Madania: Jurnal Kajian Keislaman is a peer-reviewed international journal focusing on Islamic studies. Madania accepts two types of articles: Research Articles: Scholarly reports presenting the results of quantitative or qualitative studies that contribute to the advancement of knowledge in Islamic studies across the six themes. Conceptual Articles: Papers offering theoretical perspectives, models, or philosophical analyses relevant to Islamic studies, engaging with contemporary theories and frameworks. All submissions to Madania undergo a rigorous double-blind peer-review process to ensure high standards of quality and academic integrity. Abstract

This study aims to determine the implementation stage of history learning process for students at the Pesantren Buya Hamka; the stages of knowledge, attitudes, and behavior of students regarding nationalism and patriotism; and the correlation of leadership variables, school climate, teacher performance, and pesantren culture to history learning and also to students’ knowledge, attitudes, and behavior regarding nationalism and patriotism. This study also aims to find out the significant influence of historical learning variables on knowledge, knowledge variables on attitudes and attitudes on students’ behavior. This study combines survey research quantitative approach with descriptive, correlation, and regression methods. The results show there is a significant correlation between independent variables with historical learning variables and student knowledge variables about nationalism and patriotism. Meanwhile, there is no significant correlation between independent variables and student behavior variables. The results also show only the history of learning variables among the five independent variables that significantly influence the knowledge of nationalism and student patriotism. Student knowledge variables about nationalism and patriotism partially also affect changes in student attitudes, while changes in student attitudes do not affect linearly on changes in student behavior. Penelitian ini bertujuan untuk mengetahui tahap pelaksanaan pembelajaran sejarah siswa di Pesantren Buya Hamka Kota Padang; tahap pengetahuan, sikap dan perilaku siswa berkenaan dengan nasionalisme dan patriotisme melalui pembelajaran sejarah; dan korelasi variabel  kepemimpinan, iklim sekolah, kinerja guru dan kultur Pesantren terhadap pembelajaran sejarah dan juga terhadap pengetahuan, sikap dan perilaku siswa berkenaan dengan   nasionalisme dan patriotisme. Kemudian, penelitian ini juga bertujuan untuk mengidentifikasi pengaruh signifikan variabel pembelajaran sejarah terhadap pengetahuan, pengaruh variabel pengetahuan terhadap sikap dan pengaruh sikap terhadap perilaku  siswa. Penelitian ini perpaduan penelitian survey dengan   pendekatan kuantitatif dengan metode deskriptif, korelasi dan regresi. Hasil penelitian menunjukkan terdapat korelasi signifikan antara variabel indenpendent dengan variabel pembelajaran sejarah dan variabel pengetahuan siswa tentang nasionalisme dan patriotisme. Sementara itu, tidak terdapat korelasi yang signifikan antara variabel independen dengan variabel perilaku siswa. Berikutnya  hasil analisis menunjukkan hanya variabel pembelajaran sejarah diantara lima variabel indenpenden yang berpengaruh secara signifikan terhadap pengetahuan nasionalisme dan patriotisme siswa. Variabel pengetahuan siswa tentang nasionalisme dan patriotisme secara parsial juga berpengaruh terhadap perubahan sikap siswa, sementara perubahan sikap siswa tidak berpengaruh secara linear terhadap perubahan perilaku siswa.

