Abstract

This study examines the legality of on-street parking levy practices in Kupang City from a constitutional law perspective, with a primary focus on the application of the legality principle. The background of this research stems from a significant discrepancy between the legal norms established in statutory regulations and the empirical administrative practices occurring in the field. Identified issues include the collection of levies without official tickets, the lack of clarity regarding the identity and legal status of collection officers, and the inconsistent and non-transparent application of parking tariffs. This research employs a normative-empirical legal method by applying statutory, conceptual, and empirical approaches through limited field observations. The findings indicate that although the Kupang City Government formally possesses the attribution of authority to collect parking levies, the implementation frequently deviates from the established legal procedures. Such deviant practices potentially constitute ultra vires actions and violate the principle of due process of law in government administration. This study concludes that the substantive legality of parking levies in Kupang City has not been fully realized, thereby undermining legal certainty and public trust in the legitimacy of local governance. The implications of this research emphasize the imperative for comprehensive reform of the supervision system and stricter enforcement of administrative procedures to ensure the rule of law at the local level.

Abstract

This study aims to analyze the discrepancy between regulations and social realities in fulfilling the right to education in Indonesia. Normatively, the state has established a strong legal framework to guarantee the right to education, as stipulated in the 1945 Constitution and various educational policies. However, in practice, there remains a significant gap between policy and actual conditions in society. This research employs a qualitative approach using a juridical-normative method combined with an empirical (sociological) approach. Data were collected through library research from various sources, including laws and regulations, academic journals, and reports from official institutions. The findings indicate that the discrepancy is reflected in three main aspects: unequal distribution of educational facilities, disparities in the quality of education, and the existence of children who have not accessed education. These issues are influenced by factors such as limited infrastructure, unequal distribution of teachers, geographical challenges, and socio-economic conditions. Therefore, it can be concluded that the fulfillment of the right to education in Indonesia has not been fully optimal due to ineffective and non-adaptive policy implementation. Hence, more comprehensive and contextual efforts are required to achieve an equitable, inclusive, and accessible education system for all.

Abstract

Human rights are fundamental rights inherent to every individual from birth and are guaranteed under statutory laws and regulations. These rights are universal in nature, inherent to every person, and must be respected, protected, and fulfilled by the state as well as all elements of society. However, in practice, various conditions continue to trigger human rights violations committed by both individuals and state officials. This phenomenon indicates that the protection of human rights still faces numerous challenges in its implementation. This study aims to examine the relationship between law enforcement officers and civilians, determine the extent to which the actions of law enforcement officers can be categorized as human rights violations, and analyze the mechanisms of oversight and accountability in handling cases of human rights violations. This study employed a qualitative approach using a case study method to obtain an in-depth understanding of the phenomenon under investigation. The data were analyzed descriptively to illustrate the relationship between law enforcement officers and civilians within the context of human rights protection. The findings reveal that power asymmetry is one of the main factors contributing to the abuse of authority by law enforcement officers. This condition subsequently increases the potential for human rights violations and underscores the importance of effective oversight and accountability in ensuring that law enforcement officers perform their duties and exercise their authority in accordance with applicable legal provisions.

Abstract

Amidst rising global pressure regarding sustainability and cross-border trade, customs agencies are no longer viewed merely as gatekeepers but as strategic actors in global environmental governance through the Green Customs Initiative (GCI). This research aims to uncover the evolutionary patterns of GCI research within the context of adaptive policy, map its intellectual structure, and identify future thematic directions. The methodology employs a bibliometric analysis of documents sourced from the Web of Science database, utilizing VOSviewer software to perform co-authorship, bibliographic coupling, and co-word analysis. The results demonstrate that the dominance of scientific actors in this field is determined more by the strength of collaboration networks than by the mere volume of publications. The findings identify that the primary intellectual foundations of GCI research rest upon the critical relationship between environmental regulation, international trade, market responses, and eco-innovation. Furthermore, country-level analysis highlights the central roles of China, the United States, and the United Kingdom in shaping the knowledge structure of this domain. Overall, these findings underscore that the GCI has evolved into a multidisciplinary field that requires an adaptive policy framework to respond to the dynamics of ecological risks and global trade demands through institutional flexibility and cross-actor collaboration. By integrating environmental protection into border management and risk assessment, this study provides a strategic reference for customs authorities to move toward a more responsive and knowledge-based green customs administration.

Abstract

This study aims to analyze legal protection for auction winners of mortgage rights within the framework of Indonesian laws and regulations. The auction of mortgage rights serves as a mechanism for executing secured collateral with binding legal force; however, in practice, it often raises legal issues, particularly concerning legal certainty and protection for auction winners. This research employs a normative juridical method using statutory and conceptual approaches. The findings indicate that legal protection for auction winners has been regulated under various laws, including the Mortgage Law, auction regulations, and provisions governing collateral execution. Nevertheless, challenges remain in its implementation, such as lawsuits filed by debtors or third parties that hinder the transfer and control of auctioned objects. This condition reflects a discrepancy between legal norms and their practical application. Therefore, strengthening regulations and ensuring consistency among law enforcement authorities are necessary to guarantee legal certainty and protection for auction winners. This study is expected to contribute to the development of secured transactions law and the improvement of auction practices in Indonesia.

