Abstract

This article analyzes the differences between conventional banking and Islamic banking systems in Indonesia, focusing on their operational principles and products. Indonesia, as a country with a large population and a Muslim majority, has two banking systems, namely conventional banking and Islamic banking. This article aims to provide a better understanding of these two banking systems and their implications for the development of an inclusive and sustainable financial system in Indonesia.

Abstract

One of OJK's steps in regulating this sector is through OJK Regulation Number 77/POJK.01/2016 concerning Information Technology-Based Money Lending Services. This regulation provides detailed provisions regarding the implementation of online loan services as well as educational obligations for the public to increase knowledge and understanding of financial institutions, financial products, and financial services (Mohammad Amin El Fajri, 2018). However, because there are still many illegal online loan practices, OJK is actively eradicating illegal online loan providers. This study is a qualitative descriptive study with a normative perspective. The main data is obtained from the results of a literature review. Data analysis uses qualitative analysis. The results of the study show that the supervision carried out by OJK so far has had a positive impact, especially in increasing the sense of security and legal protection for consumers, raising public awareness of their rights, and encouraging industry players to carry out healthy business practices. However, challenges such as the rise of illegal online loans, illegal collection practices, weak supervision of third parties, and the transfer of some regulatory authority to industry associations, indicate that the OJK needs to continue to update and strengthen regulations that are more assertive, systemic, and integrated.

Abstract

This study examines the shame culture phenomenon in the context of constitutional enforcement in Indonesia, particularly through a critical lens on the Constitutional Court Decision Number 90/PUU-XXI/2023. The research investigates the transformation of the Constitutional Court's role from merely a negative legislator to a positive legislator, along with its ethical and constitutional implications. The research method used is normative juridical with conceptual and case approaches. The results indicate the subordination of shame culture to political interests in Constitutional Court decision-making, which potentially degrades the values of constitutionalism and judicial ethics. This study concludes that strengthening shame culture within constitutional judicial institutions is an urgent need to re-establish the constitution's dignity as an instrument for limiting power and preventing authoritarianism. Research recommendations include reforming the selection mechanism for constitutional judges, strengthening judicial codes of ethics, and increasing public participation in constitutional judicial oversight.

Abstract

Ethical violations in the form of bribery among law enforcers (judges, prosecutors, police, and advocates) have become a systemic problem in Indonesia, undermining the principles of justice and public trust. This study aims to identify the forms of violations, driving factors, and strategies to eradicate bribery through a qualitative approach with a literature study method. The results show that ethical violations in the form of bribery/gratification, abuse of authority, conflict of interest, manipulation of evidence, and the role of intermediary advocates/clerks dominate cases such as bribery against Judge Ronald Tannur and gratification at the Juanda Airport Customs. The causal factors include weak individual integrity, materialistic work culture, ineffective supervision systems, weak legal sanctions, and political intervention. Proposed solutions include strengthening internal supervision, anti-corruption education from an early age, legal reform with strict sanctions, and protection for whistleblowers. This study emphasizes that eradicating bribery requires a holistic effort to restore the integrity of the legal profession and public trust.

Abstract

Bank credit agreements are legally binding arrangements between debtors and creditors, including when the debtor passes away. In such cases, legal responsibility for the outstanding debt may be transferred to the substitute heirs. This study aims to examine the legal liability of substitute heirs in bank credit agreements and analyze acts of default or unlawful conduct that may arise when obligations are not fulfilled. The research employs a normative legal method with a descriptive approach and juridical analysis of legislation, jurisprudence, and legal doctrines. The results show that substitute heirs bear limited liability based on the portion of inheritance received. However, in practice, breaches of obligation often occur, either due to ignorance or intentional neglect, resulting in legal consequences that harm the bank as creditor. Therefore, strengthening regulations and educating the public on the legal responsibilities of heirs are essential to ensuring legal certainty and balanced protection for all parties in the banking system.

