Abstract

 Azyumardi Azra’s Thought 1998-2015. The practice of modernization of Islamic education has been demonstrated by Azyumardi Azra at State Islamic University (UIN) of Jakarta. The type of the research used is the study of thinking figures, which is called a research figure or an individual life history. This type of the research is classified as qualitative research. The focus of this research is to identify Azra’s thoughts in the context of intellectual thinking and institutional perspective in renewing Islamic thoughts in Indonesia. This study uses primary and secondary data sources. The primary data source is a character that became the object of research, because the character is still alive, and then the primary data source in this study is Azyumardi Azra and his work. The other complement data is taken from books, papers, and journals. The result of the research indicated that the context of intellectual thinking and institutional perspectives of Azra in the renewal of Islamic thoughts in Indonesia has the same mission, namely to eliminate the scientific dichotomy in the development of PTKI. A scientific development with integrative paradigm requires an institutional transformation of State Islamic Collage (STAIN) or State Institute for Islamic Studies (IAIN) into State Islamic Universiy (UIN).

Abstract

This article aims to analyze the regulations governing stock waqf, which forms the basis for implementing stock waqf in Indonesia. Stock waqf involves movable property categorized as securities. The study employs a qualitative approach, drawing data from relevant literature on waqf. Qualitative data collection techniques include literature review related to waqf. Descriptive data analysis is used to describe and analyze the research findings. The research indicates that regulations governing stock waqf implementation are not yet comprehensive. This is due to the absence of detailed rules regarding procedures for stock waqf (Islamic endowment), whether by donating stock lots, dividends, or capital gains. The permissibility of stock waqf dividends is based on the Hanafi opinion, while the permissibility of stocks endowment stock lots is based on the Shāfi'i opinion, So basically the two types of waqf object, namely waqf in the form of dividens and lots of Shariah Shares can be used as waqf objects. Artikel ini bertujuan untuk menganalisis regulasi wakaf saham yang dijadikan landasan pelaksanaan wakaf saham di Indonesia. Wakaf saham merupakan wakaf benda bergerak yang masuk dalam kategori surat berharga. Artikel ini menggunakan pendekatan kualitatif dengan sumber data diambil dari literatur-literatur yang berkaitan dengan wakaf. Jenis data yang digunakan dalam artikel ini adalah data kualitatif dengan teknik pengumpulan data dilakukan dengan cara penelusuran kepustakaan yang berkaitan dengan wakaf. Teknik analisis data deskriptif digunakan dalam penelitian ini guna mendeskripsikan hasil penelitian beserta analisis dalam penelitian ini. Berdasarkan penelitian yang dilakukan menunjukan bahwa aturan mengenai pelaksanaan wakaf saham belum menyeluruh. Hal ini berdasarkan belum adanya aturan yang terperinci mengenai tata cara wakaf saham baik dengan mewakafkan lot saham maupun deviden atau capital gainnya. Kebolehan mewakafkan dividen saham berdasarkan pada pendapat Hanafiyah sedangkan kebolehan mewakafkan lot saham berdasarkan pendapat Syafi’iyah, sehingga pada dasarnya kedua jenis benda wakaf tersebut yaitu wakaf berupa deviden dan lot saham Syariah dapat dijadikan sebagai objek benda wakaf.

Abstract

Harmonization of Islamic Religious Norm in the System of Political Law in Indonesia. This study is aimedat exploring the relationship between norms of Islam and politics in Indonesia as well as the harmonization ofnorms of religion in the political system of law in Indonesia. The type of this research is a law’s research (legalresearch) that uses descriptive-normative approach, while the framework of the theory is to use the politicalsystem of law. The relationship between politics and religion is a region that is diferensiatif, not integral orseparate region.The political system of law in Indonesia providessome spaces for change and absorption with thereligious norms, including norms of Islam, to be a source of legal legislation in national and local area. Therefore,the philosophy and ideology of Pancasila as still able to answer the growing and dynamic development of thepresent era. One is the answer to the deliberative democratic system that developed last decade that not onlypromote the most votes, but who sought is common ground to build togetherness and cooperation

