Jurnal Keadilan Pemilu adalah Jurnal yang dihasilkan dari rumusan isue update pengawasan dan penegakan hukum elektoral. Dalam membangun keselarasan dinamika politik, hukum yang berkembang dalam proses penyelenggaraan Pemilu dan Pilkada. Hal tersebut dimaksudkan agar nilai-nilai demokrasi dan keadilan elektoral benar-benar bersifat mendasar dapat difahami dan diaplikasikan dalam pelaksanaan tugas dan fungsi Pengawas Pemilu.

Abstract

The 2024 simultaneous elections that unite the elections for the president and vice president, House of Representatives (DPR), Regional House of Representatives (DPD), Provincial and Regency/City Representatives Council (DPRD) and the elections for the Governor and Deputy Governor, the Regent and Deputy Regent, the Mayor and Deputy Mayor, face formidable challenges. In order to ensure the integrity of elections, this paper aims to investigate more comprehensively the involvement of the youth in participatory supervision. The research employs a qualitative approach based on a literature study to investigate more deeply related issues that arise in the context of participatory supervision, including the obstacles and challenges faced, the urgency of involving youth in overseeing the electoral process, and the efforts in developing democracy and being involved in the policy-making process in accordance with the applicable laws and regulations, as well as realizing synergy and collaboration between stakeholders related to cooperating with youth as the main element in realizing people's sovereignty.

Abstract

Political participation is the activity of individuals or groups that participate actively in politics by electing state leaders directly or indirectly, as well as inuencing government policies. The Election Supervisory Agency (Bawaslu) decision to invite youth to participate in quality democracy is an important breakthrough for the Election Supervisory Agency (Bawaslu). This paper uses qualitative analysis and library methods to analyze secondary data by elaborating on relevant materials, both primary and secondary. The conclusion of this paper is that the Participatory Supervisory Cadre is an investment by the Election Supervisory Agency (Bawaslu) in youth as an effort to build hope for a better quality democracy in the general election. Furthermore, the political participation of the Participatory Supervisory Cadre (SKPP) participants in the context of the 2020 election has been proven by their role as reporters and initial information providers. This indicates that the Participatory Supervisory Cadre (SKPP) is well-versed in electoral regulations and has made a genuine contribution to electoral law enforcement.

Abstract

The implementation of the General Election and Local Leader Election (Pilkada) requires the cooperation of numerous parties. One of them is by involving all community groups to be involved in supervision at every stage. Community involvement in elections is not only manifested in the form of people coming to polling stations and exercising their right to vote. One of the Election Supervisory Agency's (Bawaslu) mission is to encourage community-based participatory supervision. However, before reaching election supervision, community involvement in guarding democracy must first go through a process of socialization and the transfer of knowledge and skills in election supervision. The Participatory Monitoring Village is one of the national priority programs for participatory supervision that is being developed by the Election Supervisory Agency (Bawaslu) in West Java, where there is a group of people with the same area and concern for the progress of democracy and identical pioneering the monitoring village movement. The participatory monitoring village activities are comprised of two major components: the Citizens' Forum and Face-to-face Socialization by delivering materials on democracy, elections and participatory supervision. The community participates in the follow-up to these activities by monitoring and reporting fraud to the Election Supervisor.

Abstract

The incompatibility of the number of election supervisory personnel with a heavy workload is a human resource (HR) problem that must be addressed in the run-up to the 2024 General Elections and Simultaneous Elections. In addition, the room for evaluating the institutional governance of election organizers through the revision of the Election Law has been closed. This issue is certainly a challenge that Bawaslu must address by improving the quality of human resources and expanding the role of the community so that they are more actively participating in election supervision to create an honest, fair, and quality electoral process. Participatory supervision can be a solution to Bawaslu's problems related to the incompatibility of human resources in facing the 2024 General Elections and Simultaneous Elections.

Abstract

Election Supervisory Agency (Bawaslu) is responsible for conducting elections in a democratic and dignied manner. Thus, the code of ethics becomes an integral and inherent value in the souls of election supervisors. In the local context, West Java is the area with the most Final Voter List (DPT), so the problem is more complex, including the number of complaints about alleged violations of the code of ethics against election supervisors. This paper uses a descriptive qualitative analysis method with a literature study through the study of Election Organizer Ethics Council (DKPP) decisions. As a result, it is proven that during the 2020–2021 period, there were 13 complaints of alleged violations of the code of ethics against the Election Supervisory Agency (Bawaslu) with 50 people competing, including 5 strong warnings, 23 warnings, and 22 rehabilitations. This demonstrates that there are two reasons, namely the existence of internal violations, both in terms of integrity and professionalism, and a lack of socialization and information on Bawaslu's work to the public. The challenges ahead are conducting strict recruitment, comprehensive guidance and technology, strengthening and consistency, maintaining integrity and professionalism, the priority of the prudence principle in speech, action, and decision making, and ensuring each division performs public relations work and publishes persuasively.

Abstract

Participatory supervision is a means given to the community for providing direct control over the implementation of elections to realize democratic elections. The effectiveness of the participatory supervision must be measured by certain parameters, one of which is the submission to Bawaslu of reports of alleged election and violation. However, it is necessary to study further the extent to which the effectiveness of participatory supervision can realize democratic elections, particularly in terms of reporting alleged violations to Bawaslu. This paper uses a qualitative research methods by identifying and conducting an understanding of the literature to see the benchmarks for the effectiveness of participatory supervision. The effect of participatory monitoring on the realization of democratic elections has a considerable impact on the development of democracy in Indonesia, due to an increase in public participation during the previous election period, especially in terms of submitting information and reports of election violations. The effect of participatory supervision has also increased public awareness and concern for democratic, integrity, and dignified elections.

