Abstract

This study analyzes the nature and concept of Ibn Rushd's ijtihad in completing fiqh ikhtilaf among the ulama. He is known for his expertise in philosophy, logic, medical, and the fields of jurisprudence and jurisprudence (Islamic law). It can be proven in his monumental work "Bidayah al-Mujtahid wa Nihayah al-Muqtasid." This study conducted descriptive library research based on a normative theological approach. This study collected data from the primary source of the book "Bidayah al-Mujtahid wa Nihayah al-Muqtasid" and other relevant and related secondary sources and then analyzed it using content analysis techniques. The study results showed that: 1) Ibn Rushd has a rich experience and scientific background. He referred to many sources in his ijtihad that mostly came from the book al-Istiz\kar by Ibn Abd al-Bar, so those books influenced some of Ibn Rushd's ijtihad decisions. Thus, Ibn Rushd cannot be considered an absolute mujtahid. 2) Generally, he is still guided by the ijtihad methodology outlined critically by the Ulama. Meanwhile, there are some approaches to solve the problem of ikhtilaf, such as first, the al-jam'u approach (compromise); second, al-tarjih (selecting among the most substantial arguments); third, al-jam'u baina al-jam'i wa al -tarjih (a combination of the al-jam'u and al-tarjih approaches); fourth, tawaqquf (silence); fifth, al-takhyir (optional).

Abstract

The objectives of this study are to: 1). Describe and analyze the concept of wages regulated by the government, 2). Discover workers/laborers response to government-regulated wages, and 3). Describe and analyze the government-regulated concepts based on the approach of the two main elements in maqashid sharia, such as hifzu an-nafs and hifzu al-māl. The author used a multidisciplinary approach to overcome the problems, namely a linguistic approach, normative juridical, and qualitative-descriptive methods to collect the data. This study was classified as library research; the data collected was analyzed using content analysis on literature that is representative and has relevance to the problem, then the comparison using comparative analysis was reviewed and concluded. After reviewing and analyzing policies in the form of established concepts, the wage provisions regulated by the government in law aim to provide a sense of justice for workers/laborers and align with the main principles in maqashid sharia. Even though Islam does not explicitly state the amount of wages in detail, it strictly requires anyone who provides work to pay wages/salaries to their workers. After reviewing the existing concepts, some problems were identified that need effort to resolve.

Abstract

Islamic law is based on strong and flexible principles that are suitable for every country, people, time, and era. There are three principles in Islamic law. First, it is not burdensome and removes difficulties. Second, maintaining the benefit of all human beings. The third is the comprehensive realization of justice. There are many forms of eliminating hardship and difficulty. Among them are in the aspect of worship, in the realm of muamalah and uqūbah (sanctions). In the aspect of worship, for example, the permissibility of qasar prayer, tayamum and iftar for travelers and sick people. A situation that is also related to this is the condition of medical personnel when performing surgical operations that require a short time to carry out. It is not uncommon for this to coincide with the time of prayer until it is close to the time limit. Sometimes, the surgery goes beyond the set prayer time, even entering the next prayer time. This research was conducted using a theological-normative approach or shar'ī approach presented qualitatively. Primary data sources come from verses of the Qur'an, the Prophet's hadith. Secondary data is obtained from various sources, namely literature that studies the concept of al-taisīr, scientific journal articles, print and online media. The data are analyzed by deductive method.

Abstract

يهدف هذا البحث إلى معرفة أنواع النعت ومعانيه في أحاديث الأربعين النووية للإمام النووي. وقام الباحث بالـمنهج الـمكتبي وتقريبه تقريب نحوي وينقسيم إلى منهجين، أولهما منهج جمع الـمواد وهو يدل على أن يستخدم الباحث في جمع الـمواد تبعا للبيانات الرئيسية والثانوية، وثانيهما منهج تحليل الـمواد وهو يدل على أن يستخدم في تبيين الأحاديث التي تتضمن أنواع النعت في أحاديث الأربعين النووية وفي إحصاء معاني النعت في أحاديث الأربعين النووية. ونتيجة البحث تدل على أن النعت تعدد في أحاديث الأربعين النووية سبعة عشر حديثا وهو نعت حقيقي من الـمفرد والـجملة الفعلية والاسمية وشبه الجملة ومعاني النعت تكونت من التخصيص والتوضيح والتأكيد والـمدح.