Abstract

This study analyzed the legal alignment for post-divorce muallaf women through the decision of the Religious Courts and the implementation in Manado City. This investigation was necessary due to the high rates of male and female muallaf marriages in this city. The rights of muallaf women have been neglected after divorce, specifically those relating to livelihoods and children. However, legal alignment is a reality, providing there is reinforcement from the court as stipulated in the 1945 Constitution article 27 paragraph 1. A Qualitative method with a normative-sociological approach was used in analyzing the data. The primary data sources were informants, comprising people who changed religion because of marriage, as well as government and clergy officials. In addition, library materials were used after seriously studying the literature such as journal articles, books, and other supporting documents that relevant to this research. The findings showed that legal protection for the rights of post-divorce muallaf women was not solely the judge’s decision on paper but the responsibility of men that was to be fulfilled after the divorce. Although these rights were not adequately realized, it is concluded the tendency for muallaf women to obtain their rights with good cooperation from all litigants, including the law enforcers. This study suggested that the form of legal alignment for women based on the law is not only on paper but also an evaluation is needed from law enforcers. Studi ini menganalisis keberpihakan hukum bagi perempuan muallaf pasca bercerai lewat putusan Pengadilan Agama dan sejauhmana pengimplementasiannya bagi perempuan muallaf pasca bercerai di Kota Manado. Penyelidikan ini diperlukan karena tingginya angka perkawinan muallaf laki-laki dan perempuan di kota ini. Hak-hak perempuan muallaf, khususnya yang berkaitan dengan nafkah, anak, dan setelah perceraian, terabaikan. Padahal keberpihakan hukum menjadi kenyataan, asalkan ada penguatan dari pengadilan sebagaimana diatur dalam UUD 1945 pasal 27 ayat 1. Metode kualitatif dengan pendekatan normatif-sosiologi digunakan dalam menganalisis data. Sumber data primer adalah informan, yakni masyarakat yang pindah agama karena perkawinan, pejabat pemerintah, dan agamawan. Selain itu, digunakan bahan pustaka setelah mempelajari secara serius literatur-literatur seperti artikel jurnal, buku, dan dokumen pendukung lainnya, yang relevan dengan penelitian ini. Temuan penelitian menunjukkan bahwa perlindungan hukum terhadap hak-hak perempuan muallaf pasca cerai bukan semata-mata keputusan hakim di atas kertas melainkan tanggung jawab laki-laki yang harus dipenuhi setelah perceraian. Meskipun hak-hak tersebut tidak diwujudkan secara memadai, namun disimpulkan adanya kecenderungan perempuan muallaf untuk mendapatkan hak-haknya dengan kerjasama yang baik dari semua pihak yang berperkara, termasuk para penegak hukum. Studi ini menyarankan bahwa bentuk keberpihakan hukum bagi perempuan berdasarkan hukum tidak hanya di atas kertas sehingga diperlukan evaluasi dari penegak hukum.

Abstract

This article aims to discuss some differences between Mahmud Shaltut and Siradjuddin Abbas in interpreting the verses about the death of prophet Isa.  This paper also seeks to investigating of how they interpret, what methods they use, and what factors influence these differences. The results of the study reveal that Mahmud Shaltut interpretes the term of the tawaffa (Q.S Âli ´Imrân [3] verse 55) and tawaffaitanî (Q.S. al-Maidah [5] verse 117) in accordance with the original meaning of  “death”. On the contrary, Siradjuddin Abbas exegetes the term of tawaffa by “grasp”. These differences are because Siradjuddin Abbas uses the method of tafsir bi al-riwayah and consideres them as hadith[s] sahih. On the contrary, Mahmud Shaltut uses the method of  tafsir bi al-ra’yi and does not use such hadith[s]. As a figure of reformer in Egypt, the interpretation of Mahmud Shaltut is affected by Muhammad Abduh’s opinion who refuses the use of Ahad Hadith in belief/akidah discussion while Siradjuddin Abbas, as a traditional Islamic figure in Indonesia, attempts to counter Muhammad Abduh’s opinion because it contradicts to the  understanding of ahl al-sunnah wa al-jamaah that he followed.

Abstract

Anthtropological Approach in the Paradigm of Islamic Legal Jurisprudence. Certain problems mainlyoccuring in almost Muslim societies appears to be so complex as it requires an alternative approach in ushulfiqh as a basis for developing a fiqh that is needed. Such alternative approach is adopted with paradigm ofanthropological ushul fiqh that offers an alternative anthropological studies to find out a solution and over comethe complicated paradigm of ushul fiqh in order to be contextual meaning. The Scientific theoretical frameworkused here is the paradigm of Karl Mannheim who divided the category paradigm of science into an ideologyand utopia and scientific paradigms of Muhammad Arkoun who classified Islamic scientific reasoning becomeslogical “Tradition with a big T” (at-Turâst bi harfin kabîr) and as a logical “tradition with small t” (at-turâs biharfin shagîr). Based on the result, the anthropological studies on the paradigm of ushul fiqh or fiqh will be ableto support the level of interconnection and dynamics among various schools of law. The aspect of general andparticular pattern will be dynamic and dialectic so that the development of legal jurisprudence may function wellin accordance with the public interests as well as the nation’s benefit