Abstract

This study examines the Supreme Court's Cassation Decision Number 624 K/Ag/2017 pertaining to the musyarakah agreement that was executed between the customer and the bank, PT Sumut Padangsidimpuan Branch Office, which effectively provided the customer with funding prior to the issuance of the life insurance policy letter. According to Supreme Court Cassation Decision Number 624 K/Ag/2017, losses have to be distributed proportionately in line with Article 3 paragraph (2) of the Musyarakah Financing Agreement. The study problem formulation in this research focuses on how the bank's negligence leads to the conclusion of the musyarakah agreement, which disadvantages the customer in having to pay the remaining debt according to Supreme Court Cassation Decision Number 624 K/Ag/2017. This research is qualitative with the case-study-based approach which also employs legal protection theory as a tool to analyze research data in order to help the theory explain the role of law, which is to provide justice, order, certainty, benefit, and peace to all people, particularly when it comes to judge-decided musyarakah agreements. This study concludes that, in accordance with Articles 209–210 of the Compilation of Sharia Economic Law, an agreement terminates at the death of one of the parties, and the capital owner is responsible for paying any damages resulting from the mudharib's death. Even though the musyarakah agreement contains a combination of assets owned by the customer and the sharia bank, if the bank violates the law and fails to follow prudent banking practices, then the bank should be held legally liable for any losses incurred from the musyarakah the agreement as a form of punishment for acting illegally. Penelitian ini mengkaji Putusan Kasasi Mahkamah Agung Nomor 624 K/Ag/2017 tentang akad musyarakah yang dilakukan antara nasabah dengan bank PT Sumut Kantor Cabang Padangsidimpuan yang efektif memberikan dana kepada nasabah sebelum terbit surat polis dan asuransi jiwa. Berdasarkan Putusan Kasasi Mahkamah Agung Nomor 624 K/Ag/2017, kerugian harus dibagikan secara proporsional sesuai dengan Pasal 3 ayat (2) Akad Pembiayaan Musyarakah. Rumusan masalah kajian dalam penelitian ini terfokus pada bagaimana kelalaian bank yang berujung pada berakhirnya akad musyarakah yang merugikan nasabah karena harus membayar sisa utangnya sesuai Putusan Kasasi Mahkamah Agung Nomor 624 K/Ag/2017. Penelitian ini bersifat kualitatif dengan pendekatan studi kasus yang juga menggunakan teori perlindungan hukum sebagai alat untuk menganalisis data penelitian guna membantu menjelaskan peranan hukum yaitu memberikan keadilan, ketertiban, kepastian, kemaslahatan, dan kesejahteraan. perdamaian bagi seluruh umat manusia, khususnya dalam hal perjanjian musyarakah yang diputuskan oleh hakim. Penelitian ini menyimpulkan bahwa sesuai dengan Pasal 209–210 Kompilasi Hukum Ekonomi Syariah, suatu perjanjian berakhir karena meninggalnya salah satu pihak, dan pemilik modal bertanggung jawab untuk membayar segala kerugian yang diakibatkan oleh meninggalnya mudharib. Sekalipun akad musyarakah itu memuat gabungan harta milik nasabah dan bank syariah, namun apabila bank tersebut melanggar hukum dan tidak mengikuti praktek prinsip kehati-hatian perbankan, maka bank tersebut harus bertanggung jawab secara hukum atas segala kerugian yang timbul dari akad musyarakah tersebut sebagai bentuk hukuman atas perbuatan melawan hukum.

Abstract

Islamic Unit Linked: Is It Profitable and Fully Sharia Complience? Recently the interest of society to choose unit linked Islamic or conventional as an instrument for investment rises significantly. It is maybe because of its impressive tagline, combination between investment and protection. At glance, unit linked provide veryeasy way to invest. At the same time, customer will receive many pieces of papers describe rules dan regulations that make customer confused and do not understand how much cost must be paid for purchasing unit linked. The objective of this study is to review whether Islamic unit linked is profitable investment? Does the operationof practical Islamic unit link fully comply with sharia rules? Based on analysis conducted, not all Islamic unit link offered is profitable and fully with sharia compliance. Therefore, it is suggested to the investors should consider some aspects before deciding any investment in Islamic unit link

