Abstract

Digitalization has brought significant changes to the lives of indigenous communities, particularly in terms of social, economic, and cultural interactions. While it offers conveniences such as faster access to information, digitalization also has the potential to undermine local cultural identity and traditional values. The increasing dependency on technology, which is not equally distributed across indigenous communities, along with the spread of global culture that conflicts with local values, exacerbates this situation. Digitalization can serve as an opportunity to document and disseminate customary law through digital platforms such as social media, cloud-based applications, and GIS. However, the main challenges faced are the digital divide, the potential simplification of essential cultural values, and data security issues. Therefore, strengthening technological infrastructure, digital literacy education, robust data protection, and collaboration among the government, indigenous communities, academics, and technology practitioners are required. Through a holistic and collaborative approach, digitalization can become an effective tool to strengthen the presence of customary law as an integral part of Indonesia’s cultural identity in the modern era.

Abstract

Indonesian society is known for its plural legal system, in which customary law, Islamic law, and national law coexist and interact. In Oelet Village, East Amanuban District, East Nusa Tenggara, there exists a unique inheritance practice known as Palsait Naheun, which places the eldest son as the central figure in the inheritance process. This study aims to understand how the inheritance system is implemented according to local traditions and how it differs from the provisions of Islamic inheritance law. The research employs a literature review method with a descriptive qualitative approach, analyzing scholarly sources such as journals, theses, and relevant books. The findings show that the Palsait Naheun system reflects strong patrilineal cultural values, with inheritance being symbolically given to daughters and dominated by male heirs. Although this contrasts with Islamic law, which proportionally and explicitly guarantees women's inheritance rights, the local community perceives their customary system as a form of justice based on traditional norms. However, a growing awareness of gender justice according to Islamic principles has begun to emerge among the younger generation. This study suggests the need for intergenerational dialogue and educational approaches that respect customary values while accommodating more egalitarian principles of Islamic inheritance law.

Abstract

This study aims to analyze and also find out about the inheritance law in the Tengger tribe, which has a unique inheritance law that is passed down from generation to generation. The method used for this study is by using the literature review method. The results of this study indicate that the Tengger tribe has a bilateral inheritance system by equating boys with girls. For children who look after and care for their parents until they die, they will be given an award in the form of "hung land". If there is a problem or dispute in the distribution of this inheritance, then a deliberation and consensus will be held which will be attended by community leaders and the local village government. The inheritance law carried out in the Tengger tribe has quite striking differences with the national inheritance law, which upholds the values ​​of family, justice, balance, and obedience. Although the Tengger tribe's inheritance law system can be said to be quite different from national law, until now the Tengger tribe still continues to uphold and preserve this ancestral culture.

Abstract

This study discusses the role of Balinese customary law in resolving marital disputes using the Tri Hita Karana philosophical approach. Customary law contained in Awig-Awig not only functions as a normative rule but also contains spiritual values ​​rooted in Balinese Hindu traditions. Marriage is understood as a multidimensional event that unites two large families, so that marital conflict has a significant impact on the social structure of society. The study uses a qualitative literature review method to analyze the dispute resolution mechanism and the challenges of implementing customary law in the contemporary era. The results of the study indicate that dispute resolution prioritizes deliberation and mediation based on the Tri Hita Karana principle, which emphasizes harmony between humans and God, fellow humans, and nature. This approach has proven effective in maintaining social and spiritual balance. This study confirms the relevance of customary law as an integral part of a pluralistic national legal system, as well as a fortress for preserving local wisdom amidst the flow of modernization. The research findings provide an important contribution to the development of laws that are responsive to cultural diversity.

Abstract

Child marriage remains a significant issue in Indonesia, despite existing regulations that set a minimum legal age for marriage. This study examines Court Decision Number 442/Pdt.P/2023/PA.Krw, which granted a marriage dispensation to a minor without any urgent justification. The legal issues addressed include the judge's considerations in granting the dispensation and the extent of judicial authority in applying the principle of ius curia novit in such cases. This research employs a normative juridical and descriptive-analytical approach, using secondary data such as court decisions, marriage law, child protection law, judicial authority law, and relevant literature. The results showed that the decision was contrary to the relevant positive law which expressly prohibits underage marriage without urgency as mandated in the legislation. Granting dispensation without urgent grounds risks undermining the government’s efforts to prevent child marriage. Therefore, stricter regulations and oversight are needed to ensure the protection of children's rights.

