Abstract

The issuance of Minister of Trade Regulation Number 31 of 2023 concerning Business Licensing, Advertising, Guidance, and Supervision of Business Actors in Electronic Commerce is the Indonesian government's effort to regulate digital trading activities, including those conducted through social commerce platforms like TikTok Shop. This regulation aims to create a balanced trade ecosystem, ensure fair competition, and protect micro, small, and medium enterprises (MSMEs) in the midst of rapid technological advancements. However, the implementation of this regulation also raises challenges, particularly for MSME actors who rely on social commerce platforms as a marketplace. This paper aims to analyze the impact of the regulation on TikTok Shop and its implications for MSME development in Indonesia. The analysis is conducted by examining the content of the regulation and its effects on various stakeholders in the e-commerce ecosystem.

Abstract

The increase in phishing crimes during the COVID-19 pandemic has been influenced by various factors, including weak social control, lack of cybersecurity education, and technological disparities. This study aims to analyze the rise of phishing crimes from a criminological perspective, focusing on Social Control Theory and Differential Association Theory. Using a qualitative approach, this research examines how phishing offenders learn and operate within social groups. The findings indicate that phishing is not only motivated by financial gain but also intellectual satisfaction and organized criminal activities. Moreover, regulatory challenges persist, as existing laws such as the Electronic Information and Transactions Law (UU ITE) face enforcement limitations due to gaps in law enforcement capabilities. Strengthening cybersecurity awareness, enhancing digital literacy, and improving legal frameworks are crucial to mitigating phishing crimes. Future research should explore quantitative analyses of phishing trends and the effectiveness of policies in addressing cybercrime.

Abstract

This study aims to analyze the legal review of illegal firearms and ammunition ownership in Indonesia. The research method used in this study is the normative legal research method. The main data source in this study is secondary legal sources, consisting of Emergency Law No. 12 of 1951 and Law No. 8 of 1948 concerning the registration and granting of firearms ownership permits. The results of the study concluded that law enforcement against illegal firearms and ammunition ownership in Indonesia has been carried out in accordance with existing laws and regulations related to illegal firearms ownership, conducting investigations and law enforcement according to the facts in court and factors inhibiting law enforcement against illegal firearms and ammunition ownership in Indonesia in the form of legal factors, law enforcement, society, facilities and infrastructure, culture. The suggestion in this study is that there should be no difference in decision making and witnesses in law enforcement because of considering status, position, and economy so that law enforcement can be more optimal, and so that there are no obstacles to law enforcement, law enforcement officers need to increase supervision of the circulation of illegal firearms and ammunition through cooperation with community leaders, traditional leaders, law enforcement officers, and the media.

Abstract

This study aims to provide legal protection for production houses as copyright holders and offer knowledge about unlawful acts that can be committed by production houses regarding the economic losses caused by the illegal distribution of films on the Telegram app. It is hoped that this research will raise awareness in society that piracy or the illegal distribution of films can cause harm to production houses as well as infringe on the copyright holder’s rights. This study uses a normative legal research method with a statutory approach to analyze the applicable regulations in protecting copyright. The results of this study show that parties involved in piracy and the distribution of someone’s copyrighted work have committed unlawful acts, violating both the economic and moral rights of the copyright holder, one of which is the production house. Parties involved in piracy and distribution can be prosecuted in accordance with the provisions outlined in Article 1365 of the Civil Code and Article 113 of Law No. 28 of 2014 on copyright. This study is expected to contribute to the development of legal protection for copyright holders in Indonesia.

Abstract

This research aims to find out the factors that caused the bankruptcy of PT Sritex and to find out the impact caused by the closure of PT Sritex as of March 2025. The research method used in this research is the normative method with reference to Law Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations. The results showed that there were several factors that caused the bankruptcy of PT Sritex, namely unmanageable debt, the failure of the peace agreement, and the covid-19 pandemic which caused losses to PT Sritex. After being declared bankrupt by the Semarang Commercial Court, the creditors' meeting in bankruptcy agreed that there was no going concern for PT Sri Rejeki Isman (Sritex), so that the next process continued to debt settlement. Therefore, the impact caused by the closure of PT Sritex, namely the impact on PT Sritex employees, the textile industry, and PT Sritex creditors.