Abstract

The results of several observations regarding the religious tolerance attitudes of students in Bangka Belitung are pretty worrying, even though some tend to be radical. This research explores the paradigm of religious moderation in the Islamic religious education curriculum at Madrasah Aliyah Negeri Bangka Belitung. This research explores qualitatively the application of religious moderation in the curriculum of Islamic religious education material. Research data was taken from the MAN Pangkal Pinang and MAN 1 Muntok curriculum documents. Researchers also surveyed by distributing questionnaires to 346 students from the two schools. The research results show that the content of religious moderation has been integrated into the Islamic religious education curriculum, both in Jurisprudence, History of Islamic Culture, Al-Qur'an Hadith, and Aqidah Akhlak. However, the tendency towards a radical and robust understanding of Islam is still strong. It is evident from the survey results, namely 55.4% of respondents from MAN Pangkal Pinang and 53% of respondents from MAN 1 Muntok stated that adhering to the Pancasila ideology is more important. Almost half of the students do not agree that Pancasila should be made the state ideology. This phenomenon must receive serious attention from the government so that they comply with the laws and regulations of the Republic of Indonesia. Hasil beberapa pengamatan terhadap sikap toleransi beragama para siswa di Bangka Belitung cukup memprihatinkan, bahkan di antaranya cenderung radikal. Penelitian ini bertujuan untuk mengeksplorasi paradigma moderasi beragama dalam kurikulum pendidikan agama Islam di Madrasah Aliyah Negeri Bangka Belitung. Penelitian ini mencoba menelusuri secara kualitatif penerapan moderasi beragama dalam kurikulum materi pendidikan gama Islam. Data penelitian diambil dari dokumen kurikulum MAN Pangkal Pinang dan MAN 1 Muntok.  Selain itu, peneliti juga melakukan survey dengan menyebarkan angket terhadap 281 siswa dari kedua sekolah tersebut. Hasil penelitian menyebutkan bahwa muatan moderasi beragama sebenarnya telah diterapkan secara terintegrasi dalam kurikulum pendidikan agama Islam, baik dalam mata Pelajaran Fikih, Sejarah Kebudayaan Islam, Al-Qur’an Hadis, maupun Akidah Akhlak. Akan tetapi, kecenderungan terhadap pemahaman Islam secara radikal dan kuat masih kuat. Hal ini terbukti dari hasil survey, yakni 55, 4% responden dari MAN Pangkal Pinang dan 53% responden dari MAN 1 Muntok menyatakan bahwa berpegang teguh ideologi Pancasila lebih utama. Artinya, hampir separuh dari siswa tidak setuju kalua Pancasila dijadikan ideologi negara. Fenomen ini harus mendapat perhatian serius dari pemerintah agar mereka taat pada aturan perundang-undangan Republik Indonesia.

Abstract

Abstract: Rechtstaat and Constitutionalism in the Thought of Abdurrahman Wahid (1940-2009) and Hasyim Muzadi (1944-2017). This study aims to explore the thoughts of Abdurrahman Wahid and Hasyim Muzadi about rechtstaat and constitutionalism. This study uses the juridical-normative method with the historical-normative approach and the type of qualitative data. The data sources consist of primary, secondary, and tertiary data obtained from the number of literature and documentation. While the data collection techniques are obtained from book reviews and documentation. Data analysis method is conducted deductively and inductively. The result of this study reveals that the state law and the constitutionalism in the thoughts of Abdurrahman Wahid and Hasyim Muzadi refer to the constitution of Madinah and civil society in relation to religion and state. Abdurrahman Wahid and Hasyim Muzadi can be positioned as substantial, pluralist, nationalist, and humanist religious thinkers. Abdurrahman Wahid and Hasyim Muzadi’s contribution has proved to give improvements in strengthening the relationship between religion and state in Indonesia and has implications for rechtstaat’s future and constitutionalism in the Islamic legal system in Indonesia. The critical findings of this research are the thoughts of Abdurrahman Wahid, and Hasyim Muzadi provides enlightenment of idea and solution to the problematic rechtstaat with a cultural-religious approach.