Abstract

The main problem in this study is how to analyze the increase in child marriage in Tempe District, Wajo Regency, from the Maqasid Syar'iah Perspective? The main problem is then broken down into several sub-problems or research questions, namely: 1) What are the Causes of the Increase in Child Marriage in Tempe District, Wajo Regency? 2) What are the solutions to reduce the increase in child marriage in Tempe District, Wajo Regency? 3) How is Maqasid Syar'iah Perspective on Increasing Child Marriage in Tempe District, Wajo Regency? his type of research is classified as qualitative with the research approach used is a juridical approach, a syar'i approach, and a sociological approach. The data sources of this research are Furthermore, the data collection methods used are observation, interviews, documentation, and reference tracing. Then, data processing techniques and data analysis were carried out through several stages, namely: data collection, data reduction, data presentation, and drawing conclusions. The results of this study indicate that 1) The factors that cause an increase in child marriage in Tempe sub-district, Wajo Regency, are: a) educational factors; b) economic factors; c) cultural factors; d) community mindset factors; e) factors of pregnancy out of wedlock. 2) Solutions in suppressing the increase in child marriage in Tempe District are: a). Provide services in the field of administration including registration of marriage, divorce and reconciliation as well as other records related to the duties and roles of KUA; b) Providing Counseling and Socialization of the Marriage Law; c) Providing services in the field of marriage and sakinah families. 3) Maqashid Sharia perspective on child marriage Whether or not child marriage can be seen from one maqashid point of view, such as hifz al-nasl to avoid adultery. 1) However, it is also necessary to look at other maqashid values ​​so that the sharia maqashid analysis does not overlap. 2) The implications of this research are: 3) For the people of Tempe District, Wajo Regency, to always follow and obey all government regulations, especially regarding Law no. 16 of 2019 concerning marriage. The local government should give warnings or sanctions for people who violate the rules of Law no. 16 of 2019 concerning Marriage, especially the age limit. 3) KUA employees in the field of penghulu can optimize the penghulu to socialize and emphasize the importance of getting married according to the age limit that has been determined by law. Both through marriage advice and when invited to religious activities.

Abstract

Ḥadīth, as the second primary source of Islam, is shrouded in many issues. Its application among the Sufis has attracted an array of attention. This is because they (Sufis) appear not to be in absolute compliance with the conventional methods of ḥadīth narration, authentication and application as put in place by Muḥaddithūn and widely used by scholars, especially the Salafiyyah. This study examines the Sufis’ approach to the usage and application of ḥadīth, especially their adherence to the rules of ḥadīth authentication. The analytical method of research is adopted in this study. It avails the opportunity to analyze various texts and scholars’ submissions on the science of ḥadīth as related to this study. It is discovered from this study that the Sufis, in most of their applications of ḥadīth, downplayed the rules as set by Muḥaddithūn due to their belief that the Prophet is still alive, even after his demise, and that direct link or connection with him is possible. So, they do not need stringent conditions to establish a report from the Prophet or act on it. It is also discovered that the bulk of narrations at the Sufis’ disposal are considered to be of weak or fabricated status. However, ḥadīth of the weak category can still be applicable in the realm of meritorious acts (faḍā’il), according to majority of the scholars. It is also discovered that some Sufis hold that as long as a particular narration does not contradict the principles of Islam, ascribing such to the Prophet should be less controversial. This s, therefore, concluded that Sufis flouted the rules of ḥadīth authentication with good intentions and attached importance to their propositions to make them gain wider acceptance from the people.

