Madania: Jurnal Kajian Keislaman is a peer-reviewed international journal focusing on Islamic studies. The journal provides a platform for disseminating the latest research and scholarly discussions on Islam and Muslim culture in a broad sense, encompassing theoretical and empirical investigations of themes relevant to Muslim societies globally and beyond. Madania publishes articles under six main topics: Islamic Law – Discussions on fiqh, legal theory, and contemporary issues in Islamic jurisprudence. Islamic Education – Research on pedagogical theories, practices, and innovations in Islamic education. Islamic Economy – Analyses of Islamic financial systems, economic theories, and practices. Islamic Communication – Research on communication ethics, media studies, and the role of communication in Islamic contexts. Study of the Qur’an and Hadith – Investigations of textual analysis, interpretations, and the application of Islamic scriptures. Madania accepts two types of articles: Research Articles: Scholarly reports presenting the results of quantitative or qualitative studies that contribute to the advancement of knowledge in Islamic studies across the six themes. Conceptual Articles: Papers offering theoretical perspectives, models, or philosophical analyses relevant to Islamic studies, engaging with contemporary theories and frameworks. All submissions to Madania undergo a rigorous double-blind peer-review process to ensure high standards of quality and academic integrity. The journal is committed to publishing original, innovative, and impactful research that addresses contemporary challenges in the Islamic world.

Abstract

Falsafah Infaq dalam Perspektif Alquran. Politeisme dan ketidakadilan ekonomi merupakan dua aspek penting yang menjadi sorotan ketika Alquran pertama kali diturunkan. Dalam periode Makkah, Alquran mengecam keras penumpukan dan pemusatan harta kekayaan, sedangkan pada periode Madinah dibicarakan  masalah zakat sebagai salah satu mekanisme distribusi kekayaan yang ditetapkan sebagai kewajiban agama. Selain kewajiban zakat, Alquran juga menganjurkan untuk bersedekah, memberikan pinjaman tanpa bunga,berlaku lunak terhadap yang berutang, merelakan untuk membebaskan beban utang pada mereka yang dalam kesulitan, dan membantu mereka untuk membayarkan utang. Dalam konteks ini, menunaikan zakat dengan segala bantuan yang dapat meringankan beban ekonomi orang lain secara umum dikategorikan sebagai infak. Sebagai aktivitas ekonomi, infak tidak dapat dipisahkan dari prinsip-prinsip etika karena aspek ekonomi merupakan salah satu pondasi penting keberlangsungan kehidupan masyarakat Islam. Oleh karena itu, Alquran memberi petunjuk berupa rambu-rambu dalam menunaikan infak baik terkait dengan syarat-syarat pelaksanaannya, hal-hal yang dapat diinfakkan, manfaat infak maupun terkait dengan tujuan ditunaikannya infak itu sendiri

