Abstract

Aggravated theft committed jointly is a crime against property subject to heavier penalties under Article 363 of the Criminal Code. Decision Number 880/Pid.B/2025/PN Kis is relevant because Defendant Angga Afraga Nasrullah committed the theft with April, who is on the wanted list, with unequal roles, while the element of “committed together” was not separately explained in the judge’s considerations. This study analyzes the criminal responsibility of perpetrators of jointly committed aggravated theft in the decision. It uses normative juridical research with descriptive-analytical, statutory, and case approaches. Secondary data, consisting of primary, secondary, and tertiary legal materials, were collected through literature and document studies and analyzed qualitatively. The results show that aggravated theft committed jointly is regulated through Article 362 as the principal offense, Article 363 paragraphs (1) and (2) as aggravating provisions, and Article 55 as the participation provision. The defendant fulfilled the elements of criminal responsibility and qualified as a co-perpetrator (medepleger), although his role differed from April’s. The judge’s considerations were generally consistent with applicable criminal law provisions, but did not explicitly describe the element of joint participation or Article 55 in judicial reasoning. Therefore, future decisions should clearly explain participation to strengthen overall legal certainty and consistency

Abstract

 This research examines the application of conditional sentences in petty theft cases within PT Perkebunan Nusantara areas, as reflected in Decision Number 54/Pid.C/2025/PN Lbp concerning Imam Prayogo, who stole 2 Fresh Fruit Bunches (FFB) and loose palm oil fruits valued at Rp136,500.00. This study aims to analyze the legal regulation of petty theft under Article 364 of the Criminal Code in conjunction with Supreme Court Regulation Number 2 of 2012, the application of conditional sentences, and the judge’s legal considerations. The study employs a normative-empirical legal method using statutory and case approaches, supported by interviews with the presiding judge at Lubuk Pakam Class IA District Court. Data were analyzed descriptively and qualitatively. The findings show that Article 364 of the Criminal Code and Supreme Court Regulation Number 2 of 2012 provide proportional legal certainty by adjusting the value threshold for petty theft and establishing expedited procedures. The conditional sentence was imposed through 3 months of imprisonment with a 6-month probation period, considering the defendant’s lack of prior criminal records, admission of guilt, remorse, and minimal loss. The judge’s considerations integrated juridical, non-juridical, and philosophical aspects, emphasizing rehabilitation and the ultimum remedium principle.

Abstract

The Samapta Bhayangkara Unit (Sabhara) serves as the operational frontline of the Resort Police in maintaining public security and order. In the jurisdiction of Deli Serdang Resort Police, security challenges have increased, as indicated by an average annual growth in criminal offenses of 12.8% during 2020–2024 and a 65.4% annual increase in cybercrime. This study aims to analyze the role of the Sabhara Unit of Deli Serdang Resort Police in maintaining public security and order based on Law Number 2 of 2002 concerning the Indonesian National Police. The study employs a normative-empirical legal method, with primary data obtained through in-depth interviews with seven informants selected using purposive sampling, consisting of Sabhara officials and personnel, community leaders, and legal academics. Data were analyzed using a descriptive qualitative approach with source triangulation. The findings indicate that Sabhara has performed preventive, repressive, and community empowerment functions in accordance with Articles 13 and 14 of Law Number 2 of 2002; however, gaps remain between standards and implementation, particularly in emergency response times and case resolution. Effectiveness is also constrained by personnel shortages, limited facilities and infrastructure, low community participation, and suboptimal inter-agency coordination. Optimization requires the integration of community policing, intelligence-led policing, and problem-oriented policing, along with strengthening personnel capacity, operational facilities, procedures, and community partnerships.

