Abstract

Drug abuse remains a serious public health and social issue in Indonesia, including in Samarinda, where the prevalence of narcotics misuse and the number of reported drug-related offences remain high despite a decline in rehabilitation participation. This study aimed to examine the implementation of the Narcotics Addicts Rehabilitation Programme by the National Narcotics Board (BNN) of Samarinda City and to identify the factors constraining its implementation. A qualitative descriptive approach was employed. Data were collected through interviews, observations, and documentation involving key informants selected using snowball sampling. The data were analysed using the interactive model of Miles and Huberman, while trustworthiness was ensured through credibility, transferability, dependability, and confirmability procedures. The findings indicate that the rehabilitation programme has been implemented through three principal services: outpatient rehabilitation, post-rehabilitation, and Community-Based Intervention (CBI). These services have generally been delivered in accordance with established operational guidelines and support clients' medical, psychological, and social recovery. Nevertheless, programme implementation continues to encounter internal challenges, including limited funding and uneven capacities among recovery agents, as well as external challenges, such as inconsistent client participation, adverse social environments, public stigma, economic constraints following rehabilitation, and reluctance among some individuals to seek treatment. The findings suggest that successful rehabilitation requires not only effective institutional services but also sustained support from families, communities, and relevant stakeholders.

Abstract

Domestic violence remains a significant legal and social issue that requires preventive efforts through strengthening public legal awareness. Limited understanding of the forms of domestic violence, victims' rights, and legal protection mechanisms may hinder efforts to prevent and address domestic violence. This study aims to analyze changes in participants' legal understanding of domestic violence prevention after participating in a healthy relationship education program. This study employed empirical legal research with a socio-legal approach and a pre-experimental One Group Pretest–Posttest Design. The study involved 38 members of Aisyiyah and Nasyiatul Aisyiyah as respondents. Data were collected through Google Forms-based pre-test and post-test questionnaires, complemented by reflective questions that were thematically analyzed as supporting data. Quantitative data were analyzed descriptively to examine changes in participants' levels of understanding. The results showed that the proportion of participants with a good level of understanding increased from 76.3% in the pre-test to 94.7% in the post-test. The improvement was particularly evident in participants' understanding of the forms of domestic violence, victims' rights and legal protection, and mechanisms for accessing legal protection. The thematic analysis of participants' reflections also indicated an increased understanding of the importance of healthy communication, premarital education, and continuous legal education in preventing domestic violence. These findings indicate that healthy relationship education can serve as a preventive measure to strengthen legal knowledge and understanding as part of the broader process of enhancing public legal awareness. The involvement of women's organizations also has the potential to expand community-based legal education in domestic violence prevention efforts.

Abstract

Socio-economic transformation has shifted the configuration of roles within the household, leading to the emergence of the phenomenon where wives act as the primary breadwinners (female breadwinner). This condition raises questions regarding the relevance of equal division of marital property (50:50) as mandated by Article 97 of the Compilation of Islamic Law (KHI). This study aims to analyze the argumentative basis for the proportionality of marital property division in the female breadwinner phenomenon and to examine the application of gender justice principles in Islamic law as an alternative normative framework to achieve substantive justice. The research method employed is normative juridical with statutory, conceptual, and case approaches. The legal materials were analyzed qualitatively using a descriptive-prescriptive content analysis method. The results of the study show that religious court practices, such as in the South Jakarta Religious Court Decision Number 3522/Pdt.G/2020/PA.JS, still tend to apply Article 97 of the KHI textually and rigidly by equally dividing marital assets despite the wife's highly dominant economic contribution. Furthermore, disparities and vertical inconsistencies were found across different court levels in responding to this imbalance of economic contributions. In fact, the integration of substantive justice theory, progressive law, the principle of al-'adl wal musawah, the Islamic legal maxim of al-ghunmu bil ghurmi, and the double burden theory provides a solid operational foundation to carry out legal breakthroughs. The implication of this study urges Religious Court judges to optimize their discretionary authority through progressive and gender-responsive legal interpretations, so that the division of marital property can be proportionally adjusted to the actual contributions of each party to uphold substantive and contextual justice.

