Abstract

This extensive and comprehensive study explores the dynamic intersection between Islamic marriage jurisprudence (Fiqh Munakahat) and local cultural practices in Indonesia, focusing deeply on the traditions of proposing (Khitbah), the rigorous pillars and conditions of marriage, the provision of dowry (Mahar), and the strict marriage prohibitions. Marriage in Islam is a sacred covenant aimed at building a harmonious family, governed by precise jurisprudential rules to ensure its legal, social, and theological validity. However, the implementation of these rules in Indonesia is heavily influenced by diverse customary practices ('Urf). The research aims to critically analyze how local traditions align or conflict with classical Islamic jurisprudence. Using a qualitative library research method integrated with a socio-legal approach, the study evaluates primary Islamic texts, the Indonesian Marriage Law, the Compilation of Islamic Law, and extensive ethnographic literature. The findings prominently reveal that while many local customs serve as valid customs ('Urf Shahih) that complement Islamic law by emphasizing social harmony and family integration, certain practices bordering on extravagance and excessive material demands create severe socio-economic burdens. The paper concludes that a harmonization approach is essential, ensuring that customary practices enrich the marital process without violating the fundamental principles of Islamic jurisprudence, specifically the principles of facilitation (taisir) and the preservation of human dignity.

Abstract

This study demonstrates that the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) has established an integrated system of marriage validity and legal protection through the provisions of Articles 60–97. The validity of marriage is ensured through the mechanisms of marriage prevention and marriage annulment, which function as legal instruments to guarantee that every marriage is conducted in accordance with Islamic principles and applicable legal provisions. Marriage prevention serves as a form of preventive legal protection aimed at avoiding marriages that contain legal defects, while marriage annulment functions as a form of repressive legal protection against marriages that are proven not to fulfill the required conditions and pillars of marriage. In addition to safeguarding the validity of marriage, the Compilation of Islamic Law also provides legal protection for the continuity of family life through the regulation of the rights and obligations of spouses as well as marital property. These regulations reflect the principles of justice, balance, and public welfare (maslahah), which constitute the primary objectives of Islamic family law. Legal certainty regarding the status of husband and wife, as well as the classification of jointly acquired property and individual property, provides protection for the rights of the parties involved while minimizing the potential for disputes within family life. Based on the findings of this study, it can be understood that the provisions of Articles 60–97 of the KHI function not only as legal norms governing family relationships but also as instruments of legal protection that support the realization of families characterized by harmony, justice, and legal certainty. Therefore, efforts to enhance public understanding and effective implementation of these provisions should continue to be promoted among both society and legal practitioners so that the objectives of Islamic family law may be achieved effectively.

Abstract

This study aims to describe the internalization of the Prophet Muhammad’s eating etiquette through the Free Nutritious Meals Program in forming the religious character of eleventh-grade students at MA Ulul Absharr. This study used a descriptive qualitative method with a case study design. Data were collected through observation, interviews, and documentation involving the madrasah principal, Islamic education teachers, homeroom teacher, students, and parties involved in the meal program. The findings show that the Free Nutritious Meals Program was not only implemented as a food distribution activity, but also functioned as a pedagogical space for habituating religious values. Teachers guided students to recite basmalah, eat with the right hand, maintain order, avoid criticizing food, eat moderately, keep the eating area clean, and recite hamdalah after eating. These practices supported the formation of gratitude, discipline, responsibility, simplicity, cleanliness, politeness, and social care. The study concludes that the meal program can strengthen religious character when it is integrated with teacher role modeling, habituation, supervision, and Islamic value reinforcement.

Abstract

This study aims to examine the effect of Smartboard use on students’ learning interest in Islamic Religious Education among sixth-grade students at SD Negeri Mekarmanah. The study was conducted because learning interest in Islamic Religious Education still needed improvement, while the available Smartboard facility had not been used optimally in classroom learning. This research used a quantitative approach with a pre-experimental one group pretest-posttest design. The participants were 33 sixth-grade students selected through total sampling. Data were collected using a learning interest questionnaire, observation, and documentation. The questionnaire consisted of 12 valid items and showed acceptable reliability with a Cronbach’s Alpha value of 0.739. The data were analyzed using descriptive statistics, the Shapiro-Wilk normality test, and the Paired Sample t-Test. The results showed that the mean score increased from 40.03 in the pretest to 50.00 in the posttest. The hypothesis test showed a significant difference between pretest and posttest scores, t(32) = -16.821, p < .001. These findings indicate that Smartboard use can improve students’ attention, interest, and active involvement in Islamic Religious Education learning.

Abstract

This study aims to describe the implementation of the Mahārat Al-Lughah learning method and its implications for the Arabic language ability of santri at Pondok Pesantren Darussalamah Al-Mubarok Cianjur. This research uses a qualitative descriptive approach because it focuses on understanding the learning process, language activities, obstacles, and changes experienced by santri in a natural pesantren setting. Data were collected through observation, interviews, and documentation involving santri who participated in Mahārat Al-Lughah activities, Arabic language mentors, and pesantren administrators. The findings show that the implementation of Mahārat Al-Lughah learning is carried out through vocabulary reinforcement, listening practice, simple conversation, Arabic text reading, writing exercises, and language habituation in the pesantren environment. The method supports the development of santri’s Arabic ability in listening, speaking, reading, and writing. Its implications are seen in increased confidence, courage to speak, better vocabulary mastery, and improved understanding of Arabic texts. However, several obstacles remain, including limited vocabulary, different initial abilities, fear of making mistakes, and inconsistent use of Arabic outside formal activities.