Abstract

Digital media has significantly transformed audience consumption patterns, particularly in the television broadcasting industry. This condition requires local television stations to implement adaptive communication strategies to maintain their existence and strengthen program brand awareness. This study aims to analyze the Marketing Public Relations (MPR) strategy in strengthening brand awareness of the Michael Tjandra Luar Biasa (MTLB) program broadcast on Rajawali Televisi (RTV). The study employs the Marketing Public Relations concept and Thomas L. Harris’s. Three Ways Strategy Theory, comprising push, pull, and pass strategies, along with brand awareness indicators including brand recall, brand recognition, Purchase decisions, and consumption. Using a qualitative descriptive approach, data were collected through in-depth interviews, observation, and documentation. Informants were selected through purposive sampling, involving internal program personnel and triangulation informants. Data were analyzed through data collection, reduction, display, and conclusion drawing. The findings show that push strategies were implemented through consistent on-air and off-air promotions, pull strategies through social media, digital content, and audience satisfaction analysis, and pass strategies through collaboration with influencers, communities, and sponsors to encourage positive word of mouth. These strategies significantly strengthened MTLB’s brand awareness, particularly in brand recall and consumption. The study concludes that integrated MPR strategies can strengthen television program positioning amid media competition.

Abstract

 The connectivity judicial mechanism is an essential instrument in unifying two distinct judicial systems to avoid jurisdictional conflicts and disparities in court decisions. This study aims to analyze the legal basis of the connectivity judiciary within the Indonesian criminal justice system, harmonize regulatory inconsistencies between the general and military judiciaries, and critically review its implementation in the acid attack case against human rights activist Andrie Yunus. The research method employed is normative legal research utilizing the statute, conceptual, and case approaches. The results of the analysis indicate that Articles 170–172 of Law Number 20 Year 2025 on the Criminal Procedure Code provide a renewed affirmation of the resolution of connectivity cases as a legitimate deviation from absolute competence for the sake of effective law enforcement. Following the Pre-Trial Decision Number 62/Pid.Pra/2026/PN JKT.SEL, the opportunity to apply the connectivity judiciary to the Andrie Yunus case is wide open, given the indications of intellectual actors from civilian circles working alongside members of the Indonesian National Armed Forces. Although its implementation on the ground still faces practical hurdles such as subjectivity in determining the gravitational center of loss, potential sector-ego, and a very strict time limit for joint investigation reports of a maximum of 7 days, these challenges are balanced by the policy of a balanced composition of the joint panel of judges under Article 172 to guarantee independence. This study concludes that the connectivity judiciary is a tangible manifestation of the due process of law principle that integrates judicial jurisdictions to achieve justice without compromising legal certainty.

Abstract

The minimum marriage age restriction under Law No. 16 of 2019 often encourages couples who do not meet the age requirement to enter into unregistered marriages (nikah siri), creating legal vulnerabilities for children born from such marriages, particularly concerning their civil status and legal identity rights. This article aims to examine the civil status of children born from unregistered marriages resulting from violations of the minimum marriage age, analyze the normative legal protection of their right to identity in light of Constitutional Court Decision No. 46/PUU-VIII/2010, and compare it with the mechanisms for recognition and inheritance rights of children born outside marriage under the Indonesian Civil Code. This study employs a normative juridical method using statutory, conceptual, and case approaches. The findings indicate that, by default, children born from unregistered marriages have civil relations only with their mother and the maternal family. However, Indonesian positive law provides avenues for legal remedies through marriage validation (isbat nikah), recognition or scientific proof of the relationship with the biological father following Constitutional Court Decision No. 46/PUU-VIII/2010, and administrative mechanisms such as the Statement of Absolute Responsibility (Surat Pernyataan Tanggung Jawab Mutlak/SPTJM). The Civil Code provisions on the recognition and inheritance rights of children born outside marriage are also no longer inconsistent with the new interpretation of Article 43(1) of the Marriage Law following the decision. However, this protection remains conditional and requires stronger legal norms and regulatory harmonization.