Abstract

Muslim is the majority population in Indonesia. This has become a background to provide investment instruments to meet Islamic principles. This study analyzes the renewal of Islamic stock criteria established through Bapepam LK (The Financial Services Authority/OJK) regulations. This is normative juridical research, with the object of Bapepam LK Regulations regarding Islamic stock criteria. In Indonesia, the Islamic stock criteria were first established in 2007. Bapepam LK then made an update on the Islamic stock criteria in 2009, and the last update was in 2012. Updates in 2009 were carried out on qualitative criteria, while the quantitative criteria remained. This renewal made the criteria for Islamic stocks more stringent. While the renewal in 2012 was carried out on quantitative criteria, the qualitative criteria remained steady. This renewal had eased the criteria for Islamic stock. The results of the study showed that the issuance and renewal for the Islamic stock criteria was carried out by Bapepam LK based on the fatwa and approval letter of National Sharia Council (DSN) of Indonesian Ulema Council (MUI). The stipulation of the criteria for Islamic stocks is the outcome of DSN MUI’s ijtihad Negara Indonesia memiliki jumlah penduduknya muslim yang besar. Hal ini menjadi pendorong untuk menyediakan instrumen investasi berupa saham yang memenuhi kriteria syariat Islam. Penelitian ini menganalisa pembaharuan kriteria saham syariah yang ditetapkan melalui Perauran Bapepam LK (Sekarang OJK). Penelitian ini bersifat yuridis normatif, dengan objek Peraturan Bapepam LK tentang kriteria saham syariah. Di Indonesia, kriteria saham syariah ditetapkan pertama kali pada tahun 2007. Kemudian  Bapepam LK  melakukan pembaharuan dalam kriteria saham syariah pada tahun 2009. Dan terakhir pembaharuan dilakukan pada tahun 2012. Pembaharuan pada tahun 2009 dilakukan pada kriteria kualitatif, adapun kriteria kuantitatif tetap. Pembaharuan ini menyebabkan kriteria saham syariah semakin ketat. Sedangkan pembaharuan pada tahun 2012 dilakukan pada kriteria kuantitatif, adapun kriteria kualitatif tetap. Pembaharuan ini menyebabkan kriteria saham syariah mengalami pelonggaran. Hasil kajian menunjukan bahwa penerbitan dan pembaharuan demi pembaharuan kriteria saham syariah dilakukan Bapepam LK bersumber pada fatwa dan surat persetujuan Dewan Syariah Nasional (DSN) Majelis Ulama Indonesia (MUI). Penentuan dalam kriteria saham syariah merupakan hasil ijtihad DSN MUI.

Abstract

Islamic teachingpreached by Muhammad saw contained verious norms- moral norm, legal norm, and social norm- have beeninstitutionalized in the Islamic community as well as partly transformed into social institutions. The morerevelations received by Muhammad the more norms conveyed to humans, and the more types of socialinstitutions arise. When Muhammad was in Mecca while performing education institutions, he focused hisattention on engrafting social norms. Dealing with marriage circumstances, a lot of changes of legal normswere regulated by the Marriage Code of Number 1 1974. The changes do not mean an old thing changes to newor a current thing differs from the past. The change often means to replace something to another one whichhas been exactly existed but not popular. Allowing woman becomes a judge, for instance, is one of the lawchanges that the former law did not allow her as a judge because of following certain sect. According to othersects, such allowing is not something new, but it has been existed since classical Islamic era. The change alsomeans adopting certain concept and it is modified then. Adopted child is forbidden in Islam, but the Islamic LegalCompilation allowed it with modification.

Abstract

The aim of this study is to explain the concept of character education contained in the book of Hikam and its relevance to Indonesia's national character education program. This research was a library study that employed the content analysis technique. The data collection method was the documentation technique. The findings of this study indicate that the concept of character education in the book of Hikam emphasizes religious character education. This approach focuses on uluhiyyah (divinity), suggesting that humans should align all their life activities with God by spreading goodness in all circumstances. The closer and more obedient a person is to God, the more character and noble that person would be. This religious education is an exercise (riyadhah) and sincerity (mujahadah) that is well organized and systematic and carried out by an educator to shape a pious personality in a student, both physically and spiritually. The concept of religious character refers to faith, honesty, piety, sincerity, and patience. Religious character teaches human being to become a person with character and responsibility. The character education values in the book of Hikam strengthen Indonesia's national character education program. In Sheikh Ibn Atha'illah's view, the character education strategy are divided into two stages: planting and spreading. Religious education is very relevant to the national character education strategy, such as intervention (instilling character in students) and habituation (instilling character through the environment). Studi ini bertujuan menjelaskan konsep pendidikan karakter yang ada dalam kitab Sufi Hikam serta relevansinya terhadap program nasional pendidikan karakter yang ada di Indonesia. Penelitian ini adalah library research yang mengunakan teknik content analisa. Teknik pengumpulan data yang digunakan adalah teknik dokumentasi. Temuan dalam penelitian ini adalah konsep pendidikan karakter yang ada pada kitab sufi Hikam adalah pendidikan karakter religious yang mengacu pada karakter uluhiyyah (ketuhanan), yakni manusia harus mengorientasikan segala aktivitas kehidupanya kepada tuhan dengan menyebarkan kebaikan dimana saja berada. Semakin dekat dan taat seseorang kepada tuhanya maka orang tersebut akan semakin berkarakter dan berakhlak mulia. Pendidikan religius ini merupakan suatu latihan (riyadhah) dan kesungguhan (mujahadah) yang terencana dan sistematis, serta dilakukan oleh seorang pendidik untuk membentuk kepribadian yang shaleh pada seorang anak didik baik dari segi jasmani maupun rohaninya. Konsep karakter religius ini mengacu pada nilai-nilai keimanan, kejujuran, ketakwaan, keikhlasan dan kesabaran. Kitab Hikam mendidik seorang manusia menjadi pribadi yang berkarakter dan bertangung jawab. Nilai-nilai pendidikan karakter pada kitab Hikam menguatkan program nasional pendidikan karakter di Indonesia. Strategi pendidikan karakter dalam pandangan Syeikh Ibnu Atha’illah dibagi dalam dua tahap, yaitu proses penanaman dan penyebaran. Hal ini sangat relevan dengan strategi pendidikan karakter nasional, yaitu intervensi (penanaman karakter pada diri peserta didik), dan habituasi (penanaman karakter melalui lingkungan).

