Abstract

Development of a modern period and globalization have increased various social interaction. Such interaction may vary from free sex to unregistered marriage to cover disgrace. The status of children resulted in unregistered marriage is not clear in society whether they are legitimate or not, especially in terms of inheritance. There are three laws of inheritance prevailing in Indonesia, each has advantages and disadvantages, as well as different purpose. This research proposes to reveal the status of children resulted from unregistered marriage in accordance with the Indonesia positive laws, and that according to Islamic Law. This research is a legal research. The approach used is the statutory approach by reviewing the laws related to the inheritance of unregistered marriage, and comparative approach by comparing two existing inheritance laws in Indonesia, that is civil law and Islamic law. Children from unregistered marriage Have the same position as legitimate children in Indonesian law Nevertheless, there are two things that make difference, that is in term of identity and in inheritance, children from unregistered marriage Have the same position and part of inheritance as legitimate children, provided that the children have been authorized. While in Islamic law, children from the unregistered marriage and legitimate marriage have the same position although they have not been authorized. In both perspectives, marriage should be registered and get a certificate, otherwise, the children are categorized as those of outside marriage. So that, without recording a child’s identity, that children considered outsider child.

Abstract

Family mediation constitutes an alternative instrument for resolving domestic conflicts that emphasizes a dialogical and reconciliatory approach rather than rigid litigation procedures. This study aims to analyze the position of family mediation from both normative and psychological perspectives by examining the relevant legal regulations and their implications for the mental well-being of the parties involved. Normatively, the research is grounded in Law Number 1 of 1974 as amended by Law Number 16 of 2019 on Marriage, Law Number 23 of 2004 on the Elimination of Domestic Violence, and Supreme Court Regulation Number 1 of 2016 concerning Mediation Procedures. From a psychological standpoint, mediation is viewed as capable of reducing tension, enhancing communication, and maintaining the continuity of family relationships. The findings indicate that family mediation has the potential to serve as a humane dispute resolution mechanism; however, its effectiveness remains constrained by limited legal awareness, a lack of professional mediators, and insufficient psychological protection for vulnerable parties. Strengthening regulatory frameworks and integrating psychosocial support are therefore necessary to ensure that family mediation functions as an adaptive and equitable legal instrument.

Abstract

Premarital counseling serves as both a legal instrument and an educational medium to prepare young couples for family life. Within the framework of Law Number 1 of 1974 as amended by Law Number 16 of 2019 on Marriage, marriage is regarded as a sacred bond that requires physical, mental, and spiritual readiness. This study aims to analyze the effectiveness of premarital counseling in shaping the preparedness of young couples from the perspective of family law. The research employs a normative-juridical method with a descriptive-analytical approach through the examination of statutory regulations, legal literature, and documents related to the implementation of premarital counseling programs in Indonesia. The findings indicate that premarital counseling contributes to enhancing young couples’ understanding of rights and obligations, conflict management, and child protection. However, its implementation still encounters challenges in terms of accessibility, curriculum standardization, and public legal awareness. Therefore, premarital counseling needs to be strengthened both regulatory and substantively to function effectively as a legal instrument in fostering harmonious and equitable families.

Abstract

Domestic violence constitutes a complex social and legal issue as it involves emotional, relational, and normative dimensions. Litigation-oriented approaches often generate further consequences in the form of family disintegration and deeper psychological trauma for both victims and perpetrators. Therefore, restorative justice is regarded as a relevant alternative in addressing domestic violence cases. This study employs a normative legal approach by examining statutory regulations, legal literature, and mediation practices oriented toward reconciliation. The analysis reveals that restorative justice has the potential to enhance victim protection while maintaining the continuity of family functions, although its implementation continues to face normative and structural challenges. Accordingly, the integration of family law values with restorative justice principles may offer a more humane, equitable, and relationship-oriented solution without neglecting the rights of victims.

Abstract

The increasing number of food poisoning cases in Indonesia in recent years reflects the weakness in food safety supervision and the low compliance of food business operators with health and safety standards. This study aims to analyze the factors contributing to the rise in food poisoning cases in Indonesia and examine the urgency of tightening legal sanctions against food business operators who violate food safety regulations. This research uses a normative juridical approach with library research methods, analyzing laws, scientific literature, and data on food poisoning cases published by relevant agencies. The findings indicate that the rise in food poisoning cases is influenced by weak supervision of food distribution, the use of hazardous substances, low hygiene awareness among food operators, and the inadequate enforcement of food safety laws. Furthermore, the current legal sanctions are considered ineffective in deterring violations, as they are still administrative and relatively lenient compared to the health risks posed to the public. Therefore, tightening legal sanctions through stronger regulations, improved coordinated supervision, and the imposition of stricter penalties and criminal sanctions against food business operators that endanger consumers is necessary. This study is expected to contribute academically and provide policy recommendations to strengthen the consumer protection and food safety system in Indonesia.