Abstract

Banyak keuntungan yang dapat diperoleh dari proses digitalisasi, namun masih banyak permasalahan dalam pelaksanaan digitalisasi hukum di Indonesia. Wacana digitalisasi penegakan hulcum pemilihan umum masih menjadi perdebatan sehingga harus dikaji secara serius agar dapat dilaksanakan pada Pemilu di Indonesia. Penulis menganalisis berdasarkan kajian normatif yuridis terkait dengan permasalahan digitalisasi dalam penegakan hukum di Indonesia dan menawarkan solusi untuk mengatasi kendala digitalisasi Pemilu dan penegakan hukum Pemilu. Dalam penegakan hukum pemilu Bawaslu harus memeriksa, mengkaji, menindaklanjuti; dan memantau kasus pemilihan umum, agar sesuai dengan prosedur dan peraturan. Penyelenggaraan Pemilu harus menyiapkan teknologi; mengatasi permasalahan Cybercrime; menyusun regulasi; mempermudah birokrasi; mengatasi kendala kondisi geografis; memperkuat profesionalitas dan integritas Penyelenggara Pemilu; termasuk kemampuan sumber daya -manusia dalam pelaksanaan teknis digitalisasi penegakan hukum Pemilu. Struktur Hukum, Substansi Hukum dan Budaya Hukum dapat diterapkan untuk mempengaruhi keberhasilan penegakan hukum di suatu masyarakat yang saling bersinergi untuk penegakan hukum. Kesiapan KPCI dalam pelaksanaan digitalisasi pemilu harus diiringi dengan upaya Bawaslu mewujudkan transparansi dan akuntabilitas digitalisasi penegakan hukum Pemilu.

Abstract

Pelaksanaan pengawasan pilkada di era pandemi memiliki banyak tantangan. Dari sekian banyak tantangan yang dihadapi, dibutuhkan adanya inovasi yang bisa meningkatkan keterlibatan masyarakat sehingga semakin luas, sistemik, terstruktur dan integratif. Penggunaan teknologi informasi dalam pengawasan pilkada menjadi keniscayaan. Tulisan ini mengkaji secara spesifik untuk mengukur sejauh mana efektifitas penerapan teknologi informasi dalan pelaksanaan pengawasan tahapan sehingga mampu memenuhi tuntutan publik atas penyelenggaraan yang berkualitas, berintegritas serta dapat meningkatkan kepercayaan publik. Bawaslu dengan terobosan inovasi proses pengawasan berbasis digital melalui sistem informasi pengawasan Pemilu (Siwaslu) dan Gowaslu menjadi jawaban atas kebutuhan masyarakat dalam pengawasan pilkada yang inklusif dan aksesibel, baik bagi pemilu, peserta, maupun penyelenggara pilkada. Aplikasi tersebut dapat membantu hasil pengawasan secara cepat berkelanjutan. Meski dalam pelaksanannya terdapat beberapa evaluasi dan catatan sebagai bahan perbaikan. Penelitian ini adaìah penelitian kualitatif dengan analisis deskriptif. Adapun pengumpulan data dilakukan dengan menggunakan studi literatur melalui kajian pustaka yang terkait dengan pokok bahasan sebagai data primer.

Abstract

Pemilu merupakan ciri utama dari negara demokrasi, menghadirkan pemilu yang baik perkembangan, pada era perkembangan teknologi yang begitu pesat diperlukan adanya penyesuaian mekanisme dan prosedural berkenaan dengan penegakan hukum pemilu yang saat ini masih terbatas pada wilayah administrasi, tentunya hal ini menjadi penting adanya mengingat terdapat beberapa penanganan pelanggaran lain dalam pemilu. Metode penelitian yang digunakan dalam penelitian ini adalah adalah metode yuridis normatif, yakni yaitu penelitian terhadap kaidah hukum positif dan asas hukum yang diiakukan dengan cara melakukan evaluasi terhadap kaidah-kaidah 11L1kt011 (peraturan perundang-undangan) yang relevan. Kesimpulan dari penelitian ini adalah penggunaan teknologi informasi sangat penling bagi penegakan hukum pemilu karena menghadirkan efektivitas dan efisiensi waktu dan proses penanganan pelanggaran dan pengamanan tehadap data-data pelanggaran, serta memudahkan bagi para pelapor mengajukan Iaporan dugaan pelanggaran.

Abstract

Sejak pemilu pertama tahun 1955 hingga Saat ini, terutama sejak diberlakukannya sistem pemilihan langsung kepala daerah, persoalan netralitas birokrasi dan penyalahgunaan kekuasaan semakin mengemuka, Kehadiran norma padal 71 LILI nomor 1 tahun 2015 menjadi instrumen hukum untuk memastikan netralitas birokrasi dan mencegah abuse of power. Namun upaya penegakan hukumnya seringkali mengalami kendala karena adanya perbedaan persepsi dan penafsiran diantara para penegak hukum. Bagaimana penafsiran hukum terhadap beberapa frasa yang dipergunakan dalam pasal 71 ini? Peneliti mengkajinya dengan menggunakan pendekatan conceptual approach yang dipadu dengan Studi atas beberapa putusan pengadilan. Peneliti menemukan bahwasannya norma Pasal 71 dimaksudkan untuk menjaga marwah birokrasi agar dapat tetap mempertahankan netralitas dan professionalismenya. Penggunaan delik formil dalam memaknai frasa "menguntungkan atau merugikan " ( ayat (I) dan (3)) sangat penting untuk mencegah praktek penyalahgunaan sumber daya negara untuk kepentingan politik elektoral. Sedangkan ruang lingkup pemaknaan atas frasa "petahana" (ayat (2) dan (3)) sebaiknya dimaknai dalam arti luas.