Abstract

This local wisdom encourages strong social relations within the Toba Batak community, while al-Ghazali's thought emphasizes individual virtues in Islam. This research aimed to understand the contribution of each concept in shaping moral character and moral thinking, as well as exploring the similarities and differences between the two. Apart from that, this research also aims to highlight the relevance and applicability of these two concepts in the context of modern life. This research was used a qualitative approach by analyzing relevant literature about Dalihan Na Tolu's local wisdom and al-Ghazali's moral thoughts. The data was analyzed thematically to identify the two concepts' patterns, similarities, and differences. The research results show that Dalihan Na Tolu local wisdom and al-Ghazali's moral thoughts have significant value in forming moral and moral character. Even though they come from different cultural and religious backgrounds, they can complement each other in enriching their understanding of morality and morals. In addition, this research also highlights the importance of integrating local and universal values in forming of sustainable moral character in modern society. This research underlined the importance of understanding and appreciating cultural and religious values in the formation of moral and moral character. By utilizing the local wisdom of Dalihan Na Tolu and al-Ghazali's moral thoughts, we can develop a holistic and inclusive approach to creating more ethical and harmonious society. Kearifan lokal ini mendorong hubungan sosial yang kuat dalam komunitas Batak Toba, sementara pemikiran al-Ghazali menekankan kebajikan individual dalam Islam. Penelitian ini bertujuan untuk memahami kontribusi masing-masing konsep dalam membentuk karakter moral dan pemikiran akhlak, serta mengeksplorasi kesamaan dan perbedaan di antara keduanya. Selain itu, penelitian ini juga bertujuan untuk menyoroti relevansi dan aplikabilitas kedua konsep ini dalam konteks kehidupan modern. Penelitian ini menggunakan pendekatan kualitatif dengan menganalisis literatur yang relevan tentang kearifan lokal Dalihan Na Tolu dan pemikiran akhlak al-Ghazali. Data dianalisis secara tematik untuk mengidentifikasi pola, kesamaan, dan perbedaan antara kedua konsep tersebut. Hasil penelitian menunjukkan bahwa kearifan lokal Dalihan Na Tolu dan pemikiran akhlak al-Ghazali memiliki nilai yang signifikan dalam pembentukan karakter moral dan akhlak. Meskipun berasal dari latar belakang budaya dan agama yang berbeda, keduanya dapat saling melengkapi dalam memperkaya pemahaman tentang moralitas dan akhlak. Selain itu, penelitian ini juga menyoroti pentingnya integrasi nilai-nilai lokal dan universal dalam pembentukan karakter moral yang berkelanjutan dalam masyarakat modern. Penelitian ini menggarisbawahi pentingnya memahami dan menghargai nilai-nilai budaya dan agama dalam pembentukan karakter moral dan akhlak. Dengan memanfaatkan kearifan lokal Dalihan Na Tolu dan pemikiran akhlak al-Ghazali, kita dapat mengembangkan pendekatan yang holistik dan inklusif dalam menciptakan masyarakat yang lebih beretika dan harmonis.

Abstract

Education is an individual right for all citizens, including children with special needs. The objective of the research is a qualitative research using phenomenology approach conducted at elementary schools (SD) in Samarinda; is to describe the implementation of Islamic education teaching at inclusive schools in Samarinda. This research SD Fastabiqul Khairat Samarinda, SD Bunga Bangsa Samarinda, and State Elementary School (SDN) 016. The techniques used in data collection are observation, interview, and documentation. The data was analyzed by using the interactive model by Miles and Huberman. The finding of this research reveals that the implementation of Islamic education teaching at inclusive schools in Samarinda requires several adjustments in teaching planning, implementation process, and learning evaluation. Those adjustments were created in the form of special class, by providing specific time allocation, preparing different teaching materials, applying different teaching methods, and using a mixed approach.

Abstract

This study aims to analyze sociological law regarding marriage and divorce regulations in the digital era. The digital era has had a significant impact on marriage and divorce regulations within the framework of Islamic family law in Indonesia. This study uses sociological and legal analysis to explore the impact of technological advances on the understanding and application of these laws. Digital transformation has increased the accessibility of legal information, simplified legal procedures, and changed the social dynamics in marriage and divorce administration. Research findings show that although digitalization has increased the accessibility of legal information and simplified legal procedures, it has also introduced new complexities in the social dynamics surrounding marriage and divorce, including potential conflicts with traditional values and religious norms. Additionally, the shift to digital platforms raises serious concerns regarding data privacy and security, as the handling of sensitive personal information becomes more vulnerable to breaches. These challenges emphasize the need for a careful and balanced approach to regulatory adaptation, which not only responds to technological advances but also ensures the maintenance of basic principles of Islamic law. Ultimately, this research concludes that comprehensive policy reform is essential not only to meet the evolving needs of modern society but also to maintain the fairness, honesty and integrity of family law processes in the digital era. Such reforms must be designed to ensure that all levels of society can benefit equally from the advantages brought by digitalization, while adhering to the basic principles of Islamic law. Studi ini bertujuan untuk menganalisa hukum sosiologis terhadap peraturan perkawinan dan perceraian di era digital. Era digital telah memberikan dampak yang signifikan terhadap regulasi perkawinan dan perceraian dalam kerangka hukum keluarga Islam di Indonesia. Studi ini menggunakan analisis sosiologis dan hukum untuk mengeksplorasi dampak kemajuan teknologi terhadap pemahaman dan penerapan hukum-hukum tersebut. Transformasi digital telah meningkatkan aksesibilitas informasi hukum, menyederhanakan prosedur hukum, dan mengubah dinamika sosial dalam administrasi perkawinan dan perceraian. Temuan penelitian menunjukkan bahwa meskipun digitalisasi telah meningkatkan aksesibilitas informasi hukum dan menyederhanakan prosedur hukum, hal ini juga memperkenalkan kompleksitas baru dalam dinamika sosial yang mengelilingi perkawinan dan perceraian, termasuk potensi konflik dengan nilai-nilai tradisional dan norma-norma agama. Selain itu, peralihan ke platform digital menimbulkan kekhawatiran serius mengenai privasi dan keamanan data, karena penanganan informasi pribadi yang sensitif menjadi lebih rentan terhadap pelanggaran. Tantangan-tantangan ini menekankan perlunya pendekatan yang hati-hati dan seimbang dalam adaptasi regulasi, yang tidak hanya menanggapi kemajuan teknologi tetapi juga memastikan terpeliharanya prinsip-prinsip dasar hukum Islam. Akhirnya, penelitian ini menyimpulkan bahwa reformasi kebijakan yang komprehensif sangat penting tidak hanya untuk memenuhi kebutuhan masyarakat modern yang terus berkembang tetapi juga untuk menjaga keadilan, kejujuran, dan integritas proses hukum keluarga di era digital. Reformasi tersebut harus dirancang untuk memastikan bahwa semua lapisan masyarakat dapat memperoleh manfaat yang setara dari keuntungan yang dibawa oleh digitalisasi, sambil tetap mematuhi prinsip-prinsip dasar hukum Islam.