Abstract

The transfer of a fiduciary collateral object without the fiduciary recipient’s written consent may harm the creditor and create legal liability for the debtor. This study analyzes the legal consequences of transferring fiduciary collateral without creditor approval and evaluates the judicial reasoning in Pasuruan District Court Decision Number 127/Pid.B/2012/PN.PSR. It employs normative legal research using statutory and case approaches. Primary, secondary, and tertiary legal materials were collected through a literature review and qualitatively analyzed through deductive reasoning. The findings demonstrate that an unauthorized transfer creates civil liability in the form of breach of contract and criminal liability under Article 36 in conjunction with Article 23(2) of Law Number 42 of 1999 concerning Fiduciary Security. The court’s reasoning in finding the defendant guilty was consistent with the established facts and mutually supporting evidence. Nevertheless, returning the vehicle to the defendant without expressly confirming the continuing fiduciary encumbrance creates legal uncertainty for the creditor. The return of evidence should not be interpreted as extinguishing the registered fiduciary right while the secured debt remains unpaid or the fiduciary recipient has not released its right.

Abstract

This study was motivated by a candidacy dispute in the 2024 Belu Regional Head Election concerning the eligibility of a former convict running for the position of Deputy Regent, which raised public concern regarding the accountability of the General Election Commission of Belu Regency in verifying candidate requirements. The study aimed to analyze the accountability of the General Election Commission of Belu Regency in the verification of candidate eligibility requirements for the 2024 Regional Head Election. A qualitative method with a case study approach was employed. Data were collected through interviews, observations, and documentation and analyzed using the interactive model of Miles and Huberman, consisting of data reduction, data display, and conclusion drawing. The analysis was based on Mark Bovens' Public Accountability Theory, which includes legal, procedural, and political accountability. The findings indicate that the General Election Commission of Belu Regency conducted candidate verification in accordance with applicable legal provisions, implemented administrative verification procedures, and maintained accountability through available dispute resolution mechanisms. However, greater transparency and more effective public communication remain necessary to strengthen public trust in electoral administration. The study concludes that the accountability of the General Election Commission of Belu Regency has been adequately implemented across legal, procedural, and political dimensions and recommends improving information transparency, inter-agency coordination, and public communication to promote more accountable, transparent, and democratic electoral governance.

Abstract

This study examines the legal regulation of facilitating sexual intercourse as a livelihood under Article 421 of the Indonesian Criminal Code and the legal objectives of increasing the applicable punishment by one-third. This study employed normative legal research using statutory and conceptual approaches. The legal materials comprised primary sources, including the Indonesian Criminal Code, Human Rights Law, and Child Protection Law, as well as secondary sources consisting of books, journal articles, and relevant legal literature. The materials were qualitatively examined using descriptive-analytical methods. The results demonstrate that Article 421 does not constitute an independent criminal offense but serves as a sentencing aggravation for offenses under Articles 419 and 420 when committed habitually or for profit as a livelihood. This aggravation reflects the offender’s greater culpability and the broader social harm caused by the continuous commercialization of sexual exploitation. It seeks to promote justice, legal certainty, and utility while preventing organized sexual exploitation and protecting human dignity and children’s interests. Nevertheless, the undefined standard of habitual conduct and the expansion of prostitution through digital platforms require careful interpretation to maintain effective enforcement without undermining legality and legal certainty.

Abstract

The status of widows in society is often perceived through various perspectives influenced by culture, social environment, and religious understanding. These perceptions frequently give rise to social stigma that affects widows' social standing within the community. This study aims to analyze community perceptions of widows' status and examine them from the perspective of Islamic Family Law in Tanjungsari District, Sumedang Regency. The study employed a qualitative research method with an empirical juridical approach. Data were collected through observation, interviews, and documentation, and analyzed using descriptive qualitative techniques. The findings reveal that community perceptions of widows remain diverse. While some members of society show respect and provide social support to widows, others continue to hold negative stereotypes shaped by cultural values and social constructions. From the perspective of Islamic Family Law, widowhood is a legally recognized status that does not diminish a woman's dignity. Islam guarantees various rights for widows, including inheritance rights, maintenance, child custody, and the right to remarry. The study concludes that the negative stigma attached to widows is inconsistent with the principles of justice, human dignity, and public welfare (maslahah), which constitute the primary objectives of Islamic Family Law. Therefore, enhancing religious and social education is essential to foster a more equitable, inclusive, and Islamic-based understanding of widows within society.