Abstract

The marketing industry increasingly integrates diverse elements to enhance its impact on various corporate objectives. Across sectors, companies have adopted social media as a strategic platform for executing marketing initiatives, complemented by the utilization of influencers to bolster message credibility. This study aims to examine the relationship and contributory influence of social media marketing and influencer engagement on consumer purchase decisions. The research focuses on the Labubu brand, which experienced a significant surge in purchases during 2024. Data were collected through structured questionnaires completed by 97 respondents who met the defined sample characteristics. The study was conducted in Jakarta, targeting individuals who had made purchasing decisions regarding Labubu products. The findings reveal that both social media marketing and influencer involvement individually exert a statistically significant positive effect on purchasing decisions. Moreover, when considered concurrently, these variables jointly contribute a significant positive influence on consumers' decisions to purchase Labubu-branded products.

Abstract

Waqf is an act of worship with social and economic dimensions that plays a vital role in supporting the welfare of the community. In Indonesia, the concept of waqf has been known since the 13th century and is generally understood based on the Shafi'i school of thought, which emphasizes the eternal nature of waqf. However, administrative issues, particularly regarding the legality of waqf land, remain a challenge, including in Ujung Pandang District. This study aims to examine the data collection and certification process for waqf land carried out by the Ujung Pandang District Office of Religious Affairs (KUA), using a descriptive qualitative approach through direct observation of mosques and interviews with mosque administrators. The results show that of the nine plots of waqf land covering 0.68 hectares in the area, only one plot has been certified, while the rest lack formal legal status. The main obstacles include a lack of understanding of legal procedures, limited funding, and suboptimal assistance from the authorities. The Ujung Pandang Office of Religious Affairs (KUA) plays an active role in addressing these obstacles through systematic data collection and the preparation of reports as a basis for further policymaking. This study emphasizes the importance of optimizing data collection and certification of waqf land as an effort to maintain the blessings and sustainability of the socio-economic function of waqf, as well as the need for synergy between the KUA, the community, and related institutions to realize the legality and sustainable legal protection of waqf assets.

Abstract

Food security is essential for every country to achieve food self-sufficiency. A world filled with news and issues of climate change has led countries to prioritize their national interests, including in the context of food. The purpose of this study is to describe the food diplomacy strategy implemented by Indonesia and Japan in addressing food security issues in 2020. The method used is a qualitative method with a narrative and descriptive analytical approach. This study describes Indonesia's strategy in its cooperative relationship with Japan to improve Indonesia's food security in 2020. The results of this study indicate that in 2020, coinciding with the COVID-19 pandemic, food security issues arose. The Food and Agriculture Organization (FAO) has conveyed the threat of food scarcity during that period. In facing the COVID-19 pandemic, Indonesia is striving to stabilize the economy, one of which is by establishing international cooperation, namely cooperation with Japan.

Abstract

The transfer of employee duties from one work unit to another within a company is a common occurrence, the main purpose of which is to increase company productivity by distributing human resources optimally. This research was conducted at PT Semen Baturaja Tbk. As one of the operating companies of the Semen Indonesia Group, it does the same thing by implementing employee transfers to other operating companies. The purpose of this research was to see how much impact mutations have on employee morale. This research uses a descriptive method supported by quantitative data analysis, where data was collected from respondents totaling 35 employees who were carrying out EOD (employees on duty) throughout 2024 (January-December period). The methods used to process and analyze the data are the Product Moment Correlation Test, Correlation Test, and Correlation Coefficient Significance Test (t-Test). This research arrived at results that show a real influence between mutations on work morale as seen from the magnitude of the correlation coefficient of 0.880 and the coefficient of determination value at 77.44%. This means that the mutation variable has an influence of 77.44%, while various other factors have an influence of only 22.56%. The significance test obtained a result of 10.643, so Ho is rejected and Ha is accepted. This means that the influence of mutation on employee morale has a significant influence.

Abstract

This study aims to analyze the implementation of the Rethinking Plastics Project (2019-2022) in Tegal City in the context of marine plastic waste management and its contribution to the development of Government and Political Science. The method used is a qualitative approach with a case study design, involving the Maritime Affairs & Fisheries Service of the Tegalsari Archipelago Fisheries Port, the Tegal Bahari Children's Forum (Fantri), and waste management businesses in coastal areas. Data were collected through document analysis and analyzed using the process tracing method. The results show that although the project succeeded in reducing the percentage of plastic waste significantly at the peak of the intervention, the reduction cannot be fully attributed to the project due to limited coverage and duration of implementation. Local policies such as restrictions on single-use plastics and increasing the capacity of TPS (landfill sites) also played a significant role. This study emphasizes the importance of cross-sectoral collaboration and the integration of local policies with bilateral initiatives for sustainable plastic waste management. Recommendations include the establishment of a coordination forum, the development of incentive schemes, the expansion of inclusive education, and the strengthening of the circular economy through budget support and technical training. The contribution of this study lies in understanding the dynamics of cooperation between local governments and non-state actors in sustainable environmental management.