Abstract

Islamic Local Regulations in the Perspective of Islamic Politics and Religious Society in Indonesia. Afterreformation, the spectrum of political view in Indonesia has rapidly increased. One of the political progressessigned by local regulations that regulate some aspects of Islamic teaching is regarded as Islamic regulation.There are many regions and cities in Indonesia that applied the regulation, while other regions and cities havebeen managing the same draft through the government and legislative assembly. To improve religiosity forall, the coming Islamic-nuanced regulation is something needed significantly. In addition, implementation ofIslamic regulation in any places can encourage awareness to do the best things among communities. Islamiclegalization through Islamic regulation in public area, however, has indicated that Islam performs expressively.In some regions, for instance, there is a regulation that forces Muslim people to wear Islamic clothing and toread the Qur’an every day. The Motivation of undertaking this regulation is influenced by the theory of receptiea contrario. Looking at that theory, all Muslims should apply and do Islamic teachings because they are obligatedto do that totally. Besides, there is no force for non-Muslim people compulsively to apply such Islamic teachings

Abstract

Gaining a deep understanding of the curriculum development process and which parties are involved in the development of the Islamic religious education curriculum at the school level in an era that is now utterly digital technology is the primary goal of this study. We searched for data and information to answer this study through examined the literature of book publications and scientific articles. This study used an indepth interpretation approach and document analysis and data coding to produce valid evidence to answer this question. From the results of the study and discussion, it can be concluded that the parties have fully contributed to the development of the curriculum for teaching Islamic religious education in the digital era; Among others, policy making at the central level is forwarded by the education office in the provinces and ends with implementation and financial inclusion at the school unit level as well as involving the leadership of the parent committee and the wider community. Another contribution that is more important is the involvement of technology experts who accompany curriculum development. Mendapatkan pemahaman yang mendalam tentang proses pengembangan kurikulum dan pihak-pihak mana saja yang terlibat dalam pengembangan kurikulum pendidikan agama Islam di tingkat sekolah di era yang serba digital saat ini menjadi tujuan utama penelitian ini. Kami mencari data dan informasi untuk menjawab penelitian ini melalui telaah literatur publikasi buku dan artikel ilmiah. Kajian ini menggunakan pendekatan interpretasi mendalam dan analisis dokumen dan koding data untuk menghasilkan bukti yang valid untuk menjawab pertanyaan tersebut. Dari hasil kajian dan pembahasan, dapat disimpulkan bahwa para pihak telah berkontribusi penuh dalam pengembangan kurikulum pengajaran pendidikan agama Islam di era digital; antara lain pengambilan kebijakan di tingkat pusat diteruskan oleh dinas pendidikan di provinsi dan diakhiri dengan pelaksanaan dan inklusi keuangan di tingkat satuan sekolah serta melibatkan pimpinan komite orang tua dan masyarakat luas. Kontribusi lain yang lebih penting adalah keterlibatan ahli teknologi yang mendampingi pengembangan kurikulum.