Abstract

New Scientific Epistimology in State Collage for Islamic Studies: a ransformation from STAIN/IAIN to UIN. Historically, there is an academic anxiety for graduates’ fate of PTKIN if there are no integrated religious sciences with general sciences. Based on the fact, many scientific studies in PTKIN are only worth with theabstract, not empirical-historical. The academic’s anxieties are observed based on Ian G Barbour’s approach on the scientific assessment. The result is that the integrated-scientific epistemology is needed in PTKIN which has given the spirit and direction of the institutional transformation of STAIN /IAIN to UIN that has been successfully initiated by UIN Maliki of Malang, UIN Sunan Kalijaga Yogyakarta, and UIN Syarif Hidayatullah Jakarta. Epistemology of science recently developed at three UIN (-s) is part of development trend of an integrated approach of two sciences that Ian G Barbour stated. The integration approach emerges the newscientific epistemology such as in UIN Yogyakarta known as spider webs of Horizon scientific Teoantroposentric-Integralistik and in UIN Maliki known as clumps of trees.

This study aims to analyze the hajj services of the Ministry of Religious Affairs of the Republic of Indonesia and the Malaysian Hajj Savings Institute from the maqâshid al-syarî`ah aspect. This study used a qualitative method with a phenomenological approach. The data was obtained through interviews and documents. The data was analyzed through a process of extension of observation and triangulation of sources as well as techniques between interview data and documents. This data was then discussed and analyzed using the maqâshid al-syarî`ah approach. Aspects of the hajj service of the Ministry of Religious Affairs of the Republic of Indonesia and the Malaysian Hajj Savings Institute here include aspects of the intensity of the guidance of the hajj rituals that have been in accordance with the maqâshid al-syarî`ah in the aspects of hifdz al-dîn and hifdz al-`irdh. Hotel accommodation services are in accordance with the aspects of hifdz al-`aql, hifdz al-ruh, and hifdz al-`irdh. Consumption services are in accordance with the aspects of hifdz al-nafs and hifdz al-`aql. Meanwhile, health services are in accordance with the aspects of hifdz al-nafs. Penelitian ini bertujuan untuk menganalisis pelayanan haji kementerian Agama Republik Indonesia dan Lembaga Tabung Haji Malaysia dari aspek  maqâshid al-syarî`ah. Penelitian ini menggunakan metode kualitatif dengan pendekatan fenomenologis. Data diperoleh melalui wawancara dan dokumen. Data dianalisis melalui proses perpanjangan pengamatan dan triangulasi sumber maupun teknik antara data wawancara dan dokumen. Data ini kemudian dibahas dan dianalisis dengan pendekatan maqâshid al-syarî`ah. Aspek pelayanan haji Kementerian Agama RI dan Lembaga Tabung Haji Malaysia meliputi aspek intensitas pembimbingan manasik haji telah bersesuaian dengan maqâshid al-syarî`ah pada aspek hifdz al-dîn dan hifdz al-`irdh. Pelayanan akomodasi perhotelan bersesuaian dengan aspek hifdz al-`aql, hifdz al-ruh, dan hifdz al-`irdh.  Pelayanan konsumsi bersesuaian dengan aspek hifdz al-nafs dan hifdz al-`aql. Sedangkan pelayanan kesehatan bersesuaian dengan aspek hifdz al-nafs.