Abstract

This article aims to examine the ethical and juridical aspects of the neutrality stance taken by the Vice Regent of Garut, Luthfianisa Putri Karlina, in response to the sweeping actions conducted by the Islamic Ummah Alliance (AUI) against eateries operating during the day in Ramadan 2025. The study analyzes the suitability of the Vice Regent's reprimand actions against the organization within the legal framework and principles of public official neutrality in Indonesia. Through a juridical-normative approach, the research identifies that despite the issuance of a Community Compliance Decree by Forkopimda and MUI of Garut Regency, the decree is merely advisory and lacks the binding legal force of a regional regulation. The findings show that the Vice Regent's actions in reprimanding the religious organization were carried out in accordance with the authority outlined in Garut Regent Regulation Number 202 A of 2009 and align with the principles of due process of law and interfaith tolerance values. The study highlights the importance of balancing the enforcement of religious norms and protecting citizens' rights to engage in economic activities, particularly in multicultural societies. This case underscores the dilemma faced by public officials in addressing demands from majority groups while upholding good governance principles. The research reveals that the Vice Regent's firmness in condemning intimidation strengthens the government's legitimacy as a protector of diversity and guarantor of social order and justice. The findings contribute to developing an ethical decision-making model for public officials facing socio-religious pressures in regional governance and enrich understanding of the boundaries of public officials' authority in maintaining neutrality, legal interests, and socio-religious dynamics.

Abstract

Credit agreements as principal agreements are often followed by additional agreements such as collateral, which are interrelated in their implementation. This study aims to analyze the legal relationship between the principal agreement (credit agreement) and additional agreement (collateral) and the legality of collateral retention by creditors in the case of Supreme Court Decision No. 1733 K/Pdt/2014. The background of this study is based on a dispute between debtors and creditors regarding default, debt collection that is not in accordance with the agreement, and retention of collateral certificates without a clear legal basis. The research method used is a normative legal approach with an analysis of legal documents and court decisions. The results of the study indicate that credit agreements as principal agreements have direct implications for the validity of additional agreements, especially in terms of collateral execution. The Supreme Court ruled that the creditor's action of withholding collateral without a legal basis violated the principles of contract law, so that some of the debtor's demands were granted. In conclusion, this case emphasizes the importance of transparency and balance of rights and obligations in credit agreements to ensure legal certainty for the parties.

Abstract

Providing legal certainty is a crucial aspect in creating a conducive investment climate for business actors. One of the Indonesian government's efforts to realize this is through the implementation of an integrated electronic-based business licensing system, namely the Online Single Submission (OSS). This study aims to analyze the extent to which the OSS system is able to provide legal certainty for business actors in obtaining business licenses. The method used is normative juridical with a statutory regulatory approach and literature studies on various related regulations, such as the Job Creation Law and its implementing regulations. The results of the study show that although OSS provides easy access and efficiency of the licensing process, there are still a number of obstacles that affect legal certainty, such as data inconsistency between institutions, sudden changes in regulations, and limited understanding of business actors regarding the OSS system. Therefore, it is necessary to improve the system, increase coordination between institutions, and provide ongoing legal counseling in order to realize a transparent, accountable, and efficient licensing system.

Abstract

The misuse of firearms by members of the Indonesian National Armed Forces (TNI) constitutes a serious violation that not only breaches military discipline but also poses a threat to civilian security and public trust. This study aims to analyze the legal considerations in military court decisions involving soldiers who have misused firearms, as well as to assess the effectiveness of verdict implementation, the forms of legal accountability imposed, and the impact of public pressure on judicial proceedings. Using a normative juridical approach and case studies of several military court rulings, the findings indicate inconsistencies in sentencing, the influence of the defendants’ relationships with superiors, and a lack of transparency and internal oversight. Moreover, public pressure plays a significant role in shaping judicial outcomes—both as a driver of justice and as a potential threat to judicial independence. Reform of the military justice system is needed through strengthened oversight mechanisms, improved disciplinary training, and safeguarding judicial independence in order to achieve substantive justice and uphold public confidence

Abstract

Tulisan ini membahas tanggung jawab negara atas pelanggaran hak asasi manusia (HAM) dari perspektif hukum internasional. Dalam hukum internasional, negara bukan hanya wajib menghormati HAM, tetapi juga bertanggung jawab apabila melanggar atau gagal mencegah pelanggaran tersebut. Artikel ini mengulas aspek normatif dan institusional dari tanggung jawab negara, mulai dari sumber hukum, yurisdiksi, hinggamekanisme reparasi. Pembahasan mencakup peran lembaga internasional, pengaruh aktor non-negara, dan dinamika implementasi di negara-negara berkembang. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan deskriptif-analitis, dan merekomendasikan penguatan sistem internasional untuk penegakan tanggung jawab negara atas pelanggaran HAM
