Abstract

This study aims to analyze the role of law in resolving customary land disputes in Indonesia through a sociological perspective, focusing on the interaction between formal legal frameworks and social norms within indigenous communities. Employing a qualitative-descriptive approach and case study method, the research examines selected customary land conflicts and relevant literature on agrarian law and indigenous rights. The findings reveal that such disputes are often triggered by unclear land status, limited public understanding of customary (ulayat) rights, and a disconnect between state law and customary law. Law plays a crucial role as a conflict resolution tool, but its effectiveness largely depends on successful mediation between formal regulations and local values. This study highlights the need to enhance legal awareness among indigenous communities and the importance of collaboration between the government and local stakeholders in creating inclusive and equitable land registration systems. In conclusion, a solid understanding of agrarian law and respect for customary rights are essential to prevent conflicts and ensure social justice. The study recommends strengthening legal documentation of land ownership and improving empirical data on customary land disputes to inform more effective policy interventions.

Abstract

Bullying dan body shaming merupakan salah satu bentuk kekerasan yang sering terjadi di lingkungan pendidikan, dengan dampak negatif yang dapat dirasakan oleh korban baik secara fisik, psikologis, maupun sosial. Penelitian ini bertujuan untuk menganalisis langkah-langkah penanggulangan bullying dan body shaming dari sudut pandang hukum dan sosiologi, serta mengidentifikasi faktor-faktor yang mempengaruhi terjadinya tindakan tersebut. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi pustaka, memanfaatkan berbagai sumber ilmiah seperti jurnal dan artikel terkait. Hasil penelitian menunjukkan bahwa penegakan hukum dalam menangani bullying dan body shaming masih menghadapi sejumlah tantangan, seperti kesadaran masyarakat yang masih rendah dan implementasi kebijakan yang belum optimal. Dari sudut pandang sosiologi, faktor-faktor seperti norma kelompok, pengaruh teman sebaya, dan budaya di lingkungan sekolah memegang peranan penting dalam mendorong perilaku tersebut. Penelitian ini menekankan pentingnya kolaborasi antara sekolah, keluarga, dan masyarakat dalam membangun lingkungan yang aman dan inklusif bagi siswa. Selain itu, diperlukan kampanye publik dan peningkatan edukasi hukum untuk meningkatkan kesadaran tentang dampak negatif bullying dan body shaming, sekaligus mengurangi frekuensi kasus tersebut. Penerapan kebijakan yang dilengkapi sarana pengaduan yang aman dan penyediaan layanan konseling bagi peserta didik diharapkan dapat menjadi solusi yang efektif dan komprehensif dalam menangani permasalahan ini.

Abstract

This study aims to analyze the legal responsibility of PT. Gojek Indonesia regarding the mismatch of driver identity in the Go-Send delivery service in Serang City, based on Law Number 8 of 1999 concerning Consumer Protection. The main issue examined is the loss or non-delivery of goods due to drivers whose identities do not match the information displayed in the application. The research employs an empirical juridical approach, collecting primary data through interviews and secondary data through literature studies. The findings reveal that PT. Gojek holds legal liability to compensate consumers for their losses, either in the form of money or equivalent goods, as stipulated under consumer protection regulations. However, in practice, the dispute resolution process has not been effective, as consumers have not yet received clear compensation. Consequently, some consumers have escalated the matter to consumer protection agencies. The study concludes that PT. Gojek must improve identity verification procedures for its drivers and enhance the dissemination of information regarding claim mechanisms to users. Additionally, it is recommended to implement a mandatory-read agreement feature to ensure that consumers understand their rights. These efforts are expected to strengthen consumer trust and the overall credibility of Go-Send services.

Abstract

False, fake, or untrue, even misleading news content better known as hoaxes related to the health sector is still one of the hoaxes that should be watched out for. Although the percentage is still inferior to political hoaxes and infotainment, the impact it has caused is not a joke.  The purpose of this study is to find out about the phenomenon and impact of hoaxes in the health sector as a crime in cyberspace. To answer the problems in this study, the research method used is normative with statute approach and conceptual approach. The data analysis used is qualitative, while the data analysis method used is descriptive-analytical. From the research results, it was found that the phenomenon and impact of news and hoax content in the health sector did not only hit Indonesia but also hit several countries in the world. From the phenomenon and impact of hoaxes in the health sector in several countries, it turns out that it is not a joke. This phenomenon of hoaxes in the health sector is an anti-science movement. This means that hoaxes in the health sector are no longer about people's ignorance about which information is wrong and correct, but about how to deal with people's social attitudes and behaviors that are anti-science. If this is left unchecked and no change is made, health misinformation will continue to spread and this will certainly erode trust in the government, doctors, patients, institutions, and society.

Abstract

The purpose of this study is to analyze the legal capacity of the parties in a digital online buying and selling contract and to determine the party that can be held accountable for the goods that have been purchased according to the laws and regulations in Indonesia. Technological developments have made developments in all sectors, including in the buying and selling system. Buying and selling now uses more of the internet or what is called online buying and selling. Online buying and selling falls into the category of digital transactions or contracts. The problem that can occur in a digital contract is the capacity of the parties in this case the subjects who make the agreement. It should be noted that digital contracts are the same as conventional contracts which must be subject to Article 1320 of the Civil Code concerning the requirements for the validity of an agreement. The agreement can be canceled if there is a party that does not meet the subjective requirements of Article 1320 of the Civil Code. The subjects in online buying and selling can be done by children who use their parents' or adults' cellphones. So when the party who makes the agreement does not meet the subjective requirements and should be canceled but is not done, the agreement is considered to remain valid. For online buying and selling that has been done by children, the parents or guardians of the child must be responsible. This research is of a normative legal nature by looking at the requirements for the validity of an Agreement from Article 1320 of the Civil Code.

