcomes. Furthermore, this research contributes new evidence by specifically addressing the role of GCG, company size, and leverage in hospitality-sector firms, providing valuable implications for both scholars and industry stakeholders.

Abstract

This research is motivated by the challenges of globalization that require Islamic educational institutions to be able to equip students with strong and competitive characters. The purpose of this study is to examine in depth the efforts of the principal of MI Cerdas Nurani in facing these challenges. The research used a qualitative approach with a case study method conducted at MI Cerdas Nurani, Cimahi City. Data collection techniques included interviews, group discussions, and observations, while data analysis was conducted descriptively and narratively. The research findings indicate that the principal’s main strategy in facing globalization is maintaining the sustainability of the Habit Character Life Skill (HCL) Curriculum. This curriculum focuses on strengthening the character of religious, independent, and competitive students through the habituation of the values ​​of cleanliness, neatness, and discipline, as well as the practice of daily worship and applicable monthly habits. Implementation is carried out through stages of habit campaigns and habit celebrations by involving the active role of parents and the role models of the principal and teachers. The HCL Curriculum is a strategic innovation of the principal of MI Cerdas Nurani in fortifying students from the negative impacts of globalization while preparing them to compete globally.