Abstract

Islamic Philanthropy for Education: Dompet Dhuafa Funding Strategy in Indonesian Teacher School Program (SGI). This study is aimed at finding out the implementation of the use of zakah funds for the Indonesian Teachers School (SGI) program, and to motivate Islamic educational institutions to empower zakah as the Islamic education funding strategy in Indonesia. This research is a qualitative research and conducted in Indonesian Teachers School office with sevent respondents using snow ball sampling technique. The methods of data collection use observation, interviews, and documentation. Data validity test used is source triangulation technique, and data analysis technique used is interactive model from Huberman and Miles. The results show that Indonesian Teachers School is a teacher delivery program in disadvantaged areas by using productive zakah funds from Dompet Dhuafa. The teacher is included in the category ashnâf fî sabilillâh so it is entitled to receive the benefit of zakah. The process of funding using zakat begins with the preparation of the Annual Budget Work Plan (RKAT), the disbursement of zakah funds, the use of zakah funds by beneficiaries (teachers), the preparation of monthly financial and activity reports by beneficiaries to the Indonesian Teachers School.

Abstract

One of crucial issue in Muslim countries, not except Indonesia, is relation between religion and the state. Even though Pancasila and the 1945 Constitution  were claimed as a final, but it did not necessarily mean that position of religion, state and human rights is final and clear.  The negotiation between religion, state and human rights not only on political forum like at The House of Representative, but also in Constitutional Court  session. There are debates and opinion contestations. The problem is what is the politics of law accommodation towards religious aspirations, which the Constitutional Court has built through its decisions and arguments? Through analysis on two issues: 1) freedom of religion and belief; and 2) marriage law, this article argues that Constitutional Court’s decision, especially relation between religion, state and human rights not only based on law consideration, but also on non-law consideration. Regarding private law, the Constitutional Court opened a fairly wide accommodation, so that more religious aspects would be accommodated by the state even with limited reforms. The limit of accommodation is an Islamic criminal law that cannot be made exclusively for Muslims. The accommodation of Islamic criminal law is only possible if the norms are incorporated into the national criminal law through a process of rational objectification. Based on this argument, continuous negotiation and contestation between religion, state and human rights will go on since Indonesia is not a religious state, which is based only on one religion, nor a secular state, which does not consider religion at all. Salah satu isu krusial di negara Muslim, tidak terkecuali Indonesia, adalah relasi agama dan negara. Meskipun Pancasila dan Undang-Undang Dasar 1945 dinyatakan final, namun bukan berarti kedudukan agama, negara, dan hak asasi manusia sudah final dan jelas. Perundingan antara agama, negara dan hak asasi manusia tidak hanya di forum politik seperti di Dewan Perwakilan Daerah (DPR), tapi juga di sidang Mahkamah Konstitusi. Ada perdebatan dan kontestasi pendapat. Persoalannya, bagaimana politik akomodasi hukum terhadap aspirasi agama yang dibangun Mahkamah Konstitusi melalui putusan dan dalilnya? Melalui analisis terhadap dua isu: 1) kebebasan beragama dan berkeyakinan; dan 2) hukum perkawinan, pasal ini berpendapat bahwa putusan Mahkamah Konstitusi khususnya hubungan antara agama, negara dan hak asasi manusia tidak hanya berdasarkan pertimbangan hukum, tetapi juga pertimbangan non hukum. Terkait hukum privat, Mahkamah Konstitusi membuka akomodasi yang cukup luas, sehingga lebih banyak aspek keagamaan yang diakomodasi oleh negara meski dengan reformasi yang terbatas. Batasan akomodasi adalah hukum pidana Islam yang tidak dapat dibuat secara eksklusif untuk Muslim. Akomodasi hukum pidana Islam hanya dimungkinkan jika norma-norma tersebut dimasukkan ke dalam hukum pidana nasional melalui proses objektifikasi yang rasional. Berdasarkan argumen ini, negosiasi dan kontestasi yang terus menerus antara agama, negara dan hak asasi manusia akan terus berlangsung karena Indonesia bukanlah negara agama yang hanya didasarkan pada satu agama, bukan pula negara sekuler, yang sama sekali tidak mempertimbangkan agama.