Abstract

This study examines the urgency of regulatory reform in Indonesia from the perspective of legal politics to realize a national legal system that is just, effective, and responsive to societal needs. The shift toward a constitutional government has brought structural changes to Indonesia’s legal framework, particularly in expanding regulatory authority and complexity. Using a normative legal research method, the study applies statutory, theoretical, and conceptual approaches by analyzing primary to tertiary legal sources through qualitative analysis. The findings reveal that Indonesia’s regulatory framework has evolved through a long and fragmented process, marked by weak coordination among stakeholders and insufficient commitment to sustained legal reform. As a result, the current system has yet to ensure legal certainty, justice, and accessibility for all citizens. The study argues that ideal regulatory structuring must be rooted in Pancasila and the 1945 Constitution, incorporating the principles of transparency, public participation, justice, legal certainty, and consistency. Furthermore, it emphasizes the need to establish a specialized and independent institution as mandated by Law No. 15 of 2019 to coordinate and manage regulatory formulation effectively. Strengthening this institutional capacity is essential to achieving a legal system that supports social justice and the broader welfare of the Indonesian people.

Abstract

This study aims to analyze the form of unlawful acts in housing sale and purchase agreements and their legal consequences for consumers and developers, with a case study of Decision Number 395/Pdt.G/2021/Pn.Bks involving PT. Hadez Graha Utama. The research method uses a normative legal approach by analyzing secondary data in the form of laws and regulations, court decisions, and relevant legal literature. This study examines the legal aspects of consumer protection and contract law in the context of housing property sales and purchases. The results of the study indicate that the developer has committed an unlawful act by starting construction without having a Building Construction Permit (IMB). The court decided that the developer must pay compensation of IDR 192,730,800.00 to consumers along with court costs. This decision is an important precedent in providing legal protection for housing consumers. The conclusion of this study shows that the court decision provides legal certainty and protection for consumers, as well as a warning for developers to comply with legal provisions in housing development. Further research is needed to examine the implementation of similar decisions and their impact on the property industry and consumer protection in Indonesia.

Abstract

The death penalty is the highest form of punishment in the criminal justice system in Indonesia which is still applied for various serious crimes, such as premeditated murder, narcotics crimes, and terrorism. However, its application raises various debates from the aspects of law, human rights, and effectiveness in crime prevention. This research aims to analyze justice and transparency in the judicial process of death penalty cases in Indonesia and assess its effectiveness as an instrument of law enforcement. The method used in this research is a literature study by analyzing various legal sources, academic journals, and reports from human rights organizations. The results show that the application of the death penalty in Indonesia still faces various challenges, including the potential for judicial error, discrimination against certain groups, and lack of transparency in the legal process and execution. In addition, there is no strong evidence to suggest that the death penalty is more effective in reducing crime rates compared to life sentences. This study suggests that Indonesia needs to re-evaluate its death penalty policy by considering the principles of justice, legal effectiveness, and human rights protection. Reforming the criminal justice system and implementing a moratorium can be the first step in creating a more just and transparent legal system.

Abstract

This research focuses on addressing one of the gray areas in the practice of diplomatic asylum: the legal standing of information regarding the applicant's legal situation, compiled by the receiving state, and used as a consideration in granting asylum upon the request of the sending state, based on the Caracas Convention on Diplomatic Asylum (1955). In practice, the asylum-granting state has no obligation to allow intervention in evaluating the applicant’s condition. This results in broad discretionary authority for the sending state to unilaterally interpret the legitimacy of diplomatic asylum. This study employs a normative juridical method, relying on literature review and secondary data sources such as relevant international conventions and state practice. The findings show that the Caracas Convention does not explicitly require the receiving state to provide information or allow intervention in the evaluation process conducted by the sending state, nor does it obligate the sending state to request such information.In the absence of legal status information, the sending state may interpret the applicant’s situation based on its own political or legal considerations. This often hampers judicial processes in the receiving state and risks undermining the validity of diplomatic asylum granted to the applicant. As a recommendation, the establishment of a specific international guideline or instrument is necessary to serve as a formal reference for sending states in carefully evaluating the eligibility and status of individuals seeking diplomatic asylum.

Abstract

This research aims to provide an overview of Legal Protection for Victims Who Act in Self-Defense. In this study, the author employs a normative juridical approach. The theoretical framework used is the Theory of Factors Influencing Law Enforcement, by examining the obstacles that affect law enforcement in cases where victims attempt to defend themselves. The secondary data used in this research is sourced from various materials such as statutory regulations and legal journals. The findings show that the Indonesian Criminal Code (KUHP) regulates self-defense (noodweer) and excessive self-defense (noodweer exces) as stipulated in Article 49 paragraph (1) and paragraph (2) of the KUHP. Article 49 serves as the legal basis for providing legal protection to individuals who act in self-defense. Under this Article, a criminal act committed may be exempted from criminal liability, allowing the perpetrator to be free from any legal charges, provided that the elements of self-defense are fulfilled. Obstacles in law enforcement for cases involving self-defense include unclear legal provisions, limited understanding among law enforcement officers of the noodweer concept, lack of supporting infrastructure such as CCTV, low public awareness in reporting crimes, and a weak legal culture. Of all the factors, law enforcement is considered the most dominant because the central role of officers in enforcing regulations professionally, objectively, and fairly is crucial in determining the true realization of justice.
