Abstract

The pre-trial application is an attempt to resolve criminal cases in Indonesia and deserves special attention.Law enforcement efforts are part of an effort to create order, security, and peace in society.Law enforcement measures must be implemented responsibly, in accordance with the rules of the laws in force. (prosedur hukum).The pre-judicial stage is regulated in the Covenant which contains provisions on when the pre-trial stage is declared invalid.The pre-trial review ended at the time the re-examination of the case had begun by the State Court, while the pre-judicial review had not yet ended.The provisions concerning the time of derogation of pre-trial jurisdiction on the basis of the provisions of the Covenant are applied by the judge in various pre-judicial examinations, with the preference of the interpretation of each judge. Based on the description above, then the problem that the author discusses in this book is (1).How to regulate unprocessed deaths from the point of view of criminal law (2).On what basis the judge considers to reject the pre-trial application. This study uses a normative jurisprudential approach. The sign that the author submits is that the pre-judicial death arrangement is included in the establishment of pre-trial institutions in the Act No. 8 of 1981 on HAPPENING. (selanjutnya disebut KUHAP). As stated in Section 1, Section 10.Bab X, Sections 77 to 83, Section 1 The basis of the judicial consideration of the invalidity of the pre-trial application in the practice of criminal prosecution is the existence of different interpretations, but the first interpretation is a pre-judicial application failed since the file of the case was submitted to the state court by the prosecutor. The second interpretation states that the preliminary hearing ends from the beginning of the first hearing of the matter. The author suggests that the judge be more careful and careful in deciding whether to reject a pre-trial application. To ensure that the complainant (who is suspected of being a suspect) does not feel that his human rights have been violated,

Abstract

Undang-undang Nomor 2 tahun 2011 tentang Partai Politik Pasal 1 Ayat (1) Partai Politik adalah organisasi yang bersifat nasional dan dibentuk oleh sekelompok warga negara Indonesia secara sukarela atas dasar kesamaan kehendak dan cita-cita untuk memperjuangkan dan membela kepentingan politik anggota, masyarakat, bangsa dan negara, serta memelihara keutuhan Negara Kesatuan Republik Indonesia berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Partai Politik mengandung arti, yaitu (1) organisasi untuk mempertemukan berbagai kepentingan masyarakat, (2) keanggotaanya terdiri atas pelaku-pelaku politik dan anggota masyarakat biasa, (3) organisasi yang dibentuk untuk memperoleh kekuasaan politik dengan cara bersaing melalui pemilu, dan (4) kondisi negara yang sesuai adalah sistem demokrasi. Pasal 2 Ayat (2) Undang-undang Nomor 2 tahun 2011 tentang Partai Politik  pendirian dan pembentukan partai politik sebagaimana dimaksud pada ayat (1) menyertakan 30% (tiga puluh perseratus) keterwakilan perempuan. Frase “paling sedikit” menunjukkan syarat ini bersifat imperatif. Konsekuensinya, akan ada akibat hukum bagi partai politik peserta pemilu yang tidak mematuhi. Menurut Undang-undang ini, konsekuensi tersebut berbentuk diumumkannya partai politik peserta pemilu yang tidak mampu memenuhi keterwakilan perempuan. Jumlah penduduk di Kota Pekanbaru pada tahun 2018 yaitu mencapai 1.046.566 jiwa yang terdiri dari jumlah penduduk laki-laki sebesar 546.400 jiwa dan jumlah penduduk perempuan sebesar 518.166 jiwa.Tuntutan keterlibatan atau keterwakilan perempuan dalam politik . umumnya didasari oleh argumen bahwa untuk memperjuangkan kepentingan perempuan mempengaruhi kebijakan pemerintah maka harus dimulai dengan duduknya perempuan dalam jabatan politik. Kemudian keterwakilan perempuan dalam jabatan politik (legislatif dan partai politik) didasari oleh Persoalan pertimbangan gender tercemin jelas dalam rendahnya keterwakilan perempuan di struktur lembaga perwakilan Indonesia. Studi tentang keterlibatan perempuan dalam politik sudah banyak dilakukan, baik dalam bentuk penelitian, pengabdian, seminar-seminar (lokal, nasional, internasional), diskusi ilmiah, debat, maupun artikel dalam media masa (cetak/audio visual). Hampir semua kajian tersebut membahas kurangnya keterlibatan perempuan dalam proses pembuatan kebijakan (keterwakilan politik perempuan). Bila tidak terpenuhi, partai politik yang bersangkutan dinyatakan tidak memenuhi syarat pengajuan daftar bakal calon pada suatu daerah pemilihan. Dalam arti, semua bakal caleg yang diajukan gugur akibat tidak terpenuhi syarat keterwakilan perempuan. Konsekuensi berikutnya, partai politik peserta pemilu tidak lagi memiliki kesempatan memperoleh kursi pada dapil yang bersangkutan.