Abstract

The legal culture of society is a fundamental element in the implementation of the Complete Systematic Land Registration Program (PTSL). The success of this program is not only determined by government policies but also by the awareness, compliance, and participation of the community in registering their land. The research method is normative legal research with a statutory and conceptual approach. This study uses primary, secondary, and tertiary legal sources. The research results indicate that legal culture plays an important role in the success of the implementation of the Complete Systematic Land Registration Program (PTSL) as an effort acceleration of land registration. The legal culture reflected in the extent to which the community is willing to voluntarily register their land and follow the established procedures. Efforts to improve legal culture can be carried out through legal socialization and counseling, participatory approaches, increased transparency of officials, cultural approaches, as well as the utilization of digitization of land services. Therefore, it is recommended that the government, especially the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (ATR/BPN), together with local governments Intensifying the activities of socialization and legal counseling to the community continuously in an informative, persuasive, and educative manner as well as strengthening the role of field implementing officers by emphasizing the principles of transparency, accountability, and responsive public service. The government is also advised to optimize approaches based on local wisdom and to utilize digital technology in the land registration process to facilitate community access.

Abstract

Digital transformation in the judicial system represents a strategic step to improve the quality of legal services in Indonesia. One of the innovations implemented by the Supreme Court of the Republic of Indonesia is the E-Court system, which enables case administration and court proceedings to be conducted electronically. This study aims to analyze the effectiveness of the implementation of E-Court in realizing the principles of simple, fast, and low-cost justice, as well as to identify the obstacles faced by parties who do not utilize the system. The research method employed is a normative legal approach, involving the analysis of statutory regulations and scholarly literature. The results indicate that, normatively, E-Court has been effective in supporting judicial efficiency; however, in practice, it still encounters various challenges, including technical, social, and institutional aspects. These obstacles vary among different legal subjects, namely advocates, individuals, private legal entities, and government legal entities. Therefore, comprehensive efforts are required to optimize the implementation of E-Court to ensure that the objectives of judicial reform can be fully achieved. Furthermore, the findings reveal that, from a normative perspective, E-Court provides a more efficient mechanism compared to conventional systems, particularly in terms of case administration and communication between parties. However, this effectiveness has not been evenly realized due to constraints such as the digital divide, limited technological infrastructure, and low user readiness. Consequently, the implementation of E-Court still requires reinforcement in both technical and cultural aspects to ensure optimal accessibility for all segments of society.

Abstract

The spread of Non-Consensual Intimate Images (NCII) has become one of the most damaging forms of technology-based sexual violence in Indonesia. Komnas Perempuan data consistently shows a year-on-year rise in gender-based online violence reports, while SAFEnet documented hundreds of NCII cases between 2017 and 2023. Before Law Number 12 of 2022 on the Crime of Sexual Violence (TPKS Law) was enacted, Article 27 paragraph (1) of the Electronic Information and Transactions Law (ITE Law) was the only legal basis for handling NCII โ€” a provision that frequently revictimized survivors rather than protecting them. This study examines: (1) how NCII is regulated under the TPKS Law; and (2) the effectiveness of the TPKS Law in addressing NCII cases, analyzed through Lawrence M. Friedman's three-component theory of legal effectiveness: legal substance, legal structure, and legal culture. Normative legal research was applied using statutory, conceptual, and analytical approaches. The study finds that Article 14 of the TPKS Law provides a substantially stronger and more victim-centred legal basis than previous regulations. However, effectiveness is still hampered by inadequate law enforcement capacity, uneven availability of integrated service units (UPTD PPA), low survivor reporting rates linked to persistent stigma, and a pervasive victim-blaming culture. Law reform alone is insufficient; structural and cultural transformation must accompany it.

Abstract

State officials implicated in corruption cases in Indonesia generally do not resign because there is no legal regulation that explicitly requires it. This study aims to analyze the ethics of government as the basis for the obligation to resign for state officials implicated in corruption cases and examine the form of legal regulation. The method used is normative legal research with a statutory, conceptual, and comparative approach. The results of the study indicate two things. First, the ethics of government is positioned as a legal principle derived from Pancasila and is worthy of being used as a basis for the obligation to resign because it contains the values โ€‹โ€‹of honesty, integrity, accountability, and responsibility as moral prerequisites for public office. However, it does not yet have coercive power because it has not been transformed into a positive legal norm with sanctions. Second, existing legal regulations do not explicitly require resignation, so normativeization is needed in the law that covers all state officials with triggers starting from indications of corruption, strict sanctions, and guarantees of restoration of good name for those proven innocent.

Abstract

The growth of digital transactions in Indonesia has raised important legal questions about the status of electronic agreements. Data from APJII (2024) shows that internet users in Indonesia reached 221 million people, while BPS (2023) recorded national e-commerce transactions at Rp 476.3 trillion in 2022. These figures indicate that electronic agreements have become a primary instrument in everyday legal interactions. This study aims to analyze: (1) whether an electronic agreement can be categorized as a private deed (akta di bawah tangan) as stipulated under Article 1874 of the Indonesian Civil Code in conjunction with Articles 5 and 11 of Law Number 11 of 2008 on Electronic Information and Transactions (UU ITE); and (2) the evidentiary strength of electronic agreements as private deeds in court proceedings. Using normative legal research with statutory, conceptual, and case approaches, this study finds that electronic agreements fulfill the requirements of a private deed when they contain an electronic document recognizable under Article 5 UU ITE and a certified electronic signature meeting the requirements of Article 11 UU ITE. As to evidentiary strength, the electronic agreement has perfect evidentiary force when acknowledged by the opposing party under Article 1875 of the Civil Code, but is subject to further verification when disputed. The study recommends harmonization between the Civil Code and UU ITE, and institutional strengthening of electronic certification bodies.
