Abstract

The phenomenon of exhibitionism in Indonesia is increasingly concerning because it can occur in various public spaces such as public transportation, highways, and even live broadcasts on social media. How is criminal law implemented in the context of criminal liability for perpetrators of exhibitionism? This research uses normative (normative juridical) research with a legislative and conceptual approach. In conclusion, exhibitionism is considered a criminal offense and is regulated by the Criminal Code and the Pornography Law. The Pornography Law (Law No. 44 of 2008) strengthens criminal sanctions against exhibitionism. Article 10 of the Pornography Law implicitly defines exhibitionism as displays of nudity or pornographic content in public places. Although the term "exhibitionism" is not always explicitly stated, this regulation confirms that Indonesian law criminalizes exhibitionism. Recommendation: There needs to be explicit regulation in the Criminal Code or a special law regarding exhibitionism as a criminal offense, as it is currently often interpreted as falling under the "morality" articles (e.g., Article 281 of the Criminal Code), the meaning of which can be vague or open to multiple interpretations. The aim is to facilitate law enforcement officials in establishing evidence and prosecuting.

Abstract

The halal industry has become a rapidly growing strategic sector as public awareness of safe, healthy, and Sharia-compliant products increases. As a country with a Muslim majority, Indonesia implements a mandatory halal certification policy based on Law Number 33 of 2014 concerning Halal Product Guarantee (JPH Law), which requires all food products to be halal certified by 2026 at the latest. This study aims to analyze the implementation of the halal certification policy for food MSMEs in Pangkalpinang City and review its law enforcement against business actors who have not complied with these provisions. Using qualitative methods through literature studies, observations, and interviews, the study found that the implementation of halal certification is still hampered by the low level of understanding among MSME actors, limited capital, and procedural complexity. Law enforcement is implemented gradually through socialization, guidance, and administrative and criminal sanctions in accordance with the JPH Law and Government Regulation Number 39 of 2021. In conclusion, halal certification is not only a legal obligation but also a strategic opportunity for MSMEs to enhance competitiveness, expand markets, and strengthen consumer confidence. The successful implementation of  this policy requires effective collaboration between the government, certification bodies, and MSME operators to build an inclusive and sustainable halal industry ecosystem..

Abstract

The purpose of this study is to examine how coercive fines, or dwangsom, are used as legal guarantees for parties who suffer losses due to breach of contract in land lease agreements. Land leases are civil law arrangements that can give rise to disputes, especially when one party fails to fulfill its obligations, such as paying rent after the agreed time or refusing to vacate the leased property after the lease term ends. In such circumstances, even though the court has issued a ruling, its implementation is often hampered by the absence of an effective enforcement mechanism. Therefore, dwangsom becomes an important instrument to ensure compliance with the judge's ruling through financial pressure on the defaulting party. This study uses a literature review method by examining primary, secondary, and tertiary legal materials, such as the Civil Code (KUH Perdata), Civil Procedure Regulations (RV), court decisions, scientific journals, and other legal literature. The analysis is conducted normatively by understanding the relevance and effectiveness of dwangsom in the Indonesian civil law system. The results of the study show that the application of dwangsom serves as a means of coercion so that court decisions can be implemented voluntarily and in a timely manner, thereby ensuring that the rights of the aggrieved party are fully protected. In addition, the application of dwangsom needs to be integrated with the principle of legal certainty in land administration to prevent disputes through clear registration and recording of rights.

Abstract

This study normatively examines the handling of children involved in narcotics abuse within the framework of achieving equitable law enforcement in Indonesia. The issue represents a multidimensional problem requiring an integrated legal, social, and psychological approach. According to Law Number 11 of 2012 on the Juvenile Criminal Justice System and Law Number 35 of 2009 on Narcotics, children in conflict with the law are entitled to special treatment. Employing a normative juridical method, this research analyzes relevant legislation and legal doctrines. The findings indicate that the resolution of narcotics abuse cases involving children should prioritize restorative justice principles, emphasizing recovery and social reintegration rather than punishment. Strengthening coordination among law enforcement institutions and implementing humane rehabilitation programs are essential to realize fair and child-centered law enforcement.

Abstract

This study aims to analyze the legal responsibility of laundry service providers for damage or loss of consumer clothing, as evidenced by the laundry receipt as proof of the service agreement. The receipt serves as written evidence containing the agreement between the service provider and the consumer. The research uses a normative legal method, with primary legal sources such as the Civil Code (KUHPerdata) and the Consumer Protection Law (UUPK), along with secondary and tertiary sources. The analysis is conducted descriptively by comparing the applicable legal provisions. The findings show that the legal responsibility of laundry service providers arises from the service agreement, as stated in Article 1239 of the Civil Code and the principle of unlawful acts in Article 1365. Providers are obligated to compensate if proven negligent, in accordance with Article 19 of the UUPK. The application of the principles of justice and consumer protection forms the basis for the laundry service agreement, ensuring consumer rights are protected.