Abstract

The existence of prostitutes is undeniably growing in Padang city. There are many factors that lead a person to become a prostitute. Starting from economic demands, low levels of education, parental support, peer influence, domestic failure, and so on. Prostitution or prostitution is not considered a legitimate or legal occupation, but there are also those who continue to do it. The development of the times can change all forms of human activity, one of which is the existence of prostitutes in the city of Padang, no longer done by hanging out but with an online system using one of the applications, namely the michat application. The michat application is one of the instant messaging applications used on various cellphones. This application was originally created to help users communicate with friends and family. However, many people, especially in Indonesia, one of which is in the city of Padang, misuse this michat application as a means of online prostitution. Some of the cases that have been listed, online prostitution also occurs in the city of Padang which upholds religious values, namely adat basandi syarak, syarak basandi kitabullah. So it is necessary to conduct an in-depth study of the criminal act of online prostitution related to Commercial Sex Workers (PSK). Based on this description, the problems that the authors discuss in this thesis are (1) How is the law enforcement of online prostitution crimes against prostitutes in the Padang Police jurisdiction (2) What are the obstacles and challenges faced by the police in handling prostitution cases involving prostitutes. The method used in this research is qualitative with an empirical juridical approach. The conclusion that the author can get from the research is that law enforcement carried out by the Padang Police regarding online prostitution crimes against prostitutes is preventive and repressive. The obstacles and challenges of the police in handling cases involving prostitutes are network constraints, limited resources, changes in perpetrator tactics, the existence of perpetrators who are difficult to track, the development of digital platforms, lack of concrete evidence, and low reports.

Abstract

The recent labor incident is an iceberg phenomenon, namely workers' problems that are visible only on the surface, but the root causes of the problems are quite numerous and very unique. In the event that there is a disturbance or disturbance in the working relationship between the entrepreneur and the worker, the settlement will be resolved based on Law Number 2 of 2004 concerning Settlement of Industrial Relations. In this research, the author uses a normative juridical approach, namely a method that uses secondary data sources, namely statutory regulations, legal theory and the opinions of legal experts, which are then analyzed and draw conclusions from the problem that will be used to test and study secondary data. the. In problems that occur in the realm of employment, settlements usually occur between workers and entrepreneurs/employers and trade unions/labor unions and employers/employers. There are 4 (four) types of disputes, namely: Rights Disputes, Interest Disputes, Employment Termination Disputes and Disputes Between Trade Unions/Labour Unions Within One Company. The settlement can be resolved using litigation and non-litigation, non-litigation methods, namely by Bipatrit, Mediation, conciliation and arbitration.

Abstract

Asas Ne Bis In Idem adalah prinsip fundamental dalam hukum acara pidana yang melarang seseorang untuk dituntut dua kali atas perkara yang sama. Penelitian ini menganalisis makna, tujuan, dan penerapan asas ini dalam hukum acara pidana Indonesia. Dengan menggunakan pendekatan yuridis normatif, penelitian ini melakukan studi kepustakaan terhadap berbagai sumber hukum primer, sekunder, dan tersier terkait Asas Ne Bis In Idem. Hasil penelitian menunjukkan bahwa asas ini memiliki makna filosofis sebagai perwujudan keadilan dan kepastian hukum, serta makna yuridis dalam melindungi hak terdakwa dan menjaga efisiensi sistem peradilan. Dasar hukum utamanya adalah Pasal 76 KUHP, dengan syarat adanya identitas subjektif, identitas objektif, dan putusan yang berkekuatan hukum tetap. Abstract

Pandemi Covid-19 menyebabkan banyak perusahaan menderita kerugian, sehingga banyak perusahaan yang melakukan pemutusan hubungan kerja (PHK) pada karyawannya. Melihat ketentuan yang terdapat pada Peraturan Pemerintah Nomor 35 Tahun 2021 Tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja dan Waktu Istirahat, dan Pemutusan Hubungan Kerja, salah satu penyebab yang menjadikan perusahaan atau pengusaha bisa melakukan PHK adalah perusahaan tutup yang disebabkan keadaan memaksa (force majeure). Perlindungan hukum bagi pekerja yang terkena PHK akibat force majeure tersebut menjadi sangat penting, agar para pekerja mendapatkan hak-haknya sesuai dengan hukum yang berlaku.