Abstract

This study aims to reveal in detail the positive and negative impacts that arise from polygamy in Muslim family life. This research is a literature review, which uses documentation techniques in finding the required data. While the analytical method used is the inductive method. After conducting in-depth research, conclusions are obtained, including: The positive impact of polygamy is the opening of a way out of emergency conditions that occur in the household. Polygamy can be a solution for people to avoid committing adultery/ infidelity. Polygamy can also be a solution for someone to have children if his first wife is barren, protect widows, or channel the sexual needs of a husband who cannot be channeled properly with his first wife. While the negative impact that arises from polygamy for Muslim families is psychologically, a wife will feel disturbed and hurt to see her husband having sex with other women. A number of studies have shown that the average wife when she finds out her husband remarried spontaneously experiences feelings of depression, prolonged stress, sadness and disappointment. In addition, the relationship between husband and wife and their extended family is not harmonious. Marriage essentially connects the bond between two large families, polygamy makes the bond disrupted, maybe even broken. In addition, in the life of a polygamous family, of course, there are concerns in fostering and meeting family needs. : Penelitian ini bertujuan untuk mengungkap secara detail dampak positif dan negatif yang muncul dari poligami dalam kehidupan berkeluarga muslim. Penelitian ini bersifat kajian pustaka, yang mengunakan teknik dokumentasi dalam mencari data-data yang diperlukan. Sedangkan metode analisa yang digunakan adalah metode induktif. Setelah dilakukan penelitian secara mendalam maka diperoleh kesimpulan, antara lain: Dampak positif poligami adalah terbukanya jalan keluar dari kondisi darurat yang terjadi dalam rumah tangga. Poligami dapat menjadi solusi bagi orang terhindar dari berbuat zina/ perselingkuhan. Poligami juga bisa menjadi solusi bagi seseorang untuk memiliki keturunan jika istri pertamanya mandul, melindungi para janda, atau menyalurkan kebutuhan seks suami yang tidak dapat tersalurkan dengan baik dengan istri pertamanya. Sedangkan dampak negatif yang muncul dari poligami bagi keluarga muslim adalah secara psikologi, seorang isteri akan merasa terganggu dan sakit hati melihat suaminya berhubungan dengan perempuan lain. Sejumlah penelitian menunjukkan bahwa rata-rata isteri begitu mengetahui suaminya menikah lagi secara spontan mengalami perasaan depresi, stres berkepanjangan, sedih dan kecewa. Selain itu, hubungan suami isteri dan keluarga besarnya menjadi tidak harmonis. Perkawinan pada esensinya menyambung ikatan antara dua keluarga besar, poligami membuat ikatan itu terganggu, bahkan mungkin terputus. Selain itu, dalam kehidupan keluarga poligami tentunya terdapat kekhawatiran dalam membina dan memenuhi kebutuhan keluarga.

Maqâshid al-Qur’ân in the Verses of Religious Freedom in Interpretation of Thahâ Jâbir al-’Alwânî. This article is aimed at describing Thahâ Jâbir al-‘Alwânî’s interpretation on various verses dealing with the issues of religious freedom. Adapting an approach of maqâshid al-Qur’ân, the present paper comes to answer two main issues on the true of Alwânî’s maqâshid al-Qur’ân perception and the theoretical application of Alwânî’s maqâshid al-Qur’ân in interpreting verses of religious freedom. According to ‘Alwânî, it was concluded that there are three main segments that he called al-maqâshid al-Qur’âniyyah al-hâkimah: (1) al-tawhîd, (2) al-tazkiyah, and (3) al-‘umrân. ‘Alwânî stated that freedom of interfaith religion is important goal of sharia meaning. Freedom of interfaith religion, on the other hand, is one of the important embodiments in believing the God and tauhid. Seeing this pattern, the later purpose of the Quran is tazkiyah. This term is a value that enables people apply the message, fulfill the promise, and can perform the tasks of the caliphate. When such principles are implemented, something appears that Alwânî called ‘umrân as the next purpose of the Quran can be manifested well. ‘Umrân or ‘prosperity’ in which human being performs as a khalifah actually can create baldatun thayyibatun wa rabbun ghafûr as the real welfare.