Abstract

This study examines the phenomenon of religious fundamentalism and its challenges of religious moderation in the midst the implementation of the new normal rules due to the Covid-19 pandemic. There are three focus research problems discussed in this study, namely; fundamentalism, moderation, and the new normal era. By using qualitative research and analysis based on the sociological theory of religion, this study finds a number of findings; first, one of the crucial issues in the midst of the implementation of the new normal Covid-19 policy is to promote the practice of fundamentalism in the name of religion. In many places, the problem of religious fundamentalism in the new normal era occurs in the form of crowd activities and religious crowds which do not follow the health protocol rules; second, the great danger of fundamentalism in the implementation of the new normal, it is not only because of their socio-religious activities which often violate health protocols, but also because their religious paradigm is identical to violence and anarchism, so that it often triggers socio-religious upheaval in society; third, the emergence of the phenomenon of religious fundamentalism in the new normal era today creates its own challenges for the future of moderation of religion throughout the world. The challenge lies in their religious paradigm, which often features fanatical, textual and exclusive attitudes, behaviors and ways of thinking. This attitude clearly contradicts moderation, which has always focused on universality values such as justice (al-adâlah), middle (al-tawassut), balance (al-tawâzun), and tolerance (al-tasâmuh). Studi ini mengkaji fenomena fundamentalisme agama dan problemnya terhadap moderasi beragama di tengah diterapkannya aturan new normal akibat pandemi Covid-19. Terdapat tiga fokus permasalahan penelitian yang dibahas dalam kajian ini, yaitu; fundamentalisme, moderatisme, dan era new normal. Dengan mempergunakan jenis penelitian kualitatif dan analisa berdasarkan teori sosiologi agama, studi ini mendapati sejumlah temuan; pertama, salah satu persoalan krusial di tengah pemberlakuan kebijakan new normal Covid-19 adalah mengemukanya praktik fundamentalisme atas nama agama. Di banyak tempat, problem fundamentalisme agama di era new normal terjadi dalam bentuk aktivitas keramaian dan kerumunan keagamaan yang dalam pelaksananya tidak mengikuti aturan protokol kesehatan; kedua, bahaya besar praktik fundamentalisme di tengah penerapan new normal, itu bukan saja karena aktivitas sosial keagamaan mereka yang seringkali melangar protokol kesehatan, namun juga karena paradigma keagamaan mereka yang identik dengan kekerasan dan anarkisme, sehingga tak jarang memicu gejolak sosial keagamaan di tengah masyarakat; ketiga, munculnya fenomena fundamentalisme agama di era new normal saat ini melahirkan tantangan tersendiri bagi masa depan moderasi agama di seluruh dunia. Tantangan tersebut ada pada paradigma keagamaan mereka yang seringkali menonjolkan sikap, perilaku, dan cara berpikir yang fanatik, tekstual, dan eksklusif. Sikap ini jelas jauh bersebrangan dengan moderatisme yang selama ini senantiasa menitikberatkan pada nilai keadilan universalitas seperti (al- adâlah), tengah-tengah (al-tawassut),  keseimbangan (al-tawâzun), dan toleran (al-tasâmuh).

Abstract

The View of M. Quraish  Shihab View on the Position  of  the Quran in Science Development. The Moslem scholars disagree over the relationship between the Quran and science. Al-Ghazâlî, for example, states that all branches of science, both the already and the unknown, derived from the Quran. While Al-Syâthîbi ’s view is different from Al-Ghazâlî thus it needs to clearance the position of the Quran in the development of knowledge. The research question is how the position of the Quran in the development of science according to the view of M. Quraish Shihab? This study was conducted using a philosophical approach. The conclusion of this research is that the position of the Quran in the development of science more as an ethical basis rather than as a source of science or epistemological base. The Quran is a support for Moslem to seek, research, and develop science. It means that the Quran fills the axiology of scientific development.