Abstract

This study examines legal protection for consumers regarding discrepancies in packaged cooking oil volume based on Law No. 8 of 1999 on Consumer Protection. The research employs a normative legal method with statutory, conceptual, and case approaches. The findings indicate that businesses reducing product volume without clear notification violate consumer rights and UUPK provisions. Law enforcement mechanisms include government supervision, sanctions, and consumer protection institutions. To enhance consumer protection, stricter monitoring, firm regulations, and public education are necessary.

Abstract

This study aims to determine the form of protection of digital copyright holders against copyright infringement. This study is a normative legal study using primary and secondary legal materials. This study uses an approach in the form of a legislative approach and is analyzed using a syllogism with a deductive mindset. The results of this study indicate that copyright is an exclusive right of the creator that is obtained automatically after a creation is manifested in a tangible form without reducing restrictions in accordance with the provisions of laws and regulations. The use of technology makes it easy for people to search for and access the information they need. This technological advancement has also made copyright infringement through piracy increasingly rampant. One of the violations that occurs is piracy by re-uploading which occurs due to advances in technology and information. Copyright protection on various digital platforms is an obligation that must be considered by the public to protect digital works. Piracy often occurs on platforms that have features for sharing video content. The less good consequences that result are the practice of piracy by re-uploading.

Abstract

Current efforts to eradicate corruption are not only focused on arresting and imposing criminal sanctions on perpetrators, but also through efforts to restore the country's financial and economic losses by confiscating assets or property belonging to perpetrators of corruption. Asset recovery or confiscation of assets from perpetrators of corruption is an important thing that must be considered in handling corruption cases, as a form of recovery of state losses. Therefore, there must be a good policy formulation to support the implementation of asset recovery. Indonesia needs special regulations or rules that have legal force and have special rules regarding the mechanism for confiscating assets and property suspected of being obtained from the proceeds of corruption. This study is entitled Asset Confiscation as a Form of Punishment for Perpetrators of Corruption. The purpose of this study is to determine and explain legal policies related to asset confiscation.

Abstract

Family conflict is a common phenomenon that can negatively impact emotional well-being and the stability of relationships between family members. Mediation, as an alternative conflict resolution, offers a constructive approach by involving a neutral third party. The goodwill of the conflicting parties is a crucial factor in the success of the mediation process. This article examines the important role of goodwill in family mediation, including honesty, openness, willingness to listen, respect, focus on solutions, and adherence to agreements. Mediation has been shown to be effective in resolving various types of family conflicts, such as intergenerational conflict, sibling conflict, and marital conflict. The benefits of mediation include maintaining family relationships, tailored solutions, confidentiality, and empowering family members to take control of conflict resolution. The mediator plays a vital role in facilitating the mediation process and creating a conducive environment. The conclusion of this study is that goodwill is the foundation of successful family mediation. When conflicting parties approach mediation in good faith, they can reach solutions that strengthen family relationships and enhance mutual well-being.

Abstract

The digital era has brought inevitable changes to human life, changing the way we communicate, interact, and access information. Digital space has become a new public space where individuals can express themselves, access information, and participate in public life. However, this digital space is also vulnerable to human rights violations, such as mass surveillance, the spread of hate speech, and information manipulation. The rapid development of digital technology has outstripped the ability of international law to regulate it, creating a significant legal gap where human rights in the digital space are not adequately protected. This challenge is further complicated by the cross-border nature of the internet and other digital technologies. This journal discusses international legal issues related to the protection of human rights in the digital era. This research uses a normative legal research method with a case study approach, analyzing international legal documents such as international treaties, UN resolutions, and international court jurisprudence. This journal also analyzes case studies related to human rights violations in the digital era. The results of the study indicate that a more comprehensive international legal framework, clear international standards, and effective law enforcement efforts are needed to protect human rights in the digital space. The proposed recommendations include developing a comprehensive legal framework, enhancing international cooperation, strengthening law enforcement efforts, increasing public awareness, and civil society participation.