Abstract

The protection of children's and women's rights is a central issue in Islamic family law and remains highly relevant in the contemporary Indonesian context. This article aims to analyze the protection of children's and women's rights through three main instruments, namely child custody (hadhanah), guardianship (wilayah), and marriage dissolution regulations. This study employs a normative juridical method using statutory and conceptual approaches by examining the Qur’an, Hadith, classical fiqh literature, and the Compilation of Islamic Law (Kompilasi Hukum Islam/KHI) as the applicable legal framework in Indonesia. The discussion shows that hadhanah represents a parental responsibility that continues after divorce based on the best interests of the child. Guardianship serves as a legal protection mechanism for minors in personal, property, and marital matters. Meanwhile, marriage dissolution regulations under the KHI combine Islamic legal principles with modern legal certainty to protect women and children from its legal consequences. These instruments collectively reflect the objectives of maqashid al-shariah, particularly hifzh al-nasl and hifzh al-nafs, in Indonesian Islamic family law.

Abstract

Contemporary Arab thought has been significantly shaped by attempts to explain the failure of modernization in the Arab-Islamic world. One of the prominent scholars contributing to this discourse is Hisham Sharabi through his concept of neopatriarchy. This article aims to analyze the concept of neopatriarchy as an instrument of social and cultural criticism developed by Sharabi to examine the problems of modern Arab society. This study employs a library research method with a philosophical-critical approach. The primary sources consist of Sharabi’s major works, particularly Neopatriarchy: A Theory of Distorted Change in Arab Society, along with various supporting literature discussing contemporary Arab socio-political thought. Data were analyzed using content analysis and critical interpretation of Sharabi’s ideas. The findings reveal that neopatriarchy represents a distorted form of modernity, a condition in which societies adopt modern institutions while simultaneously preserving traditional patriarchal patterns of relationships based on domination, obedience, and subordination. These structures are reproduced within the family, education, religion, and the state, thereby hindering the development of rationality, democracy, and individual emancipation. Sharabi’s cultural critique emphasizes the importance of deconstructing authority, reforming education, practicing cultural self-criticism (naqd al-dhat), and fostering critical consciousness as prerequisites for social transformation. Sharabi’s thought remains highly relevant for understanding various issues facing contemporary Muslim societies, particularly those related to education, power relations, and the formation of a democratic culture.

Abstract

This study aims to map the development of research on Qur’an reading through the Tilawati method, with specific attention to fluency, recitation rhythm, tajweed, makhraj, and the use of the rost melody. The study addresses the need for a systematic understanding of how the Tilawati method has been positioned in academic literature on Qur’an learning. A bibliometric mapping approach was used by collecting publication metadata from relevant academic databases. The data were selected, cleaned, and analyzed through descriptive bibliometric indicators and VOSviewer visualization, including co-occurrence, overlay, density, and co-authorship analyses. The findings show that the Tilawati method is strongly connected with Qur’an learning, reading ability, tajweed, fluency, students, and reading quality. However, recitation rhythm and the rost melody have not yet become dominant themes, although both are important elements of the Tilawati method. The co-authorship analysis also indicates that author collaboration remains fragmented across small research groups. This study contributes by identifying thematic trends, research gaps, and future directions for Tilawati-based Qur’an learning, especially in relation to rhythm, digital literacy, and reading quality evaluation.

Abstract

This study discusses the reconstruction of Islamic family law in addressing the dynamics of Generation Z households in the digital era, which is characterized by rapid social change. The purpose of this study is to analyze the shifting meaning of marriage among Generation Z and to examine the challenges of Islamic family law in responding to these changes in a contextual manner. The method used is qualitative research with a library research approach through the analysis of various literature related to Islamic family law, Generation Z, and the impact of digitalization on social life. The results of the study show that Generation Z experiences a shift in marriage values from sacred aspects toward rational-pragmatic considerations influenced by economic conditions, psychological factors, and exposure to digital media. The “marriage is scary” phenomenon reflects an increasing fear of the institution of marriage due to social construction in digital media. This study concludes that a more adaptive, contextual, and responsive reconstruction of Islamic family law is needed without abandoning its fundamental principles of Sharia.

Abstract

This study examines the phenomenon of political primordialism in Indonesian democracy through the perspective of Islamic constitutional law as a normative framework, focusing on how identity based preferences such as religion, ethnicity, and group affiliation influence voters’ choices in leadership elections and how these practices are evaluated within Islamic leadership principles. Departing from the tension between the ideal of rational democracy and the empirical reality of rising identity politics, this research employs a qualitative approach with a descriptive analytical method integrating empirical data and normative analysis of the principles of trustworthiness, justice, and competence. The findings show that political primordialism functions not only as a strategy for electoral mobilization by political actors but is also interpreted by voters as a form of collective identity representation, however from the perspective of Islamic constitutional law such practices tend to deviate as they prioritize identity over leadership quality which consequently weakens political rationality and undermines the principles of justice and public welfare in governance.