Abstract

The issue of minimum wage policy in Indonesia, particularly within the hospitality industry, remains a complex and ongoing debate. This policy plays a significant role in improving the welfare of workers; however, its implementation faces legal challenges and discrepancies between government regulations and practical realities. This study aims to analyze the problems associated with the minimum wage policy in the hospitality sector and the legal challenges faced by both workers and employers in its enforcement. The research employs a normative juridical approach using library research methods, including an examination of laws and regulations, related literature, and field data regarding the implementation of the minimum wage policy in the hospitality industry. The findings of the study reveal that although the minimum wage policy has been established to protect workers, its implementation remains uncertain. Legal challenges include the misalignment between the government-set minimum wage and the financial capacity of hotels, as well as differing interpretations of existing regulations. Additionally, there are practices of non-compliance by some employers, which adversely affect workers. The study recommends strengthening supervision of minimum wage implementation, simplifying regulations, and tightening sanctions for businesses that violate the rules in order to achieve social justice for workers in the hospitality sector.

Abstract

Illegal logging is a significant environmental issue in North Aceh Regency, which not only damages ecosystems but also threatens the livelihoods of communities dependent on natural resources. This study aims to analyze the role of Pawang Uteun, an indigenous institution, in combating illegal logging through the integration of customary law and state law. The Pawang Uteun plays a crucial role in regulating and conserving adat forests based on longstanding indigenous norms. Using a qualitative approach, this research gathers data through in-depth interviews with indigenous leaders, government officials, and local communities, as well as relevant literature review. The findings show that while state laws and regulations exist to address illegal logging, their implementation is often hindered by institutional limitations and resource constraints. In contrast, the customary law applied by Pawang Uteun has proven effective in managing forest use and engaging the community in direct oversight. The integration of customary law and state law strengthens the position of Pawang Uteun in combating illegal logging by providing socially accepted sanctions and fostering active participation in forest protection. This study recommends strengthening cooperation between indigenous institutions and the state to enhance monitoring of illegal logging and preserve adat forests, which are vital for the community's survival.

Abstract

The handling of incomplete corpses in emergency situations presents a complex issue, considering the importance of respecting the deceased in Islam and the challenges faced in emergency conditions such as natural disasters or accidents. This study aims to analyze the handling of incomplete corpses from the perspectives of Islamic law and forensic science. Specifically, this research examines Islamic legal provisions regarding the burial of incomplete corpses and discusses the dilemmas that arise in emergency situations, such as time constraints and the condition of the body. On the other hand, forensic science provides technical guidelines for identifying incomplete corpses and the procedures required to ensure the deceased's rights are respected, such as forensic analysis to recognize the identity of the deceased and further investigation. The research method used is a qualitative approach with an in-depth literature review on Islamic law related to corpse handling in emergency conditions, as well as the application of forensic principles in handling incomplete corpses. The findings show that although Islamic law regulates corpse handling in detail, in emergency situations, the procedures can be adjusted according to the principle of public welfare without diminishing the obligation to respect the deceased. In the context of forensic science, identification of incomplete corpses can still be performed using appropriate techniques, although standard procedures may not be fully applicable.

Abstract

In capital financing, cooperation is an essential component of economic activities, particularly within the Islamic economic system, which emphasizes principles of justice, partnership, and profit-sharing. This study aims to analyze the concept, legal foundation, and implementation of two main forms of capital cooperation contracts in Islamic law, namely mudharabah and musyarakah. This research employs a qualitative approach using a library research method by examining various sources such as the Qur'an, Hadith, classical fiqh literature, and relevant scientific journals. The results of the study indicate that mudharabah is a partnership between the capital owner (shahibul maal) and the entrepreneur or manager (mudharib), in which profits are shared according to a prior agreement, while losses are borne by the capital owner as long as there is no negligence on the part of the manager. Meanwhile, musyarakah is a partnership involving two or more parties who each contribute capital and share both risks and profits proportionally. Both contracts have strong legal foundations in Islamic law and reflect the principles of justice and balance in economic activities.The implementation of mudharabah and musyarakah contracts in contemporary economic practices, such as Islamic financial institutions, demonstrates that these contracts can serve as fairer alternatives to conventional interest-based financing systems. However, in practice, several challenges remain, including limited public understanding, business risks, and issues related to supervision and regulation. Therefore, enhancing public awareness and strengthening regulatory frameworks are necessary to ensure the optimal implementation of Sharia-based capital cooperation contracts.In conclusion, mudharabah and musyarakah are important instruments in the Islamic economic system, as they promote not only profit generation but also uphold values of justice, transparency, and public welfare.

Abstract

Migrant workers constitute one of the vulnerable groups frequently exposed to exploitation, discrimination, and violations of human rights, both in their countries of origin and in destination countries. In the Indonesian context, various cases involving violence, unpaid wages, and weak legal protection demonstrate the urgent need to strengthen safeguards for migrant workers. This article aims to analyze the protection of migrant workers from the perspective of Islamic law by emphasizing the principles of justice, humanity, and respect for human rights. The research employs a normative juridical method with a descriptive qualitative approach, through an examination of relevant Qur’anic verses, hadith, and fiqh literature, as well as a comparison with international legal instruments. The results of the analysis indicate that Islam emphasizes the importance of fair treatment of workers, the obligation of employers to provide decent wages, and the protection of human dignity as a mandate of Sharia. These principles are in line with international standards and, therefore, may serve as a normative and ethical basis for strengthening policies on the protection of migrant workers.