Abstract

Artikel ini membahas tentang Mistisisme dalam Falsafah Jou se ngofangare di Kesultanan Ternate. Jenis penelitian ini adalah penelitian lapangan. Adapun Pendekatan metodologi yang digunakan adalah pendekatan historis filsofis, dan fenomenologi, sumber data yang digunakan adalah sumber data primer dan data sekunder metode yang digunakan yaitu: Pengamatan (observasi), Wawancara (interview) yang di dalam wawancara terdapat wawancara terstuktur (struktured Interview), dan wawancara Mendalam serta Dokumentasi. Teknik analisis data adalah analisis deskriptif. Hasil penelitian menunjukkan bahwa, 1. Di wilayah Ternate Maluku Utara telah mengalami peradaban Tauhid sebelum kedatangan Islam. Orang Ternate telah mengetahui Tuhan dengan sebutan Jou. Tuhan sebagai Dzat tertingi Giki Amoi (Tuhan yang Satu) 2. Mistisisme yang dimiliki oleh Kesultanan Ternate suda lebih dulu sebelum kedatangan Islam. Di Ternate, dikenal dengan Jou se Ngofangare landasannya adalah Tuhan yang bersifat immateril. Padangan hidup tidak boleh dipisahkan dengan adanya mencari Tuhan dengan konsep budayanya masing-masing. Suba Jou merupakan segalah yang tidak bisa dipisahkan dari hubungan antara Tuhan dan hamba-Nya yang dilakukan sepanjang hidupnya di dunia dan diahirat. 3. Falsafah yang dianut oleh kesultanan Ternate, dijadikan sebagai pandangan hidup masyarakat dengan aturan-aturan yang ditetapkan oleh Kesultanan Ternate, disebut sebagai hukum adat. Sembilan hukum adat Kesultanan Ternate yang mengandung makna religi yaitu: Adat se Atorang, Istiadat se Kabasaran, Galib se Lakudi, Sere se Duniru, Cing se Cingare, Baso se Rasai, Cara se Ngale, Loa se Banar, Duka se Cinta, Baso se Hormat. Implikasi penelitian ini adalah, pertama peneliti, harapkan bagi masyarakat kesultanan Ternate terutama masyarakat adat, para ulama, dan para pemimpin Kesultanan Ternate agar selalu meningkatkan Falsafah dan Mistisisme dikesultanan Ternate agar selalu hidup dan berkembang sesuai dengan adat seatorang. Kedua diharapkan kepada Kesultanan Ternate terutama selaku petugas Kesultanan bobato dunia dan bobato ahirat agar hendak melakukan pelayanan kepada masyarakat hususnya masayarakat (balakusu se kano-kano). Ketiga. Diharapkan kepada pemerinta kebudayaan untuk mengintensif sosialiasi-sosaliasi tetang pencatatan budaya sampai kedesa-desa terpencil.

Abstract

إن بعض شباب الإندونيسين اليوم يعجلون النكاح بأسباب، وقد تركوا منهجم السليمة وعودوا منهجهم الزوجية بالرجوع إلى ما نهج به التكنولوجية ، ومن المعلوم أن القرآن هو من أفضل المنهج ليسيل إلى حقائق السعادة، والطرق لمعرفة أسراره هي بتفسير، ولقد قام بعض المفسرين تفسيره بغير مراعاة أسباب النزول بل أنهم يلحقونه فيبعد معناه من حقيقته، ولا سيما يقوم على هذا العمل المفسروون المعاصرون، فلمن يعرف أهمية أسباب النزول ومكانته فإنهم رأوا أنها من آلات أو أدوات لفهم كلام الله ، والنكاح كان من أمر ضروري عند معظم الناس، وقد أخذ أكثرهم ببحثه، وكانت سورة النور من أحد السور التى تبين عن هذه المسألة. وإن هذه الدراسة تهدف إلى معرفة الأمور ما يتعلق بأسباب النزول و مناسبتها بشباب الإندونيسين اليوم ،وتحدد البحث في سورة النور الآية 32-33، واستخدم الباحث منهج الوصفي والتحليل في كتابة هذه الدراسة واسنتدت طريقة جمع بياناتها بالاطلاع والقرآءة المتكررة على تلك الآية حسب أراء المفسرين الذين قاموا بتفسير هذه الآية من حيث أسباب نزولها ومنسابتها ، وتوصلت الدراسة إلى نتائجها، منها أن هذه الآية تحث على أداء النكاح لمن الباع، والمنع على تحقير الفقراء لما لديهم من النقصان، والسن المثالى له لما عنده الزاد خص فيه في النكاح.