Abstract

The article examines 2013 curriculum (K-13) implementation of Islamic Religious Education (PAI) subject towards paradigm of scientific and characteristic. There were two issues to be discussed: First, how do the teachers plan the K-13 implementation? Second, how do the teachers implement the learning patterns of PAI subject according to K13? Qualitative approach was employed by understanding related-person performance in certain situation naturally, or without influenced by surrounding. In qualitative study analysis, inductive method was applied by overlooking initial hypothesis, while exploring the patterns, forms, and themes in examining data systematically. The present study found that the implementation of K-13 in PAI subject at State Vocational High School (SMKN) 2 Bengkulu run systematically and programmatically. The K-13 program was began with conducting training, designing program for annually, every semester, monthly, and daily, as well as for remedial program. The learning process of K-13 was implemented through introductory, core, and closing activities. The K-13 implementation indicated scientific-based learning, such as inquiry, discovery, problem solving, and video analysis. This implementation revealed that benefit to build religious character. Artikel ini secara umum mengkaji implementasi kurikulum 2013 (K-13) dalam mata pelajaran Pendidikan Agama Islam (PAI) dengan paradigma saintifik dan karakter. Ada dua permasalahan yang akan dijawab dalam tulisan ini. Pertama, bagaimanakah  langkah-langkah perencanaan yang dilakukan guru dalam mengimplementasikan Kurikulum 2013 yang berparadigma saintifik dan karakter,? Kedua, bagaimanakah langkah-langkah  guru  dalam mengimplementasikan pola pembelajaran PAI  sesuai paradigma kurikulum 2013 yang bercirikan saintifik dan karakter?  Kajian ini menggunakan pendekatan kualitatitf. Sesuai dengan kerangka penelitian kualitatif, peneliti  memahami peristiwa dalam kaitannya dengan orang dalam situasi tertentu secara wajar, langsung apa adanya, tanpa dipengaruhi unsur-unsur dari lingkungan.  Analisis dalam peneletian kualitatif menggunakan  cara induktif dengan mengesampingkan hipotesis awal, namun mencari pola, bentuk dan tema-tema dalam mengungkapkan data secara sistematis.  Tulisan ini mengungkapkan temuan bahwa implementasi kurikulum 2013 dalam mata pelajaran PAI di Sekolah Menengah Kejuruan Negeri (SMKN) 2 Bengkulu berjalan secara sistematis dan terprogram. Diawali dengan pelatihan kurikulum 2013 di kalangan guru PAI,  penyusunan program tahunan, program semester, program mingguan dan harian, dan program remedial. Implementasi   K-13 dalam  pembelajaran   melalui  kegiatan awal, kegiatan inti, dan kegiatan akhir dalam pembelajaran. Pembelajarannya terbukti menggunakan rambu-rambu saintifik, yaitu: inkuiri, diskoveri, pemecahan masalah, dan analisis video. Implementasinya terbukti bermanfaat secara positif  penanaman karakter religius.

Abstract

This study aimed at discussing the philosophical basis of the fatwa of Muhammadiyah and Nahdatul Ulama at Labuhanbatu Regency regarding changes in worship activities due to Covid 19. This study was descriptive field research. Data collection techniques used are interviews and documentation. The analysis technique used is Miles and Huberman. The findings of this study were the philosophy of the Muhammadiyah fatwa regarding changes in worship activities due to covid 19 based on the hifdzu al-nafs wa al-dîn command. The obligation to look after oneself and is inseparable. Meanwhile, the philosophy of Nahdatul Ulama's fatwa was based on the maqâshid al-syarî`ah principle, namely jalbu al-mashâlih wa dar’u al-mafâsid. Nahdatul Ulama, the largest Islamic organization, comprehends that worship should not neglect the soul's safety. The basis of this philosophy can be observed from the concept of the `indal khauf prayer. Prayer is an  obligatory worship, but in conditions where the safety of the soul is threatened, the practice of praying can adjust to the conditions; even if this dharurat condition is drastic, the scholars allow fî ayyi amkân prayer practice.  Penelitian ini membahas landasan filosofi fatwa Muhammadiyah dan Nahdatul Ulama Kabupaten Labuhanbatu terhadap perubahan aktivitas ibadah akibat covid 19. Studi ini adallah penelitian lapangan yang berifat deskriptif. Teknik pengumpulan data yang digunakan adalah wawancara dan dokumentasi. Teknik analisa yang digunakan adalah Miles dan Huberman. Temuan penelitian ini adalah filosofi fatwa Muhammadiyah terhadap perubahan aktivitas ibadah akibat covid 19 didasarkan pada perintah hifdzu al-nafs wa al-dîn. Kewajiban menjaga diri dan agama saling bersinergi tidak bisa dipisah-pisahkan antara satu dengan lainnya. Sedangkan  filosofi fatwa Nahdatul Ulama didasari oleh prinsip maqâshid al-syarî`ah yakni jalbu al-mashâlih wa dar’u al-mafâsid. Nahdatul Ulama sebagai organisasi Islam terbesar sangat paham sekali bahwa ibadah tidak boleh mengesampingakan keselamatan jiwa. Dasar filosofi ini terlihat pada konsep salat `indal khauf. Ibadah shalat merupakan ibadah yang sangat wajib dan harus dilaksanakan, namun dalam kondisi keselamatan jiwa terancam maka praktek ibadah shalat ini bisa menyesuaikan kondisi, bahkan jika kondisi darurat ini sudah sangat parah maka para ulama membolehkan shalat fî ayyi amkân.