Abstract

Effective law enforcement is a key factor in fostering traffic discipline and reducing violations on the roads. However, the phenomenon of drivers attempting to evade ticketing, either by fleeing or resisting law enforcement, remains a significant challenge in traffic law enforcement efforts. This article aims to analyze strategies and measures that can be implemented to optimize law enforcement against drivers who avoid fines. Through a more systematic approach and supporting technologies, such as the implementation of automated monitoring systems and improving the capacity of law enforcement officers, it is hoped that a stronger deterrent effect can be created, resulting in improved driver compliance with traffic regulations. This study also discusses the importance of community involvement in supporting these policies to create a safer and more orderly traffic environment. In conclusion, strengthening law enforcement against drivers who evade fines can significantly contribute to enhancing traffic compliance and reducing road accidents.

Abstract

This study discusses the legal analysis of unlawful acts in the transportation of mining products based on East Kalimantan Regional Regulation No. 10 of 2012 concerning the Management of Public Roads and Special Roads for the Transportation of Coal and Palm Oil. The research focuses on identifying elements of unlawful acts, the implementation of regulations by local governments, and criminal provisions imposed on corporations that violate mining transportation regulations. The research uses a normative legal method by examining legislation, legal literature, and field data as supporting evidence. The results of the study show that violations of the obligation to build special roads, the use of public roads without permission, and non-compliance with technical provisions constitute unlawful acts both formally and materially. The implementation of local regulations faces challenges such as weak supervision and compensation practices that are not in accordance with the law, but it still provides a strong normative basis for local governments through administrative and criminal sanctions. The criminal provisions in the local regulation play a significant role as an instrument of deterrence against corporations, while also supporting the application of the principle of good mining practice and the protection of public safety and interests. Thus, this study emphasizes the importance of local law enforcement in maintaining order, public safety, and the sustainability of mining governance in East Kalimantan.

Abstract

This study was motivated by the phenomenon of corporations expanding their land beyond the boundaries of their cultivation rights (HGU), which raises criminal law issues. These actions have an impact on land ownership by communities in several villages in the Tempelang subdistrict, environmental damage, and agrarian order. This study aims to analyze the qualifications of land expansion outside of land use rights by corporations in the Tempelang sub-district, West Bangka, from a criminal law perspective and to examine the legal interpretation of these actions because, so far, these actions have only been viewed as violations of private law and cannot have criminal implications. This study uses a normative legal research method, with a legislative approach and a case approach. Data was obtained through literature studies, legal documents, and secondary legal materials in the form of interviews, which were then analyzed qualitatively. This study is expected to contribute, particularly in clarifying legal events and actions, in this case land expansion beyond land use rights by corporations, as well as strengthening law enforcement regarding land expansion beyond land use rights and providing recommendations for improvements in regulation and implementation in the field.

Abstract

The maritime territorial dispute between Indonesia and China in the North Natuna Sea is a strategic issue in the study of international maritime law. This conflict stems from China's unilateral claim through the nine-dash line concept that overlaps with Indonesia's Exclusive Economic Zone (EEZ). This article is a literature review that aims to analyze the implementation of the 1982 United Nations Convention on the Law of the Sea (UNCLOS) as the international legal basis for resolving the dispute. The study was conducted by examining various previous studies, academic journals, international legal documents, and international court decisions such as the South China Sea Arbitration (Philippines v. China, 2016). The results of the study show that UNCLOS 1982 expressly establishes the sovereign rights of coastal states over natural resources in the EEZ area up to 200 nautical miles as stipulated in Article 57. Meanwhile, China's nine-dash line claim has no internationally recognized legal basis because it contradicts the principle of jus cogens and is not regulated in UNCLOS. Therefore, the implementation of UNCLOS 1982 plays a fundamental role in maintaining legal certainty and upholding Indonesia's maritime sovereignty in the North Natuna Sea. This research is expected to contribute to the development of international legal literature and serve as a reference in formulating maritime dispute resolution policies in the Southeast Asian region.

Abstract

: The restorative justice paradigm views drug addicts as individuals who need physical, mental, and social recovery. This study analyses the role of advocates in restorative justice-based law enforcement. Using empirical legal methods, this study explores legal aid practices through interviews with advocates, law enforcement officials, addicts, and rehabilitation workers, as well as reviewing the Narcotics Law, Criminal Procedure Code, and Supreme Court Regulation No. 4 of 2014. The results show that advocates play an important role in ensuring that addicts are treated as victims, not criminals. Substantive assistance with medical and psychological evidence supports rehabilitation, while procedural assistance ensures due process of law. Non-litigious assistance such as counselling and family mediation also reinforces restorative principles. However, the effectiveness of legal aid is influenced by factors such as the competence of advocates, the alignment of the vision of officials, the availability of rehabilitation facilities, family support, and legal culture. The unpreparedness of these elements can hinder the implementation of restorative justice. Therefore, improving the quality of legal aid and synergy between institutions is very important to create a more humane criminal justice system for drug addicts.