Abstract

Fenomena childfree di Indonesia telah menjadi topik yang menarik perhatian, terutama di kalangan masyarakat Muslim yang menghadapi tantangan modernisasi, perubahan sosial, dan dinamika kehidupan urban. Penelitian ini bertujuan untuk menganalisis fenomena childfree dari perspektif maqasid al-syariah, yang merupakan tujuan-tujuan syariat dalam Islam. Dalam konteks ini, pernikahan tidak hanya dilihat sebagai ikatan biologis antara pria dan wanita, tetapi juga sebagai sarana untuk menjaga keberlangsungan umat manusia dan melahirkan keturunan yang berkualitas. Hasil penelitian menunjukkan bahwa meskipun pilihan untuk tidak memiliki anak dapat dipahami sebagai bentuk kebebasan individu, hal ini bertentangan dengan prinsip-prinsip maqasid al-syariah yang menekankan pentingnya melestarikan keturunan dan mencapai kemaslahatan bagi masyarakat. Dalam Islam, pernikahan memiliki tujuan yang lebih luas, termasuk membentuk generasi yang saleh dan bertakwa kepada Allah, serta berkontribusi pada kesejahteraan masyarakat. Fenomena childfree juga mencerminkan perubahan nilai dan pandangan masyarakat terhadap pernikahan dan keluarga, di mana banyak pasangan memilih untuk fokus pada karier, kebebasan pribadi, dan kualitas hidup. Pilihan ini sering kali dipicu oleh kekhawatiran tentang kondisi dunia yang tidak stabil dan tantangan dalam membesarkan anak. Dengan demikian, fenomena ini perlu dipertimbangkan secara kritis dalam konteks nilai-nilai Islam dan dampaknya terhadap struktur sosial. Penelitian ini diharapkan dapat memberikan wawasan yang lebih dalam mengenai implikasi sosial dan budaya dari pilihan childfree serta mendorong diskusi lebih lanjut tentang pernikahan, keturunan, dan tanggung jawab sosial dalam perspektif Islam.

Abstract

Penelitian ini bertujuan untuk mengkaji konsep moderasi beragama dalam Islam, pesan-pesan moderasi dalam Al-Quran, dan nilai-nilai moderasi beragama berdasarkan pemahaman hermeneutik. Metode yang digunakan adalah kualitatif dengan pendekatan deskriptif-analisis, serta menerapkan hermeneutik untuk menafsirkan teks dan mendapatkan makna yang mendalam. Data diperoleh melalui penelitian pustaka dengan mengutip dan menganalisis literatur yang relevan. Hasil penelitian menunjukkan bahwa konsep moderasi beragama dalam Islam dikenal sebagai wasathiyah, yang dipahami sebagai upaya menjaga keseimbangan dalam beragama. Beberapa ulama, seperti Yusuf al-Qardhawi, al-Ghazali, dan al-Qurthubi, memberikan penafsiran yang menekankan pentingnya keseimbangan antara kehidupan dunia dan akhirat serta keadilan. Wasathiyah berfungsi sebagai panduan bagi umat Islam untuk menghindari ekstremisme dan radikalisme, serta untuk mengembangkan sikap toleransi dan saling menghormati antarumat beragama. Pesan-pesan moderasi dalam Al-Quran dapat ditemukan dalam ayat-ayat seperti Q.S. al-Maidah [5]: 8 dan Q.S. al-Anbiya [21]: 107, yang menekankan nilai keadilan (ta’adul) dan keseimbangan (tawazun). Telaah hermeneutik terhadap nilai-nilai moderasi dalam Al-Quran, khususnya dalam Q.S. al-Baqarah [2]: 143, menyoroti pentingnya posisi umat Islam sebagai umat pertengahan yang menjadi saksi atas perbuatan manusia. Substansi dari wasathiyah mencakup harmoni antara keyakinan dan moral. Penelitian ini menegaskan pentingnya aktualisasi moderasi beragama sesuai dengan prinsip-prinsip yang terkandung dalam Al-Quran, serta menunjukkan bahwa pemahaman terhadap pesan-pesan moderasi harus dilakukan secara komprehensif untuk menemukan titik temu dalam dimensi esoteris kehidupan beragama, sehingga dapat menciptakan masyarakat yang harmonis dan toleran.