Abstract

The designation of Lake Toba Caldera as a UNESCO Global Geopark on 7 July 2020 has reshaped the profile of foreign visitors to the area, shifting it from ordinary tourism traffic toward internationally scaled visits involving researchers, delegations, journalists, and tourists from many countries. This shift calls for a reconsideration of how immigration supervision is designed in an area spanning seven regencies and involving multiple institutions at once. This article was developed through a literature study of immigration legislation, tourism policy documents, and prior scholarly work, with the aim of constructing a conceptual framework for analysing immigration supervision of foreign nationals in internationally designated geopark areas. The proposed framework combines Soerjono Soekanto's Legal Effectiveness Theory five factors: the law itself, law enforcers, facilities, society, and legal culture with Supervision Theory, which emphasises a cycle of standard-setting, performance measurement, and corrective action. The study suggests that the gap between das Sollen and das Sein in immigration supervision in geopark areas stems from the interaction between these five factors and three distinctive characteristics of internationally designated geoparks: cross-regency territorial breadth, inter-agency authority fragmentation, and international management standards. The article proposes three conceptual propositions for empirical testing in subsequent research, while also offering an analytical model that can be replicated in other geoparks or national strategic tourism areas in Indonesia.

Abstract

The rising flow of foreign investment in Indonesia has been followed by an increase in the number of foreign workers, including within the working area of Immigration Office Class II TPI Pematang Siantar, which covers plantation and manufacturing industrial zones as well as the Sei Mangkei Special Economic Zone. This growth has been accompanied by a corresponding rise in immigration violations, such as overstaying, misuse of residence permits, and working without a valid foreign manpower utilization plan (RPTKA). This article presents the conceptual framework and research design intended to examine the implementation of, and obstacles to, immigration supervision of foreign workers within the working area of Immigration Office Class II TPI Pematang Siantar. The study is designed using a descriptive-analytical qualitative approach combined with a normative-empirical (socio-legal) approach, drawing primary data from semi-structured interviews and non-participant observation of immigration officials, the local Manpower Office, the Foreign Supervision Team (TIMPORA), and employers of foreign workers, alongside secondary data from statutory regulations and official documents. Data analysis is planned using the interactive model of Miles, Huberman, and Saldaña, with validity tested through source and technique triangulation. The analytical framework draws on supervision theory and Soerjono Soekanto's legal effectiveness theory to identify the factors of legal substance, law enforcement apparatus, facilities, society, and legal culture that shape the effectiveness of supervision. This article is expected to provide a conceptual foundation for subsequent field research and preliminary recommendations for strengthening immigration supervision of foreign workers in natural-resource-based industrial regions.

Abstract

Public complaints are an important part of public services that require an effective communication strategy to ensure that complaints can be properly received and followed up. The Karanganyar Regency Department of Trade, Industry, and Manpower (Disdagperinaker) utilizes the Sapamas Website as a digital platform for handling public complaints. This study aims to analyze the communication strategy implemented by Disdagperinaker Karanganyar Regency in handling public complaints through the Sapamas Website. This research uses a descriptive qualitative method with data collected through observation, interviews, and documentation. The analysis uses the communication strategy model of Cutlip, Center, and Broom, consisting of fact finding, planning, communicating/action, and evaluation, supported by SWOT analysis. The results show that Disdagperinaker Karanganyar Regency has implemented the four stages of communication strategy. The fact finding, planning, and communicating/action stages have been implemented well through digital media, complaint procedures, complaint forms, and responsive communication. The evaluation stage has also been implemented through complaint recapitulation and public information service reports, although improvements are needed in measuring public satisfaction and following up evaluation results. The findings highlight the importance of strengthening evaluation to improve public complaint services.

Abstract

This study examines how Tempo.co and Okezone.com, two Indonesian online news outlets, framed the issue of disability in their coverage between 1 November and 31 December 2025. Framing shapes public understanding of social groups through the selection, emphasis, and omission of particular aspects of reality, and disability-related news is especially prone to charity-based or stereotypical representation. Using a qualitative content analysis grounded in the framing model of William A. Gamson and Andre Modigliani, the study analyzed 17 disability-related articles from Okezone.com and 66 from Tempo.co, drawn from a total population of 66 articles published during the observation period. Data were collected through online observation, documentation, and literature study, then coded across five framing devices (metaphors, catchphrases, exemplars, depictions, visual images) and three reasoning devices (roots, appeals to principle, consequences), with credibility strengthened through source, method, and theory triangulation. The findings show that Okezone.com predominantly constructs disability through a charity-model frame emphasizing empathy, institutional care, and individual success stories, whereas Tempo.co constructs a rights-based frame emphasizing structural discrimination, legal protection, and civic participation.