Abstract

Violations of the law are actions that violate laws and regulations, policies and other actions that indicate corruption, collusion and nepotism within the Coordinating Ministry for Maritime Affairs and Investment. Violations of the law can be committed by anyone, including students, and can take various forms, from the lightest to the most serious. The law regulates people's behavior by determining what actions are prohibited and regulating the sanctions that can be imposed on perpetrators of violations. This research uses an empirical juridical approach, where this approach examines applicable legal provisions and what happens in reality in society. This research analyzes the impact of law violations on the environment, analyzing cases of illegal waste dumping in Batam City. The main legal basis that regulates this is Batam City Regional Regulation Number 11 of 2013 concerning waste management, and article 69 paragraph 1 which regulates sanctions for violations of illegal waste disposal in Batam City.

Abstract

One common issue related to joint property between spouses arises when inheritance is opened due to divorce or death. The concept of inheritance division in joint property appears straightforward but is complex and often triggers conflicts among heirs who may question the distribution process. The implementation of this law affects financial rights, inheritance, and responsibilities during and after marriage. However, it also raises questions and challenges regarding the protection of individual assets and the division of property in case of divorce or death of one spouse. This research aims to analyze the concept of inheritance division in joint property when one spouse passes away. The article employs a literature review method with a comparative approach involving the comparison of two or more objects, phenomena, or concepts to evaluate their differences and similarities. The objective of this research is to gain a deeper understanding of these differences and similarities to address the complexity of inheritance division in joint property. Using a comparative approach, the article aims to provide insights into issues related to inheritance division in joint property, thereby offering a clearer understanding of the complexities involved.

Abstract

Globalization has led to an increase in interaction between countries, which in turn has led to an increase in the flow of people leaving and entering a country. According to Minister of Law and Human Rights Regulation No. 44 of 2015, increased international mobility requires stricter supervision of foreigners entering Indonesian territory. Immigration has an important role in regulating and supervising foreigners entering a country in accordance with Law Number 6 Year 2011 on Immigration. Article 2 of the law states that the supervision of foreigners aims to protect national interests. The limitations of the problems in this paper are 1) Policies implemented by Indonesia against foreigners entering the Indonesian Territory; 2) The system of supervision of foreigners that has been implemented by the Indonesian government; and 3) Application of Immigration Administrative Measures against foreigners in the Indonesian Territory. The method used is normative law by analyzing primary legal materials such as Law No. 6 of 2011, as well as secondary legal materials so that conclusions are obtained; 1) The entry of foreigners into Indonesia must be in accordance with selective policies, which include entry, stay, and exit from the territory of Indonesia 2) Immigration conducts surveillance to reduce the possibility of misuse of applicable laws and regulations and take action against foreigners who violate the rules in order to maintain the immigration function. 3) Immigration acts as a law enforcer, and guardian of the development of supervision to reduce the possibility of abuse of applicable laws and regulations and take action against foreigners who violate the rules in order to maintain the immigration function.

Abstract

Drug abuse cases involving public figures, including artists and officials, have become a media spotlight, highlighting that the drug problem transcends social and economic boundaries. When individuals who are supposed to be role models for society are involved in drug abuse, it underscores the urgency for more effective prevention and law enforcement measures. Combating drug trafficking is a top priority in maintaining public safety and order. A notable case is that of Teddy Minahasa, which highlights the crucial role of the police in tackling drug networks. This paper examines: 1) Legal Regulations Regarding Law Enforcement by the Police Against Police Officers Who Break the Law; 2) Law Enforcement Against Police Officers Involved in Drug Trafficking (Case Study of Teddy Minahasa's Methamphetamine Distribution). To address these issues, a normative juridical research method is used, yielding the following results: 1) Legal Regulations Regarding Law Enforcement by the Police Against Police Officers Who Break the Law, namely Articles 34-35 of Law Number 2 of 2002 concerning the Police and Articles 5, 6, and 9 of Government Regulation Number 2 of 2003 concerning the Discipline of Police Members, as well as the Criminal Code (KUHP). Oversight mechanisms are carried out both internally by the Inspectorate of General Supervision (Itwasum) and the Division of Profession and Security (Divpropam), and externally by the National Police Commission (Kompolnas), which plays an important role in enforcing discipline and ethics. Police officers involved in criminal acts are processed through general courts without any special legal immunity. Despite challenges such as strong corps culture and corruption practices, reforms continue to improve the system and increase transparency and accountability in law enforcement; 2) Law Enforcement Against Police Officers Involved in Drug Trafficking (Case Study of Teddy Minahasa's Methamphetamine Distribution), demonstrating the vital role of the police in combating destructive drug networks. Such cases not only threaten social security but also undermine the integrity of the police institution. The police must play an important role in identifying, investigating, and dismantling drug syndicates by utilizing technology and inter-agency cooperation. With public support and joint commitment, law enforcement against drug cases can become more effective, ensuring public safety and upholding the rule of law in Indonesia.
